1212 1 AN ACT concerning government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Freedom of Information Act is amended by
1616 5 changing Sections 2 and 7 as follows:

1818 7 Sec. 2. Definitions. As used in this Act:
1919 8 (a) "Public body" means all legislative, executive,
2020 9 judicial, administrative, or advisory bodies of the State,
2121 10 state universities and colleges, counties, townships, cities,
2222 11 villages, incorporated towns, school districts and all other
2323 12 municipal corporations, boards, bureaus, committees, or
2424 13 commissions of this State, any subsidiary bodies of any of the
2525 14 foregoing including but not limited to committees and
2626 15 subcommittees thereof, and a School Finance Authority created
2727 16 under Article 1E of the School Code. "Public body" does not
2828 17 include a child death review team or the Illinois Child Death
2929 18 Review Teams Executive Council established under the Child
3030 19 Death Review Team Act, or a regional youth advisory board or
3131 20 the Statewide Youth Advisory Board established under the
3232 21 Department of Children and Family Services Statewide Youth
3333 22 Advisory Board Act.
3434 23 (b) "Person" means any individual, corporation,

7373 3 (c) "Public records" means all records, reports, forms,
7474 4 writings, letters, memoranda, books, papers, maps,
7575 5 photographs, microfilms, cards, tapes, recordings, electronic
7676 6 data processing records, electronic communications, recorded
7777 7 information and all other documentary materials pertaining to
7878 8 the transaction of public business, regardless of physical
7979 9 form or characteristics, having been prepared by or for, or
8080 10 having been or being used by, received by, in the possession
8181 11 of, or under the control of any public body.
8282 12 (c-5) "Private information" means unique identifiers,
8383 13 including a person's social security number, driver's license
8484 14 number, employee identification number, biometric identifiers,
8585 15 personal financial information, passwords or other access
8686 16 codes, medical records, home or personal telephone numbers,
8787 17 and personal email addresses. Private information also
8888 18 includes home address and personal license plates, except as
8989 19 otherwise provided by law or when compiled without possibility
9090 20 of attribution to any person. For a public body that is a
9191 21 HIPAA-covered entity, "private information" includes
9292 22 electronic medical records and all information, including
9393 23 demographic information, contained within or extracted from an
9494 24 electronic medical records system operated or maintained by
9595 25 the public body in compliance with State and federal medical
9696 26 privacy laws and regulations, including, but not limited to,

107107 1 the Health Insurance Portability and Accountability Act and
108108 2 its regulations, 45 CFR Parts 160 and 164. As used in this
109109 3 subsection, "HIPAA-covered entity" has the meaning given to
110110 4 the term "covered entity" in 45 CFR 160.103.
111111 5 (c-10) "Commercial purpose" means the use of any part of a
112112 6 public record or records, or information derived from public
113113 7 records, in any form for sale, resale, or solicitation or
114114 8 advertisement for sales or services. For purposes of this
115115 9 definition, requests made by news media and non-profit,
116116 10 scientific, or academic organizations shall not be considered
117117 11 to be made for a "commercial purpose" when the principal
118118 12 purpose of the request is (i) to access and disseminate
119119 13 information concerning news and current or passing events,
120120 14 (ii) for articles of opinion or features of interest to the
121121 15 public, or (iii) for the purpose of academic, scientific, or
122122 16 public research or education.
123123 17 (d) "Copying" means the reproduction of any public record
124124 18 by means of any photographic, electronic, mechanical or other
125125 19 process, device or means now known or hereafter developed and
126126 20 available to the public body.
127127 21 (e) "Head of the public body" means the president, mayor,
128128 22 chairman, presiding officer, director, superintendent,
129129 23 manager, supervisor or individual otherwise holding primary
130130 24 executive and administrative authority for the public body, or
131131 25 such person's duly authorized designee.
132132 26 (f) "News media" means a newspaper or other periodical

143143 1 issued at regular intervals whether in print or electronic
144144 2 format, a news service whether in print or electronic format,
145145 3 a radio station, a television station, a television network, a
146146 4 community antenna television service, or a person or
147147 5 corporation engaged in making news reels or other motion
148148 6 picture news for public showing.
149149 7 (g) "Recurrent requester", as used in Section 3.2 of this
150150 8 Act, means a person that, in the 12 months immediately
151151 9 preceding the request, has submitted to the same public body
152152 10 (i) a minimum of 50 requests for records, (ii) a minimum of 15
153153 11 requests for records within a 30-day period, or (iii) a
154154 12 minimum of 7 requests for records within a 7-day period. For
155155 13 purposes of this definition, requests made by news media and
156156 14 non-profit, scientific, or academic organizations shall not be
157157 15 considered in calculating the number of requests made in the
158158 16 time periods in this definition when the principal purpose of
159159 17 the requests is (i) to access and disseminate information
160160 18 concerning news and current or passing events, (ii) for
161161 19 articles of opinion or features of interest to the public, or
162162 20 (iii) for the purpose of academic, scientific, or public
163163 21 research or education.
164164 22 For the purposes of this subsection (g), "request" means a
165165 23 written document (or oral request, if the public body chooses
166166 24 to honor oral requests) that is submitted to a public body via
167167 25 personal delivery, mail, telefax, electronic mail, or other
168168 26 means available to the public body and that identifies the

179179 1 particular public record the requester seeks. One request may
180180 2 identify multiple records to be inspected or copied.
181181 3 (h) "Voluminous request" means a request that: (i)
182182 4 includes more than 5 individual requests for more than 5
183183 5 different categories of records or a combination of individual
184184 6 requests that total requests for more than 5 different
185185 7 categories of records in a period of 20 business days; or (ii)
186186 8 requires the compilation of more than 500 letter or
187187 9 legal-sized pages of public records unless a single requested
188188 10 record exceeds 500 pages. "Single requested record" may
189189 11 include, but is not limited to, one report, form, e-mail,
190190 12 letter, memorandum, book, map, microfilm, tape, or recording.
191191 13 "Voluminous request" does not include a request made by
192192 14 news media and non-profit, scientific, or academic
193193 15 organizations if the principal purpose of the request is: (1)
194194 16 to access and disseminate information concerning news and
195195 17 current or passing events; (2) for articles of opinion or
196196 18 features of interest to the public; or (3) for the purpose of
197197 19 academic, scientific, or public research or education.
198198 20 For the purposes of this subsection (h), "request" means a
199199 21 written document, or oral request, if the public body chooses
200200 22 to honor oral requests, that is submitted to a public body via
201201 23 personal delivery, mail, telefax, electronic mail, or other
202202 24 means available to the public body and that identifies the
203203 25 particular public record or records the requester seeks. One

216216 2 (i) "Severance agreement" means a mutual agreement between
217217 3 any public body and its employee for the employee's
218218 4 resignation in exchange for payment by the public body.

221221 7 Sec. 7. Exemptions.
222222 8 (1) When a request is made to inspect or copy a public
223223 9 record that contains information that is exempt from
224224 10 disclosure under this Section, but also contains information
225225 11 that is not exempt from disclosure, the public body may elect
226226 12 to redact the information that is exempt. The public body
227227 13 shall make the remaining information available for inspection
228228 14 and copying. Subject to this requirement, the following shall
229229 15 be exempt from inspection and copying:
230230 16 (a) Information specifically prohibited from
231231 17 disclosure by federal or State law or rules and
232232 18 regulations implementing federal or State law.
233233 19 (b) Private information, unless disclosure is required
234234 20 by another provision of this Act, a State or federal law,
235235 21 or a court order.
236236 22 (b-5) Files, documents, and other data or databases
237237 23 maintained by one or more law enforcement agencies and
238238 24 specifically designed to provide information to one or
239239 25 more law enforcement agencies regarding the physical or

250250 1 mental status of one or more individual subjects.
251251 2 (c) Personal information contained within public
252252 3 records, the disclosure of which would constitute a
253253 4 clearly unwarranted invasion of personal privacy, unless
254254 5 the disclosure is consented to in writing by the
255255 6 individual subjects of the information. "Unwarranted
256256 7 invasion of personal privacy" means the disclosure of
257257 8 information that is highly personal or objectionable to a
258258 9 reasonable person and in which the subject's right to
259259 10 privacy outweighs any legitimate public interest in
260260 11 obtaining the information. The disclosure of information
261261 12 that bears on the public duties of public employees and
262262 13 officials shall not be considered an invasion of personal
263263 14 privacy.
264264 15 (d) Records in the possession of any public body
265265 16 created in the course of administrative enforcement
266266 17 proceedings, and any law enforcement or correctional
267267 18 agency for law enforcement purposes, but only to the
268268 19 extent that disclosure would:
269269 20 (i) interfere with pending or actually and
270270 21 reasonably contemplated law enforcement proceedings
271271 22 conducted by any law enforcement or correctional
272272 23 agency that is the recipient of the request;
273273 24 (ii) interfere with active administrative
274274 25 enforcement proceedings conducted by the public body
275275 26 that is the recipient of the request;

286286 1 (iii) create a substantial likelihood that a
287287 2 person will be deprived of a fair trial or an impartial
288288 3 hearing;
289289 4 (iv) unavoidably disclose the identity of a
290290 5 confidential source, confidential information
291291 6 furnished only by the confidential source, or persons
292292 7 who file complaints with or provide information to
293293 8 administrative, investigative, law enforcement, or
294294 9 penal agencies; except that the identities of
295295 10 witnesses to traffic crashes, traffic crash reports,
296296 11 and rescue reports shall be provided by agencies of
297297 12 local government, except when disclosure would
298298 13 interfere with an active criminal investigation
299299 14 conducted by the agency that is the recipient of the
300300 15 request;
301301 16 (v) disclose unique or specialized investigative
302302 17 techniques other than those generally used and known
303303 18 or disclose internal documents of correctional
304304 19 agencies related to detection, observation, or
305305 20 investigation of incidents of crime or misconduct, and
306306 21 disclosure would result in demonstrable harm to the
307307 22 agency or public body that is the recipient of the
308308 23 request;
309309 24 (vi) endanger the life or physical safety of law
310310 25 enforcement personnel or any other person; or
311311 26 (vii) obstruct an ongoing criminal investigation

323323 2 (d-5) A law enforcement record created for law

333333 12 Training Act, except to the extent authorized under that
334334 13 Section. This includes the documents supplied to the
335335 14 Illinois Law Enforcement Training Standards Board from the
336336 15 Illinois State Police and Illinois State Police Merit
337337 16 Board.
338338 17 (d-7) Information gathered or records created from the
339339 18 use of automatic license plate readers in connection with
340340 19 Section 2-130 of the Illinois Vehicle Code.
341341 20 (e) Records that relate to or affect the security of
342342 21 correctional institutions and detention facilities.
343343 22 (e-5) Records requested by persons committed to the
344344 23 Department of Corrections, Department of Human Services
345345 24 Division of Mental Health, or a county jail if those

397397 4 (e-10) Law enforcement records of other persons
398398 5 requested by a person committed to the Department of
399399 6 Corrections, Department of Human Services Division of
400400 7 Mental Health, or a county jail, including, but not
401401 8 limited to, arrest and booking records, mug shots, and
402402 9 crime scene photographs, except as these records may be
403403 10 relevant to the requester's current or potential case or
404404 11 claim.
405405 12 (f) Preliminary drafts, notes, recommendations,
406406 13 memoranda, and other records in which opinions are
407407 14 expressed, or policies or actions are formulated, except
408408 15 that a specific record or relevant portion of a record
409409 16 shall not be exempt when the record is publicly cited and
410410 17 identified by the head of the public body. The exemption
411411 18 provided in this paragraph (f) extends to all those
412412 19 records of officers and agencies of the General Assembly
413413 20 that pertain to the preparation of legislative documents
414414 21 and to all those records that pertain to the preparation
415415 22 of judicial opinions and orders.
416416 23 (g) Trade secrets and commercial or financial
417417 24 information obtained from a person or business where the
418418 25 trade secrets or commercial or financial information are
419419 26 furnished under a claim that they are proprietary,

430430 1 privileged, or confidential, and that disclosure of the
431431 2 trade secrets or commercial or financial information would
432432 3 cause competitive harm to the person or business, and only
433433 4 insofar as the claim directly applies to the records
434434 5 requested.
435435 6 The information included under this exemption includes
436436 7 all trade secrets and commercial or financial information
437437 8 obtained by a public body, including a public pension
438438 9 fund, from a private equity fund or a privately held
439439 10 company within the investment portfolio of a private
440440 11 equity fund as a result of either investing or evaluating
441441 12 a potential investment of public funds in a private equity
442442 13 fund. The exemption contained in this item does not apply
443443 14 to the aggregate financial performance information of a
444444 15 private equity fund, nor to the identity of the fund's
445445 16 managers or general partners. The exemption contained in
446446 17 this item does not apply to the identity of a privately
447447 18 held company within the investment portfolio of a private
448448 19 equity fund, unless the disclosure of the identity of a
449449 20 privately held company may cause competitive harm.
450450 21 Nothing contained in this paragraph (g) shall be
451451 22 construed to prevent a person or business from consenting
452452 23 to disclosure.
453453 24 (h) Proposals and bids for any contract, grant, or
454454 25 agreement, including information which if it were
455455 26 disclosed would frustrate procurement or give an advantage

466466 1 to any person proposing to enter into a contractor
467467 2 agreement with the body, until an award or final selection
468468 3 is made. Information prepared by or for the body in
469469 4 preparation of a bid solicitation shall be exempt until an
470470 5 award or final selection is made.
471471 6 (i) Valuable formulae, computer geographic systems,
472472 7 designs, drawings, and research data obtained or produced
473473 8 by any public body when disclosure could reasonably be
474474 9 expected to produce private gain or public loss. The
475475 10 exemption for "computer geographic systems" provided in
476476 11 this paragraph (i) does not extend to requests made by
477477 12 news media as defined in Section 2 of this Act when the
478478 13 requested information is not otherwise exempt and the only
479479 14 purpose of the request is to access and disseminate
480480 15 information regarding the health, safety, welfare, or
481481 16 legal rights of the general public.
482482 17 (j) The following information pertaining to
483483 18 educational matters:
484484 19 (i) test questions, scoring keys, and other
485485 20 examination data used to administer an academic
486486 21 examination;
487487 22 (ii) information received by a primary or
488488 23 secondary school, college, or university under its
489489 24 procedures for the evaluation of faculty members by
490490 25 their academic peers;
