311 1 AN ACT concerning local government.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
6-4 Section 5. The America's Central Port District Act is
7-5 amended by changing Sections 7.5, 15, 19, 21, and 25 as

15+5 Reconstruction Act is amended by changing Section 1 as

10-8 Sec. 7.5. Authorization to borrow moneys. The District's
11-9 Board may borrow money from any governmental agency, bank, or
12-10 other financial institution and may provide appropriate
13-11 security for that borrowing, if the money is repaid within 20
14-12 years after the money is borrowed. "Financial institution" has
15-13 the meaning given in Section 8-1-3.1 of the Illinois Municipal
16-14 Code means any bank subject to the Illinois Banking Act, any
17-15 savings and loan association subject to the Illinois Savings
18-16 and Loan Act of 1985, any savings bank subject to the Savings
19-17 Bank Act, and any federally chartered commercial bank or
20-18 savings and loan association organized and operated in this
21-19 State pursuant to the laws of the United States.

33-1 District shall be a Board of Commissioners consisting of up to
34-2 9 members, to be known as the America's Central Port District
35-3 Board. All members of the Board shall be residents of the
36-4 District and shall be known as Commissioners of the America's
37-5 Central Port District Board. The members of the Board shall
38-6 serve without compensation but shall be reimbursed for actual
39-7 expenses incurred by them in the performance of their duties.
40-8 However, any Commissioner of the Board who is appointed to the
41-9 office of secretary or treasurer may receive compensation for
42-10 his services as such officer. No Commissioner of the Board or
43-11 employee of the District shall have any private financial
44-12 interest, profit or benefit in any contract, work or business
45-13 of the District nor in the sale or lease of any property to or
46-14 from the District, except to the extent allowed under "An Act
47-15 to prevent fraudulent and corrupt practices in the making or
48-16 accepting of official appointments and contracts by public
49-17 officers", approved April 9, 1872, as now or hereafter
50-18 amended.

53-21 Sec. 19. Regular meetings of the Board shall be held at

68-1 ordinance or resolution, and the affirmative vote of a
69-2 majority of those members physically present at least 5
70-3 members shall be necessary for the adoption of any ordinance
71-4 or resolution. All such ordinances and resolutions before
72-5 taking effect shall be approved by the chairman of the Board,
73-6 and if he approves thereof he shall sign the same, and such as
74-7 he does not approve he shall return to the Board with his
75-8 objections thereto in writing at the next regular meeting of
76-9 the Board occurring after the passage thereof. But in the case
77-10 the chairman fails to return any ordinance or resolution with
78-11 his objections thereto by the time aforesaid, he shall be
79-12 deemed to have approved the same and it shall take effect
80-13 accordingly. Upon the return of any ordinance or resolution by
81-14 the chairman with his objections, the vote by which the same
82-15 was passed shall be reconsidered by the Board, and if upon such
83-16 reconsideration said ordinance or resolution is passed by the
84-17 affirmative vote of at least two-thirds of the 6 members, it
85-18 shall go into effect notwithstanding the veto of the chairman.
86-19 All ordinances, resolutions and all proceedings of the
87-20 District and all documents and records in its possession shall
88-21 be public records, and open to public inspection, except such
89-22 documents and records as are kept or prepared by the Board for
90-23 use in negotiations, legal actions or proceedings to which the
91-24 District is a party.

104-2 Sec. 21. All funds deposited by the treasurer in any bank
105-3 or savings and loan association shall be placed in the name of
106-4 the District and shall be withdrawn or paid out only by check
107-5 or draft upon the bank or savings and loan association, signed
108-6 by the treasurer and countersigned by the chairman of the
109-7 Board, or by Automated Clearing House transaction or other
110-8 electronic means. Subject to prior approval of such
111-9 designations by a majority of the Board, the chairman may
112-10 designate any other Board member or any officer of the
113-11 District to affix the signature of the chairman and the
114-12 treasurer may designate any other officer of the District to
115-13 affix the signature of the treasurer to any check or draft for
116-14 payment of salaries or wages and for payment of any other
117-15 obligation of not more than $2,500.00.
118-16 No bank or savings and loan association shall receive
119-17 public funds as permitted by this Section, unless it has
120-18 complied with the requirements established pursuant to the
121-19 Public Funds Investment Act Section 6 of "An Act relating to
122-20 certain investments of public funds by public agencies",
123-21 approved July 23, 1943, as now or hereafter amended.

138-1 to prepare and print to be prepared and printed a complete and
139-2 detailed report and financial statement of the operations and
140-3 assets and liabilities of the Port District. A reasonably
141-4 sufficient number of copies of such report shall be printed
142-5 for distribution to persons interested, upon request, and a
143-6 copy of the report thereof shall be filed with the Governor and
144-7 the county clerks and the presiding officers of the county
145-8 boards of Madison and Jersey Counties. A copy of such report or
146-9 a summary of the report shall be addressed and submitted to and
147-10 mailed to the Mayor or ranking official and city council or
148-11 president and board of trustees of each municipality within
149-12 the area of the District.
