11	11	1 AN ACT concerning renewable energy.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 Transparent, Inclusive, and Competitively Neutral Energy
16	16	6 Policy Act.
17	17	7 Section 5. Findings. The General Assembly finds that:
18	18	8 (1) Illinois is emerging as a national leader in clean
19	19	9 energy policy, which is exemplified by the enactment and
20	20	10 implementation of the Climate and Equitable Jobs Act
21	21	11 (Public Act 102-662).
22	22	12 (2) To address the significant increase in electricity
23	23	13 demand in the State and to attract additional investment,
24	24	14 Illinois must significantly expand its clean energy
25	25	15 generation capacity.
26	26	16 (3) Each incremental addition of clean energy
27	27	17 generation provides measurable value in combating climate
28	28	18 change.
29	29	19 (4) Illinois consumers are best served by broad and
30	30	20 robust competition in the procurement processes that are
31	31	21 critical to achieving the State's clean energy goals.
32	32	22 (5) Transparent, inclusive, and competitively neutral
33	33	23 procurement processes will help produce cost-effective

71	71	4 (6) In pursuit of clean energy goals, the State
72	72	5 recognizes the importance of attracting new developers and
73	73	6 resources, as well as the value of retaining existing
74	74	7 developers that have already invested in the communities,
75	75	8 workers, and infrastructure of Illinois.
76	76	9 (7) Competitive procurements that enable projects to
77	77	10 compete on a level playing field help deliver the
78	78	11 highest-value clean energy solutions at the lowest cost to
79	79	12 consumers.
80	80	13 (8) Restricting competition among clean energy
81	81	14 resources inappropriately transfers technology, market,
82	82	15 and operational risks from developers to taxpayers and
83	83	16 consumers.
84	84	17 (9) Transparent, inclusive, and competitively neutral
85	85	18 procurement processes, which provide all qualified
86	86	19 participants with equal access to information, help: (i)
87	87	20 ensure that decisions are properly documented; (ii) foster
88	88	21 trust among bidders, investors, and the public; (iii)
89	89	22 enhance the credibility of the procurement process; and
90	90	23 (iv) strengthen confidence in the results of the
91	91	24 procurement process.
92	92	25 (10) Prompt action is essential to ensure Illinois
93	93	26 remains on track to achieve its climate objectives and to

105	105	2 (11) It is the policy of the State to adopt a
