11	11	1 AN ACT concerning State government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Energy Efficient Building Act is amended by
15	15	5 changing Section 10 as follows:

17	17	7 Sec. 10. Definitions.
18	18	8 "Agency" means the Environmental Protection Agency.
19	19	9 "Board" means the Capital Development Board.
20	20	10 "Building" includes both residential buildings and
21	21	11 commercial buildings.
22	22	12 "Code" means the 2021 latest published edition of the
23	23	13 International Code Council's International Energy Conservation
24	24	14 Code as adopted by the Board, including any published
25	25	15 supplements adopted by the Board and any amendments and
26	26	16 adaptations to the Code that are made by the Board.
27	27	17 "Commercial building" means any building except a building
28	28	18 that is a residential building, as defined in this Section.
29	29	19 "Municipality" means any city, village, or incorporated
30	30	20 town.
31	31	21 "Residential building" means (i) a detached one-family or
32	32	22 2-family dwelling or (ii) any building that is 3 stories or
33	33	23 less in height above grade that contains multiple dwelling

68	68	1 units, in which the occupants reside on a primarily permanent
69	69	2 basis, such as a townhouse, a row house, an apartment house, a
70	70	3 convent, a monastery, a rectory, a fraternity or sorority
71	71	4 house, a dormitory, and a rooming house; provided, however,
72	72	5 that when applied to a building located within the boundaries
73	73	6 of a municipality having a population of 1,000,000 or more,
74	74	7 the term "residential building" means a building containing
75	75	8 one or more dwelling units, not exceeding 4 stories above
76	76	9 grade, where occupants are primarily permanent.
77	77	10 "Site energy index" means a scalar published by the
78	78	11 Pacific Northwest National Laboratories representing the ratio
79	79	12 of the site energy performance of an evaluated code compared
80	80	13 to the site energy performance of the 2006 International
81	81	14 Energy Conservation Code. A "site energy index" includes only
82	82	15 conservation measures and excludes net energy credit for any
83	83	16 on-site or off-site energy production.
