12	12	1 AN ACT concerning finance.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The State Finance Act is amended by adding
16	16	5 Section 5.1030 as follows:

18	18	7 Sec. 5.1030. The Surrogacy Agreement Escrow Protection
19	19	8 Fund.
20	20	9 Section 10. The Gestational Surrogacy Act is amended by
21	21	10 adding Section 57 as follows:

23	23	12 Sec. 57.Surrogacy Agreement Escrow Protection Fund.
24	24	13 (a) The Surrogacy Agreement Escrow Protection Fund is
25	25	14 created as a special income-earning fund in the State
26	26	15 treasury.
27	27	16 (b) All moneys paid into the Fund together and all
28	28	17 accumulated undistributed income shall be held as a special
29	29	18 fund in the State treasury. The Fund shall be used solely for
30	30	19 the purpose of providing restitution to those who have
31	31	20 suffered monetary loss arising out of an escrow transaction
32	32	21 related to a gestational surrogacy contract as regulated by

70	70	2 (c) The Fund shall be applied only to restitution ordered
71	71	3 by the Director of Public Health. Restitution may not exceed
72	72	4 the amount actually lost. The Fund may not be used for the
73	73	5 payment of attorney's fees or other fees.
74	74	6 (d) The Fund shall be subrogated to the amount of the
75	75	7 restitution, and the Director shall request the Attorney
76	76	8 General to engage in all reasonable collection steps to
77	77	9 collect restitution from the party responsible for the loss
78	78	10 and reimburse the Fund.
79	79	11 (e) Notwithstanding any other provisions of this Section,
80	80	12 the payment of restitution from the Fund shall be a matter of
81	81	13 grace and not of right, and no person shall have any vested
82	82	14 rights in the Fund as a beneficiary or otherwise. Before
83	83	15 seeking restitution from the Fund, the person or beneficiary
84	84	16 shall apply for restitution on a form provided by the
85	85	17 Director. The form shall include any information the Director
86	86	18 may reasonably require to determine that restitution is
87	87	19 appropriate.
88	88	20 (f) Any person who suffered a monetary loss that would
89	89	21 qualify them for restitution under this Section on or after
90	90	22 January 1, 2023, may apply for restitution.
91	91	23 (g) Every entity in the State engaged in escrow
92	92	24 transactions as required by this Act shall be assessed a
93	93	25 yearly fee of $1,000. At any time when the balance of the Fund
94	94	26 falls below $150,000, a special fee must be assessed in the
