1212 1 AN ACT concerning regulation.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Barber, Cosmetology, Esthetics, Hair
1616 5 Braiding, and Nail Technology Act of 1985 is amended by
1717 6 changing Sections 3A-1 and 3-1 as follows:

1919 8 (Section scheduled to be repealed on January 1, 2026)
2020 9 Sec. 3-1. Cosmetology defined. Any one or any combination
2121 10 of the following practices constitutes the practice of
2222 11 cosmetology when done for cosmetic or beautifying purposes and
2323 12 not for the treatment of disease or of a muscular or nervous
2424 13 disorder: arranging, braiding, dressing, cutting, trimming,
2525 14 curling, waving, chemical restructuring, shaping, singeing,
2626 15 bleaching, coloring or similar work, upon the hair of the head
2727 16 or any cranial prosthesis; cutting or trimming facial hair of
2828 17 any person; any practice of manicuring, pedicuring, decorating
2929 18 nails, applying sculptured nails or otherwise artificial nails
3030 19 by hand or with mechanical or electrical apparatus or
3131 20 appliances, or in any way caring for the nails or the skin of
3232 21 the hands or feet including massaging the hands, arms, elbows,
3333 22 feet, lower legs, and knees of another person for other than
3434 23 the treatment of medical disorders; any practice of epilation

7171 1 or depilation of any person; any practice for the purpose of
7272 2 cleansing, massaging or toning the skin of the scalp;
7373 3 beautifying, massaging, cleansing, exfoliating, or stimulating
7474 4 the stratum corneum of the epidermis by the use of cosmetic
7575 5 preparations, body treatments, body wraps, the use of
7676 6 hydrotherapy, or any device, electrical, mechanical, or
7777 7 otherwise, including hydrodermabrasion devices such as the
7878 8 Hydrafacial machine; applying make-up or eyelashes to any
7979 9 person or lightening or coloring hair on the body and removing
8080 10 superfluous hair from the body of any person by the use of
8181 11 depilatories, waxing, threading, or tweezers. The term
8282 12 "cosmetology" does not include the services provided by an
8383 13 electrologist. Nail technology is the practice and the study
8484 14 of cosmetology only to the extent of manicuring, pedicuring,
8585 15 decorating, and applying sculptured or otherwise artificial
8686 16 nails, or in any way caring for the nail or the skin of the
8787 17 hands or feet including massaging the hands, arms, elbows,
8888 18 feet, lower legs, and knees. Cosmetologists are prohibited
8989 19 from using any technique, product, or practice intended to
9090 20 affect the living layers of the skin. The term cosmetology
9191 21 includes rendering advice on what is cosmetically appealing,
9292 22 but no person licensed under this Act shall render advice on
9393 23 what is appropriate medical treatment for diseases of the
9494 24 skin. Purveyors of cosmetics may demonstrate such cosmetic
9595 25 products in conjunction with any sales promotion and shall not
9696 26 be required to hold a license under this Act. Nothing in this

107107 1 Act shall be construed to prohibit the shampooing of hair by
108108 2 persons employed for that purpose and who perform that task
109109 3 under the direct supervision of a licensed cosmetologist or
110110 4 licensed cosmetology teacher.

115115 9 (A) Any one or combination of the following practices,
116116 10 when done for cosmetic or beautifying purposes and not for the
117117 11 treatment of disease or of a muscular or nervous disorder,
118118 12 constitutes the practice of esthetics:
119119 13 1. Beautifying, massaging, cleansing, exfoliating, or
120120 14 stimulating the stratum corneum of the epidermis by the
121121 15 use of cosmetic preparations, body treatments, body wraps,
122122 16 hydrotherapy, or any device, electrical, mechanical, or
123123 17 otherwise, including hydrodermabrasion devices such as the
124124 18 Hydrafacial machine, for the care of the skin;
125125 19 2. Applying make-up or eyelashes to any person or
126126 20 lightening or coloring hair on the body except the scalp;
127127 21 and
128128 22 3. Removing superfluous hair from the body of any
129129 23 person.
130130 24 However, esthetics does not include the services provided

148148 7 (B) "Esthetician" means any person who, with hands or
149149 8 mechanical or electrical apparatus or appliances, engages only
150150 9 in the use of cosmetic preparations, body treatments, body
151151 10 wraps, hydrotherapy, makeups, antiseptics, tonics, lotions,
152152 11 creams or other preparations or in the practice of massaging,
153153 12 cleansing, exfoliating the stratum corneum of the epidermis,
154154 13 stimulating, manipulating, beautifying, grooming, threading,
155155 14 or similar work on the face, neck, arms and hands or body in a
156156 15 superficial mode, and not for the treatment of medical
157157 16 disorders.
