312 1 AN ACT concerning regulation.
413 2 Be it enacted by the People of the State of Illinois,
514 3 represented in the General Assembly:
615 4 Section 5. The Nurse Practice Act is amended by changing

1322 11 (a) The purpose of nursing education rules and regulations
1423 12 is to ensure that graduates of nursing education programs are
1524 13 prepared for safe and effective nursing practice. Early
1625 14 intervention when standards are not met assists programs in
1726 15 making improvements before warning signs are evident and
18-16 before sanctions are necessary. The purpose of Board and
19-17 Department approval of a registered professional nursing
20-18 education program is to do the following:

4380 10 (b) To establish a new registered professional nursing
4481 11 education program, the proposed program's administrator must
45-12 notify the Department of the intention to establish a new
46-13 program. The Department may approve the proposed program after
47-14 a recommendation from the Board, upon the successful
48-15 completion of the following process and a site visit:
82+12 notify the Board of the intention to establish a new program.
83+13 The Board must approve the proposed program upon the
84+14 successful completion of the following process and a site
85+15 visit:
4986 16 (1) The proposed program must provide a feasibility
5087 17 study that includes the following information to the

5491 21 (B) evidence of adequate institutional financial

85-16 must meet the requirements set forth by the
86-17 Department; and
87-18 (H) a proposed timeline for initiating the
88-19 program.
89-20 (2) After the feasibility study has been submitted to
90-21 the Department, the proposed program must complete the
91-22 following program components and processes and submit
92-23 verification of completion to the Department:
93-24 (A) development of a comprehensive program
94-25 curriculum;
95-26 (B) submission of the program's ongoing systematic

122+16 (H) a proposed timeline for initiating the
123+17 program.
124+18 (2) After the feasibility study has been submitted to
125+19 the Board, the proposed program must complete the

112-7 (c) Nursing education rules must be based on
113-8 evidence-based criteria and used to monitor the quality of a
114-9 registered professional nursing education program. All
115-10 registered professional nursing education programs must meet
116-11 the following requirements:
117-12 (1) The program must have written and published
118-13 criteria for student admission, progression, and
119-14 performance.
120-15 (2) The written policies and procedures of the program
121-16 must be reviewed and approved by the program's identified
122-17 governing body and be readily accessible according to
123-18 accreditation standards.
124-19 (3) The program must have policies in place that hold
125-20 students responsible for professional behavior, including
126-21 honesty and integrity, as outlined in the program's
127-22 policies or student handbook. Such handbook or policies
128-23 should be made available to the Department upon request.
129-24 (4) The administrator of the program must (i) hold a
130-25 graduate degree in nursing, (ii) have a minimum of 2 years
131-26 of clinical nursing and nursing education experience,

142-1 (iii) hold a current, active, and unencumbered license as
143-2 a registered nurse in this State, (iv) have institutional
144-3 authority and administrative responsibility over the
145-4 program, and (v) be responsible for submitting the
146-5 Department's annual report, consisting of aggregate
147-6 program data as determined by the Board, by the provided
148-7 deadline.
149-8 (d) Faculty members of a registered professional nursing
150-9 education program must meet the following criteria:
151-10 (1) possess the requisite academic and experiential
152-11 qualifications; and
153-12 (2) hold either:
154-13 (A) a graduate degree in nursing with at least 2
155-14 years of practical experience, if the faculty member
156-15 teaches didactic nursing courses; or
157-16 (B) a current, active, and unencumbered license as
158-17 a registered nurse in this State and a graduate degree
159-18 in nursing, if the faculty member teaches clinical,
160-19 lab, or simulation experience courses.
161-20 A faculty member who does not hold a graduate degree in
162-21 nursing, but who holds a bachelor's degree in nursing, may
163-22 teach didactic nursing, clinical, lab, or simulation
164-23 experience courses if the faculty member obtains a waiver from
165-24 the Division of Professional Regulation. A faculty member who
166-25 does not meet the requirements of paragraph (2) of this
167-26 subsection but who obtains a waiver to teach shall be

190-13 (2) Newly hired faculty members must be mentored by
191-14 experientially prepared colleagues.
192-15 (3) Faculty members must participate in ongoing
193-16 professional development.
194-17 (4) The program must provide access to faculty
195-18 development activities.
196-19 (f) To maintain enrollment in a registered professional
197-20 nursing program, students must meet health standards, criminal
198-21 background requirements, and other compliance standards as
199-22 required by the program's clinical affiliation agreements.
200-23 (g) The curriculum of a registered professional nursing
201-24 program must meet the following requirements:
202-25 (1) be built on a foundation of biological, physical,
203-26 social, and behavioral sciences;

218-5 in a variety of clinical settings, and meet the holistic
219-6 needs of diverse individuals, families, communities, and
220-7 populations across the life span;
221-8 (4) combined with clinical experiences, prepare the
222-9 graduate to take the NCLEX-RN exam for licensure;
223-10 (5) have strategies that are in place to remediate
224-11 errors and near-misses in the clinical setting;
225-12 (6) meet the standards of the program's accrediting
226-13 body;
227-14 (7) have clinical affiliation agreements in place for
228-15 clinical experiences;
229-16 (8) have distance education methods that are
230-17 consistent with the accreditation and regulatory
231-18 standards; and
232-19 (9) provide direct care clinical experiences with
233-20 patients, as defined by accrediting and regulatory bodies.
234-21 (h) A professional nursing education program shall not use
235-22 simulation as a substitute for traditional clinical
236-23 experiences for more than 25% of a course's total clinical
237-24 hours. Programs may seek an exception to this subsection from
238-25 the Board and must follow the requirements set forth in the
239-26 "Guidelines for the Use of Simulation by Prelicensure Nursing

251-2 (h-5) The program must develop criteria to evaluate the
252-3 simulation activities and allow students to evaluate the
253-4 simulation experience on an ongoing basis.
254-5 (i) The program's resources must be sufficient to support
255-6 the program's needs to meet its mission, goals, and outcomes.
256-7 The program must provide accessibility resources to all
257-8 students, including those enrolled in distance education, and
258-9 institutional resources that assist students with academic and
259-10 financial challenges.
260-11 (j) A registered professional nursing program must be
261-12 accredited by a national accrediting body recognized by the
262-13 United States Department of Education. If the program has its
263-14 accreditation revoked, the program must submit a copy of the
264-15 notice of revocation from the accrediting body to the Board
265-16 within 30 days after receipt.
266-17 (k) If the Department obtains evidence at any time that a
267-18 registered professional nursing program does not comply with
268-19 this Act, the Department may perform an unannounced site
269-20 visit. The Department shall have the discretion to determine
270-21 if a complaint is unwarranted and not have to conduct a site
271-22 visit. Such evidence may include, but is not limited to, the
272-23 following:
273-24 (1) complaints from students, faculty, or clinical
274-25 agencies;
275-26 (2) program administrator turnover of more than 3

287+1 (2) The program must have short-term and long-term
288+2 plans for integrating simulation into the curriculum, a
289+3 method of debriefing each simulated activity, and a plan
290+4 to orient faculty to simulation.
291+5 (3) The program must develop criteria to evaluate the
292+6 simulation activities and allow students to evaluate the
293+7 simulation experience on an ongoing basis.
294+8 (i) The program's resources must be sufficient to support
295+9 the program's needs to meet its mission, goals, and outcomes.
296+10 The program must provide accessibility resources to all
297+11 students, including those enrolled in distance education, and
298+12 institutional resources that assist students with academic and
299+13 financial challenges.
300+14 (j) A registered professional nursing program must be

303+17 accreditation revoked, the program must submit a copy of the
304+18 notice of revocation from the accrediting body to the Board
305+19 within 30 days after receipt.
306+20 (k) If the Board obtains evidence at any time that a
307+21 registered professional nursing program does not comply with
308+22 this Act, the Board may perform an unannounced site visit.
309+23 Such evidence may include, but is not limited to, the
310+24 following:
311+25 (1) complaints from students, faculty, or clinical

292-7 The Department has the discretion to determine if a
293-8 complaint is unwarranted and if a site visit must be
294-9 conducted.
295-10 (a) All registered professional nurse education programs
296-11 must be reviewed by the Board and approved by the Department
297-12 before the successful completion of such a program may be
298-13 applied toward meeting the requirements for registered
299-14 professional nurse licensure under this Act. Any program
300-15 changing the level of educational preparation or the
301-16 relationship with or to the parent institution or establishing
302-17 an extension of an existing program must request a review by
303-18 the Board and approval by the Department. The Board shall
304-19 review and make a recommendation for the approval or
305-20 disapproval of a program by the Department based on the
306-21 following criteria:
307-22 (1) a feasibility study that describes the need for
308-23 the program and the facilities used, the potential of the
309-24 program to recruit faculty and students, financial support
310-25 for the program, and other criteria, as established by
311-26 rule;

374-17 Education and approved by the Department.
375-18 (d) Any institution conducting a registered professional
376-19 nursing program that wishes to discontinue the program must do
377-20 each of the following:
378-21 (1) Notify the Department, in writing, of its intent

405-12 in this Section and must meet the clinical and faculty
406-13 requirements for institutions outside of this State, as
407-14 established by rule. The institution responsible for
408-15 conducting an out-of-State registered professional nursing
409-16 education program and the administrator of the program shall
410-17 be responsible for ensuring that the individual faculty and
411-18 preceptors overseeing the clinical experience are academically
412-19 and professionally competent.
413-20 (m) To operate under this Act, a registered professional
414-21 nursing education program must maintain approval by the
415-22 Department in accordance with the following:
416-23 (1) A registered professional nursing education
417-24 program must complete and submit an annual evaluation
418-25 report to the Department and maintain programmatic
419-26 accreditation by a national accrediting body for nursing

445-16 (n) The Department shall make the policies and procedures
446-17 related to probationary status transparent, and related forms
447-18 shall be readily available to program administrators on the
448-19 Department's website.
449-20 (o) The Department may, without a hearing, rescind the
450-21 license of an individual who has been identified by a federal
451-22 investigation as presenting illegitimate educational
452-23 credentials that have been flagged by the National Council of
453-24 State Boards of Nursing. If the Department rescinds the
454-25 license of an individual under this subsection (o), the
455-26 Department shall notify the licensee of the rescission in

467+1 (2) The Board shall review and analyze various sources

483+17 (n) If a registered professional nursing education program
484+18 loses its national accreditation, the program must do the
485+19 following:
486+20 (1) notify the Board within 30 days after the loss;
487+21 and
488+22 (2) immediately notify all enrolled students and
489+23 applicants of the loss of its national accreditation and
490+24 the corrective actions the program will take to regain the
491+25 accreditation.
492+26 The Board, upon receipt of the program's notice, shall

471-6 not be an automatic bar to licensure if the applicant elects to
472-7 re-apply. Nothing in this subsection (o) shall prevent the
473-8 Department from considering a rescission during a future
474-9 regulatory action. The Department may adopt rules to implement
475-10 this subsection (o).

484-19 as a registered professional nurse is eligible for licensure
485-20 when the following requirements are met:
486-21 (1) the applicant has submitted a completed written
487-22 application, on forms provided by the Department, and
488-23 fees, as established by the Department;
489-24 (2) the applicant has graduated from a professional
490-25 nursing education program approved by the Department or

508+6 by the Board within 12 months, unless otherwise directed by
509+7 the Board. If the deficiencies are not corrected within the
510+8 specified time frame, the Board may withdraw the program's
511+9 approval status.
512+10 (o) The Board shall make the policies and procedures
513+11 related to probationary status transparent, and related forms
514+12 shall be readily available to program administrators on the
515+13 Board's website.
516+14 (p) The Board may withdraw its approval of a registered
517+15 professional nursing education program if, after proper notice
518+16 and an opportunity to be heard are provided, it determines
519+17 that:
520+18 (1) the program fails to meet the Department of
521+19 Financial and Professional Regulation's rules regarding
522+20 this Act;
523+21 (2) the program failed to correct the identified
524+22 deficiencies within the time specified by the Board; or
525+23 (3) there is evidence of fraud or dishonesty in the
526+24 program's application for program approval.
527+25 The Board may reinstate approval if the program submits
528+26 evidence of compliance with the nursing education rules and

501-1 has been granted a certificate of completion of
502-2 pre-licensure requirements from another United States
503-3 jurisdiction;
504-4 (3) the applicant has successfully completed a
505-5 licensure examination approved by the Department;
506-6 (4) (blank);
507-7 (5) the applicant has submitted to the criminal
508-8 history records check required under Section 50-35 of this
509-9 Act;
510-10 (6) the applicant has submitted, either to the
511-11 Department or its designated testing service, a fee
512-12 covering the cost of providing the examination; failure to
513-13 appear for the examination on the scheduled date at the
514-14 time and place specified after the applicant's application
515-15 for examination has been received and acknowledged by the
516-16 Department or the designated testing service shall result
517-17 in the forfeiture of the examination fee; and
518-18 (7) the applicant has met all other requirements
519-19 established by the Department by rule.
520-20 An applicant for licensure by examination may take the
521-21 Department-approved examination in another jurisdiction.
522-22 (b-3) An applicant who graduates from a professional
523-23 nursing program in this State on or after January 1, 2024 (the
524-24 effective date of Public Act 103-533) this amendatory Act of
525-25 the 103rd General Assembly and does not take the licensure
526-26 examination within 180 days after his or her degree is

539+1 this Act within the provided time frame.
540+2 (q) A registered professional nursing education program
541+3 denied approval or placed on probationary status may appeal
542+4 such a decision. All actions related to an appeal shall be in
543+5 accordance with due process rights.
544+6 (r) A registered professional nursing education program
545+7 may be closed due to withdrawal of Board approval or may close
546+8 voluntarily. In the event of closure, regardless of cause, the
547+9 program shall:
548+10 (1) make provisions to maintain the standards for
549+11 nursing education during the transition to closure;
550+12 (2) arrange for secure storage and access to academic
551+13 records and transcripts;
552+14 (3) develop a teach-out plan to assist students in
553+15 completing their nursing education; and
554+16 (4) provide written confirmation to the Board that the
555+17 teach-out plan has been implemented.
556+18 (s) During a declared state of emergency or a disaster
557+19 declared by the Governor, the Board may authorize an approved
558+20 registered professional nursing education programs to
559+21 implement mitigation efforts to address issues, including, but
560+22 not limited to, the availability of clinical placement sites,
561+23 the transition to virtual learning from in-person platforms,
562+24 and changes in the use of simulation. The program shall keep
563+25 records of any mitigation policies or strategies used and the
564+26 program shall include such records in its annual report

538-2 licensure examination for a second time shall be required to
539-3 demonstrate proof of completion of a National Council
540-4 Licensure Examination preparatory class or a comparable test
541-5 preparatory program before taking a subsequent licensure
542-6 examination or the graduate may return to the institution of
543-7 higher education from which he or she graduated which shall
544-8 provide remedial educational resources to the graduate at no
545-9 cost to the graduate. Such an applicant must contact the
546-10 institution of higher education from which he or she graduated
547-11 prior to retesting.
548-12 (b-4) (Blank). All professional nursing programs in
549-13 probationary status on the effective date of this amendatory
550-14 Act of the 103rd General Assembly and subject to a program
551-15 revision plan shall be deemed in good standing for a period of
552-16 3 years beginning on the effective date of this amendatory Act
553-17 of the 103rd General Assembly. Prior to September 1, 2026, no
554-18 professional nursing program shall be placed on probationary
555-19 status for failing to reach a passage rate of less than 75%.
556-20 (b-5) If an applicant for licensure by examination
557-21 neglects, fails, or refuses to take an examination or fails to
558-22 pass an examination for a license within 3 years of the date of
559-23 initial application, the application shall be denied. When an
560-24 applicant's application is denied due to the failure to pass
561-25 the examination within the 3-year period, that applicant must
562-26 undertake an additional course of education as defined by rule

574-2 application must be accompanied by the required fee, evidence
575-3 of meeting the requirements in force at the time of the new
576-4 application, and evidence of completion of the additional
577-5 course of education prescribed by rule.
578-6 (c) An applicant for licensure by examination shall have
579-7 one year after the date of notification of the successful
580-8 completion of the examination to apply to the Department for a
581-9 license. If an applicant fails to apply within one year, the
582-10 applicant shall be required to retake and pass the examination
583-11 unless licensed in another jurisdiction of the United States.
584-12 (d) An applicant for licensure by examination who passes
585-13 the Department-approved licensure examination for professional
586-14 nursing may obtain employment as a license-pending registered
587-15 nurse and practice under the direction of a registered
588-16 professional nurse or an advanced practice registered nurse
589-17 until such time as he or she receives his or her license to
590-18 practice or until the license is denied. In no instance shall
591-19 any such applicant practice or be employed in any management
592-20 capacity. An individual may be employed as a license-pending
593-21 registered nurse if all of the following criteria are met:
594-22 (1) He or she has completed and passed the
595-23 Department-approved licensure exam and presents to the
596-24 employer the official written notification indicating
597-25 successful passage of the licensure examination.
598-26 (2) He or she has completed and submitted to the

616+7 (6) the applicant has submitted, either to the
617+8 Department or its designated testing service, a fee
618+9 covering the cost of providing the examination; failure to
619+10 appear for the examination on the scheduled date at the
620+11 time and place specified after the applicant's application
621+12 for examination has been received and acknowledged by the
622+13 Department or the designated testing service shall result
623+14 in the forfeiture of the examination fee; and
624+15 (7) the applicant has met all other requirements
625+16 established by the Department by rule.
626+17 An applicant for licensure by examination may take the
627+18 Department-approved examination in another jurisdiction.
628+19 (b-3) An applicant who graduates from a professional
629+20 nursing program in this State on or after January 1, 2024 (the
630+21 effective date of Public Act 103-533) this amendatory Act of
631+22 the 103rd General Assembly and does not take the licensure
632+23 examination within 180 days after his or her degree is
633+24 conferred by the institution of higher education or fails the
634+25 licensure examination for a second time shall be required to
635+26 demonstrate proof of completion of a National Council

609-1 Department an application for licensure under this Section
610-2 as a registered professional nurse.
611-3 (3) He or she has submitted the required licensure

616-8 (e) The privilege to practice as a license-pending

646+1 Licensure Examination preparatory class or a comparable test
647+2 preparatory program before taking a subsequent licensure
648+3 examination or the graduate may return to the institution of
649+4 higher education from which he or she graduated which shall
650+5 provide remedial educational resources to the graduate at no
651+6 cost to the graduate. Such an applicant must contact the
652+7 institution of higher education from which he or she graduated
653+8 prior to retesting.
654+9 (b-4) (Blank). All professional nursing programs in
655+10 probationary status on the effective date of this amendatory
656+11 Act of the 103rd General Assembly and subject to a program
657+12 revision plan shall be deemed in good standing for a period of
658+13 3 years beginning on the effective date of this amendatory Act
659+14 of the 103rd General Assembly. Prior to September 1, 2026, no
660+15 professional nursing program shall be placed on probationary
661+16 status for failing to reach a passage rate of less than 75%.
662+17 (b-5) If an applicant for licensure by examination
663+18 neglects, fails, or refuses to take an examination or fails to
664+19 pass an examination for a license within 3 years of the date of
665+20 initial application, the application shall be denied. When an
666+21 applicant's application is denied due to the failure to pass
667+22 the examination within the 3-year period, that applicant must
668+23 undertake an additional course of education as defined by rule
669+24 prior to submitting a new application for licensure. Any new
670+25 application must be accompanied by the required fee, evidence
671+26 of meeting the requirements in force at the time of the new

648-4 (k) All applicants for registered professional nurse

655-11 (l) All applicants for registered nurse licensure by
656-12 examination who are graduates of practical nursing educational
657-13 programs in a country other than the United States and its
658-14 territories shall have their nursing education credentials
659-15 evaluated by a Department-approved nursing credentialing
660-16 evaluation service. No such applicant may be issued a license
661-17 under this Act unless the applicant's program is deemed by the
662-18 nursing credentialing evaluation service to be equivalent to a
663-19 professional nursing education program approved by the
664-20 Department. An applicant who has graduated from a nursing
665-21 educational program outside of the United States or its
666-22 territories and whose first language is not English shall
667-23 submit evidence of English proficiency, as defined by rule.
