1717 1 AN ACT concerning public employee benefits.
1818 2 Be it enacted by the People of the State of Illinois,
1919 3 represented in the General Assembly:
2020 4 Section 5. The Illinois Pension Code is amended by
2121 5 changing Sections 5-167.1, 5-238, 6-164, and 6-229 as follows:

2525 9 (a) A policeman who retires from service after September
2626 10 1, 1967 with at least 20 years of service credit shall, upon
2727 11 either the first of the month following the first anniversary
2828 12 of his date of retirement if he is age 55 or over on that
2929 13 anniversary date, or upon the first of the month following his
3030 14 attainment of age 55 if it occurs after the first anniversary
3131 15 of his retirement date, have his then fixed and payable
3232 16 monthly annuity increased by 3% and such first fixed annuity
3333 17 as granted at retirement increased by an additional 3% in
3434 18 January of each year thereafter.
3535 19 Any policeman born before January 1, 1945 who qualifies

138138 15 Any policeman born on or after January 1, 1966 who
139139 16 qualifies for a minimum annuity and retires after September 1,
140140 17 1967 but has not received the initial increase under this
141141 18 subsection before January 1, 2023 is entitled to receive the
142142 19 initial increase under this subsection on (1) January 1, 2023,
143143 20 (2) the first anniversary of the date of retirement, or (3)
144144 21 attainment of age 55, whichever occurs last. The changes to
145145 22 this Section made by this amendatory Act of the 103rd General
146146 23 Assembly apply without regard to whether the policeman or
147147 24 annuitant terminated service before the effective date of this
148148 25 amendatory Act of the 103rd General Assembly.

161161 2 (c) To help defray the cost of such increases in annuity,
162162 3 there shall be deducted, beginning September 1, 1967, from
163163 4 each payment of salary to a policeman, 1/2 of 1% of each salary
164164 5 payment concurrently with and in addition to the salary
165165 6 deductions otherwise made for annuity purposes.
166166 7 The city, in addition to the contributions otherwise made
167167 8 by it for annuity purposes under other provisions of this
168168 9 Article, shall make matching contributions concurrently with
169169 10 such salary deductions.
170170 11 Each such 1/2 of 1% deduction from salary and each such
171171 12 contribution by the city of 1/2 of 1% of salary shall be
172172 13 credited to the Automatic Increase Reserve, to be used to
173173 14 defray the cost of the annuity increase provided by this
174174 15 Section. Any balance in such reserve as of the beginning of
175175 16 each calendar year shall be credited with interest at the rate
176176 17 of 3% per annum.
177177 18 Such deductions from salary and city contributions shall
178178 19 continue while the policeman is in service.
179179 20 The salary deductions provided in this Section are not
180180 21 subject to refund, except to the policeman himself, in any
181181 22 case in which: (i) the policeman withdraws prior to
182182 23 qualification for minimum annuity or Tier 2 monthly retirement
183183 24 annuity and applies for refund, (ii) the policeman applies for
184184 25 an annuity of a type that is not subject to annual increases
185185 26 under this Section, or (iii) a term annuity becomes payable.

196196 1 In such cases, the total of such salary deductions shall be

202202 7 effective date of this amendatory Act of the 97th General
203203 8 Assembly shall be increased on the January 1 occurring either
204204 9 on or after (i) the attainment of age 55 60 or (ii) the first
205205 10 anniversary of the annuity start date, whichever is later.
206206 11 Each annual increase shall be calculated at 3% or one-half the
207207 12 annual unadjusted percentage increase (but not less than zero)
208208 13 in the consumer price index-u for the 12 months ending with the
209209 14 September preceding each November 1, whichever is less, of the
210210 15 originally granted retirement annuity. If the annual
211211 16 unadjusted percentage change in the consumer price index-u for
212212 17 a 12-month period ending in September is zero or, when
213213 18 compared with the preceding period, decreases, then the
214214 19 annuity shall not be increased.
215215 20 For the purposes of this subsection (d), "consumer price
216216 21 index-u" means the index published by the Bureau of Labor
217217 22 Statistics of the United States Department of Labor that
218218 23 measures the average change in prices of goods and services
219219 24 purchased by all urban consumers, United States city average,
220220 25 all items, 1982-84 = 100. The new amount resulting from each
221221 26 annual adjustment shall be determined by the Public Pension

236236 5 Sec. 5-238. Provisions applicable to new hires; Tier 2.
237237 6 (a) Notwithstanding any other provision of this Article,
238238 7 the provisions of this Section apply to a person who first
239239 8 becomes a policeman under this Article on or after January 1,
240240 9 2011, and to certain qualified survivors of such a policeman.
241241 10 Such persons, and the benefits and restrictions that apply
242242 11 specifically to them under this Article, may be referred to as
243243 12 "Tier 2".
244244 13 (b) A policeman who has withdrawn from service, has
245245 14 attained age 50 or more, and has 10 or more years, but less
246246 15 than 20 years, of service in that capacity shall be entitled,
247247 16 upon proper application being received by the Fund, to receive
248248 17 a Tier 2 monthly retirement annuity for his service as a police
249249 18 officer. The Tier 2 monthly retirement annuity shall be
250250 19 computed by multiplying 2.5% for each year of such service by
251251 20 his or her final average salary, subject to an annuity
252252 21 reduction factor of one-half of 1% for each month that the
253253 22 police officer's age at retirement is under age 55. The Tier 2
254254 23 monthly retirement annuity of a policeman who is retiring
255255 24 after attaining age 50 with 20 or more years of creditable

267267 1 annuity is in lieu of any age and service annuity or other form
268268 2 of retirement annuity under this Article.
269269 3 The maximum retirement annuity under this subsection (b)
270270 4 shall be 75% of final average salary.
271271 5 For the purposes of this subsection (b), "final average
272272 6 salary" means the average monthly salary obtained by dividing
273273 7 the total salary of the policeman during the 96 consecutive
274274 8 months of service within the last 120 months of service in
275275 9 which the total salary was the highest by the number of months
276276 10 of service in that period.
277277 11 Beginning on January 1, 2011, for all purposes under this
278278 12 Code (including without limitation the calculation of benefits
279279 13 and employee contributions), the annual salary based on the
280280 14 plan year of a member or participant to whom this Section
281281 15 applies shall not exceed $106,800; however, that amount shall
282282 16 annually thereafter be increased by the lesser of (i) 3% of
283283 17 that amount, including all previous adjustments, or (ii)
284284 18 one-half the annual unadjusted percentage increase (but not
285285 19 less than zero) in the consumer price index-u for the 12 months
286286 20 ending with the September preceding each November 1, including
287287 21 all previous adjustments.
288288 22 (c) Notwithstanding any other provision of this Article,
289289 23 for a person who first becomes a policeman under this Article
290290 24 on or after January 1, 2011, eligibility for and the amount of
291291 25 the annuity to which the qualified surviving spouse, children,
292292 26 and parents are entitled under this subsection (c) shall be

304304 2 (1) The surviving spouse of a deceased policeman to
305305 3 whom this Section applies shall be deemed qualified to
306306 4 receive a Tier 2 surviving spouse's annuity under this
307307 5 paragraph (1) if: (i) the deceased policeman meets the
308308 6 requirements specified under subdivision (A), (B), (C), or
309309 7 (D) of this paragraph (1); and (ii) the surviving spouse
310310 8 would not otherwise be excluded from receiving a widow's
311311 9 annuity under the eligibility requirements for a widow's
312312 10 annuity set forth in Section 5-146. The Tier 2 surviving
313313 11 spouse's annuity is in lieu of the widow's annuity
314314 12 determined under any other Section of this Article and is
315315 13 subject to the requirements of Section 5-147.1.
316316 14 As used in this subsection (c), "earned annuity" means
317317 15 a Tier 2 monthly retirement annuity determined under
318318 16 subsection (b) of this Section, including any increases
319319 17 the policeman had received pursuant to Section 5-167.1.
320320 18 (A) If the deceased policeman was receiving an
321321 19 earned annuity at the date of his or her death, the
322322 20 Tier 2 surviving spouse's annuity under this paragraph
323323 21 (1) shall be in the amount of 66 2/3% of the
324324 22 policeman's earned annuity at the date of death.
325325 23 (B) If the deceased policeman was not receiving an
326326 24 earned annuity but had at least 10 years of service at
327327 25 the time of death, the Tier 2 surviving spouse's
328328 26 annuity under this paragraph (1) shall be the greater

350350 12 policeman with at least 1 1/2 but less than 10 years of
351351 13 service at the time of death, the Tier 2 surviving
352352 14 spouse's annuity under this paragraph (1) shall be in
353353 15 the amount of 30% of the annual maximum salary
354354 16 attached to the classified civil service position of a
355355 17 first class patrolman at the time of his death.
356356 18 (D) If the performance of an act or acts of duty
357357 19 results directly in the death of a policeman subject
358358 20 to this Section, or prevents him from subsequently
359359 21 resuming active service in the police department, and
360360 22 if the policeman's Tier 2 surviving spouse would
361361 23 otherwise meet the eligibility requirements for a
362362 24 compensation annuity or supplemental annuity granted
363363 25 under Section 5-144, then in addition to the Tier 2
364364 26 surviving spouse's annuity provided under subdivision

468468 22 5-152.1; except that any salary used for computing a Tier
469469 23 2 parent's annuity shall be subject to the Tier 2 salary
470470 24 cap provided under subsection (b) of this Section. For the

641641 16 employee receiving a term annuity.
642642 17 (c) To help defray the cost of such increases in annuity,
643643 18 there shall be deducted, beginning September 1, 1959, from
644644 19 each payment of salary to a fireman, 1/8 of 1% of each such
645645 20 salary payment and an additional 1/8 of 1% beginning on
646646 21 September 1, 1961, and September 1, 1963, respectively,
647647 22 concurrently with and in addition to the salary deductions
648648 23 otherwise made for annuity purposes.
649649 24 Each such additional 1/8 of 1% deduction from salary which
650650 25 shall, on September 1, 1963, result in a total increase of 3/8

679679 18 becomes a fireman under this Article on or after January 1,
680680 19 2011 shall be increased on the January 1 occurring either on or
681681 20 after (i) the attainment of age 55 60 or (ii) the first
682682 21 anniversary of the annuity start date, whichever is later.

823823 19 (A) If the deceased fireman was receiving an
824824 20 earned pension at the date of his or her death, the
825825 21 Tier 2 surviving spouse's annuity under this paragraph

877877 1 under Section 6-140 shall be deemed to be qualified
878878 2 for a Tier 2 surviving spouse's annuity under this
879879 3 subdivision (D); except that no such annuity shall be
880880 4 paid to the surviving spouse of a fireman who dies
881881 5 while in receipt of disability benefits when the
882882 6 fireman's death was caused by an intervening illness
883883 7 or injury unrelated to the illness or injury that had
884884 8 prevented him from subsequently resuming active
885885 9 service in the fire department. The Tier 2 surviving
886886 10 spouse's annuity calculated under this subdivision (D)
887887 11 shall be in lieu of, but in the same amount and paid in
888888 12 the same manner as, the widow's annuity provided under
889889 13 Section 6-140; except that the salary used for
890890 14 computing a Tier 2 surviving spouse's annuity under
891891 15 this subdivision (D) shall be subject to the Tier 2
892892 16 salary cap provided under subsection (b) of this
893893 17 Section.
894894 18 (E) Notwithstanding any other provision of this
895895 19 Article, the monthly Tier 2 surviving spouse's annuity
896896 20 under subdivision (A) or (B) of this paragraph (1)
897897 21 shall be increased on the January 1 next occurring
898898 22 after (i) attainment of age 60 by the recipient of the
899899 23 Tier 2 surviving spouse's annuity or (ii) the first
900900 24 anniversary of the Tier 2 surviving spouse's annuity
901901 25 start date, whichever is later, and on each January 1
902902 26 thereafter, by 3% or one-half the annual unadjusted

913913 1 percentage increase in the consumer price index-u for
914914 2 the 12 months ending with September preceding each
915915 3 November 1, whichever is less, of the originally
916916 4 granted Tier 2 surviving spouse's annuity. If the
917917 5 annual unadjusted percentage change in the consumer
918918 6 price index-u for a 12-month period ending in
919919 7 September is zero or, when compared with the preceding
920920 8 period, decreases, then the annuity shall not be
921921 9 increased.
922922 10 (F) Notwithstanding the other provisions of this
923923 11 paragraph (1), for a qualified surviving spouse who is
924924 12 entitled to a Tier 2 surviving spouse's annuity under
925925 13 subdivision (A), (B), (C), or (D) of this paragraph
926926 14 (1), that Tier 2 surviving spouse's annuity shall not
927927 15 be less than the amount of the minimum widow's annuity
928928 16 established from time to time under Section 6-128.4.
929929 17 (2) Surviving children of a deceased fireman subject
930930 18 to this Section who would otherwise meet the eligibility
931931 19 requirements for a child's annuity set forth in Sections
932932 20 6-147 and 6-148 shall be deemed qualified to receive a
933933 21 Tier 2 child's annuity under this subsection (c), which
934934 22 shall be in lieu of, but in the same amount and paid in the
935935 23 same manner as, the child's annuity provided under those
936936 24 Sections; except that any salary used for computing a Tier
937937 25 2 child's annuity shall be subject to the Tier 2 salary cap

955955 7 (3) Surviving parents of a deceased fireman subject to

957957 9 requirements for a parent's annuity set forth in Section
958958 10 6-149 shall be deemed qualified to receive a Tier 2
959959 11 parent's annuity under this subsection (c), which shall be
960960 12 in lieu of, but in the same amount and paid in the same
961961 13 manner as, the parent's annuity provided under Section
962962 14 6-149; except that any salary used for computing a Tier 2
963963 15 parent's annuity shall be subject to the Tier 2 salary cap
964964 16 provided under subsection (b) of this Section. For the
965965 17 purposes of this Section, a reference to "annuity" in
966966 18 Section 6-149 includes: (i) in the context of a widow, a
967967 19 Tier 2 surviving spouse's annuity and (ii) in the context
968968 20 of a child, a Tier 2 child's annuity.
969969 21 (d) The General Assembly finds and declares that the
970970 22 provisions of this Section, as enacted by Public Act 96-1495,
971971 23 require clarification relating to necessary eligibility
972972 24 standards and the manner of determining and paying the
973973 25 intended Tier 2 benefits and contributions in order to enable
974974 26 the Fund to unambiguously implement and administer benefits

988988 4 6-167 made by this amendatory Act of the 99th General Assembly
989989 5 are enacted to clarify the provisions of this Section as

993993 9 (e) The changes to Sections 6-150, 6-158, 6-164 (except
994994 10 for the changes to subsection (a) of that Section), 6-166, and
995995 11 6-167 made by this amendatory Act of the 99th General Assembly
996996 12 are intended to be retroactive to January 1, 2011 (the
997997 13 effective date of Public Act 96-1495) and, for the purposes of
998998 14 Section 1-103.1 of this Code, they apply without regard to
999999 15 whether the relevant fireman was in service on or after the
10001000 16 effective date of this amendatory Act of the 99th General
