11	11	1 AN ACT concerning health.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 Illinois Health and Safety in Cosmetology and Barbering
16	16	6 Products Disclosure Act.
17	17	7 Section 5. Definitions. In this Act:
18	18	8 "Barber" means any person licensed under the laws of
19	19	9 Illinois to practice barbering. "Barber" includes "licensed
20	20	10 barber" as that term is used in the Barber, Cosmetology,
21	21	11 Esthetics, Hair Braiding, and Nail Technology Act of 1985.
22	22	12 "Beauty supply retailer" means any business, including
23	23	13 beauty salons, barber shops, or retail stores, that sells
24	24	14 personal care and beauty products, including hair care,
25	25	15 skincare, and makeup products.
26	26	16 "Chemical products" means any cosmetic, hair care,
27	27	17 skincare, or personal grooming product used or sold by
28	28	18 cosmetologists, barbers, or beauty supply retailers that
29	29	19 contains ingredients known to have potential health risks such
30	30	20 as carcinogenic, reproductive, or endocrine-disrupting
31	31	21 effects.
32	32	22 "Cosmetologist" means any person licensed under the laws
33	33	23 of Illinois to practice cosmetology, esthetics, or nail

68	68	1 technology. "Cosmetologist" includes "licensed
69	69	2 cosmetologist", "licensed esthetician", and "licensed nail
70	70	3 technician" as those terms are used in the Barber,
71	71	4 Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act
72	72	5 of 1985.
73	73	6 "Health risks" means risks to human health that include,
74	74	7 but are not limited to, cancer, birth defects, reproductive
75	75	8 harm, skin irritation, endocrine disruption, and other
76	76	9 long-term health effects as identified by the U.S.
77	77	10 Environmental Protection Agency, the U.S. Food and Drug
78	78	11 Administration, or other authoritative health organizations.
79	79	12 Section 10. Posting of health risk information.
80	80	13 (a) All cosmetologists, barbers, and beauty supply
81	81	14 retailers operating within the State of Illinois shall display
82	82	15 a visible and easily readable notice in a prominent location
83	83	16 within their business establishment that provides information
84	84	17 on the potential health risks associated with the chemical
85	85	18 products contained in the products they use or sell.
86	86	19 (b) The posted notice must include, at a minimum, the
87	87	20 following:
88	88	21 (1) A statement that some products may contain
89	89	22 chemicals known to cause harm to human health.
90	90	23 (2) A list of common chemicals or ingredients found in
91	91	24 beauty and personal care products, including formaldehyde,
92	92	25 phthalates, parabens, and toluene, and their associated

104	104	2 (3) A reference to resources where customers can
105	105	3 access more detailed information, including the website of
106	106	4 the Illinois Department of Public Health and other
107	107	5 relevant health organizations.
108	108	6 (c) The posted notice must be at least 11 inches by 14
109	109	7 inches in size, placed in a visible location near the
110	110	8 reception area or other commonly accessed areas of the
111	111	9 business where customers can easily read the notice. The font
112	112	10 size must be large enough to be legible from a reasonable
113	113	11 distance.
114	114	12 (d) The Illinois Department of Public Health shall develop
115	115	13 a posted notice that complies with this Section and make that
116	116	14 notice available for download as a printable document on its
117	117	15 Internet website.
118	118	16 Section 15. Pamphlet distribution.
119	119	17 (a) At the point of sale, all cosmetologists, barbers, and
120	120	18 beauty supply retailers must provide each customer with a
121	121	19 pamphlet containing the same information detailed in Section
122	122	20 10. This pamphlet must be provided to customers for any
123	123	21 service involving the use of beauty or personal care products.
124	124	22 (b) The pamphlet must include:
125	125	23 (1) A brief description of the potential health risks
126	126	24 associated with chemicals commonly used in beauty

139	139	2 products such as hair relaxers, hair dyes, nail polishes,

146	146	9 pamphlet that complies with this Section and make that
