19 | 19 | | 9 (a) Any driver or operator of a motor vehicle who, having |

20 | 20 | | 10 been given a visual or audible signal by a peace officer |
---|
21 | 21 | | 11 directing such driver or operator to bring his vehicle to a |
---|
22 | 22 | | 12 stop, wilfully fails or refuses to obey such direction, |
---|
23 | 23 | | 13 increases his speed, extinguishes his lights, or otherwise |
---|
24 | 24 | | 14 flees or attempts to elude the officer, is guilty of a Class A |
---|
25 | 25 | | 15 misdemeanor, except that fleeing or attempting to elude a |
---|
26 | 26 | | 16 peace officer is a Class 4 felony if there is video evidence of |
---|
27 | 27 | | 17 the driver or operator of the motor vehicle fleeing or |
---|
28 | 28 | | 18 attempting to elude the peace officer and that the fleeing or |
---|
29 | 29 | | 19 attempting to elude the peace officer results in damage to |
---|
30 | 30 | | 20 property of the State, a unit of local government, or school |
---|
31 | 31 | | 21 district. The signal given by the peace officer may be by hand, |

32 | 32 | | 22 voice, siren, red or blue light. Provided, the officer giving |

33 | 33 | | 23 such signal shall be in police uniform, and, if driving a |
