313 1 AN ACT concerning local government.
414 2 Be it enacted by the People of the State of Illinois,
515 3 represented in the General Assembly:
616 4 Section 5. The Law Enforcement Officer-Worn Body Camera
717 5 Act is amended by changing Section 10-10 as follows:

919 7 Sec. 10-10. Definitions. As used in this Act:
1020 8 "Auxiliary officer" means an individual serving the police
1121 9 agency of a municipality pursuant to Section 3.1-30-20 of the
1222 10 Illinois Municipal Code or serving a county sheriff pursuant
1323 11 to Section 3-6013 of the Counties Code.
1424 12 "Badge" means an officer's department issued
1525 13 identification number associated with his or her position as a
1626 14 police officer with that department.
1727 15 "Board" means the Illinois Law Enforcement Training
1828 16 Standards Board created by the Illinois Police Training Act.
1929 17 "Business offense" means a petty offense for which the
2030 18 fine is in excess of $1,000.
2131 19 "Community caretaking function" means a task undertaken by
2232 20 a law enforcement officer in which the officer is performing
2333 21 an articulable act unrelated to the investigation of a crime.
2434 22 "Community caretaking function" includes, but is not limited
2535 23 to, participating in town halls or other community outreach,

4585 12 enforcement officer acting in the course of his or her duties.
4686 13 "Law enforcement officer" or "officer" means any person
4787 14 employed by a State, county, municipality, special district,
4888 15 college, unit of government, or any other entity authorized by
4989 16 law to employ peace officers or exercise police authority and
5090 17 who is primarily responsible for the prevention or detection
5191 18 of crime and the enforcement of the laws of this State. "Law
5292 19 enforcement officer" or "officer" includes an auxiliary
5393 20 officer assigned to public service.
5494 21 "Law enforcement agency" means all State agencies with law
5595 22 enforcement officers, county sheriff's offices, municipal,
5696 23 special district, college, or unit of local government police
5797 24 departments.
5898 25 "Law enforcement-related encounters or activities"
5999 26 include, but are not limited to, traffic stops, pedestrian

70110 1 stops, arrests, searches, interrogations, investigations,
71111 2 pursuits, crowd control, traffic control, non-community
72112 3 caretaking interactions with an individual while on patrol, or
73113 4 any other instance in which the officer is enforcing the laws
74114 5 of the municipality, county, or State. "Law
75115 6 enforcement-related encounter or activities" does not include
76116 7 when the officer is completing paperwork alone, is
77117 8 participating in training in a classroom setting, or is only
78118 9 in the presence of another law enforcement officer.
79119 10 "Minor traffic offense" means a petty offense, business
80120 11 offense, or Class C misdemeanor under the Illinois Vehicle
81121 12 Code or a similar provision of a municipal or local ordinance.
82122 13 "Officer-worn body camera" means an electronic camera
83123 14 system for creating, generating, sending, receiving, storing,
84124 15 displaying, and processing audiovisual recordings that may be
85125 16 worn about the person of a law enforcement officer.
86126 17 "Peace officer" has the meaning provided in Section 2-13
87127 18 of the Criminal Code of 2012.
88128 19 "Petty offense" means any offense for which a sentence of
89129 20 imprisonment is not an authorized disposition.
90130 21 "Recording" means the process of capturing data or
91131 22 information stored on a recording medium as required under
92132 23 this Act.
93133 24 "Recording medium" means any recording medium authorized
94134 25 by the Board for the retention and playback of recorded audio

140180 1 is a law enforcement officer acting in the course of his or her

142182 3 "Law enforcement officer" or "officer" means any person

146186 7 of the public interest at the risk of that person's life.
147187 8 "Officer-worn body camera" means an electronic camera

149189 10 displaying, and processing audiovisual recordings that may be
150190 11 worn about the person of a law enforcement officer.

175215 1 (a) The Law Enforcement Camera Grant Fund is created as a
176216 2 special fund in the State treasury. From appropriations to the
177217 3 Board from the Fund, the Board must make grants to units of
178218 4 local government in Illinois and Illinois public universities
179219 5 for the purpose of (1) purchasing or leasing in-car video
180220 6 cameras for use in law enforcement vehicles, (2) purchasing or
181221 7 leasing officer-worn body cameras and associated technology
182222 8 for law enforcement officers and auxiliary officers, and (3)
183223 9 training for law enforcement officers and auxiliary officers
184224 10 in the operation of the cameras. Grants under this Section may
185225 11 be used to offset data storage and related licensing costs for
186226 12 officer-worn body cameras. For the purposes of this Section,
187227 13 "purchasing or leasing" includes providing funding to units of
188228 14 local government in advance that can be used to obtain this
189229 15 equipment rather than only for reimbursement of purchased
190230 16 equipment.
191231 17 Moneys received for the purposes of this Section,
192232 18 including, without limitation, fee receipts and gifts, grants,
193233 19 and awards from any public or private entity, must be
194234 20 deposited into the Fund. Any interest earned on moneys in the
195235 21 Fund must be deposited into the Fund.
196236 22 (b) The Board may set requirements for the distribution of
197237 23 grant moneys and determine which law enforcement agencies are
198238 24 eligible.
199239 25 (b-5) The Board shall consider compliance with the Uniform
200240 26 Crime Reporting Act as a factor in awarding grant moneys.
