11	11	1 AN ACT concerning criminal law.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the Retail
15	15	5 Sale of Tianeptine Prohibition Act.
16	16	6 Section 5. Retail sale of tianeptine products.
17	17	7 (a) Beginning January 1, 2026, no person shall sell, offer
18	18	8 to sell, or distribute in the State any product containing
19	19	9 tianeptine.
20	20	10 (b) This Act does not apply to any product containing
21	21	11 tianeptine that is lawfully dispensed or prescribed by a
22	22	12 pharmacist or a health care professional. In this subsection
23	23	13 (b), "health care professional" means any person who treats
24	24	14 human ailments and is subject to licensure or regulation by
25	25	15 this State, including students and residents.
26	26	16 Section 10. Sentence. A violation of Section 5 is a
27	27	17 business offense, punishable by a minimum fine of $1,500 for
28	28	18 each violation.
