1414 1 AN ACT concerning public employee benefits.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Illinois Pension Code is amended by
1818 5 changing Section 9-179.1 as follows:
1919 6 (40 ILCS 5/9-179.1) (from Ch. 108 1/2, par. 9-179.1)
2020 7 Sec. 9-179.1. Military service. A contributing employee
2121 8 may elect to purchase creditable service for up to 48 months of
2222 9 active-duty military service, whether or not that service
2323 10 followed service as a county employee. To establish this
2424 11 creditable service, the contributing employee must pay to the
2525 12 Fund an amount determined by the Fund to represent the
2626 13 employee contributions for the creditable service based on his
2727 14 or her rate of compensation after the military service, plus
2828 15 interest at the effective rate from the date of discharge to
2929 16 the date of payment. A contributing employee may apply for
3030 17 creditable service for up to 2 years of military service
3131 18 whether or not the military service followed service as a
3232 19 county employee. The military service need not have been
3333 20 served in wartime, but the employee must not have been
3434 21 dishonorably discharged. To establish this creditable service
3535 22 the applicant must pay to the Fund, while in the service of the
3636 23 county, an amount determined by the Fund to represent the

7979 1 employee contributions for the creditable service established,
8080 2 based on the employee's rate of compensation on his or her last
8181 3 day as a contributor before the military service, or on his or
8282 4 her first day as a contributor after the military service,
8383 5 whichever is greater, plus interest at the effective rate from
8484 6 the date of discharge to the date of payment. If a person who
8585 7 has established any credit under this Section applies for or
8686 8 receives any early retirement incentive under Section 9-134.2,
8787 9 the credit under this Section shall be forfeited and the
8888 10 amount paid to the Fund under this Section shall be refunded.
