1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by
1515 5 changing Section 11-204 as follows:

1717 7 Sec. 11-204. Fleeing or attempting to elude a peace
1818 8 officer.
1919 9 (a) Any driver or operator of a motor vehicle who, having
2020 10 been given a visual or audible signal by a peace officer
2121 11 directing such driver or operator to bring his vehicle to a
2222 12 stop, wilfully fails or refuses to obey such direction,
2323 13 increases his speed, extinguishes his lights, or otherwise
2424 14 flees or attempts to elude the officer, is guilty of a Class A
2525 15 misdemeanor, except that fleeing or attempting to elude a
2626 16 peace officer is a Class 4 felony if there is video evidence of
2727 17 the driver or operator of the motor vehicle fleeing or
2828 18 attempting to elude the peace officer and that the fleeing or
2929 19 attempting to elude the peace officer results in damage to
3030 20 property of the State, a unit of local government, or school
3131 21 district. The signal given by the peace officer may be by hand,
3232 22 voice, siren, red or blue light. Provided, the officer giving
3333 23 such signal shall be in police uniform, and, if driving a
