3	11		1 AN ACT concerning education.
4	12		2 Be it enacted by the People of the State of Illinois,
5	13		3 represented in the General Assembly:
6	14		4 Section 5. The Board of Higher Education Act is amended by
7	15		5 changing Section 8 as follows:

9	17		7 Sec. 8. The Board of Trustees of the University of
10	18		8 Illinois, the Board of Trustees of Southern Illinois
11	19		9 University, the Board of Trustees of Chicago State University,
12	20		10 the Board of Trustees of Eastern Illinois University, the
13	21		11 Board of Trustees of Governors State University, the Board of
14	22		12 Trustees of Illinois State University, the Board of Trustees
15	23		13 of Northeastern Illinois University, the Board of Trustees of
16	24		14 Northern Illinois University, and the Board of Trustees of
17	25		15 Western Illinois University shall submit to the Board not
18	26		16 later than the 15th day of November of each year their its
19	27		17 budget proposals for the operation and capital needs of the
20	28		18 institutions under their its governance or supervision for the
21	29		19 ensuing fiscal year. The Illinois Community College Board
22	30		20 shall submit to the Board by December 15 of each year its
23	31		21 budget proposal for the operation and capital needs of the
24	32		22 institutions under its governance or supervision for the

34	68		1 procedures developed by the Board in the design of an
35	69		2 information system for State universities and colleges.
36	70		3 In order to maintain a cohesive system of higher
37	71		4 education, the Board and its staff shall communicate on a
38	72		5 regular basis with all public university presidents. They
39	73		6 shall meet at least semiannually to achieve economies of scale
40	74		7 where possible and provide the most innovative and efficient
41	75		8 programs and services.
42	76		9 The Board, in the analysis of formulating the annual
43	77		10 budget request, shall consider rates of tuition and fees and
44	78		11 undergraduate tuition and fee waiver programs at the State
45	79		12 universities and colleges. The Board shall also consider the
46	80		13 current and projected utilization of the total physical plant
47	81		14 of each campus of a university or college in approving the
48	82		15 capital budget for any new building or facility.
49	83		16 The Board of Higher Education shall submit to the
50	84		17 Governor, to the General Assembly, and to the appropriate
51	85		18 budget agencies of the Governor and General Assembly its
52	86		19 analysis and recommendations on such budget proposals.
53	87		20 The Board is directed to form a broad-based group of
54	88		21 individuals representing the Office of the Governor, the
55	89		22 General Assembly, public institutions of higher education,
56	90		23 State agencies, business and industry, statewide organizations
57	91		24 representing faculty and staff, and others as the Board shall
58	92		25 deem appropriate to devise a system for allocating State
59	93		26 resources to public institutions of higher education based

71	105		2 success and certificate and degree completion.
72	106		3 Beginning in Fiscal Year 2013, the Board of Higher
73	107		4 Education budget recommendations to the Governor and the
74	108		5 General Assembly shall include allocations to public
75	109		6 institutions of higher education based upon performance
76	110		7 metrics designed to promote and measure student success in
77	111		8 degree and certificate completion. Public university metrics
78	112		9 must be adopted by the Board by rule, and public community
79	113		10 college metrics must be adopted by the Illinois Community
80	114		11 College Board by rule. These metrics must be developed and
81	115		12 promulgated in accordance with the following principles:
82	116		13 (1) The metrics must be developed in consultation with
83	117		14 public institutions of higher education, as well as other
84	118		15 State educational agencies and other higher education
85	119		16 organizations, associations, interests, and stakeholders
86	120		17 as deemed appropriate by the Board.
87	121		18 (2) The metrics shall include provisions for
88	122		19 recognizing the demands on and rewarding the performance
89	123		20 of institutions in advancing the success of students who
90	124		21 are academically or financially at risk, including
91	125		22 first-generation students, low-income students, and
92	126		23 students traditionally underrepresented in higher
93	127		24 education, as specified in Section 9.16 of this Act.
94	128		25 (3) The metrics shall recognize and account for the

107	141		2 (4) The metrics shall focus on the fundamental goal of
108	142		3 increasing completion of college courses, certificates,
109	143		4 and degrees. Performance metrics shall recognize the
110	144		5 unique and broad mission of public community colleges
111	145		6 through consideration of additional factors, including,
112	146		7 but not limited to, enrollment, progress through key
113	147		8 academic milestones, transfer to a baccalaureate
114	148		9 institution, and degree completion.
115	149		10 (5) The metrics must be designed to maintain the
116	150		11 quality of degrees, certificates, courses, and programs.
117	151		12 In devising performance metrics, the Board may be guided by
118	152		13 the report of the Higher Education Finance Study Commission.
119	153		14 Each State university must submit its plan for capital
120	154		15 improvements of non-instructional facilities to the Board for
121	155		16 approval before final commitments are made if the total cost
122	156		17 of the project as approved by the institution's board of
123	157		18 control is in excess of $2 million. Non-instructional uses
124	158		19 shall include but not be limited to dormitories, union
125	159		20 buildings, field houses, stadium, other recreational
126	160		21 facilities and parking lots. The Board shall determine whether
127	161		22 or not any project submitted for approval is consistent with
128	162		23 the strategic plan for higher education and with instructional
129	163		24 buildings that are provided for therein. If the project is
130	164		25 found by a majority of the Board not to be consistent, such
131	165		26 capital improvement shall not be constructed.
