Abdelnasser Rashid SYNOPSIS AS INTRODUCED: 815 ILCS 505/2HHHH new Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for any person to engage in a commercial transaction or trade practice with a consumer in which: (1) the consumer is communicating or otherwise interacting with a chatbot, artificial intelligence agent, avatar, or other computer technology that engages in a textual or aural conversation; (2) the communication may mislead or deceive a reasonable consumer to believe that the consumer is communicating with a human representative; and (3) the consumer is not notified in a clear and conspicuous manner that the consumer is communicating with an artificial intelligence system and not a human representative. 1111 1 AN ACT concerning business.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Consumer Fraud and Deceptive Business
1515 5 Practices Act is amended by adding Section 2HHHH as follows:
1616 6 (815 ILCS 505/2HHHH new)
1717 7 Sec. 2HHHH. Commercial transactions; artificial
1818 8 intelligence disclosure. It is an unlawful practice within the
1919 9 meaning of this Act, whether or not a consumer is in fact
2020 10 misled, deceived, or damaged, for any person to engage in a
2121 11 commercial transaction or trade practice with a consumer in
2222 12 which:
2323 13 (1) the consumer is communicating or otherwise
2424 14 interacting with a chatbot, artificial intelligence agent,
2525 15 avatar, or other computer technology that engages in a
2626 16 textual or aural conversation;
2727 17 (2) the communication may mislead or deceive a
2828 18 reasonable consumer to believe that the consumer is
2929 19 communicating with a human representative; and
3030 20 (3) the consumer is not notified in a clear and
3131 21 conspicuous manner that the consumer is communicating with
3232 22 an artificial intelligence system and not a human
