1111 1 AN ACT concerning health.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Illinois Health and Safety in Cosmetology and Barbering
1616 6 Products Disclosure Act.
1717 7 Section 5. Definitions. In this Act:
1818 8 "Barber" means any person licensed under the laws of
1919 9 Illinois to practice barbering. "Barber" includes "licensed
2020 10 barber" as that term is used in the Barber, Cosmetology,
2121 11 Esthetics, Hair Braiding, and Nail Technology Act of 1985.
2222 12 "Beauty supply retailer" means any business, including
2323 13 beauty salons, barber shops, or retail stores, that sells
2424 14 personal care and beauty products, including hair care,
2525 15 skincare, and makeup products.
2626 16 "Chemical products" means any cosmetic, hair care,
2727 17 skincare, or personal grooming product used or sold by
2828 18 cosmetologists, barbers, or beauty supply retailers that
2929 19 contains ingredients known to have potential health risks such
3030 20 as carcinogenic, reproductive, or endocrine-disrupting
3131 21 effects.
3232 22 "Cosmetologist" means any person licensed under the laws
3333 23 of Illinois to practice cosmetology, esthetics, or nail

6969 2 cosmetologist", "licensed esthetician", and "licensed nail
7070 3 technician" as those terms are used in the Barber,
7171 4 Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act
7272 5 of 1985.
7373 6 "Health risks" means risks to human health that include,
7474 7 but are not limited to, cancer, birth defects, reproductive
7575 8 harm, skin irritation, endocrine disruption, and other
7676 9 long-term health effects as identified by the U.S.
7777 10 Environmental Protection Agency, the U.S. Food and Drug
7878 11 Administration, or other authoritative health organizations.
7979 12 Section 10. Posting of health risk information.
8080 13 (a) All cosmetologists, barbers, and beauty supply
8181 14 retailers operating within the State of Illinois shall display
8282 15 a visible and easily readable notice in a prominent location
8383 16 within their business establishment that provides information
8484 17 on the potential health risks associated with the chemical
8585 18 products contained in the products they use or sell.
8686 19 (b) The posted notice must include, at a minimum, the
8787 20 following:
8888 21 (1) A statement that some products may contain
8989 22 chemicals known to cause harm to human health.
9090 23 (2) A list of common chemicals or ingredients found in
9191 24 beauty and personal care products, including formaldehyde,
9292 25 phthalates, parabens, and toluene, and their associated

104104 2 (3) A reference to resources where customers can
105105 3 access more detailed information, including the website of
106106 4 the Illinois Department of Public Health and other
107107 5 relevant health organizations.
108108 6 (c) The posted notice must be at least 11 inches by 14
109109 7 inches in size, placed in a visible location near the
110110 8 reception area or other commonly accessed areas of the
111111 9 business where customers can easily read the notice. The font
112112 10 size must be large enough to be legible from a reasonable
113113 11 distance.
114114 12 (d) The Illinois Department of Public Health shall develop
115115 13 a posted notice that complies with this Section and make that
116116 14 notice available for download as a printable document on its
117117 15 Internet website.
118118 16 Section 15. Pamphlet distribution.
119119 17 (a) At the point of sale, all cosmetologists, barbers, and
120120 18 beauty supply retailers must provide each customer with a
121121 19 pamphlet containing the same information detailed in Section
122122 20 10. This pamphlet must be provided to customers for any
123123 21 service involving the use of beauty or personal care products.
124124 22 (b) The pamphlet must include:
125125 23 (1) A brief description of the potential health risks
126126 24 associated with chemicals commonly used in beauty

138138 1 (2) A list of specific ingredients commonly found in
139139 2 products such as hair relaxers, hair dyes, nail polishes,
140140 3 and other personal care items, along with their known or
141141 4 suspected health effects.
142142 5 (3) Contact information for the Illinois Department of
143143 6 Public Health and other trusted resources for additional
144144 7 information.
145145 8 (c) The Department of Public Health shall develop a
146146 9 pamphlet that complies with this Section and make that
147147 10 pamphlet available for download as a printable document on its
148148 11 Internet website.
