13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Freedom of Information Act is amended by
16	16	5 changing Sections 2 and 7 as follows:

18	18	7 Sec. 2. Definitions. As used in this Act:
19	19	8 (a) "Public body" means all legislative, executive,
20	20	9 judicial, administrative, or advisory bodies of the State,
21	21	10 state universities and colleges, counties, townships, cities,
22	22	11 villages, incorporated towns, school districts and all other
23	23	12 municipal corporations, boards, bureaus, committees, or
24	24	13 commissions of this State, any subsidiary bodies of any of the
25	25	14 foregoing including but not limited to committees and
26	26	15 subcommittees thereof, and a School Finance Authority created
27	27	16 under Article 1E of the School Code. "Public body" does not
28	28	17 include a child death review team or the Illinois Child Death
29	29	18 Review Teams Executive Council established under the Child
30	30	19 Death Review Team Act, or a regional youth advisory board or
31	31	20 the Statewide Youth Advisory Board established under the
32	32	21 Department of Children and Family Services Statewide Youth
33	33	22 Advisory Board Act.

73	73	3 (c) "Public records" means all records, reports, forms,
74	74	4 writings, letters, memoranda, books, papers, maps,
75	75	5 photographs, microfilms, cards, tapes, recordings, electronic
76	76	6 data processing records, electronic communications, recorded
77	77	7 information and all other documentary materials pertaining to
78	78	8 the transaction of public business, regardless of physical
79	79	9 form or characteristics, having been prepared by or for, or
80	80	10 having been or being used by, received by, in the possession
81	81	11 of, or under the control of any public body.
82	82	12 (c-5) "Private information" means unique identifiers,
83	83	13 including a person's social security number, driver's license
84	84	14 number, employee identification number, biometric identifiers,
85	85	15 personal financial information, passwords or other access
86	86	16 codes, medical records, home or personal telephone numbers,
87	87	17 and personal email addresses. Private information also
88	88	18 includes home address and personal license plates, except as
89	89	19 otherwise provided by law or when compiled without possibility
90	90	20 of attribution to any person. For a public body that is a
91	91	21 HIPAA-covered entity, "private information" includes
92	92	22 electronic medical records and all information, including
93	93	23 demographic information, contained within or extracted from an
94	94	24 electronic medical records system operated or maintained by
95	95	25 the public body in compliance with State and federal medical
96	96	26 privacy laws and regulations, including, but not limited to,

107	107	1 the Health Insurance Portability and Accountability Act and
108	108	2 its regulations, 45 CFR Parts 160 and 164. As used in this
109	109	3 subsection, "HIPAA-covered entity" has the meaning given to
110	110	4 the term "covered entity" in 45 CFR 160.103.
111	111	5 (c-10) "Commercial purpose" means the use of any part of a
112	112	6 public record or records, or information derived from public
113	113	7 records, in any form for sale, resale, or solicitation or
114	114	8 advertisement for sales or services. For purposes of this
115	115	9 definition, requests made by news media and non-profit,
116	116	10 scientific, or academic organizations shall not be considered
117	117	11 to be made for a "commercial purpose" when the principal
118	118	12 purpose of the request is (i) to access and disseminate
119	119	13 information concerning news and current or passing events,
120	120	14 (ii) for articles of opinion or features of interest to the
121	121	15 public, or (iii) for the purpose of academic, scientific, or
122	122	16 public research or education.
123	123	17 (d) "Copying" means the reproduction of any public record
124	124	18 by means of any photographic, electronic, mechanical or other
125	125	19 process, device or means now known or hereafter developed and
126	126	20 available to the public body.
127	127	21 (e) "Head of the public body" means the president, mayor,
128	128	22 chairman, presiding officer, director, superintendent,
129	129	23 manager, supervisor or individual otherwise holding primary
130	130	24 executive and administrative authority for the public body, or
131	131	25 such person's duly authorized designee.
132	132	26 (f) "News media" means a newspaper or other periodical

143	143	1 issued at regular intervals whether in print or electronic
144	144	2 format, a news service whether in print or electronic format,
145	145	3 a radio station, a television station, a television network, a
146	146	4 community antenna television service, or a person or
147	147	5 corporation engaged in making news reels or other motion
148	148	6 picture news for public showing.
149	149	7 (g) "Recurrent requester", as used in Section 3.2 of this
150	150	8 Act, means a person that, in the 12 months immediately
151	151	9 preceding the request, has submitted to the same public body
152	152	10 (i) a minimum of 50 requests for records, (ii) a minimum of 15
153	153	11 requests for records within a 30-day period, or (iii) a
154	154	12 minimum of 7 requests for records within a 7-day period. For
155	155	13 purposes of this definition, requests made by news media and
156	156	14 non-profit, scientific, or academic organizations shall not be
157	157	15 considered in calculating the number of requests made in the
158	158	16 time periods in this definition when the principal purpose of
159	159	17 the requests is (i) to access and disseminate information
160	160	18 concerning news and current or passing events, (ii) for
161	161	19 articles of opinion or features of interest to the public, or
162	162	20 (iii) for the purpose of academic, scientific, or public
163	163	21 research or education.
164	164	22 For the purposes of this subsection (g), "request" means a
165	165	23 written document (or oral request, if the public body chooses
166	166	24 to honor oral requests) that is submitted to a public body via
167	167	25 personal delivery, mail, telefax, electronic mail, or other
168	168	26 means available to the public body and that identifies the

179	179	1 particular public record the requester seeks. One request may
180	180	2 identify multiple records to be inspected or copied.
181	181	3 (h) "Voluminous request" means a request that: (i)
182	182	4 includes more than 5 individual requests for more than 5
183	183	5 different categories of records or a combination of individual
184	184	6 requests that total requests for more than 5 different
185	185	7 categories of records in a period of 20 business days; or (ii)
186	186	8 requires the compilation of more than 500 letter or
187	187	9 legal-sized pages of public records unless a single requested
188	188	10 record exceeds 500 pages. "Single requested record" may
189	189	11 include, but is not limited to, one report, form, e-mail,
190	190	12 letter, memorandum, book, map, microfilm, tape, or recording.
191	191	13 "Voluminous request" does not include a request made by
192	192	14 news media and non-profit, scientific, or academic
193	193	15 organizations if the principal purpose of the request is: (1)
194	194	16 to access and disseminate information concerning news and
195	195	17 current or passing events; (2) for articles of opinion or
196	196	18 features of interest to the public; or (3) for the purpose of
197	197	19 academic, scientific, or public research or education.
198	198	20 For the purposes of this subsection (h), "request" means a
199	199	21 written document, or oral request, if the public body chooses
200	200	22 to honor oral requests, that is submitted to a public body via
201	201	23 personal delivery, mail, telefax, electronic mail, or other
202	202	24 means available to the public body and that identifies the
203	203	25 particular public record or records the requester seeks. One
204	204	26 request may identify multiple individual records to be

216	216	2 (i) "Severance agreement" means a mutual agreement between
217	217	3 any public body and its employee for the employee's
218	218	4 resignation in exchange for payment by the public body.

221	221	7 Sec. 7. Exemptions.
222	222	8 (1) When a request is made to inspect or copy a public
223	223	9 record that contains information that is exempt from
224	224	10 disclosure under this Section, but also contains information
225	225	11 that is not exempt from disclosure, the public body may elect
226	226	12 to redact the information that is exempt. The public body
227	227	13 shall make the remaining information available for inspection
228	228	14 and copying. Subject to this requirement, the following shall
229	229	15 be exempt from inspection and copying:
230	230	16 (a) Information specifically prohibited from
231	231	17 disclosure by federal or State law or rules and
232	232	18 regulations implementing federal or State law.
233	233	19 (b) Private information, unless disclosure is required
234	234	20 by another provision of this Act, a State or federal law,
235	235	21 or a court order.
236	236	22 (b-5) Files, documents, and other data or databases
237	237	23 maintained by one or more law enforcement agencies and
238	238	24 specifically designed to provide information to one or
239	239	25 more law enforcement agencies regarding the physical or

250	250	1 mental status of one or more individual subjects.
251	251	2 (c) Personal information contained within public
252	252	3 records, the disclosure of which would constitute a
253	253	4 clearly unwarranted invasion of personal privacy, unless
254	254	5 the disclosure is consented to in writing by the
255	255	6 individual subjects of the information. "Unwarranted
256	256	7 invasion of personal privacy" means the disclosure of
257	257	8 information that is highly personal or objectionable to a
258	258	9 reasonable person and in which the subject's right to
259	259	10 privacy outweighs any legitimate public interest in
260	260	11 obtaining the information. The disclosure of information
261	261	12 that bears on the public duties of public employees and
262	262	13 officials shall not be considered an invasion of personal
263	263	14 privacy.
264	264	15 (d) Records in the possession of any public body
265	265	16 created in the course of administrative enforcement
266	266	17 proceedings, and any law enforcement or correctional
267	267	18 agency for law enforcement purposes, but only to the
268	268	19 extent that disclosure would:
269	269	20 (i) interfere with pending or actually and
270	270	21 reasonably contemplated law enforcement proceedings
271	271	22 conducted by any law enforcement or correctional
272	272	23 agency that is the recipient of the request;
273	273	24 (ii) interfere with active administrative
274	274	25 enforcement proceedings conducted by the public body
275	275	26 that is the recipient of the request;

287	287	2 person will be deprived of a fair trial or an impartial
288	288	3 hearing;
289	289	4 (iv) unavoidably disclose the identity of a
290	290	5 confidential source, confidential information
291	291	6 furnished only by the confidential source, or persons
292	292	7 who file complaints with or provide information to
293	293	8 administrative, investigative, law enforcement, or
294	294	9 penal agencies; except that the identities of
295	295	10 witnesses to traffic crashes, traffic crash reports,
296	296	11 and rescue reports shall be provided by agencies of
297	297	12 local government, except when disclosure would
298	298	13 interfere with an active criminal investigation
299	299	14 conducted by the agency that is the recipient of the
300	300	15 request;
301	301	16 (v) disclose unique or specialized investigative
302	302	17 techniques other than those generally used and known
303	303	18 or disclose internal documents of correctional
304	304	19 agencies related to detection, observation, or
305	305	20 investigation of incidents of crime or misconduct, and
306	306	21 disclosure would result in demonstrable harm to the
307	307	22 agency or public body that is the recipient of the
308	308	23 request;
309	309	24 (vi) endanger the life or physical safety of law
310	310	25 enforcement personnel or any other person; or
311	311	26 (vii) obstruct an ongoing criminal investigation

397	397	4 (e-10) Law enforcement records of other persons
398	398	5 requested by a person committed to the Department of

400	400	7 Mental Health, or a county jail, including, but not
401	401	8 limited to, arrest and booking records, mug shots, and
402	402	9 crime scene photographs, except as these records may be
403	403	10 relevant to the requester's current or potential case or
404	404	11 claim.
405	405	12 (f) Preliminary drafts, notes, recommendations,
406	406	13 memoranda, and other records in which opinions are
407	407	14 expressed, or policies or actions are formulated, except
408	408	15 that a specific record or relevant portion of a record
409	409	16 shall not be exempt when the record is publicly cited and
410	410	17 identified by the head of the public body. The exemption
411	411	18 provided in this paragraph (f) extends to all those
412	412	19 records of officers and agencies of the General Assembly
413	413	20 that pertain to the preparation of legislative documents
414	414	21 and to all those records that pertain to the preparation
415	415	22 of judicial opinions and orders.
416	416	23 (g) Trade secrets and commercial or financial
417	417	24 information obtained from a person or business where the
418	418	25 trade secrets or commercial or financial information are
419	419	26 furnished under a claim that they are proprietary,

430	430	1 privileged, or confidential, and that disclosure of the
431	431	2 trade secrets or commercial or financial information would
432	432	3 cause competitive harm to the person or business, and only
433	433	4 insofar as the claim directly applies to the records
434	434	5 requested.
435	435	6 The information included under this exemption includes
436	436	7 all trade secrets and commercial or financial information
437	437	8 obtained by a public body, including a public pension
438	438	9 fund, from a private equity fund or a privately held
439	439	10 company within the investment portfolio of a private
440	440	11 equity fund as a result of either investing or evaluating
441	441	12 a potential investment of public funds in a private equity
442	442	13 fund. The exemption contained in this item does not apply
443	443	14 to the aggregate financial performance information of a
444	444	15 private equity fund, nor to the identity of the fund's
445	445	16 managers or general partners. The exemption contained in
446	446	17 this item does not apply to the identity of a privately
447	447	18 held company within the investment portfolio of a private
448	448	19 equity fund, unless the disclosure of the identity of a
449	449	20 privately held company may cause competitive harm.
450	450	21 Nothing contained in this paragraph (g) shall be
451	451	22 construed to prevent a person or business from consenting
452	452	23 to disclosure.
453	453	24 (h) Proposals and bids for any contract, grant, or
454	454	25 agreement, including information which if it were
455	455	26 disclosed would frustrate procurement or give an advantage

525	525	24 would not be subject to discovery in litigation, and

551	551	14 computerized systems, employee manuals, and any other
552	552	15 information that, if disclosed, would jeopardize the
553	553	16 security of the system or its data or the security of
554	554	17 materials exempt under this Section.
555	555	18 (p) Records relating to collective negotiating matters
556	556	19 between public bodies and their employees or
557	557	20 representatives, except that any final contract or
558	558	21 agreement shall be subject to inspection and copying.
559	559	22 (q) Test questions, scoring keys, and other
560	560	23 examination data used to determine the qualifications of
561	561	24 an applicant for a license or employment.
562	562	25 (r) The records, documents, and information relating
563	563	26 to real estate purchase negotiations until those
