1414 1 AN ACT concerning public employee benefits.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Illinois Pension Code is amended by
1818 5 changing Section 3-110.12 as follows:
1919 6 (40 ILCS 5/3-110.12)
2020 7 Sec. 3-110.12. Transfer to Article 4 fund.
2121 8 (a) At any time during the 6 months following the
2222 9 effective date of this Section, an active member of an Article
2323 10 4 firefighters' pension fund may apply for transfer to that
2424 11 fund of up to 6 years of his or her creditable service
2525 12 accumulated in the police pension fund under this Article that
2626 13 is administered by the same unit of local government if that
2727 14 active member was not subject to disciplinary action when he
2828 15 or she terminated employment with that police department. The
2929 16 creditable service shall be transferred upon payment by the
3030 17 police pension fund to the Article 4 fund of an amount equal
3131 18 to:
3232 19 (1) the amounts accumulated to the credit of the
3333 20 applicant on the books of the fund on the date of transfer
3434 21 for the service to be transferred; and
3535 22 (2) employer contributions in an amount equal to the
3636 23 amount determined under item (1); and

7979 1 (3) any interest paid by the applicant in order to

8484 6 (a-5) At any time during the 6 months following the
8585 7 effective date of this amendatory Act of the 102nd General
8686 8 Assembly or the 6 months following the effective date of this
8787 9 amendatory Act of the 104th General Assembly, an active member
8888 10 of an Article 4 firefighters' pension fund may apply for
8989 11 transfer to that fund of up to 8 years of his or her creditable
9090 12 service accumulated in a police pension fund under this
9191 13 Article that is administered by a unit of local government if
9292 14 that active member was not subject to disciplinary action when
9393 15 he or she terminated employment with that police department.
9494 16 The creditable service shall be transferred upon payment by
9595 17 the police pension fund to the Article 4 fund of an amount
9696 18 equal to:
9797 19 (1) the amounts accumulated to the credit of the
9898 20 applicant on the books of the fund on the date of transfer
9999 21 for the service to be transferred; and
100100 22 (2) employer contributions in an amount equal to the
101101 23 amount determined under item (1); and
102102 24 (3) any interest paid by the applicant in order to

117117 3 (b) At the time of applying for transfer of creditable
118118 4 service under this Section, an active member of an Article 4
119119 5 firefighters' pension fund may, for the purpose of that
120120 6 transfer, reinstate creditable service that was terminated by
121121 7 receipt of a refund, by payment to the police pension fund of
122122 8 the amount of the refund with interest thereon at the rate of
123123 9 6% per year, compounded annually, from the date of the refund
124124 10 to the date of payment.

126126 12 Section 90. The State Mandates Act is amended by adding
127127 13 Section 8.49 as follows:

129129 15 Sec. 8.49. Exempt mandate. Notwithstanding Sections 6 and
130130 16 8 of this Act, no reimbursement by the State is required for
131131 17 the implementation of any mandate created by this amendatory
132132 18 Act of the 104th General Assembly.
