Provides that beginning January 1, 2026, no person shall sell, offer to sell, or distribute in the State any product containing tianeptine. Provides that the Act does not apply to any product containing tianeptine that is lawfully dispensed or prescribed by a pharmacist or a health care professional. Provides that a violation is a business offense, punishable by a minimum fine of $1,500 for each violation. Defines "health care professional". Effective January 1, 2026. 1111 1 AN ACT concerning criminal law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the Retail
1515 5 Sale of Tianeptine Prohibition Act.
1616 6 Section 5. Retail sale of tianeptine products.
1717 7 (a) Beginning January 1, 2026, no person shall sell, offer
1818 8 to sell, or distribute in the State any product containing
1919 9 tianeptine.
2020 10 (b) This Act does not apply to any product containing
2121 11 tianeptine that is lawfully dispensed or prescribed by a
2222 12 pharmacist or a health care professional. In this subsection
2323 13 (b), "health care professional" means any person who treats
2424 14 human ailments and is subject to licensure or regulation by
2525 15 this State, including students and residents.
2626 16 Section 10. Sentence. A violation of Section 5 is a
2727 17 business offense, punishable by a minimum fine of $1,500 for
2828 18 each violation.
