1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The State Finance Act is amended by adding
1616 5 Section 5.1030 as follows:

2323 12 Sec. 57.Surrogacy Agreement Escrow Protection Fund.
2424 13 (a) The Surrogacy Agreement Escrow Protection Fund is
2525 14 created as a special income-earning fund in the State
2626 15 treasury.
2727 16 (b) All moneys paid into the Fund together and all
2828 17 accumulated undistributed income shall be held as a special
2929 18 fund in the State treasury. The Fund shall be used solely for
3030 19 the purpose of providing restitution to those who have
3131 20 suffered monetary loss arising out of an escrow transaction

7070 2 (c) The Fund shall be applied only to restitution ordered
7171 3 by the Director of Public Health. Restitution may not exceed
7272 4 the amount actually lost. The Fund may not be used for the
7373 5 payment of attorney's fees or other fees.
7474 6 (d) The Fund shall be subrogated to the amount of the
7575 7 restitution, and the Director shall request the Attorney
7676 8 General to engage in all reasonable collection steps to
7777 9 collect restitution from the party responsible for the loss
7878 10 and reimburse the Fund.
7979 11 (e) Notwithstanding any other provisions of this Section,
8080 12 the payment of restitution from the Fund shall be a matter of
8181 13 grace and not of right, and no person shall have any vested
8282 14 rights in the Fund as a beneficiary or otherwise. Before
8383 15 seeking restitution from the Fund, the person or beneficiary
8484 16 shall apply for restitution on a form provided by the
8585 17 Director. The form shall include any information the Director
8686 18 may reasonably require to determine that restitution is
8787 19 appropriate.
8888 20 (f) Any person who suffered a monetary loss that would
8989 21 qualify them for restitution under this Section on or after
9090 22 January 1, 2023, may apply for restitution.
9191 23 (g) Every entity in the State engaged in escrow
9292 24 transactions as required by this Act shall be assessed a
9393 25 yearly fee of $1,000. At any time when the balance of the Fund
9494 26 falls below $150,000, a special fee must be assessed in the
