12	12	1 AN ACT concerning gaming.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Video Gaming Act is amended by changing
16	16	5 Sections 27 and 65 as follows:
17	17	6 (230 ILCS 40/27)
18	18	7 Sec. 27. Prohibition of video gaming by political
19	19	8 subdivision.
20	20	9 (a) A municipality may pass an ordinance prohibiting video
21	21	10 gaming within the corporate limits of the municipality. A
22	22	11 county board may, for the unincorporated area of the county,
23	23	12 pass an ordinance prohibiting video gaming within the
24	24	13 unincorporated area of the county.
25	25	14 (b) On and after July 1, 2022, a qualified fraternal
26	26	15 organization that derives its charter from a national
27	27	16 fraternal organization and a qualified veterans organization
28	28	17 that derives its charter from a national veterans organization
29	29	18 shall be eligible to apply to the Board for a license allowing
30	30	19 video gaming as a licensed fraternal establishment or a
31	31	20 licensed veterans establishment if the proposed fraternal
32	32	21 establishment or veterans establishment is located in:
33	33	22 (1) a municipality having a population of not more
34	34	23 than 1,000,000 that has enacted an ordinance prohibiting

72	72	2 (2) a county having a population of not more than
73	73	3 1,000,000 that has enacted an ordinance prohibiting video
74	74	4 gaming within the unincorporated area of the county.
75	75	5 If the license is granted by the Board, then the licensed
76	76	6 fraternal establishment or licensed veterans establishment may
77	77	7 operate video gaming terminals pursuant to this Act.
78	78	8 (c) No home rule unit of local government with a
79	79	9 population of over 1,000,000, based on the 2000 U.S. Census,
80	80	10 may enforce any local ordinance passed prior to the effective
81	81	11 date of this amendatory Act of the 104th General Assembly
82	82	12 prohibiting the operation of video gaming terminals within the
83	83	13 corporate limits of the municipality. This subsection (c) is a
84	84	14 denial and limitation of home rule powers and functions under
85	85	15 subsection (g) of Section 6 of Article VII of the Illinois
86	86	16 Constitution.

90	90	20 (a) A non-home rule unit of government may not impose any
91	91	21 fee for the operation of a video gaming terminal in excess of
92	92	22 $250 per year.

94	94	24 over 1,000,000, based on the 2000 U.S. Census, may not impose
