Tracy Katz Muhl SYNOPSIS AS INTRODUCED: New Act625 ILCS 27/10815 ILCS 505/2HHHH new Creates the Rental Age Protection Act. Provides that it is unlawful for an automobile rental company to refuse to rent a motor vehicle to any person 18 years of age or older on the basis of age if insurance coverage for a person of that age is available. Provides that an automobile rental company may not charge a person any extra costs for insurance based solely on the age of the person renting the motor vehicle. Provides that it is unlawful for a lodging establishment to refuse to rent a room to any person 18 years of age or older on the basis of age or charge a person a higher rate than the regular rate charged to rent a room on the basis of age. Provides that a violation of any of the provisions of the Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Defines terms. Amends the Renter's Financial Responsibility and Protection Act to remove provisions concerning minimum age requirements. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change. 1313 1 AN ACT concerning business.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 1. Short title. This Act may be cited as the Rental
1717 5 Age Protection Act.
1818 6 Section 5. Definitions. As used in this Act:
1919 7 "Automobile rental company" means a person or entity whose
2020 8 primary business is renting motor vehicles to the public for
2121 9 30 days or less.
2222 10 "Lodging establishment" means any building or buildings
2323 11 maintained, advertised, and held out to the public to be a
2424 12 place where lodging is offered for consideration to travelers
2525 13 and guests. "Lodging establishment" includes hotels, inns,
2626 14 motels, tourist homes or courts, and lodging houses.
2727 15 "Motor vehicle" means a motor vehicle as defined in the
2828 16 Illinois Vehicle Code that a person with a Class D driver's
2929 17 license may operate.
3030 18 "Person" means a natural person, corporation, partnership,
3131 19 trust, or other entity, and in the case of an entity, it shall
3232 20 include any other entity in which it has a majority interest or
3333 21 which it effectively controls as well as the individual
3434 22 officers, directors, and other persons in active control of
3535 23 the activities of each such entity.

7474 1 Section 10. Automobile rental companies. It is unlawful
7575 2 for an automobile rental company to refuse to rent a motor
7676 3 vehicle to any person 18 years of age or older on the basis of
7777 4 age if insurance coverage for a person of that age is
7878 5 available. An automobile rental company may not charge a
7979 6 person any extra costs for insurance based solely on the age of
8080 7 the person renting the motor vehicle. Nothing in this Section
8181 8 prohibits an automobile rental company from requiring a person
8282 9 to provide documentation confirming the age of that person
8383 10 before entering into a rental agreement.
8484 11 Section 15. Lodging establishments. It is unlawful for a
8585 12 lodging establishment to refuse to rent a room to any person 18
8686 13 years of age or older on the basis of age or charge a person a
8787 14 higher rate than the regular rate charged to rent a room on the
8888 15 basis of age. Nothing in this Section prohibits a lodging
8989 16 establishment from requiring a person to provide documentation
9090 17 confirming the age of that person before entering into a
9191 18 rental agreement.
9292 19 Section 20. Enforcement by Attorney General. A violation
9393 20 of any of the provisions of this Act is an unlawful practice
9494 21 under the Consumer Fraud and Deceptive Business Practices Act.
9595 22 All remedies, penalties, and authority granted to the Attorney
9696 23 General by that Act shall be available to him or her for the

108108 2 Section 90. The Renter's Financial Responsibility and
109109 3 Protection Act is amended by changing Section 10 as follows:

111111 5 Sec. 10. Definitions. As used in this Act:
112112 6 "Rental Company" means a person or entity that rents
113113 7 private passenger vehicles to the public for 30 days or less.
114114 8 "Renter" means a person or entity that obtains the use of a
115115 9 private passenger vehicle from a rental company under terms of
116116 10 a rental agreement.
117117 11 "Rental Agreement" means an agreement for 30 days or less
118118 12 setting forth the terms and conditions governing the use of a
119119 13 private passenger vehicle provided by a rental company.
120120 14 "Authorized Driver" means: the renter; the renter's spouse
121121 15 if the spouse is a licensed driver and satisfies the rental
122122 16 company's minimum age requirement; the renter's employer,
123123 17 employee, or co-worker if that person is a licensed driver,
124124 18 satisfies the rental company's minimum age requirement, and at
125125 19 the time of the rental is engaged in a business activity with
126126 20 the renter; any person who is expressly listed by the rental
127127 21 company on the rental agreement as an authorized driver; and
128128 22 any person driving directly to a medical or police facility
129129 23 under circumstances reasonably believed to constitute an
130130 24 emergency and who is a licensed driver.

141141 1 "Damage Waiver" means a rental company's agreement not to
142142 2 hold an authorized driver liable for all or a part of any
143143 3 damage to or loss of a rented vehicle for which the renter may
144144 4 be liable pursuant to Section 6-305.2. "Damage Waiver" shall
145145 5 encompass within its meaning other similar terms used by
146146 6 rental companies, such as "Collision Damage Waiver", "Loss
147147 7 Damage Waiver", "Physical Damage Waiver", and the like.
