1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Acupuncture Practice Act is amended by
1515 5 changing Section 10 as follows:

1818 8 Sec. 10. Definitions. As used in this Act:
1919 9 "Acupuncture" means evaluation or treatment that is
2020 10 effected by stimulating certain body points by the insertion
2121 11 of pre-sterilized, single-use, disposable needles, unless
2222 12 medically contraindicated. "Acupuncture" includes, but is not
2323 13 limited to, stimulation that may be effected by the
2424 14 application of heat, including far infrared, or cold,
2525 15 electricity, electro or magnetic stimulation, cold laser,
2626 16 vibration, cupping, gua sha, manual pressure, or other
2727 17 methods, with or without the concurrent use of needles, to
2828 18 prevent or modify the perception of pain, to normalize
2929 19 physiological functions, or for the treatment of diseases or
3030 20 dysfunctions of the body and includes the determination of a
3131 21 care regimen or treatment protocol according to traditional
3232 22 East Asian principles and activities referenced in Section 15
3333 23 of this Act for which a written referral is not required. In

6868 1 accordance with this Section, the practice known as dry
6969 2 needling or intramuscular manual stimulation, or similar
7070 3 wording intended to describe such practice, is determined to
7171 4 be within the definition, scope, and practice of acupuncture.
7272 5 Acupuncture also includes evaluation or treatment in
7373 6 accordance with traditional and modern practices of East Asian
7474 7 medical theory, including, but not limited to, moxibustion,
7575 8 herbal medicinals, natural or dietary supplements, manual
7676 9 methods, exercise, and diet to prevent or modify the
7777 10 perception of pain, to normalize physiological functions, or
7878 11 for the treatment of diseases or dysfunctions of the body and
7979 12 includes activities referenced in Section 15 of this Act for
8080 13 which a written referral is not required. Acupuncture also
8181 14 includes ordering laboratory tests in accordance with State
8282 15 law to check, track, evaluate, and monitor the status and
8383 16 effectiveness of pain management, herbal medicinal plans,
8484 17 dietary and exercise plans, and orders as may be provided to
8585 18 the patient from a physician licensed under the Medical
8686 19 Practice Act. Acupuncture does not include radiology,
8787 20 electrosurgery, chiropractic technique, physical therapy,
8888 21 naprapathic technique, use or prescribing of any
8989 22 pharmaceuticals, or vaccines, or determination of a
9090 23 differential diagnosis. An acupuncturist licensed under this
9191 24 Act who is not also licensed as a physical therapist under the
9292 25 Illinois Physical Therapy Act shall not hold himself or
9393 26 herself out as being qualified to provide physical therapy or

104104 1 physiotherapy services.
105105 2 "Acupuncturist" means a person who practices acupuncture
106106 3 in all its forms, including traditional and modern practices
107107 4 in both teachings and delivery, and who is licensed by the
108108 5 Department. An acupuncturist shall refer to a licensed
109109 6 physician or dentist any patient whose condition should, at
110110 7 the time of evaluation or treatment, be determined to be
111111 8 beyond the scope of practice of the acupuncturist.
112112 9 "Address of record" means the designated address recorded
113113 10 by the Department in the applicant's or licensee's application
114114 11 file or license file as maintained by the Department's
115115 12 licensure maintenance unit.
116116 13 "Board" means the Board of Acupuncture appointed by the
117117 14 Secretary.
118118 15 "Dentist" means a person licensed under the Illinois
119119 16 Dental Practice Act.
120120 17 "Department" means the Department of Financial and
121121 18 Professional Regulation.
122122 19 "Email address of record" means the designated email
123123 20 address recorded by the Department in the applicant's
124124 21 application file or the licensee's license file as maintained
125125 22 by the Department's licensure maintenance unit.
126126 23 "Physician" means a person licensed under the Medical
127127 24 Practice Act of 1987.
128128 25 "Referral by written order" for purposes of this Act means
