Provides that beginning on the effective date of the amendatory Act, the Department of Human Services shall not approve any initial or renewal application for the licensure of a facility where substance use treatment or intervention services will be provided within 1,000 feet of: (i) any building or buildings or real property comprising a public or private elementary or secondary school, community college, college, or university, including any adjacent school yard, school playing field, or school playground; (ii) a public playground; or (iii) any public park building or real property comprising any public park. Provides that nothing in the amendatory Act shall be construed to invalidate any initial or renewal application for licensure approved prior to the effective date of the amendatory Act. 1111 1 AN ACT concerning State government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Substance Use Disorder Act is amended by
1515 5 adding Section 15-50 as follows:
1616 6 (20 ILCS 301/15-50 new)
1717 7 Sec. 15-50. Substance abuse treatment and intervention
1818 8 services; licensing restriction. Beginning on and after the
1919 9 effective date of this amendatory Act of the 104th General
2020 10 Assembly, the Department of Human Services shall not approve
2121 11 any initial or renewal application for the licensure of a
2222 12 facility where substance use treatment or intervention
2323 13 services will be provided within 1,000 feet of:
2424 14 (i) any building or buildings or real property
2525 15 comprising a public or private elementary or secondary
2626 16 school, community college, college, or university,
2727 17 including any adjacent school yard, school playing field,
2828 18 or school playground;
2929 19 (ii) a public playground; or
3030 20 (iii) any public park building or real property
3131 21 comprising any public park.
3232 22 Nothing in this Section shall be construed to invalidate
3333 23 any initial or renewal application for licensure approved
