Includes the counties of Lee, Ogle, and Whiteside in the program to increase cameras along expressways and the State highway system. Provides that images from the cameras, including, but not limited to, images of license plates collected by state-operated cameras and cameras operated by the Illinois State Toll Highway Authority, may be used by any law enforcement agency conducting an active law enforcement investigation. Removes provision allowing images from the cameras to be used by any law enforcement agency conducting an active law enforcement investigation. Provides that all images from the cameras that are exported through a law enforcement database shall be deleted from that law enforcement database within 120 days, unless the images are relevant to an ongoing investigation or pending criminal trial. Provides that any forcible felony, gunrunning, or firearms trafficking offense, as specified, respectively, committed on an expressway monitored by a camera system funded by money from the Road Fund or money from the Illinois State Toll Highway Authority and investigated by officers of the Illinois State Police may be prosecuted by the Attorney General or the State's Attorney where the offense was committed. Provides that the Act supersedes provisions in the Toll Highway Act regarding the confidentiality of personally identifiable information obtained through electronic toll collection systems. 416 2 Be it enacted by the People of the State of Illinois,

618 4 Section 5. The Freedom of Information Act is amended by

377423 20 servitude, robbery, burglary, residential burglary, aggravated
378424 21 arson, arson, aggravated kidnaping, kidnaping, and aggravated
379425 22 battery resulting in great bodily harm or permanent disability

405451 14 Lee, Macon, Madison, McHenry, Morgan, Ogle, Peoria, Rock
406452 15 Island, Sangamon, St. Clair, Whiteside, Will, and Winnebago
407453 16 and (ii) Jean-Baptiste Pointe DuSable Lake Shore Drive in Cook
408454 17 County. Within 90 days after June 3, 2022 (the effective date
409455 18 of Public Act 102-1042), details about the program objectives,
410456 19 counties where the program is operational, and policies under
411457 20 which the program operates shall be made publicly available
412458 21 and posted online.
413459 22 (b) Images from the cameras, including, but not limited
414460 23 to, images of license plates collected by state-operated
415461 24 cameras and cameras operated by the Illinois State Toll

429475 3 may be extracted by any authorized user and used by any
430476 4 municipal police department, county sheriff's office, State
431477 5 Police officer, or other law enforcement agency with
432478 6 jurisdiction in the investigation of any offenses involving
433479 7 vehicular hijacking, aggravated vehicular hijacking,
434480 8 terrorism, motor vehicle theft, or any forcible felony,
435481 9 including, but not limited to, offenses involving the use of a
436482 10 firearm; to detect expressway hazards and highway conditions;
437483 11 and to facilitate highway safety and incident management.
438484 12 Images from the cameras shall not be used to enforce petty
439485 13 offenses or offenses not listed in this subsection, unless use
440486 14 of the images pertains to expressway or highway safety or
441487 15 hazards. Images from the cameras may be used by any law
442488 16 enforcement agency conducting an active law enforcement
443489 17 investigation. All images from the cameras that are exported
444490 18 through a law enforcement database shall be deleted from that
445491 19 law enforcement database within 120 days, unless the images
446492 20 are relevant to an ongoing investigation or pending criminal
447493 21 trial. Cameras shall not be used to monitor individuals or
448494 22 groups in a discriminatory manner contrary to applicable State
449495 23 or federal law.
450-24 (b-5) By August 1st June 30th of each year, the Illinois
451-25 State Police, the Illinois Department of Transportation, and
452-26 the Illinois State Toll Highway Authority shall issue a joint

475521 13 (c) Subject to appropriation, any funds needed to conduct
476522 14 the program for use on the expressways or State highway system
477523 15 under the jurisdiction of the Department of Transportation
478524 16 shall be taken from the Road Fund and shall be included in
479525 17 requests for qualification processes. Any funds needed to
480526 18 conduct the program for use on expressways under the
481527 19 jurisdiction of the Illinois State Toll Highway Authority
482528 20 shall be paid for by funds from the Illinois State Tollway
483529 21 Highway Authority and shall be included in requests for
484530 22 qualification processes.
485531 23 (c-5) Any forcible felony, gunrunning, or firearms
486532 24 trafficking offense, as defined in Section 2-8, 24-3a, or
487533 25 24-3b of the Criminal Code of 2012, respectively, committed on
