Kifowit SYNOPSIS AS INTRODUCED: 40 ILCS 5/5-178 from Ch. 108 1/2, par. 5-178 Amends the Chicago Police Article of the Illinois Pension Code. Provides that a board of 9 (instead of 8) members shall constitute a board of trustees of the fund. Provides that the board shall consist of 4 persons appointed by the mayor of the city; 4 (instead of 3) policemen employed by the city, at least one of whom shall be a lieutenant (instead of a lieutenant or of a rank superior to lieutenant), one of whom shall be of the rank of sergeant, and 2 (instead of one) of whom shall be of the rank of investigator or a rank inferior to that rank; and one annuitant of the fund. Provides that any newly created elected position on the board shall be filled in the same manner as provided for vacant positions. 1111 1 AN ACT concerning public employee benefits.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Pension Code is amended by
1515 5 changing Section 5-178 as follows:
1616 6 (40 ILCS 5/5-178) (from Ch. 108 1/2, par. 5-178)
1717 7 Sec. 5-178. Board created. A board of 8 members shall
1818 8 constitute a board of trustees authorized to administer the
1919 9 provisions of this Article. The board shall be known as the
2020 10 Retirement Board of the Policemen's Annuity and Benefit Fund
2121 11 of the city.
2222 12 The board shall consist of 4 persons appointed by the
2323 13 mayor of the city; 4 3 policemen employed by the city, at least
2424 14 one of whom shall be a lieutenant or of a rank superior to
2525 15 lieutenant, one of whom shall be of the rank of sergeant, and 2
2626 16 one of whom shall be of the rank of investigator or a rank
2727 17 inferior to that rank; and one annuitant of the fund, or a
2828 18 pensioner of any prior police pension fund in operation, by
2929 19 authority of law, in the city. Children less than age 18 shall
3030 20 not be eligible for board membership. The term of office for
3131 21 all members shall be 3 years. For the election to be held in
3232 22 2008 only, the terms for the member who is a lieutenant or of a
3333 23 rank superior to lieutenant and the member who is a sergeant

6868 1 shall be 3 years and the terms for the member who is an
6969 2 investigator or a rank inferior to that rank and the annuitant
7070 3 member shall be 4 years. After the terms of the 2008 election
7171 4 are completed, the terms revert to 3-year terms for each
7272 5 elected trustee. Upon his election, the member holding the
7373 6 rank of investigator or a rank inferior to that rank shall be
7474 7 detailed by the Police Superintendent to the office of the
7575 8 board for the duration of his or her term as trustee.
7676 9 Any newly created elected position on the board shall be
7777 10 filled in the same manner as provided for vacant positions
7878 11 under Section 5-180.
7979 12 The members of a retirement board holding office in a city
8080 13 at the time this Article becomes effective, including elected,
8181 14 appointed and ex officio ex-officio members, shall continue in
8282 15 office until the expiration of their respective terms or
8383 16 appointment and until their respective successors are elected
8484 17 or appointed, and qualified.
8585 18 At least 30 days prior to the expiration of the term of
8686 19 office of each appointive member the mayor shall appoint a
8787 20 successor for a term of 3 years.
8888 21 The board shall conduct a regular election at least 30
8989 22 days prior to the expiration of the terms of the active
9090 23 policemen members and annuitant or beneficiary members for
9191 24 election of a successor of each such member for a term of 3
9292 25 years.
9393 26 Any member of the board so appointed or elected shall
