Barbara Hernandez SYNOPSIS AS INTRODUCED: 305 ILCS 5/12-4.60 new Amends the Administration Article of the Illinois Public Aid Code. Requires the Department of Human Services to develop and implement a transitional benefits program for the Supplemental Nutrition Assistance Program (SNAP) that is designed in such a way that a SNAP beneficiary will not experience an immediate loss of benefits should his or her income exceed the maximum allowable income for the SNAP program. Provides that transitional benefits offered shall gradually step down the beneficiary's monthly benefit proportionate to the increase in the beneficiary's income thereby allowing for a transition to self-sufficiency while incentivizing work and financial stability. Sets forth how a SNAP beneficiary's transitional benefit will be determined under the transitional benefits program. Requires SNAP beneficiaries who are receiving transitional benefits to comply with all SNAP requirements, including work requirements. Makes implementation of the transitional benefits program subject to appropriation and any necessary federal waivers or approvals. Grants the Department rulemaking authority. 11	11	1 AN ACT concerning public aid.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Public Aid Code is amended by
15	15	5 adding Section 12-4.60 as follows:
16	16	6 (305 ILCS 5/12-4.60 new)
17	17	7 Sec. 12-4.60. Transitional benefits program for SNAP
18	18	8 recipients. Subject to appropriation and any necessary federal
19	19	9 waivers or approvals, the Department of Human Services shall
20	20	10 develop and implement a transitional benefits program for the
21	21	11 Supplemental Nutrition Assistance Program (SNAP) that is
22	22	12 designed in such a way that a SNAP beneficiary will not
23	23	13 experience an immediate loss of benefits should his or her
24	24	14 income exceed the maximum allowable income for the SNAP
25	25	15 program. The transitional benefits offered shall provide for a
26	26	16 transition to self-sufficiency while incentivizing work and
27	27	17 financial stability.
28	28	18 The transitional benefits offered shall gradually step
29	29	19 down the beneficiary's monthly benefit proportionate to the
30	30	20 increase in the beneficiary's income. The determination for a
31	31	21 beneficiary's transitional benefit shall be as follows: For
32	32	22 each percentage increase in the beneficiary's monthly
33	33	23 household income over the program's maximum allowable income

68	68	1 or $6,250, adjusted for increases in cost-of-living, if any,
69	69	2 as of the preceding July over the level as of July of the
70	70	3 immediately preceding year of the Consumer Price Index for All
71	71	4 Urban Consumers, or successor index, published by the U.S.
72	72	5 Department of Labor, or its successor agency, whichever is
73	73	6 lower, up to 300% of the federal poverty level, the monthly
74	74	7 benefits shall be decreased by the same percentage.
75	75	8 Beneficiaries receiving transitional benefits under this
76	76	9 Section shall comply with all SNAP program requirements,
77	77	10 including work requirements.
78	78	11 The Department may adopt any rules necessary to implement
79	79	12 this Section.
