311 1 AN ACT concerning safety.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Electric Vehicle Rebate Act is amended by
7-5 changing Sections 10, 15, 27, and 40 as follows:

9-7 Sec. 10. Definitions. As used in this Act:
10-8 "Agency" means the Environmental Protection Agency.
11-9 "Covered Area" means the counties of Cook, DuPage, Kane,
12-10 Lake, McHenry, and Will, the townships of Aux Sable and Goose
13-11 Lake in Grundy County, and the township of Oswego in Kendall
14-12 County.
15-13 "Electric vehicle" means a vehicle that is exclusively
16-14 powered by and refueled by electricity, must be plugged in to
17-15 charge, and is legally permitted licensed to drive on all
18-16 public roadways, including interstate highways. "Electric
19-17 Vehicle" does not include electric mopeds, electric
20-18 off-highway vehicles primarily intended to be driven
21-19 off-highway, including golf carts and electric vehicles with a
22-20 maximum speed below 45 miles per hour, or hybrid electric
23-21 vehicles and extended-range electric vehicles that are also
24-22 equipped with conventional fueled propulsion or auxiliary
25-23 engines.

34-1 "Eligible applicant" means persons and families whose
35-2 income does not exceed 500% of the federal poverty line for the
36-3 current State fiscal year and who may not be claimed as a
37-4 dependent.
38-5 "Eligible vehicle" means an electric vehicle, as defined
39-6 by this Act, with a selling price not exceeding $80,000 as
40-7 shown on the bill of sale, that has not previously received a
41-8 rebate under this Act. For the purposes of this Act, State and
42-9 local taxes, license and registration fees, documentary
43-10 service fees, and aftermarket products, including, but not
44-11 limited to, extended warranties, service contracts, and other
45-12 voluntary vehicle protection products, are excluded from the
46-13 calculation of the selling price if separately itemized on the
47-14 bill of sale.
48-15 "Environmental justice community" has the same meaning,
49-16 based on existing methodologies and findings, used and as may
50-17 be updated by the Illinois Power Agency and its Program
51-18 Administrator of the Illinois Solar for All Program.
52-19 "Low-income applicants Low income" means persons and
53-20 families whose income does not exceed 80% of the regional or
54-21 county State median income for the current State fiscal year,
55-22 as established by the United States Department of Housing and
56-23 Urban Development's Illinois Income Limits by metropolitan
57-24 area and county Health and Human Services.

70-2 Sec. 15. Rulemaking. The Agency shall adopt promulgate
71-3 rules as necessary and dedicate sufficient resources to
72-4 implement Section 27 of this Act. Such rules shall be
73-5 consistent with applicable provisions of the Clean Air Act and
74-6 any regulations promulgated pursuant thereto. The Secretary of
75-7 State may adopt promulgate rules to implement Section 35 of
76-8 this Act.

80-12 Sec. 27. Electric vehicle rebate.
81-13 (a) Beginning July 1, 2022, and continuing as long as
82-14 funds are available, each eligible applicant person shall be
83-15 eligible to apply for a rebate, in the amounts set forth below,
84-16 following the purchase of an eligible electric vehicle in
85-17 Illinois. The Agency shall accept applications and issue
86-18 rebates consistent with the provisions of this Act and any
87-19 implementing regulations adopted by the Agency. In no event
88-20 shall a rebate amount exceed the purchase price of the
89-21 vehicle.
90-22 (1) Beginning July 1, 2025 2022, a $2,000 $4,000
91-23 rebate for eligible applicants toward the purchase of a
92-24 new or used an electric vehicle that is not an electric
93-25 motorcycle and a $1,500 rebate for the purchase of an

105-2 Low-income applicants are eligible for an additional
106-3 $2,000 rebate for new or used vehicles that are not

108-5 (2) (Blank). Beginning July 1, 2026, a $2,000 rebate
109-6 for the purchase of an electric vehicle that is not an

111-8 (3) Beginning July 1, 2028, a $1,500 rebate for
112-9 eligible applicants toward the purchase of a new or used
113-10 an electric vehicle that is not an electric motorcycle and
114-11 a $750 rebate for the purchase of an electric vehicle that
115-12 is an electric motorcycle. Low-income applicants are
116-13 eligible for an additional $1,500 for new or used vehicles
117-14 that are not electric motorcycles.
118-15 (4) (Blank). Beginning July 1, 2022, a $1,500 rebate
119-16 for the purchase of an electric vehicle that is an
120-17 electric motorcycle.
121-18 (b) To be eligible to receive a rebate, a purchaser must:
122-19 (1) Reside in Illinois, both at the time the vehicle
123-20 was purchased and at the time the rebate is issued.
124-21 (2) Purchase an electric vehicle in Illinois on or
125-22 after July 1, 2022 and be the owner of the vehicle at the
126-23 time the rebate is issued. Rented or leased vehicles,
127-24 vehicles purchased from an out-of-state dealership, and
128-25 vehicles delivered to or received by the purchaser
129-26 out-of-state are not eligible for a rebate under this Act.

140-1 (3) Apply for the rebate within 180 90 days after the
141-2 vehicle purchase date, and provide to the Agency proof of
142-3 residence, proof of vehicle ownership, and proof that the
143-4 vehicle was purchased in Illinois, including a copy of a
144-5 purchase agreement noting an Illinois seller. The
145-6 purchaser must notify the Agency of any changes in
146-7 residency or ownership of the vehicle that occur between
147-8 application for a rebate and issuance of a rebate.
148-9 (4) Apply for the rebate during an open rebate cycle,
149-10 as identified by the Agency.
150-11 (5) Certify that the purchaser qualifies as an
151-12 eligible applicant and a low-income applicant, if
152-13 applicable.
153-14 (c) The Agency shall make available in application
154-15 materials methods for purchasers to identify as low-income
155-16 applicants. The Agency shall prioritize the review of
156-17 qualified applications from low-income applicant purchasers
157-18 and award rebates to qualified purchasers accordingly.
158-19 (d) The purchaser must retain ownership of the vehicle for
159-20 a minimum of 12 consecutive months immediately after the
160-21 vehicle purchase date. The purchaser must continue to reside
161-22 in Illinois during that time frame and register the vehicle in
162-23 Illinois during that time frame. Rebate recipients who fail to
163-24 satisfy any of the above criteria will be required to
164-25 reimburse the Agency all or part of the original rebate amount
165-26 and shall notify the Agency within 60 days of failing to

177-2 (e) Rebates administered under this Section shall be
178-3 available for both new and used electric vehicles.
179-4 (f) A rebate administered under this Act may only be
180-5 applied for and awarded one time per vehicle identification
181-6 number. A rebate may only be applied for and awarded once per
182-7 purchaser in any 10-year period.
183-8 (g) For program auditing purposes, the Agency may request
184-9 from a rebate recipient additional information and
185-10 documentation evidencing eligibility for a rebate issued on or
186-11 after July 1, 2025, including copies of income tax returns
187-12 that corroborate the certification referenced in paragraph (5)
188-13 of subsection (b). If requested by the Agency, a rebate
189-14 recipient shall provide the information and documentation
190-15 within the timeframe specified in the Agency's request. If the
191-16 rebate recipient fails to provide the information and
192-17 documentation requested by the Agency by the specified
193-18 deadline, or if the information and documentation provided
194-19 evidences that the rebate recipient was not eligible for the
195-20 rebate or the rebate recipient fails to corroborate the
196-21 certification referenced in paragraph (5) of subsection (b),
197-22 the rebate recipient may be required to reimburse the Agency
198-23 all or part of the original rebate amount.

211-1 Sec. 40. Appropriations from the Electric Vehicle Rebate
212-2 Fund.
213-3 (a) The Agency shall estimate the amount of user fees
214-4 expected to be collected under Section 35 of this Act for each
215-5 fiscal year. User fee funds shall be deposited into and
216-6 distributed from the Electric Vehicle Rebate Fund in the
217-7 following manner:
218-8 (1) Through fiscal year 2023, an annual amount not to
219-9 exceed $225,000 may be appropriated to the Agency from the
220-10 Electric Vehicle Rebate Fund to pay its costs of
221-11 administering the programs authorized by Section 27 of
222-12 this Act. Beginning in fiscal year 2024 and in each fiscal
223-13 year thereafter, an annual amount not to exceed $600,000
224-14 may be appropriated to the Agency from the Electric
225-15 Vehicle Rebate Fund to pay its costs of administering the
226-16 programs authorized by Section 27 of this Act. An amount
227-17 not to exceed $225,000 may be appropriated to the
228-18 Secretary of State from the Electric Vehicle Rebate Fund
229-19 to pay the Secretary of State's costs of administering the
230-20 programs authorized under this Act.
231-21 (2) In fiscal year 2022 and each fiscal year
232-22 thereafter, after appropriation of the amounts authorized
233-23 by item (1) of subsection (a) of this Section, the
234-24 remaining moneys estimated to be collected during each
235-25 fiscal year shall be appropriated.

247-1 (4) Moneys appropriated to fund the programs
248-2 authorized in Sections 25 and 30 shall be expended only
249-3 after they have been collected and deposited into the
250-4 Electric Vehicle Rebate Fund.
251-5 (b) Amounts General Revenue Fund amounts appropriated to
252-6 and deposited into the Electric Vehicle Rebate Fund from the
253-7 General Revenue Fund, or any other fund, shall be distributed
254-8 from the Electric Vehicle Rebate Fund to fund the program
255-9 authorized in Section 27.
