14	14	1 AN ACT concerning public employee benefits.
15	15	2 Be it enacted by the People of the State of Illinois,
16	16	3 represented in the General Assembly:
17	17	4 Section 5. The Illinois Pension Code is amended by
18	18	5 changing Section 3-110.12 as follows:
19	19	6 (40 ILCS 5/3-110.12)
20	20	7 Sec. 3-110.12. Transfer to Article 4 fund.
21	21	8 (a) At any time during the 6 months following the
22	22	9 effective date of this Section, an active member of an Article
23	23	10 4 firefighters' pension fund may apply for transfer to that
24	24	11 fund of up to 6 years of his or her creditable service
25	25	12 accumulated in the police pension fund under this Article that
26	26	13 is administered by the same unit of local government if that
27	27	14 active member was not subject to disciplinary action when he
28	28	15 or she terminated employment with that police department. The
29	29	16 creditable service shall be transferred upon payment by the
30	30	17 police pension fund to the Article 4 fund of an amount equal
31	31	18 to:
32	32	19 (1) the amounts accumulated to the credit of the
33	33	20 applicant on the books of the fund on the date of transfer
34	34	21 for the service to be transferred; and
35	35	22 (2) employer contributions in an amount equal to the
36	36	23 amount determined under item (1); and

84	84	6 (a-5) At any time during the 6 months following the
85	85	7 effective date of this amendatory Act of the 102nd General
86	86	8 Assembly or the 6 months following the effective date of this
87	87	9 amendatory Act of the 104th General Assembly, an active member
88	88	10 of an Article 4 firefighters' pension fund may apply for
89	89	11 transfer to that fund of up to 8 years of his or her creditable
90	90	12 service accumulated in a police pension fund under this
91	91	13 Article that is administered by a unit of local government if
92	92	14 that active member was not subject to disciplinary action when
93	93	15 he or she terminated employment with that police department.
94	94	16 The creditable service shall be transferred upon payment by
95	95	17 the police pension fund to the Article 4 fund of an amount

117	117	3 (b) At the time of applying for transfer of creditable
118	118	4 service under this Section, an active member of an Article 4
119	119	5 firefighters' pension fund may, for the purpose of that
120	120	6 transfer, reinstate creditable service that was terminated by
121	121	7 receipt of a refund, by payment to the police pension fund of
122	122	8 the amount of the refund with interest thereon at the rate of
123	123	9 6% per year, compounded annually, from the date of the refund
124	124	10 to the date of payment.

126	126	12 Section 90. The State Mandates Act is amended by adding

129	129	15 Sec. 8.49. Exempt mandate. Notwithstanding Sections 6 and
130	130	16 8 of this Act, no reimbursement by the State is required for
131	131	17 the implementation of any mandate created by this amendatory
