1313 1 AN ACT concerning education.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The School Code is amended by adding Section
1717 5 2-3.206 as follows:
1818 6 (105 ILCS 5/2-3.206 new)
1919 7 Sec. 2-3.206. School ventilation.
2020 8 (a) As used in this Section:
2121 9 "Active classroom" means any room currently being used for
2222 10 any duration of in-person instruction of 4 or more students at
2323 11 a time.
2424 12 "ASHRAE" means the American Society of Heating,
2525 13 Refrigerating and Air-Conditioning Engineers.
2626 14 "Certified assessor" means:
2727 15 (1) a certified technician; or
2828 16 (2) a person who is certified to perform ventilation
2929 17 verification assessments of heating, ventilation, and air
3030 18 conditioning systems through a certification body
3131 19 accredited by the American National Standards Institute.
3232 20 "CADR" means clean air delivery rate.
3333 21 "Certified technician" means a person who is certified as
3434 22 a Testing, Adjusting, and Balancing Bureau Technician by the
3535 23 International Certification Board and accredited to comply

8585 10 "HVAC" means Heating, Ventilation, and Air Conditioning.
8686 11 "Mechanical engineer" means a professional engineer
8787 12 licensed as a mechanical engineer by the Department of
8888 13 Financial and Professional Regulation who has professional
8989 14 experience with heating, ventilation, and air conditioning
9090 15 systems.
9191 16 "PM2.5" means particulate matter at 2.5 microns or less.
9292 17 "PM10" means particulate matter at 10 microns or less.
9393 18 "PPM" means parts per million.
9494 19 "UV" means ultraviolet.
9595 20 "Skilled and trained construction workforce" means a
9696 21 workforce in which at least 40% of the workers are graduates of
9797 22 or registered in and attending an accredited apprenticeship
9898 23 program registered with the United States Department of Labor.
9999 24 (b) The State Board of Education shall require all school

112112 1 an educational document, in a PDF and a physical format,
113113 2 explaining, at a minimum, the values of good indoor air
114114 3 quality, including peer-reviewed research demonstrating the
115115 4 effects of poor and good indoor air quality, an explanation of
116116 5 the airborne transmission of pathogens and other airborne
117117 6 substances, a basic explanation of air changes per hour and
118118 7 the relation to outdoor air and filtered air, and best
119119 8 practice recommendations for a portable air cleaner and an air
120120 9 quality monitor, including guidance on the theory, function,
121121 10 placement, and operation of the monitor. The document shall be
122122 11 developed with the assistance of a major independent and
123123 12 nonpartisan approved organization recognized as a subject
124124 13 matter expert in the field of air quality, such as a local
125125 14 ASHRAE chapter. This document shall be created and supplied to
126126 15 schools within 3 months after the effective date of this
127127 16 amendatory Act of the 104th General Assembly.
128128 17 (c) Subject to appropriation, the State Board shall
129129 18 require all school districts to ensure that all active
130130 19 classrooms that are not mechanically ventilated have at least
131131 20 2 properly functioning windows, or one window in situations
132132 21 where only one is present, that can open and can safely stay
133133 22 open. School districts must be in compliance with this Section
134134 23 within 6 months after the effective date of this amendatory
135135 24 Act of the 104th General Assembly.
136136 25 (d) Subject to appropriation, the State Board shall
137137 26 require all school districts to ensure that all active

148148 1 classrooms are equipped with an air quality monitor that:
149149 2 (1) is installed and operating within one month
150150 3 following delivery;
151151 4 (2) remains in the active classroom until classroom is
152152 5 no longer an active classroom;
153153 6 (3) is an air quality monitor that has been determined
154154 7 by the State Board to be suitable, by the State Board
155155 8 seeking out and obtaining a written statement noting that
156156 9 the capabilities of the monitor in question are sufficient
157157 10 to serve the purposes described in this Section, from a
158158 11 major independent and nonpartisan organization recognized
159159 12 as a subject matter expert in the field of air quality,
160160 13 such as a local ASHRAE chapter. The written statement
161161 14 shall minimally address suitability of: the selected
162162 15 monitor's measurement technology, calibration
163163 16 specifications, and manufacturer stated accuracies and
164164 17 ranges;
165165 18 (4) measures, at a minimum, carbon dioxide and PM2.5.
166166 19 Selected monitors are recommended to also measure carbon
167167 20 monoxide, PM10, volatile organic compounds, temperature,
168168 21 and humidity;
169169 22 (5) displays, at a minimum, carbon dioxide readings
170170 23 through a display on the device or other means, such as on
171171 24 a computer or cellular phone application;
172172 25 (6) is corded and does not rely solely on batteries

184184 1 (7) is to be located between 3 and 6 feet above the
185185 2 floor and at least 5 feet away from doors, operable
186186 3 windows, or human occupants;
187187 4 (8) connects via a wired or wireless connection to
188188 5 other applicable monitors so as to permit recording of
189189 6 data which includes at least the maximum carbon dioxide
190190 7 concentrations for a period of at least one year, as well
191191 8 as remote access to current air quality readings through a
192192 9 computer or cellular phone application; and
193193 10 (9) provides notification through a visual indicator
194194 11 on the monitor, or other alert such as electronic mail,
195195 12 text message or cellular phone application, when the
196196 13 carbon dioxide levels in the classroom have exceeded a PPM
197197 14 level recommended to the State Board in writing by a major
198198 15 independent and nonpartisan organization recognized as a
199199 16 subject matter expert in the field of air quality, such as
200200 17 a local ASHRAE chapter.
201201 18 Each school shall record all incidents where the
202202 19 recommended PPM level was breached in a classroom and maintain
203203 20 those records for at least 5 years.
204204 21 Any supplied air quality monitor under this subsection may
205205 22 not be shared between active classrooms.
206206 23 If devices matching the criteria described in this
207207 24 subsection are unavailable, the State Board shall contact a
208208 25 major independent and nonpartisan organization recognized as a
209209 26 subject matter expert in the field of air quality, such as a

220220 1 local ASHRAE chapter, and request assistance in determining
221221 2 suitable selection criteria for an air quality monitor that
222222 3 will sufficiently accomplish the goals of: providing teachers
223223 4 and staff with air quality information to facilitate managing
224224 5 indoor air quality; storing a sufficient type and duration of
225225 6 data to facilitate ventilation assessments; provide remote
226226 7 access to current air quality readings; and generally align
227227 8 with contemporary best practice recommendations.
228228 9 (e) Subject to appropriation, the State Board shall
229229 10 require all school districts to ensure that all active
230230 11 classrooms are equipped with a portable air cleaner that:
231231 12 (1) is installed and operating within one month
232232 13 following delivery;
233233 14 (2) remains in the active classroom until classroom is
234234 15 no longer an active classroom;
235235 16 (3) is a portable air cleaner the State Board has
236236 17 determined to be suitable, by seeking out and obtaining a
237237 18 written statement noting that the capabilities of the
238238 19 portable air cleaner in question are sufficient to serve
239239 20 the purposes described in this Section, from a major
240240 21 independent and nonpartisan organization recognized as a
241241 22 subject matter expert in the field of air quality, such as
242242 23 a local ASHRAE chapter;
243243 24 (4) utilizes a HEPA filter that captures 99.97% of 0.3
244244 25 micron particles. A filter stated to be equal to or
245245 26 superior to a HEPA may not be used;

256256 1 (5) utilizes or has the option of utilizing a
257257 2 secondary filter for gaseous pollutants, such as activated
258258 3 carbon;
259259 4 (6) only utilizes HEPA filtration, as opposed to
260260 5 additional technologies such as ionization, chemical
261261 6 processes, and UV. If such additional technologies are
262262 7 present in the selected portable air cleaner they must be
263263 8 able to be disabled;
264264 9 (7) Produces 500 or more CFM as measured by CADR or
265265 10 similar metric of filtered airflow;
266266 11 (8) Produces 500 or more CFM of filtered airflow at
267267 12 under 45 dBA of noise, according to manufacturer supplied
268268 13 dBA test results measured at one meter in front of the
269269 14 portable air cleaner;
270270 15 (9) is Underwriters Laboratories certified or
271271 16 certified to Underwriters Laboratories standards;
272272 17 (10) has a manufacturer's warranty of at least one
273273 18 year;
274274 19 (11) shall be continuously operated during room
275275 20 occupancy on at least low speed;
276276 21 (12) shall be maintained according to manufacturer's
277277 22 recommendation, written approval shall be obtained from
278278 23 the manufacturer if deviation from standard
279279 24 recommendations is being considered; and
280280 25 (13) shall be replaced within one month if it becomes
281281 26 inoperable.

292292 1 If a single portable air cleaner on the market does not
293293 2 meet the parameters of this subsection, then 2 or more
294294 3 portable air cleaners per active classroom may be substituted
295295 4 if they produce a combined 500 or more CFM, as measured by CADR
296296 5 or similar metric, of filtered airflow at under 45 combined
297297 6 dBA of noise according to manufacturer supplied dBA test
298298 7 results measured at one meter in front of the portable air
299299 8 cleaner.
300300 9 Any supplied portable air cleaner may not be shared
301301 10 between active classrooms.
302302 11 (f) Subject to appropriation, the State Board shall
303303 12 require all school districts to supply each school with 5
304304 13 additional portable air cleaners and 5 additional air quality
305305 14 monitors that meet the requirements of subsections (d) and (e)
306306 15 to be used in school health offices, libraries, cafeterias,
307307 16 and other similar spaces.
308308 17 (g) Subject to appropriation, the State Board shall
309309 18 require all school districts to undertake a ventilation
310310 19 verification assessment of all mechanical ventilation systems
311311 20 in the school district performed by a certified assessor or a
312312 21 mechanical engineer and shall be based on physical
313313 22 measurements made during the assessment. If an assessment is
314314 23 performed by a certified assessor, the assessment report shall
315315 24 be reviewed by a mechanical engineer. The ventilation
316316 25 verification assessment shall verify whether the existing
317317 26 mechanical ventilation system is operating in accordance with

328328 1 design parameters and meets the requirements of any applicable
329329 2 building codes. The ventilation verification assessment for a
330330 3 heating, ventilation, and air conditioning system shall
331331 4 include:
332332 5 (1) testing for maximum filter efficiency;
333333 6 (2) measurements of outside air rate;
334334 7 (3) verification of operation of ventilation
335335 8 components;
336336 9 (4) measurement of all air distribution inlets and
337337 10 outlets;
338338 11 (5) verification of unit operation and that required
339339 12 maintenance has been performed;
340340 13 (6) verification of control sequences;
341341 14 (7) verification or installation of carbon dioxide
342342 15 sensors; and
343343 16 (8) collection of field data for the installation of
344344 17 mechanical ventilation if none exists.
345345 18 (h) The verification assessment report from the mechanical
346346 19 engineer shall include appropriate corrective actions needed
347347 20 for the mechanical ventilation system or the heating,
348348 21 ventilation, and air conditioning infrastructure, including
349349 22 installation of appropriate filters, installation of carbon
350350 23 dioxide sensors and additional maintenance, repairs, upgrades
351351 24 or replacement.
352352 25 (i) The school district shall have a ventilation
353353 26 verification assessment performed on all mechanical
