14 | 14 | | 4 Section 5. The Vital Records Act is amended by changing |

17 | 17 | | 7 Sec. 24. (1) To protect the integrity of vital records, to |

18 | 18 | | 8 insure their proper use, and to insure the efficient and |

19 | 19 | | 9 proper administration of the vital records system, access to |

20 | 20 | | 10 vital records, and indexes thereof, including vital records in |
---|
21 | 21 | | 11 the custody of local registrars and county clerks originating |
---|
22 | 22 | | 12 prior to January 1, 1916, is limited to the custodian and his |
---|
23 | 23 | | 13 employees, and then only for administrative purposes, except |
---|
24 | 24 | | 14 that the indexes of those records in the custody of local |
---|
25 | 25 | | 15 registrars and county clerks, originating prior to January 1, |
---|
26 | 26 | | 16 1916, shall be made available to persons for the purpose of |
---|
27 | 27 | | 17 genealogical research. Original, photographic or |
---|
28 | 28 | | 18 microphotographic reproductions of original records of births |
---|
29 | 29 | | 19 100 years old and older and deaths 50 years old and older, and |

78 | 78 | | 11 and any municipal, county, multi-county, public health |

79 | 79 | | 12 district, or regional health officer recognized by the |
---|
80 | 80 | | 13 Department may examine vital records for the purpose only of |
---|
81 | 81 | | 14 carrying out the public health programs and responsibilities |
---|
82 | 82 | | 15 under his jurisdiction. |
---|
83 | 83 | | 16 (3) The State Registrar of Vital Records, may disclose, or |
---|
84 | 84 | | 17 authorize the disclosure of, data contained in the vital |
---|
85 | 85 | | 18 records when deemed essential for bona fide research purposes |
---|
86 | 86 | | 19 which are not for private gain. |
---|
87 | 87 | | 20 This amendatory Act of 1973 does not apply to any home rule |
---|
88 | 88 | | 21 unit. |

89 | 89 | | 22 (4) The State Registrar shall exchange with the Department |

116 | 116 | | 13 (5) No rule adopted by the Department shall be construed, |

117 | 117 | | 14 either explicitly or implicitly, as restricting access to |
---|
118 | 118 | | 15 vital records by any municipality, county, multicounty, public |
---|
119 | 119 | | 16 health district, or regional health officer recognized by the |
---|
120 | 120 | | 17 Department for the purposes described in subsections (2) and |
---|
121 | 121 | | 18 (3). |
