2121 1 AN ACT concerning regulation.
2222 2 Be it enacted by the People of the State of Illinois,
2323 3 represented in the General Assembly:
2424 4 Section 5. The Barber, Cosmetology, Esthetics, Hair
2525 5 Braiding, and Nail Technology Act of 1985 is amended by
2626 6 changing Sections 2-2, 2-4, 3-2, 3-3, 3-4, 3A-2, 3A-3, 3C-2,
2727 7 3C-3, 3E-2, and 3E-3 as follows:

3030 10 Sec. 2-2. Licensure as a barber; qualifications. A person
3131 11 is qualified to receive a license as a barber if that person
3232 12 has applied in writing on forms prescribed by the Department,
3333 13 has paid the required fees, and:
3434 14 a. Is at least 16 years of age; and
3535 15 b. Has a certificate of graduation from a school
3636 16 providing secondary education, or the recognized
3737 17 equivalent of such a certificate, or persons who are
3838 18 beyond the age of compulsory school attendance; and
3939 19 c. Has graduated from a school of barbering or school
4040 20 of cosmetology approved by the Department, having
4141 21 completed a total of 1500 hours in the study of barbering
4242 22 extending over a period of not less than 9 months nor more

106106 9 school of barbering or cosmetology may also provide that a
107107 10 maximum of 10% of the 1500 hours may be completed in an
108108 11 internship program and supervised by a licensed barber,
109109 12 subject to rules of the Department. Time spent in such
110110 13 study under the laws of another state or territory of the
111111 14 United States or of a foreign country or province shall be
112112 15 credited toward the period of study required by the
113113 16 provisions of this paragraph; and
114114 17 d. Has passed an examination caused to be conducted by
115115 18 the Department or its designated testing service to
116116 19 determine fitness to receive a license as a barber; and
117117 20 e. Has met all other requirements of this Act.

140140 8 (1) completed a total of 500 hours in barber
141141 9 teacher training extending over a period of not less
142142 10 than 3 months nor more than 2 years and has had 3 years
143143 11 of practical experience as a licensed barber;
144144 12 (2) completed a total of 1,000 hours of barber
145145 13 teacher training extending over a period of not less
146146 14 than 6 months nor more than 2 years. A school of
147147 15 barbering or cosmetology may provide a maximum of 50%
148148 16 of the hours required for theory portions of the
149149 17 practicum through online or distance study, subject to
150150 18 the rules of the Department, including subject-matter
151151 19 limitations, for the hours required in this paragraph;

153153 21 (3) completed the cosmetology teacher training as
154154 22 specified in paragraph (4) of subsection (a) of
155155 23 Section 3-4 of this Act and completed a supplemental
156156 24 barbering course as established by rule;

322322 13 school of barbering or cosmetology may provide a maximum
323323 14 of 50% of the hours required for theory portions of the
324324 15 practicum through online or distance study, subject to the
325325 16 rules of the Department, including subject-matter
326326 17 limitations, for the hours required in this paragraph;
327327 18 (5) has passed an examination authorized by the
328328 19 Department to determine eligibility to receive a license
329329 20 as a cosmetology teacher or barber teacher; and
330330 21 (6) has met any other requirements of this Act.
331331 22 An individual who receives a license as a cosmetology
332332 23 teacher shall not be required to maintain an active
333333 24 cosmetology license in order to practice cosmetology as
334334 25 defined in this Act.

365365 20 teacher licenses after January 1, 2009. Any person issued a
366366 21 license as a cosmetology clinic teacher before January 1,
367367 22 2009, may renew the license after that date under this Act and
368368 23 that person may continue to renew the license or have the
369369 24 license restored during his or her lifetime, subject only to
370370 25 the renewal or restoration requirements for the license under

612612 20 (B) Related concepts consisting of 35 hours of
613613 21 classroom instruction in the following subject areas:
614614 22 Braid removal and scalp care; basic styling knowledge;
615615 23 tools and equipment; growth patterns, styles and
616616 24 sectioning; client consultation and face shapes; and
617617 25 client education, pre-care, post-care, home care and

644644 16 (b) The expiration date and renewal period for each
645645 17 license issued under this Act shall be set by rule.
646646 18 (c) Within 2 years after the effective date of this
647647 19 amendatory Act of the 96th General Assembly, the Department
648648 20 may issue a hair braider license to any applicant who does not
649649 21 meet the requirements of items (2) and (3) of subsection (a) of
650650 22 this Section if the applicant: (1) files an application in
651651 23 accordance with subsection (a), (2) pays the required fee, (3)
652652 24 has not committed an offense that would be grounds for
653653 25 discipline under this Act, and (4) is able to demonstrate to
654654 26 the Department through tax records or affidavits that he or
