311 1 AN ACT concerning education.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Board of Higher Education Act is amended by
715 5 changing Section 8 as follows:

917 7 Sec. 8. The Board of Trustees of the University of
1018 8 Illinois, the Board of Trustees of Southern Illinois
1119 9 University, the Board of Trustees of Chicago State University,
1220 10 the Board of Trustees of Eastern Illinois University, the
1321 11 Board of Trustees of Governors State University, the Board of
1422 12 Trustees of Illinois State University, the Board of Trustees
1523 13 of Northeastern Illinois University, the Board of Trustees of
1624 14 Northern Illinois University, and the Board of Trustees of
1725 15 Western Illinois University shall submit to the Board not
1826 16 later than the 15th day of November of each year their its
1927 17 budget proposals for the operation and capital needs of the
2028 18 institutions under their its governance or supervision for the
2129 19 ensuing fiscal year. The Illinois Community College Board
2230 20 shall submit to the Board by December 15 of each year its
2331 21 budget proposal for the operation and capital needs of the
2432 22 institutions under its governance or supervision for the
2533 23 ensuing fiscal year. Each budget proposal shall conform to the

3468 1 procedures developed by the Board in the design of an
3569 2 information system for State universities and colleges.
3670 3 In order to maintain a cohesive system of higher
3771 4 education, the Board and its staff shall communicate on a
3872 5 regular basis with all public university presidents. They
3973 6 shall meet at least semiannually to achieve economies of scale
4074 7 where possible and provide the most innovative and efficient
4175 8 programs and services.
4276 9 The Board, in the analysis of formulating the annual
4377 10 budget request, shall consider rates of tuition and fees and
4478 11 undergraduate tuition and fee waiver programs at the State
4579 12 universities and colleges. The Board shall also consider the
4680 13 current and projected utilization of the total physical plant
4781 14 of each campus of a university or college in approving the
4882 15 capital budget for any new building or facility.
4983 16 The Board of Higher Education shall submit to the
5084 17 Governor, to the General Assembly, and to the appropriate
5185 18 budget agencies of the Governor and General Assembly its
5286 19 analysis and recommendations on such budget proposals.
5387 20 The Board is directed to form a broad-based group of
5488 21 individuals representing the Office of the Governor, the
5589 22 General Assembly, public institutions of higher education,
5690 23 State agencies, business and industry, statewide organizations
5791 24 representing faculty and staff, and others as the Board shall
5892 25 deem appropriate to devise a system for allocating State
5993 26 resources to public institutions of higher education based

72106 3 Beginning in Fiscal Year 2013, the Board of Higher
73107 4 Education budget recommendations to the Governor and the
74108 5 General Assembly shall include allocations to public
75109 6 institutions of higher education based upon performance
76110 7 metrics designed to promote and measure student success in
77111 8 degree and certificate completion. Public university metrics
78112 9 must be adopted by the Board by rule, and public community
79113 10 college metrics must be adopted by the Illinois Community
80114 11 College Board by rule. These metrics must be developed and
81115 12 promulgated in accordance with the following principles:
82116 13 (1) The metrics must be developed in consultation with
83117 14 public institutions of higher education, as well as other
84118 15 State educational agencies and other higher education
85119 16 organizations, associations, interests, and stakeholders
86120 17 as deemed appropriate by the Board.
87121 18 (2) The metrics shall include provisions for
88122 19 recognizing the demands on and rewarding the performance
89123 20 of institutions in advancing the success of students who
90124 21 are academically or financially at risk, including
91125 22 first-generation students, low-income students, and
92126 23 students traditionally underrepresented in higher
93127 24 education, as specified in Section 9.16 of this Act.
94128 25 (3) The metrics shall recognize and account for the
95129 26 differentiated missions of institutions and sectors of

107141 2 (4) The metrics shall focus on the fundamental goal of
108142 3 increasing completion of college courses, certificates,
109143 4 and degrees. Performance metrics shall recognize the
110144 5 unique and broad mission of public community colleges
111145 6 through consideration of additional factors, including,
112146 7 but not limited to, enrollment, progress through key
113147 8 academic milestones, transfer to a baccalaureate
114148 9 institution, and degree completion.
115149 10 (5) The metrics must be designed to maintain the
116150 11 quality of degrees, certificates, courses, and programs.
117151 12 In devising performance metrics, the Board may be guided by
118152 13 the report of the Higher Education Finance Study Commission.
119153 14 Each State university must submit its plan for capital
120154 15 improvements of non-instructional facilities to the Board for
121155 16 approval before final commitments are made if the total cost
122156 17 of the project as approved by the institution's board of
123157 18 control is in excess of $2 million. Non-instructional uses
124158 19 shall include but not be limited to dormitories, union
125159 20 buildings, field houses, stadium, other recreational
126160 21 facilities and parking lots. The Board shall determine whether
127161 22 or not any project submitted for approval is consistent with
128162 23 the strategic plan for higher education and with instructional
129163 24 buildings that are provided for therein. If the project is
130164 25 found by a majority of the Board not to be consistent, such
131165 26 capital improvement shall not be constructed.
