The Mental Health Early Action on Campus Act is 5 amended by changing Sections 30 and 40 as follows: 6 (110 ILCS 58/30) 7 Sec. 30. Training. 8 (a) The board of trustees of each public college or 9 university must designate an expert panel to develop and 10 implement policies and procedures that (i) advise students, 11 faculty, and staff on the proper procedures for identifying 12 and addressing the needs of students exhibiting symptoms of 13 mental health conditions, (ii) promote understanding of the 14 rules of Section 504 of the federal Rehabilitation Act of 1973 15 and the federal Americans with Disabilities Act of 1990 to 16 increase knowledge and understanding of student protections 17 under the law, and (iii) provide training if appropriate. 18 The expert panel shall be comprised of at least 2 19 administrators, 2 members of faculty, and one mental health 20 professional. 21 (b) The Technical Assistance Center under Section 45 shall 22 set initial standards for policies and procedures referenced 23 in subsection (a) to ensure statewide consistency. 104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 HB3385 Introduced , by Rep. Training must include the 6 policies and procedures developed by the public college or 7 university referenced under subsection (a). 8 (Source: P.A. 101-251, eff. 7-1-20.) 9 (110 ILCS 58/40) 10 Sec. 40. Local partnerships. 11 (a) Each public college or university must form strategic 12 partnerships with local mental health service providers to 13 improve overall campus mental wellness and augment on-campus 14 capacity. The strategic partnerships must include linkage 15 agreements with off-campus mental health service providers 16 that establish a foundation for referrals for students when 17 needs cannot be met on campus due to capacity or preference of 18 the student. The strategic partnerships must also include (i) 19 avenues for on-campus and off-campus mental health service 20 providers to increase visibility to students via marketing and 21 outreach, (ii) opportunities to engage the student body 22 through student outreach initiatives like mindfulness 23 workshops or campus-wide wellness fairs, and (iii) 24 opportunities to support awareness and training requirements 25 under this Act. HB3385 - 2 - LRB104 09964 LNS 20034 b HB3385- 3 -LRB104 09964 LNS 20034 b HB3385 - 3 - LRB104 09964 LNS 20034 b HB3385 - 3 - LRB104 09964 LNS 20034 b 1 (b) Through a combination of on-campus capacity, 2 off-campus linkage agreements with mental health service 3 providers, and contracted telehealth therapy services, each 4 public college or university shall attempt to meet a benchmark 5 ratio of one clinical, non-student staff member to 1,250 6 students. However, each public college or university shall 7 provide at least 3 on-site licensed clinical professional 8 counselors or licensed clinical social workers or less than 3 9 if the benchmark ratio falls under 3. These professionals must 10 be available on weekdays from 10 a.m. to 6 p.m. excluding 11 holidays. If linkage agreements are used, the agreements must 12 include the capacity of students providers are expected to 13 serve within the agency. Two years after the effective date of 14 this Act, and once every 5 years thereafter, the Technical 15 Assistance Center developed under Section 45 must propose to 16 the General Assembly an updated ratio based on actual ratios 17 in this State and any new information related to appropriate 18 benchmarks for clinician-to-student ratios.
