1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. Purpose. The purpose of this amendatory Act of
1515 5 the 104th General Assembly is to address health care needs
1616 6 within the Department of Corrections by providing nursing
1717 7 scholarship assistance to eligible students in this State,
1818 8 subject to appropriation, and require a public service
1919 9 commitment agreement to work within the Department of
2020 10 Corrections for a specified duration. The Program shall be
2121 11 administered by the Illinois Student Assistance Commission
2222 12 with the guidance and assistance of the Department.
2323 13 Section 10. The Higher Education Student Assistance Act is
2424 14 amended by adding Section 65.135 as follows:

6767 1 pre-licensure nursing education program located in this State
6868 2 that has received approval from the Department of Financial
6969 3 and Professional Regulation for an associate degree in nursing
7070 4 program, an associate degree in applied sciences in nursing
7171 5 program, a hospital-based diploma in nursing program, a
7272 6 baccalaureate degree in nursing program, a graduate degree in
7373 7 nursing program, or a certificate in a practical nursing
7474 8 program approved by the Board of Higher Education or any
7575 9 successor agency with similar authority. An eligible
7676 10 institution must maintain compliance with all applicable State
7777 11 and federal laws. An eligible institution is not necessarily
7878 12 eligible for other programs administered by the Commission and
7979 13 is not required to meet the definition of "institution of
8080 14 higher learning", "qualified institution", or "institution"
8181 15 under Section 10 of this Act. The Commission may establish by
8282 16 rule additional requirements for an eligible institution.
8383 17 (b) Subject to appropriation, the Commission shall award a
8484 18 nursing in correctional facilities scholarship to each
8585 19 qualified applicant. To determine the maximum annual
8686 20 scholarship amount available to a recipient enrolled full
8787 21 time, the Commission shall consider tuition and fee charges
8888 22 and projected living expenses at community colleges and
8989 23 universities statewide under the following criteria:
9090 24 (1) To determine the maximum scholarship amount for a
9191 25 recipient pursuing a certificate in practical nursing at
9292 26 an eligible institution, a hospital-based diploma in

103103 1 nursing, or an associate degree or diploma in nursing from
104104 2 an community college, the Commission shall add the
105105 3 weighted tuition and fees charged by community colleges in
106106 4 this State to the uniform living allowance reported in the
107107 5 weighted Monetary Award Program budget.
108108 6 (2) To determine the maximum scholarship amount for a
109109 7 recipient pursuing an associate, baccalaureate, or
110110 8 graduate degree in nursing at a private 2-year college or
111111 9 a public or private 4-year eligible institution in this
112112 10 State, the Commission shall add the weighted tuition and
113113 11 fees charged by institutions of higher learning to the
114114 12 uniform living allowance reported in the weighted Monetary
115115 13 Award Program budget.
116116 14 The total amount of scholarship assistance awarded by the
117117 15 Commission under this Section to an eligible applicant in any
118118 16 given fiscal year, when added to other financial assistance
119119 17 awarded to that individual for that year, may not exceed the
120120 18 cost of attendance at the institution at which the student is
121121 19 enrolled. If the amount of financial assistance to be awarded
122122 20 to a qualified student exceeds the cost of attendance at the
123123 21 institution at which the student is enrolled, the scholarship
124124 22 awarded under this Section shall be reduced by an amount equal
125125 23 to the amount by which the combined financial assistance
126126 24 available to the student exceeds the cost of attendance.
127127 25 (c) The Commission shall, on an annual basis, receive and

139139 1 Section. An applicant is eligible for a scholarship under this
140140 2 Section if the Commission finds that the applicant meets all
141141 3 of the following criteria:
142142 4 (1) Is a resident of this State.
143143 5 (2) Is enrolled in an eligible institution on at least
144144 6 a part-time basis.
145145 7 (3) Expresses a commitment to work as a nurse within
146146 8 the Department for a minimum of 3 years.
147147 9 (4) Is not receiving financial assistance during the
148148 10 same academic year through a scholarship program under the
149149 11 Nursing Education Scholarship Law.
150150 12 When selecting scholarship recipients from among eligible
151151 13 applicants, the Commission shall give preference first to
152152 14 previous recipients of a scholarship under this Section,
153153 15 provided that a recipient continues to meet the eligibility
154154 16 requirements set forth in this Section and maintains
155155 17 satisfactory academic progress as determined by the
156156 18 institution of higher education at which the recipient is
157157 19 enrolled. In considering new recipients, the Commission shall
158158 20 prioritize funding for students with financial need, as
159159 21 determined by the Commission.
160160 22 (d) Prior to receiving scholarship assistance for an
161161 23 academic year, each recipient of a scholarship awarded under
162162 24 this Section must sign an agreement pledging that, within the
163163 25 one-year period following the termination of the academic
164164 26 program for which the recipient was awarded a scholarship, the

175175 1 recipient shall:
176176 2 (1) begin working as a nurse within the Department for
177177 3 a period of not less than 3 years; and
178178 4 (2) upon request of the Commission and subject to
179179 5 confirmation with the Department, provide the Commission
180180 6 with evidence that the recipient is fulfilling or has
181181 7 fulfilled the terms of the agreement required under this
182182 8 subsection (d).
183183 9 (e) A recipient may receive scholarship assistance under
184184 10 this Section for the equivalent of 8 semesters or 16 quarters
185185 11 of full-time enrollment.
186186 12 (f) All applications for a scholarship under this Section
187187 13 shall be made to the Commission in a form and manner prescribed
188188 14 by the Commission. An applicant shall also submit any
189189 15 supporting documents deemed necessary by the Commission at the
190190 16 time of application.
191191 17 (g) All scholarship funds distributed under this Section
192192 18 shall be paid to the eligible institution on behalf of the
193193 19 scholarship recipient.
194194 20 (h) If a recipient of a scholarship awarded under this
195195 21 Section fails to fulfill the agreement required under this
196196 22 Section, the Commission shall require the recipient to repay
197197 23 the amount of the scholarship or scholarships received,
198198 24 prorated according to the fraction of the agreement not
199199 25 completed, plus interest at a rate of 5% and, if applicable,

211211 1 Commission under this Section shall be remitted to the State
212212 2 Comptroller for deposit into the General Revenue Fund.
213213 3 (i) A recipient of a scholarship awarded by the Commission
214214 4 under this Section is not in violation of the agreement
215215 5 entered into pursuant to this Section if the recipient (i) is
216216 6 serving as a member of the Armed Services or Reserve Forces of
217217 7 the United States, (ii) has a temporary total disability, as
218218 8 established by a sworn affidavit of a qualified physician,
219219 9 (iii) is taking additional courses, on at least a half-time
220220 10 basis, related to nursing, or (iv) has extenuating and
221221 11 specific circumstances in which the recipient is unable to
222222 12 achieve full-time employment as a nurse within the Department
223223 13 and is able to provide evidence of that fact, subject to review
224224 14 by the Commission. Any extension of the period during which
225225 15 the agreement must be fulfilled is subject to limitations of
226226 16 duration established by the Commission, with the guidance and
227227 17 assistance of the Department.
228228 18 (j) In providing guidance and assistance to the
229229 19 Commission, the Department may collaborate with accredited
230230 20 State nursing schools to facilitate this Section. Eligible
231231 21 institutions are encouraged to support and promote this
232232 22 Section among their nursing students.
233233 23 (k) The Department, in consultation with the Commission,
234234 24 shall provide an annual report to the General Assembly on this
235235 25 Section's effectiveness, including the number of recipients,
236236 26 their service periods, and any challenges faced.

247247 1 (l) The funding for scholarships under this Section is
248248 2 subject to appropriation. Additional contributions from
249249 3 private entities, philanthropic organizations, or federal
250250 4 grants may supplement the scholarships.
251251 5 (m) The Commission shall administer this Section and shall
252252 6 make all necessary and proper rules not inconsistent with this
253253 7 Section for this Sections's effective implementation, with the
254254 8 guidance and assistance of the Department.
