11 104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 HB3088 Introduced , by Rep. Anna Moeller SYNOPSIS AS INTRODUCED: 20 ILCS 505/5.36 new Amends the Children and Family Services Act. Requires the Department of Children and Family Services and the Department of Human Services to adopt rules that permit a licensed child care institution or group home that provides residential developmental disability services to youth under the age of 22 to request an age waiver to allow such youth to continue to receive residential developmental disability services at the facility beyond their 22nd birthday. Requires the rules to include waiver application requirements, waiver renewals, and criteria a youth must meet to qualify for extended residential developmental disability services. Provides that a licensed child care institution or group home that receives Department approval of its waiver application shall not be issued any notice of violation or citation for providing extended residential developmental disability services to a youth within the terms of the approved waiver application. Requires the Department of Children and Family Services and the Department of Human Services' Division of Developmental Disabilities to ensure that the rates determined for extended residential developmental disability services authorized under an approved age waiver are on parity with the rates determined for residential developmental disability services provided to youth under the age of 22. Provides that nothing in the amendatory Act shall be construed to reduce the level or type of services and supports provided to a youth beyond their 22nd birthday under an approved age waiver application. 1111 1 AN ACT concerning State government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Children and Family Services Act is amended
1515 5 by adding Section 5.36 as follows:

1717 7 Sec. 5.36. Extended residential developmental disability
1818 8 services. Notwithstanding any other provision of law to the
1919 9 contrary, the Department of Children and Family Services and
2020 10 the Department of Human Services shall adopt rules that permit
2121 11 a licensed child care institution or group home that provides
2222 12 residential developmental disability services to youth under
2323 13 the age of 22 to request an age waiver to allow such youth to
2424 14 continue to receive residential developmental disability
2525 15 services and supports at the facility beyond their 22nd
2626 16 birthday. The rules shall include waiver application
2727 17 requirements, waiver renewals, and criteria a youth must meet
2828 18 to qualify for extended residential developmental disability
2929 19 services. A licensed child care institution or group home that
3030 20 receives Department approval of its waiver application shall
3131 21 not be issued any notice of violation or citation for
