1515 1 AN ACT concerning liquor.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 5. The Liquor Control Act of 1934 is amended by
1919 5 changing Sections 1-3.12, 1-3.40, 3-12, 5-1, and 5-3 as

2222 8 Sec. 1-3.12. "Wine-maker" means a person engaged in the

8484 6 Sec. 3-12. Powers and duties of State Commission.
8585 7 (a) The State Commission shall have the following powers,
8686 8 functions, and duties:
8787 9 (1) To receive applications and to issue licenses to
8888 10 manufacturers, foreign importers, importing distributors,
8989 11 distributors, non-resident dealers, on premise consumption
9090 12 retailers, off premise sale retailers, special event
9191 13 retailer licensees, special use permit licenses, auction
9292 14 liquor licenses, brew pubs, caterer retailers,
9393 15 non-beverage users, railroads, including owners and
9494 16 lessees of sleeping, dining and cafe cars, airplanes,
9595 17 boats, brokers, and wine maker's premises licensees in
9696 18 accordance with the provisions of this Act, and to suspend
9797 19 or revoke such licenses upon the State Commission's
9898 20 determination, upon notice after hearing, that a licensee
9999 21 has violated any provision of this Act or any rule or
100100 22 regulation issued pursuant thereto and in effect for 30
101101 23 days prior to such violation. Except in the case of an
102102 24 action taken pursuant to a violation of Section 6-3, 6-5,
103103 25 or 6-9, any action by the State Commission to suspend or

114114 1 revoke a licensee's license may be limited to the license
115115 2 for the specific premises where the violation occurred. An
116116 3 action for a violation of this Act shall be commenced by
117117 4 the State Commission within 2 years after the date the
118118 5 State Commission becomes aware of the violation.
119119 6 In lieu of suspending or revoking a license, the
120120 7 commission may impose a fine, upon the State Commission's
121121 8 determination and notice after hearing, that a licensee
122122 9 has violated any provision of this Act or any rule or
123123 10 regulation issued pursuant thereto and in effect for 30
124124 11 days prior to such violation.
125125 12 For the purpose of this paragraph (1), when
126126 13 determining multiple violations for the sale of alcohol to
127127 14 a person under the age of 21, a second or subsequent
128128 15 violation for the sale of alcohol to a person under the age
129129 16 of 21 shall only be considered if it was committed within 5
130130 17 years after the date when a prior violation for the sale of
131131 18 alcohol to a person under the age of 21 was committed.
132132 19 The fine imposed under this paragraph may not exceed
133133 20 $500 for each violation. Each day that the activity, which
134134 21 gave rise to the original fine, continues is a separate
135135 22 violation. The maximum fine that may be levied against any
136136 23 licensee, for the period of the license, shall not exceed
137137 24 $20,000. The maximum penalty that may be imposed on a
138138 25 licensee for selling a bottle of alcoholic liquor with a
139139 26 foreign object in it or serving from a bottle of alcoholic

150150 1 liquor with a foreign object in it shall be the
151151 2 destruction of that bottle of alcoholic liquor for the
152152 3 first 10 bottles so sold or served from by the licensee.
153153 4 For the eleventh bottle of alcoholic liquor and for each
154154 5 third bottle thereafter sold or served from by the
155155 6 licensee with a foreign object in it, the maximum penalty
156156 7 that may be imposed on the licensee is the destruction of
157157 8 the bottle of alcoholic liquor and a fine of up to $50.
158158 9 Any notice issued by the State Commission to a
159159 10 licensee for a violation of this Act or any notice with
160160 11 respect to settlement or offer in compromise shall include
161161 12 the field report, photographs, and any other supporting
162162 13 documentation necessary to reasonably inform the licensee
163163 14 of the nature and extent of the violation or the conduct
164164 15 alleged to have occurred. The failure to include such
165165 16 required documentation shall result in the dismissal of
166166 17 the action.
167167 18 (2) To adopt such rules and regulations consistent
168168 19 with the provisions of this Act which shall be necessary
169169 20 to carry on its functions and duties to the end that the
170170 21 health, safety and welfare of the People of the State of
171171 22 Illinois shall be protected and temperance in the
172172 23 consumption of alcoholic liquors shall be fostered and
173173 24 promoted and to distribute copies of such rules and
174174 25 regulations to all licensees affected thereby.

186186 1 the State, county and municipal governments, county and
187187 2 city police departments and upon prosecuting officers for
188188 3 such information and assistance as it deems necessary in
189189 4 the performance of its duties.
190190 5 (4) To recommend to local commissioners rules and
191191 6 regulations, not inconsistent with the law, for the
192192 7 distribution and sale of alcoholic liquors throughout the
193193 8 State.
194194 9 (5) To inspect, or cause to be inspected, any premises
195195 10 in this State where alcoholic liquors are manufactured,
196196 11 distributed, warehoused, or sold. Nothing in this Act
197197 12 authorizes an agent of the State Commission to inspect
198198 13 private areas within the premises without reasonable
199199 14 suspicion or a warrant during an inspection. "Private
200200 15 areas" include, but are not limited to, safes, personal
201201 16 property, and closed desks.
202202 17 (5.1) Upon receipt of a complaint or upon having
203203 18 knowledge that any person is engaged in business as a
204204 19 manufacturer, importing distributor, distributor, or
205205 20 retailer without a license or valid license, to conduct an
206206 21 investigation. If, after conducting an investigation, the
207207 22 State Commission is satisfied that the alleged conduct
208208 23 occurred or is occurring, it may issue a cease and desist
209209 24 notice as provided in this Act, impose civil penalties as
210210 25 provided in this Act, notify the local liquor authority,
211211 26 or file a complaint with the State's Attorney's Office of

222222 1 the county where the incident occurred or the Attorney
223223 2 General.
224224 3 (5.2) Upon receipt of a complaint or upon having
225225 4 knowledge that any person is shipping alcoholic liquor
226226 5 into this State from a point outside of this State if the
227227 6 shipment is in violation of this Act, to conduct an
228228 7 investigation. If, after conducting an investigation, the
229229 8 State Commission is satisfied that the alleged conduct
230230 9 occurred or is occurring, it may issue a cease and desist
231231 10 notice as provided in this Act, impose civil penalties as
232232 11 provided in this Act, notify the foreign jurisdiction, or
233233 12 file a complaint with the State's Attorney's Office of the
234234 13 county where the incident occurred or the Attorney
235235 14 General.
236236 15 (5.3) To receive complaints from licensees, local
237237 16 officials, law enforcement agencies, organizations, and
238238 17 persons stating that any licensee has been or is violating
239239 18 any provision of this Act or the rules and regulations
240240 19 issued pursuant to this Act. Such complaints shall be in
241241 20 writing, signed and sworn to by the person making the
242242 21 complaint, and shall state with specificity the facts in
243243 22 relation to the alleged violation. If the State Commission
244244 23 has reasonable grounds to believe that the complaint
245245 24 substantially alleges a violation of this Act or rules and
246246 25 regulations adopted pursuant to this Act, it shall conduct

258258 1 the State Commission is satisfied that the alleged
259259 2 violation did occur, it shall proceed with disciplinary
260260 3 action against the licensee as provided in this Act.
261261 4 (5.4) To make arrests and issue notices of civil
262262 5 violations where necessary for the enforcement of this
263263 6 Act.
264264 7 (5.5) To investigate any and all unlicensed activity.
265265 8 (5.6) To impose civil penalties or fines to any person
266266 9 who, without holding a valid license, engages in conduct
267267 10 that requires a license pursuant to this Act, in an amount
268268 11 not to exceed $20,000 for each offense as determined by
269269 12 the State Commission. A civil penalty shall be assessed by
270270 13 the State Commission after a hearing is held in accordance
271271 14 with the provisions set forth in this Act regarding the
272272 15 provision of a hearing for the revocation or suspension of
273273 16 a license.
274274 17 (6) To hear and determine appeals from orders of a
275275 18 local commission in accordance with the provisions of this
276276 19 Act, as hereinafter set forth. Hearings under this
277277 20 subsection shall be held in Springfield or Chicago, at
278278 21 whichever location is the more convenient for the majority
279279 22 of persons who are parties to the hearing.
280280 23 (7) The State Commission shall establish uniform
281281 24 systems of accounts to be kept by all retail licensees
282282 25 having more than 4 employees, and for this purpose the

294294 1 more than 4 employees and establish a uniform system of
295295 2 accounts for each class and prescribe the manner in which
296296 3 such accounts shall be kept. The State Commission may also
297297 4 prescribe the forms of accounts to be kept by all retail
298298 5 licensees having more than 4 employees, including, but not
299299 6 limited to, accounts of earnings and expenses and any
300300 7 distribution, payment, or other distribution of earnings
301301 8 or assets, and any other forms, records, and memoranda
302302 9 which in the judgment of the commission may be necessary
303303 10 or appropriate to carry out any of the provisions of this
304304 11 Act, including, but not limited to, such forms, records,
305305 12 and memoranda as will readily and accurately disclose at
306306 13 all times the beneficial ownership of such retail licensed
307307 14 business. The accounts, forms, records, and memoranda
308308 15 shall be available at all reasonable times for inspection
309309 16 by authorized representatives of the State Commission or
310310 17 by any local liquor control commissioner or his or her
311311 18 authorized representative. The commission may, from time
312312 19 to time, alter, amend, or repeal, in whole or in part, any
313313 20 uniform system of accounts, or the form and manner of
314314 21 keeping accounts.
315315 22 (8) In the conduct of any hearing authorized to be
316316 23 held by the State Commission, to appoint, at the
317317 24 commission's discretion, hearing officers to conduct
318318 25 hearings involving complex issues or issues that will
319319 26 require a protracted period of time to resolve, to

330330 1 examine, or cause to be examined, under oath, any
331331 2 licensee, and to examine or cause to be examined the books
332332 3 and records of such licensee; to hear testimony and take
333333 4 proof material for its information in the discharge of its
334334 5 duties hereunder; to administer or cause to be
335335 6 administered oaths; for any such purpose to issue subpoena
336336 7 or subpoenas to require the attendance of witnesses and
337337 8 the production of books, which shall be effective in any
338338 9 part of this State, and to adopt rules to implement its
339339 10 powers under this paragraph (8).
340340 11 Any circuit court may, by order duly entered, require
341341 12 the attendance of witnesses and the production of relevant
342342 13 books subpoenaed by the State Commission and the court may
343343 14 compel obedience to its order by proceedings for contempt.
344344 15 (9) To investigate the administration of laws in
345345 16 relation to alcoholic liquors in this and other states and
346346 17 any foreign countries, and to recommend from time to time
347347 18 to the Governor and through him or her to the legislature
348348 19 of this State, such amendments to this Act, if any, as it
349349 20 may think desirable and as will serve to further the
350350 21 general broad purposes contained in Section 1-2 hereof.
351351 22 (10) To adopt such rules and regulations consistent
352352 23 with the provisions of this Act which shall be necessary
353353 24 for the control, sale, or disposition of alcoholic liquor
354354 25 damaged as a result of an accident, wreck, flood, fire, or
355355 26 other similar occurrence.

380380 15 (12) To develop and maintain a repository of license

383383 18 (14) On or before April 30, 2008 and every 2 years
384384 19 thereafter, the State Commission shall present a written
385385 20 report to the Governor and the General Assembly that shall
386386 21 be based on a study of the impact of Public Act 95-634 on
387387 22 the business of soliciting, selling, and shipping wine
388388 23 from inside and outside of this State directly to
389389 24 residents of this State. As part of its report, the State
390390 25 Commission shall provide all of the following information:

421421 20 alcoholic liquors, the State Commission shall conduct
422422 21 alcohol compliance operations to investigate whether
423423 22 businesses that are soliciting, selling, and shipping wine
424424 23 from inside or outside of this State directly to residents
425425 24 of this State are licensed by this State or are selling or
426426 25 attempting to sell wine to persons under 21 years of age in

442442 5 license under this Act to the Illinois Attorney General
443443 6 and to the U.S. Department of Treasury's Alcohol and
444444 7 Tobacco Tax and Trade Bureau.
445445 8 (17)(A) A person licensed to make wine under the laws
446446 9 of another state who has a winery shipper's license under
447447 10 this Act and annually produces less than 25,000 gallons of
448448 11 wine or a person who has a first-class or second-class
449449 12 wine manufacturer's license, a first-class or second-class
450450 13 wine-maker's license, or a limited wine manufacturer's
451451 14 license under this Act and annually produces less than
452452 15 25,000 gallons of wine may make application to the
453453 16 Commission for a self-distribution exemption to allow the
454454 17 sale of not more than 5,000 gallons of the exemption
455455 18 holder's wine to retail licensees per year and to sell
456456 19 cider, mead, or both cider and mead to brewers, class 1
457457 20 brewers, class 2 brewers, and class 3 brewers that,
458458 21 pursuant to subsection (e) of Section 6-4 of this Act,
459459 22 sell beer, cider, mead, or any combination thereof to
460460 23 non-licensees at their breweries.
461461 24 (B) In the application, which shall be sworn under
462462 25 penalty of perjury, such person shall state (1) the date
463463 26 it was established; (2) its volume of production and sales

482482 9 in compliance with State revenue and liquor laws; (2) is
483483 10 not a member of any affiliated group that produces
484484 11 directly or indirectly more than 25,000 gallons of wine
485485 12 per annum, 930,000 gallons of beer per annum, or 50,000
486486 13 gallons of spirits per annum; (3) will not annually
487487 14 produce for sale more than 25,000 gallons of wine, 930,000
488488 15 gallons of beer, or 50,000 gallons of spirits; and (4)
489489 16 will not annually sell more than 5,000 gallons of its wine
490490 17 to retail licensees.
491491 18 (D) A self-distribution exemption holder shall
492492 19 annually certify to the State Commission its production of
493493 20 wine in the previous 12 months and its anticipated
494494 21 production and sales for the next 12 months. The State
495495 22 Commission may fine, suspend, or revoke a
496496 23 self-distribution exemption after a hearing if it finds
497497 24 that the exemption holder has made a material
498498 25 misrepresentation in its application, violated a revenue

526526 17 self-distribution exemption holder from entering into or
527527 18 simultaneously having a distribution agreement with a
528528 19 licensed Illinois distributor.
529529 20 (H) It is the intent of this paragraph (17) to promote
530530 21 and continue orderly markets. The General Assembly finds
531531 22 that, in order to preserve Illinois' regulatory
532532 23 distribution system, it is necessary to create an
533533 24 exception for smaller makers of wine as their wines are
534534 25 frequently adjusted in varietals, mixes, vintages, and

560560 15 any combination thereof to non-licensees at their

739739 14 (G) It is the intent of this paragraph (18) to promote
740740 15 and continue orderly markets. The General Assembly finds
741741 16 that in order to preserve Illinois' regulatory
742742 17 distribution system, it is necessary to create an
743743 18 exception for smaller manufacturers in order to afford and
744744 19 allow such smaller manufacturers of beer access to the
745745 20 marketplace in order to develop a customer base without
746746 21 impairing the integrity of the 3-tier system.
747747 22 (19)(A) A class 1 craft distiller licensee or a
748748 23 non-resident dealer who manufactures less than 50,000
749749 24 gallons of distilled spirits per year may make application

872872 3 (C) Any application submitted shall be posted on the
873873 4 State Commission's website at least 45 days before action
874874 5 by the State Commission. The State Commission shall
875875 6 approve the application for a self-distribution exemption
876876 7 if the class 3 brewer licensee: (1) is in compliance with
877877 8 the State, revenue, and alcoholic beverage laws; (2) is
878878 9 not a member of any affiliated group that manufacturers,
879879 10 directly or indirectly, more than 465,000 gallons of beer
880880 11 per annum; (3) shall not annually manufacture for sale
881881 12 more than 465,000 gallons of beer or more than 155,000
882882 13 gallons at any single brewery premises; and (4) shall not
883883 14 annually sell more than 6,200 gallons of beer from each
884884 15 in-state or out-of-state class 3 brewery premises, and
885885 16 shall not exceed 18,600 gallons annually in the aggregate,
886886 17 to retail licensees and class 3 brewers and to brewers,
887887 18 class 1 brewers, and class 2 brewers that, pursuant to
888888 19 subsection (e) of Section 6-4 of this Act, sell beer,
889889 20 cider, or both beer and cider to non-licensees at their
890890 21 breweries.
891891 22 (D) A self-distribution exemption holder shall
892892 23 annually certify to the State Commission its manufacture
893893 24 of beer during the previous 12 months and its anticipated
894894 25 manufacture and sales of beer for the next 12 months. The

908908 3 misrepresentation in its application, violated a revenue
909909 4 or alcoholic beverage law of Illinois, exceeded the
910910 5 manufacture of 465,000 gallons of beer in any calendar
911911 6 year or became part of an affiliated group manufacturing
912912 7 more than 465,000 gallons of beer, or exceeded the sale to
913913 8 retail licensees, brewers, class 1 brewers, class 2
914914 9 brewers, and class 3 brewers of 6,200 gallons per brewery
915915 10 location or 18,600 gallons in the aggregate.
916916 11 (E) The State Commission may adopt rules governing
917917 12 self-distribution exemptions consistent with this Act.
918918 13 (F) Nothing in this paragraph shall prohibit a
919919 14 self-distribution exemption holder from entering into or
920920 15 simultaneously having a distribution agreement with a
921921 16 licensed Illinois importing distributor or a distributor.
922922 17 If a self-distribution exemption holder enters into a
923923 18 distribution agreement and has assigned distribution
924924 19 rights to an importing distributor or distributor, then
925925 20 the self-distribution exemption holder's distribution
926926 21 rights in the assigned territories shall cease in a
927927 22 reasonable time not to exceed 60 days.
928928 23 (G) It is the intent of this paragraph to promote and
929929 24 continue orderly markets. The General Assembly finds that
930930 25 in order to preserve Illinois' regulatory distribution

946946 5 (b) On or before April 30, 1999, the Commission shall
947947 6 present a written report to the Governor and the General
948948 7 Assembly that shall be based on a study of the impact of Public
949949 8 Act 90-739 on the business of soliciting, selling, and
950950 9 shipping alcoholic liquor from outside of this State directly
951951 10 to residents of this State.
952952 11 As part of its report, the Commission shall provide the
953953 12 following information:
954954 13 (i) the amount of State excise and sales tax revenues
955955 14 generated as a result of Public Act 90-739;
956956 15 (ii) the amount of licensing fees received as a result
957957 16 of Public Act 90-739;
958958 17 (iii) the number of reported violations, the number of
959959 18 cease and desist notices issued by the Commission, the
960960 19 number of notices of violations issued to the Department
961961 20 of Revenue, and the number of notices and complaints of
962962 21 violations to law enforcement officials.

12111211 19 permitted by any exemption approved by the State Commission
12121212 20 pursuant to Section 6-4 of this Act. A class 1 craft distiller
12131213 21 license holder may store such spirits at a non-contiguous

12811281 17 transferred shall be subject to Article VIII of this Act; (iv)
12821282 18 a written record shall be maintained by the distiller and
12831283 19 distilling pub specifying the amount, date of delivery, and
12841284 20 receipt of the product by the distilling pub; and (v) the
12851285 21 distilling pub shall be located no farther than 80 miles from
12861286 22 the class 2 craft distiller's licensed location.

13451345 9 Commission provides prior approval, a class 1 brewer may
13461346 10 annually transfer up to 930,000 gallons of beer manufactured
13471347 11 by that class 1 brewer to the premises of a licensed class 1
13481348 12 brewer wholly owned and operated by the same licensee.
13491349 13 Class 13. A class 2 brewer license, which may only be
13501350 14 issued to a licensed brewer or licensed non-resident dealer,
13511351 15 shall allow the manufacture of up to 3,720,000 gallons of beer
13521352 16 per year provided that the class 2 brewer licensee does not
13531353 17 manufacture more than a combined 3,720,000 gallons of beer per
13541354 18 year and is not a member of or affiliated with, directly or
13551355 19 indirectly, a manufacturer that produces more than 3,720,000
13561356 20 gallons of beer per year. If a class 2 brewer manufactures
13571357 21 spirits, it shall also obtain and shall only be eligible for,
13581358 22 in addition to any current license, a class 2 craft distiller
13591359 23 license, shall not manufacture more than 100,000 gallons of
13601360 24 spirits per year, and shall not be a member of or affiliated
13611361 25 with, directly or indirectly, a manufacturer that produces

13771377 5 shall not be a member of or affiliated with, directly or
13781378 6 indirectly, a manufacturer that produces more than 150,000
13791379 7 gallons of wine a year. A class 2 brewer licensee may make
13801380 8 sales and deliveries to importing distributors and
13811381 9 distributors, but shall not make sales or deliveries to any
13821382 10 other licensee. If the State Commission provides prior
13831383 11 approval, a class 2 brewer licensee may annually transfer up
13841384 12 to 3,720,000 gallons of beer manufactured by that class 2
13851385 13 brewer licensee to the premises of a licensed class 2 brewer
13861386 14 wholly owned and operated by the same licensee.
13871387 15 A class 2 brewer may transfer beer to a brew pub wholly
13881388 16 owned and operated by the class 2 brewer subject to the
13891389 17 following limitations and restrictions: (i) the transfer shall
13901390 18 not annually exceed more than 31,000 gallons; (ii) the annual
13911391 19 amount transferred shall reduce the brew pub's annual
13921392 20 permitted production limit; (iii) all beer transferred shall
13931393 21 be subject to Article VIII of this Act; (iv) a written record
13941394 22 shall be maintained by the brewer and brew pub specifying the
13951395 23 amount, date of delivery, and receipt of the product by the
13961396 24 brew pub; and (v) the brew pub shall be located no farther than
13971397 25 80 miles from the class 2 brewer's licensed location.

14181418 10 than 155,000 gallons at a single brewery premises, and shall
14191419 11 allow the sale of no more than 6,200 gallons of beer from each
14201420 12 in-state or out-of-state class 3 brewery premises, or 18,600
14211421 13 gallons in the aggregate, to retail licensees, class 1
14221422 14 brewers, class 2 brewers, and class 3 brewers as long as the
14231423 15 class 3 brewer licensee does not manufacture more than a
14241424 16 combined 465,000 gallons of beer per year and is not a member
14251425 17 of or affiliated with, directly or indirectly, a manufacturer
14261426 18 that produces more than 465,000 gallons of beer per year to
14271427 19 make sales to importing distributors, distributors, retail
14281428 20 licensees, brewers, class 1 brewers, class 2 brewers, and
14291429 21 class 3 brewers in accordance with the conditions set forth in
14301430 22 paragraph (20) of subsection (a) of Section 3-12. If the State
14311431 23 Commission provides prior approval, a class 3 brewer may
14321432 24 annually transfer up to 155,000 gallons of beer manufactured
14331433 25 by that class 3 brewer to the premises of a licensed class 3

14481448 4 Class 15. A third-class wine-maker's license shall allow
14491449 5 the manufacture of up to 250,000 gallons of wine per year and
14501450 6 the storage and sale of such wine to distributors in this State
14511451 7 and to persons without the State, as may be permitted by law.
14521452 8 (a-1) A manufacturer which is licensed in this State to
14531453 9 make sales or deliveries of alcoholic liquor to licensed
14541454 10 distributors or importing distributors and which enlists
14551455 11 agents, representatives, or individuals acting on its behalf
14561456 12 who contact licensed retailers on a regular and continual
14571457 13 basis in this State must register those agents,
14581458 14 representatives, or persons acting on its behalf with the
14591459 15 State Commission.
14601460 16 Registration of agents, representatives, or persons acting
14611461 17 on behalf of a manufacturer is fulfilled by submitting a form
14621462 18 to the Commission. The form shall be developed by the
14631463 19 Commission and shall include the name and address of the
14641464 20 applicant, the name and address of the manufacturer he or she
14651465 21 represents, the territory or areas assigned to sell to or
14661466 22 discuss pricing terms of alcoholic liquor, and any other
14671467 23 questions deemed appropriate and necessary. All statements in
14681468 24 the forms required to be made by law or by rule shall be deemed
14691469 25 material, and any person who knowingly misstates any material
14701470 26 fact under oath in an application is guilty of a Class B

14871487 7 (b) A distributor's license shall allow (i) the wholesale

14901490 10 without the State, as may be permitted by law; (ii) the sale of
14911491 11 beer, cider, mead, or any combination thereof to brewers,
14921492 12 class 1 brewers, and class 2 brewers that, pursuant to
14931493 13 subsection (e) of Section 6-4 of this Act, sell beer, cider,
14941494 14 mead, or any combination thereof to non-licensees at their
14951495 15 breweries; (iii) the sale of vermouth to class 1 craft
14961496 16 distillers and class 2 craft distillers that, pursuant to
14971497 17 subsection (e) of Section 6-4 of this Act, sell spirits,
14981498 18 vermouth, or both spirits and vermouth to non-licensees at
14991499 19 their distilleries; or (iv) as otherwise provided in this Act.
15001500 20 No person licensed as a distributor shall be granted a
15011501 21 non-resident dealer's license.
15021502 22 (c) An importing distributor's license may be issued to
15031503 23 and held by those only who are duly licensed distributors,
15041504 24 upon the filing of an application by a duly licensed
15051505 25 distributor, with the Commission and the Commission shall,

15181518 2 allow the importation of alcoholic liquor by the licensee into
15191519 3 this State from any point in the United States outside this
15201520 4 State, and the purchase of alcoholic liquor in barrels, casks
15211521 5 or other bulk containers and the bottling of such alcoholic
15221522 6 liquors before resale thereof, but all bottles or containers
15231523 7 so filled shall be sealed, labeled, stamped and otherwise made
15241524 8 to comply with all provisions, rules and regulations governing
15251525 9 manufacturers in the preparation and bottling of alcoholic
15261526 10 liquors. The importing distributor's license shall permit such
15271527 11 licensee to purchase alcoholic liquor from Illinois licensed
15281528 12 non-resident dealers and foreign importers only. No person
15291529 13 licensed as an importing distributor shall be granted a
15301530 14 non-resident dealer's license.
15311531 15 (d) A retailer's license shall allow the licensee to sell
15321532 16 and offer for sale at retail, only in the premises specified in
15331533 17 the license, alcoholic liquor for use or consumption, but not
15341534 18 for resale in any form. Except as provided in Section 6-16,
15351535 19 6-29, or 6-29.1, nothing in this Act shall deny, limit,
15361536 20 remove, or restrict the ability of a holder of a retailer's
15371537 21 license to transfer or ship alcoholic liquor to the purchaser
15381538 22 for use or consumption subject to any applicable local law or
15391539 23 ordinance. For the purposes of this Section, "shipping" means
15401540 24 the movement of alcoholic liquor from a licensed retailer to a
15411541 25 consumer via a common carrier. Except as provided in Section
15421542 26 6-16, 6-29, or 6-29.1, nothing in this Act shall deny, limit,

15561556 4 hours from the time the alcoholic liquor leaves the licensed
15571557 5 premises of the retailer for delivery. For the purposes of
15581558 6 this Section, "delivery" means the movement of alcoholic
15591559 7 liquor purchased from a licensed retailer to a consumer
15601560 8 through the following methods:
15611561 9 (1) delivery within licensed retailer's parking lot,
15621562 10 including curbside, for pickup by the consumer;
15631563 11 (2) delivery by an owner, officer, director,
15641564 12 shareholder, or employee of the licensed retailer; or
15651565 13 (3) delivery by a third-party contractor, independent
15661566 14 contractor, or agent with whom the licensed retailer has
15671567 15 contracted to make deliveries of alcoholic liquors.
15681568 16 Under subsection (1), (2), or (3), delivery shall not
15691569 17 include the use of common carriers.
15701570 18 Any retail license issued to a manufacturer shall only
15711571 19 permit the manufacturer to sell beer at retail on the premises
15721572 20 actually occupied by the manufacturer. For the purpose of
15731573 21 further describing the type of business conducted at a retail
15741574 22 licensed premises, a retailer's licensee may be designated by
15751575 23 the State Commission as (i) an on premise consumption
15761576 24 retailer, (ii) an off premise sale retailer, or (iii) a
15771577 25 combined on premise consumption and off premise sale retailer.

15891589 1 1,000,000 inhabitants, a home rule unit may not regulate the
15901590 2 delivery of alcoholic liquor inconsistent with this
15911591 3 subsection. This paragraph is a limitation under subsection
15921592 4 (i) of Section 6 of Article VII of the Illinois Constitution on
15931593 5 the concurrent exercise by home rule units of powers and
15941594 6 functions exercised by the State. A non-home rule municipality
15951595 7 may not regulate the delivery of alcoholic liquor inconsistent
15961596 8 with this subsection.
15971597 9 Notwithstanding any other provision of this subsection
15981598 10 (d), a retail licensee may sell alcoholic liquors to a special
15991599 11 event retailer licensee for resale to the extent permitted
16001600 12 under subsection (e).
16011601 13 (e) A special event retailer's license (not-for-profit)
16021602 14 shall permit the licensee to purchase alcoholic liquors from
16031603 15 an Illinois licensed distributor (unless the licensee
16041604 16 purchases less than $500 of alcoholic liquors for the special
16051605 17 event, in which case the licensee may purchase the alcoholic
16061606 18 liquors from a licensed retailer) and shall allow the licensee
16071607 19 to sell and offer for sale, at retail, alcoholic liquors for
16081608 20 use or consumption, but not for resale in any form and only at
16091609 21 the location and on the specific dates designated for the
16101610 22 special event in the license. An applicant for a special event
16111611 23 retailer license must (i) furnish with the application: (A) a
16121612 24 resale number issued under Section 2c of the Retailers'
16131613 25 Occupation Tax Act or evidence that the applicant is
16141614 26 registered under Section 2a of the Retailers' Occupation Tax

16381638 14 limits; and (iii) show proof satisfactory to the State
16391639 15 Commission that the applicant has obtained local authority
16401640 16 approval.
16411641 17 Nothing in this Act prohibits an Illinois licensed
16421642 18 distributor from offering credit or a refund for unused,
16431643 19 salable alcoholic liquors to a holder of a special event
16441644 20 retailer's license or the special event retailer's licensee
16451645 21 from accepting the credit or refund of alcoholic liquors at
16461646 22 the conclusion of the event specified in the license.
16471647 23 (f) A railroad license shall permit the licensee to import
16481648 24 alcoholic liquors into this State from any point in the United
16491649 25 States outside this State and to store such alcoholic liquors

16661666 6 alcoholic liquors to be sold or dispensed on a club, buffet,
16671667 7 lounge or dining car operated on an electric, gas or steam
16681668 8 railway in this State; and provided further, that railroad
16691669 9 licensees exercising the above powers shall be subject to all
16701670 10 provisions of Article VIII of this Act as applied to importing
16711671 11 distributors. A railroad license shall also permit the
16721672 12 licensee to sell or dispense alcoholic liquors on any club,
16731673 13 buffet, lounge or dining car operated on an electric, gas or
16741674 14 steam railway regularly operated by a common carrier in this
16751675 15 State, but shall not permit the sale for resale of any
16761676 16 alcoholic liquors to any licensee within this State. A license
16771677 17 shall be obtained for each car in which such sales are made.
16781678 18 (g) A boat license shall allow the sale of alcoholic
16791679 19 liquor in individual drinks, on any passenger boat regularly
16801680 20 operated as a common carrier on navigable waters in this State
16811681 21 or on any riverboat operated under the Illinois Gambling Act,
16821682 22 which boat or riverboat maintains a public dining room or
16831683 23 restaurant thereon.
16841684 24 (h) A non-beverage user's license shall allow the licensee
16851685 25 to purchase alcoholic liquor from a licensed manufacturer or
16861686 26 importing distributor, without the imposition of any tax upon

17481748 16 Upon approval from the State Commission, a wine-maker's
17491749 17 premises license shall allow the licensee to sell and offer
17501750 18 for sale at (i) the wine-maker's licensed premises and (ii) at
17511751 19 up to 3 2 additional locations for use and consumption and not
17521752 20 for resale. Each location shall require additional licensing
17531753 21 per location as specified in Section 5-3 of this Act. A
17541754 22 wine-maker's premises licensee shall secure liquor liability
17551755 23 insurance coverage in an amount at least equal to the maximum
17561756 24 liability amounts set forth in subsection (a) of Section 6-21
17571757 25 of this Act.

18141814 10 (l) (i) A broker's license shall be required of all
18151815 11 persons who solicit orders for, offer to sell or offer to
18161816 12 supply alcoholic liquor to retailers in the State of Illinois,
18171817 13 or who offer to retailers to ship or cause to be shipped or to
18181818 14 make contact with distillers, craft distillers, rectifiers,
18191819 15 brewers or manufacturers or any other party within or without
18201820 16 the State of Illinois in order that alcoholic liquors be
18211821 17 shipped to a distributor, importing distributor or foreign
18221822 18 importer, whether such solicitation or offer is consummated
18231823 19 within or without the State of Illinois.
18241824 20 No holder of a retailer's license issued by the Illinois
18251825 21 Liquor Control Commission shall purchase or receive any
18261826 22 alcoholic liquor, the order for which was solicited or offered
18271827 23 for sale to such retailer by a broker unless the broker is the
18281828 24 holder of a valid broker's license.
18291829 25 The broker shall, upon the acceptance by a retailer of the
18301830 26 broker's solicitation of an order or offer to sell or supply or

18461846 6 within this State, other than a retail licensee, who, for a fee

18491849 9 to be shipped from this State and delivered to residents
18501850 10 outside of this State by an express company, common carrier,
18511851 11 or contract carrier. This Section does not apply to any person
18521852 12 who promotes, solicits, or accepts orders for wine as
18531853 13 specifically authorized in Section 6-29 of this Act.
18541854 14 A broker's license under this subsection (l) shall not
18551855 15 entitle the holder to buy or sell any alcoholic liquors for his
18561856 16 own account or to take or deliver title to such alcoholic
18571857 17 liquors.
18581858 18 This subsection (l) shall not apply to distributors,
18591859 19 employees of distributors, or employees of a manufacturer who
18601860 20 has registered the trademark, brand or name of the alcoholic
18611861 21 liquor pursuant to Section 6-9 of this Act, and who regularly
18621862 22 sells such alcoholic liquor in the State of Illinois only to
18631863 23 its registrants thereunder.
18641864 24 Any agent, representative, or person subject to
18651865 25 registration pursuant to subsection (a-1) of this Section
18661866 26 shall not be eligible to receive a broker's license.

18771877 1 (m) A non-resident dealer's license shall permit such
18781878 2 licensee to ship into and warehouse alcoholic liquor into this
18791879 3 State from any point outside of this State, and to sell such

18811881 5 importing distributors and to no one else in this State;
18821882 6 provided that (i) said non-resident dealer shall register with
18831883 7 the Illinois Liquor Control Commission each and every brand of

18851885 9 licensees during the license period, (ii) it shall comply with
18861886 10 all of the provisions of Section 6-9 hereof with respect to
18871887 11 registration of such Illinois licensees as may be granted the
18881888 12 right to sell such brands at wholesale by duly filing such
18891889 13 registration statement, thereby authorizing the non-resident
18901890 14 dealer to proceed to sell such brands at wholesale, and (iii)
18911891 15 the non-resident dealer shall comply with the provisions of
18921892 16 Sections 6-5 and 6-6 of this Act to the same extent that these
18931893 17 provisions apply to manufacturers. No person licensed as a
18941894 18 non-resident dealer shall be granted a distributor's or
18951895 19 importing distributor's license.
18961896 20 (n) A brew pub license shall allow the licensee to only (i)
18971897 21 manufacture up to 155,000 gallons of beer per year only on the
18981898 22 premises specified in the license, (ii) make sales of the beer
18991899 23 manufactured on the premises or, with the approval of the
19001900 24 Commission, beer manufactured on another brew pub licensed
19011901 25 premises that is wholly owned and operated by the same
19021902 26 licensee to importing distributors, distributors, and to

19281928 16 owned, operated, and licensed locations.
19291929 17 A brew pub licensee shall not under any circumstance sell
19301930 18 or offer for sale beer manufactured by the brew pub licensee to
19311931 19 retail licensees.
19321932 20 A person who holds a class 2 brewer license may
19331933 21 simultaneously hold a brew pub license if the class 2 brewer
19341934 22 (i) does not, under any circumstance, sell or offer for sale
19351935 23 beer manufactured by the class 2 brewer to retail licensees;
19361936 24 (ii) does not hold more than 3 brew pub licenses in this State;
19371937 25 (iii) does not manufacture more than a combined 3,720,000

19571957 9 1, 2015 may (i) continue to qualify for and hold that brew pub
19581958 10 license for the licensed premises and (ii) manufacture more
19591959 11 than 3,720,000 gallons of beer per year and continue to
19601960 12 qualify for and hold that brew pub license if that brewer,
19611961 13 class 2 brewer, or non-resident dealer does not simultaneously
19621962 14 hold a class 1 brewer license and is not a member of or
19631963 15 affiliated with, directly or indirectly, a manufacturer that
19641964 16 produces more than 3,720,000 gallons of beer per year or that
19651965 17 produces any other alcoholic liquor.
19661966 18 A brew pub licensee may apply for a class 3 brewer license
19671967 19 and, upon meeting all applicable qualifications of this Act
19681968 20 and relinquishing all commonly owned brew pub or retail
19691969 21 licenses, shall be issued a class 3 brewer license. Nothing in
19701970 22 this Act shall prohibit the issuance of a class 3 brewer
19711971 23 license if the applicant:
19721972 24 (1) has a valid retail license on or before May 1,

19981998 14 (o) A caterer retailer license shall allow the holder to
19991999 15 serve alcoholic liquors as an incidental part of a food
20002000 16 service that serves prepared meals which excludes the serving
20012001 17 of snacks as the primary meal, either on or off-site whether
20022002 18 licensed or unlicensed. A caterer retailer license shall allow
20032003 19 the holder, a distributor, or an importing distributor to
20042004 20 transfer any inventory to and from the holder's retail
20052005 21 premises and shall allow the holder to purchase alcoholic
20062006 22 liquor from a distributor or importing distributor to be
20072007 23 delivered directly to an off-site event.
20082008 24 Nothing in this Act prohibits a distributor or importing
20092009 25 distributor from offering credit or a refund for unused,
20102010 26 salable beer to a holder of a caterer retailer license or a

20362036 16 engage a distributor or importing distributor to transfer any
20372037 17 inventory from any off-site location to its caterer retailer
20382038 18 premises at the conclusion of an off-site event, provided that
20392039 19 the distributor or importing distributor issues bona fide
20402040 20 charges to the caterer retailer licensee for fuel, labor, and
20412041 21 delivery and the distributor or importing distributor collects
20422042 22 payment from the caterer retailer licensee prior to the
20432043 23 distributor or importing distributor transferring inventory to
20442044 24 the caterer retailer premises.
20452045 25 For purposes of this subsection (o), an "act of God" means
20462046 26 an unforeseeable event, such as a rain or snow storm, hail, a

20672067 11 (q) A special use permit license shall allow an Illinois
20682068 12 licensed retailer to transfer a portion of its alcoholic
20692069 13 liquor inventory from its retail licensed premises to the
20702070 14 premises specified in the license hereby created; to purchase
20712071 15 alcoholic liquor from a distributor or importing distributor
20722072 16 to be delivered directly to the location specified in the
20732073 17 license hereby created; and to sell or offer for sale at
20742074 18 retail, only in the premises specified in the license hereby
20752075 19 created, the transferred or delivered alcoholic liquor for use
20762076 20 or consumption, but not for resale in any form. A special use
20772077 21 permit license may be granted for the following time periods:
20782078 22 one day or less; 2 or more days to a maximum of 15 days per
20792079 23 location in any 12-month period. An applicant for the special
20802080 24 use permit license must also submit with the application proof

21392139 11 for resale. Prior to receiving a winery shipper's license, an
21402140 12 applicant for the license must provide the Commission with a
21412141 13 true copy of its current license in any state in which it is
21422142 14 licensed as a manufacturer of wine. An applicant for a winery
21432143 15 shipper's license must also complete an application form that
21442144 16 provides any other information the Commission deems necessary.
21452145 17 The application form shall include all addresses from which
21462146 18 the applicant for a winery shipper's license intends to ship
21472147 19 wine, including the name and address of any third party,
21482148 20 except for a common carrier, authorized to ship wine on behalf
21492149 21 of the manufacturer. The application form shall include an
21502150 22 acknowledgement consenting to the jurisdiction of the
21512151 23 Commission, the Illinois Department of Revenue, and the courts
21522152 24 of this State concerning the enforcement of this Act and any
21532153 25 related laws, rules, and regulations, including authorizing

21812181 17 or renewal, that he or she only ships wine, either directly or
21822182 18 indirectly through a third-party provider, from the licensee's
21832183 19 own production.
21842184 20 Except for a common carrier, a third-party provider
21852185 21 shipping wine on behalf of a winery shipper's license holder
21862186 22 is the agent of the winery shipper's license holder and, as
21872187 23 such, a winery shipper's license holder is responsible for the
21882188 24 acts and omissions of the third-party provider acting on
21892189 25 behalf of the license holder. A third-party provider, except

22062206 6 Revenue, file with the State Commission a statement detailing

22112211 11 (1) the name, address, and license number of the

22152215 15 If the Department of Revenue or the State Commission requests
22162216 16 a statement under this paragraph, the third-party provider
22172217 17 must provide that statement no later than 30 days after the
22182218 18 request is made. Any books, records, supporting papers, and
22192219 19 documents containing information and data relating to a
22202220 20 statement under this paragraph shall be kept and preserved for
22212221 21 a period of 3 years, unless their destruction sooner is
22222222 22 authorized, in writing, by the Director of Revenue, and shall
22232223 23 be open and available to inspection by the Director of Revenue

22432243 7 The State Commission shall adopt rules as soon as

22482248 12 violated the provisions of this Act with regard to any winery

22502250 14 A winery shipper licensee must pay to the Department of
22512251 15 Revenue the State liquor gallonage tax under Section 8-1 for
22522252 16 all wine that is sold by the licensee and shipped to a person
22532253 17 in this State. For the purposes of Section 8-1, a winery
22542254 18 shipper licensee shall be taxed in the same manner as a
22552255 19 manufacturer of wine. A licensee who is not otherwise required

22832283 11 (r) must comply with the requirements of Section 6-29 of this

22852285 13 Pursuant to paragraph (5.1) or (5.3) of subsection (a) of
22862286 14 Section 3-12, the State Commission may receive, respond to,
22872287 15 and investigate any complaint and impose any of the remedies
22882288 16 specified in paragraph (1) of subsection (a) of Section 3-12.
22892289 17 As used in this subsection, "third-party provider" means
22902290 18 any entity that provides fulfillment house services, including
22912291 19 warehousing, packaging, distribution, order processing, or
22922292 20 shipment of wine, but not the sale of wine, on behalf of a
22932293 21 licensed winery shipper.
22942294 22 (s) A craft distiller tasting permit license shall allow
22952295 23 an Illinois licensed class 1 craft distiller or class 2 craft

23112311 3 transferred alcoholic liquor in accordance with subsection (c)
23122312 4 of Section 6-31 of this Act. The transferred alcoholic liquor
23132313 5 may not be sold or resold in any form. An applicant for the
23142314 6 craft distiller tasting permit license must also submit with

23182318 10 (t) A brewer warehouse permit may be issued to the holder

23212321 13 warehouse permit shall allow the holder to store or warehouse
23222322 14 up to 930,000 gallons of tax-determined beer manufactured by
23232323 15 the holder of the permit at the premises specified on the
23242324 16 permit. If the holder of the permit is a class 2 brewer
23252325 17 licensee, the brewer warehouse permit shall allow the holder
23262326 18 to store or warehouse up to 3,720,000 gallons of
23272327 19 tax-determined beer manufactured by the holder of the permit
23282328 20 at the premises specified on the permit. Sales to
23292329 21 non-licensees are prohibited at the premises specified in the
23302330 22 brewer warehouse permit.
23312331 23 (u) A distilling pub license shall allow the licensee to
23322332 24 only (i) manufacture up to 5,000 gallons of spirits per year
23332333 25 only on the premises specified in the license, (ii) make sales

23602360 16 A distilling pub licensee shall not under any circumstance
23612361 17 sell or offer for sale spirits manufactured by the distilling
23622362 18 pub licensee to retail licensees.
23632363 19 A person who holds a class 2 craft distiller license may
23642364 20 simultaneously hold a distilling pub license if the class 2
23652365 21 craft distiller (i) does not, under any circumstance, sell or
23662366 22 offer for sale spirits manufactured by the class 2 craft
23672367 23 distiller to retail licensees; (ii) does not hold more than 3
23682368 24 distilling pub licenses in this State; (iii) does not
23692369 25 manufacture more than a combined 100,000 gallons of spirits

23922392 12 (w) A beer showcase permit license shall allow an
23932393 13 Illinois-licensed distributor to transfer a portion of its
23942394 14 beer inventory from its licensed premises to the premises
23952395 15 specified in the beer showcase permit license, and, in the
23962396 16 case of a class 3 brewer, transfer only beer the class 3 brewer
23972397 17 manufactures from its licensed premises to the premises
23982398 18 specified in the beer showcase permit license; and to sell or
23992399 19 offer for sale at retail, only in the premises specified in the
24002400 20 beer showcase permit license, the transferred or delivered
24012401 21 beer for on or off premise consumption, but not for resale in
24022402 22 any form and to sell to non-licensees not more than 96 fluid

26692669 12 Fees collected under this Section shall be paid into the
26702670 13 Dram Shop Fund. The State Commission shall waive license
26712671 14 renewal fees for those retailers' licenses that are designated
26722672 15 as "1A" by the State Commission and expire on or after July 1,
26732673 16 2022, and on or before June 30, 2023. One-half of the funds
26742674 17 received for a retailer's license shall be paid into the Dram
26752675 18 Shop Fund and one-half of the funds received for a retailer's
26762676 19 license shall be paid into the General Revenue Fund.
26772677 20 No fee shall be paid for licenses issued by the State
