1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by
1515 5 changing Section 6-110 as follows:

1717 7 Sec. 6-110. Licenses issued to drivers.
1818 8 (a) The Secretary of State shall issue to every qualifying
1919 9 applicant a driver's license as applied for, which license
2020 10 shall bear a distinguishing number assigned to the licensee,
2121 11 the legal name, signature, zip code, date of birth, residence
2222 12 address, the Firearm Owners Identification or Concealed Carry
2323 13 license number, if applicable, and a brief description of the
2424 14 licensee.
2525 15 Licenses issued shall also indicate the classification and
2626 16 the restrictions under Section 6-104 of this Code. The
2727 17 Secretary may adopt rules to establish informational
2828 18 restrictions that can be placed on the driver's license
2929 19 regarding specific conditions of the licensee.
3030 20 A driver's license issued may, in the discretion of the
3131 21 Secretary, include a suitable photograph of a type prescribed
3232 22 by the Secretary.
3333 23 (a-1) If the licensee is less than 18 years of age, unless

6868 1 one of the exceptions in subsection (a-2) apply, the license
6969 2 shall, as a matter of law, be invalid for the operation of any
7070 3 motor vehicle during the following times:
7171 4 (A) Between 11:00 p.m. Friday and 6:00 a.m. Saturday;
7272 5 (B) Between 11:00 p.m. Saturday and 6:00 a.m. on
7373 6 Sunday; and
7474 7 (C) Between 10:00 p.m. on Sunday to Thursday,
7575 8 inclusive, and 6:00 a.m. on the following day.
7676 9 (a-2) The driver's license of a person under the age of 18
7777 10 shall not be invalid as described in subsection (a-1) of this
7878 11 Section if the licensee under the age of 18 was:
7979 12 (1) accompanied by the licensee's parent or guardian
8080 13 or other person in custody or control of the minor;
8181 14 (2) on an errand at the direction of the minor's
8282 15 parent or guardian, without any detour or stop;
8383 16 (3) in a motor vehicle involved in interstate travel;
8484 17 (4) going to or returning home from an employment
8585 18 activity, without any detour or stop;
8686 19 (5) involved in an emergency;
8787 20 (6) going to or returning home from, without any
8888 21 detour or stop, an official school, religious, or other
8989 22 recreational activity supervised by adults and sponsored
9090 23 by a government or governmental agency, a civic
9191 24 organization, or another similar entity that takes
9292 25 responsibility for the licensee, without any detour or

104104 1 (7) exercising First Amendment rights protected by the
105105 2 United States Constitution, such as the free exercise of
106106 3 religion, freedom of speech, and the right of assembly; or
107107 4 (8) married or had been married or is an emancipated
108108 5 minor under the Emancipation of Minors Act.
109109 6 (a-2.5) The driver's license of a person who is 17 years of
110110 7 age and has been licensed for at least 12 months is not invalid
111111 8 as described in subsection (a-1) of this Section while the
112112 9 licensee is participating as an assigned driver in a Safe
113113 10 Rides program that meets the following criteria:
114114 11 (1) the program is sponsored by the Boy Scouts of
115115 12 America or another national public service organization;
116116 13 and
117117 14 (2) the sponsoring organization carries liability
118118 15 insurance covering the program.
119119 16 (a-3) If a graduated driver's license holder over the age
120120 17 of 18 committed an offense against traffic regulations
121121 18 governing the movement of vehicles or any violation of Section
122122 19 6-107 or Section 12-603.1 of this Code in the 6 months prior to
123123 20 the graduated driver's license holder's 18th birthday, and was
124124 21 subsequently convicted of the offense, the provisions of
125125 22 subsection (a-1) shall continue to apply until such time as a
126126 23 period of 6 consecutive months has elapsed without an
127127 24 additional violation and subsequent conviction of an offense
128128 25 against traffic regulations governing the movement of vehicles
129129 26 or Section 6-107 or Section 12-603.1 of this Code.

140140 1 (a-4) If an applicant for a driver's license or
141141 2 instruction permit has a current identification card issued by
142142 3 the Secretary of State, the Secretary may require the
143143 4 applicant to utilize the same residence address and name on
144144 5 the identification card, driver's license, and instruction
145145 6 permit records maintained by the Secretary. The Secretary may
146146 7 promulgate rules to implement this provision.
147147 8 (a-5) If an applicant for a driver's license is an
148148 9 employee of the Department of Children and Family Services
149149 10 with a job title of "Child Protection Specialist Trainee",
150150 11 "Child Protection Specialist", "Child Protection Advanced
151151 12 Specialist", "Child Welfare Specialist Trainee", "Child
152152 13 Welfare Specialist", or "Child Welfare Advanced Specialist" or
153153 14 a judicial officer or a peace officer, the applicant may elect
154154 15 to have his or her office or work address listed on the license
155155 16 instead of the applicant's residence or mailing address. The
156156 17 Secretary of State shall adopt rules to implement this
157157 18 subsection (a-5). For the purposes of this subsection (a-5),
158158 19 "peace officer" means any person who by virtue of his or her
159159 20 office or public employment is vested by law with a duty to
160160 21 maintain public order or to make arrests for a violation of any
161161 22 penal statute of this State, whether that duty extends to all
162162 23 violations or is limited to specific violations.
163163 24 (b) Until the Secretary of State establishes a First
164164 25 Person Consent organ and tissue donor registry under Section
165165 26 6-117 of this Code, the Secretary of State shall provide a

176176 1 format on the reverse of each driver's license issued which
177177 2 the licensee may use to execute a document of gift conforming
178178 3 to the provisions of the Illinois Anatomical Gift Act. The
179179 4 format shall allow the licensee to indicate the gift intended,
180180 5 whether specific organs, any organ, or the entire body, and
181181 6 shall accommodate the signatures of the donor and 2 witnesses.
182182 7 The Secretary shall also inform each applicant or licensee of
183183 8 this format, describe the procedure for its execution, and may
184184 9 offer the necessary witnesses; provided that in so doing, the
185185 10 Secretary shall advise the applicant or licensee that he or
186186 11 she is under no compulsion to execute a document of gift. A
187187 12 brochure explaining this method of executing an anatomical
188188 13 gift document shall be given to each applicant or licensee.
189189 14 The brochure shall advise the applicant or licensee that he or
190190 15 she is under no compulsion to execute a document of gift, and
191191 16 that he or she may wish to consult with family, friends, or
192192 17 clergy before doing so. The Secretary of State may undertake
193193 18 additional efforts, including education and awareness
194194 19 activities, to promote organ and tissue donation.
195195 20 (c) The Secretary of State shall designate on each
196196 21 driver's license issued a space where the licensee may place a
197197 22 sticker or decal of the uniform size as the Secretary may
198198 23 specify, which sticker or decal may indicate in appropriate
199199 24 language that the owner of the license carries an Emergency
200200 25 Medical Information Card.
201201 26 The sticker may be provided by any person, hospital,

212212 1 school, medical group, or association interested in assisting
213213 2 in implementing the Emergency Medical Information Card, but
214214 3 shall meet the specifications as the Secretary may by rule or
215215 4 regulation require.
216216 5 (d) The Secretary of State shall designate on each
217217 6 driver's license issued a space where the licensee may
218218 7 indicate his blood type and RH factor.
219219 8 (e) The Secretary of State shall provide that each
220220 9 original or renewal driver's license issued to a licensee
221221 10 under 21 years of age shall be of a distinct nature from those
222222 11 driver's licenses issued to individuals 21 years of age and
223223 12 older. The color designated for driver's licenses for
224224 13 licensees under 21 years of age shall be at the discretion of
225225 14 the Secretary of State.
226226 15 (e-1) The Secretary shall provide that each driver's
227227 16 license issued to a person under the age of 21 displays the
228228 17 date upon which the person becomes 18 years of age and the date
229229 18 upon which the person becomes 21 years of age.
230230 19 (e-3) The General Assembly recognizes the need to identify
231231 20 military veterans living in this State for the purpose of
232232 21 ensuring that they receive all of the services and benefits to
233233 22 which they are legally entitled, including health care
234234 23 healthcare, education assistance, and job placement. To assist
235235 24 the State in identifying these veterans and delivering these
236236 25 vital services and benefits, the Secretary of State is
237237 26 authorized to issue drivers' licenses with the word "veteran"

248248 1 appearing on the face of the licenses. This authorization is
249249 2 predicated on the unique status of veterans. The Secretary may
250250 3 not issue any other driver's license which identifies an
251251 4 occupation, status, affiliation, hobby, or other unique
252252 5 characteristics of the license holder which is unrelated to
253253 6 the purpose of the driver's license.
254254 7 (e-5) Beginning on or before July 1, 2015, the Secretary
255255 8 of State shall designate a space on each original or renewal
256256 9 driver's license where, at the request of the applicant, the
257257 10 word "veteran" shall be placed. The veteran designation shall
258258 11 be available to a person identified as a veteran under
259259 12 subsection (e) of Section 6-106 of this Code who was
260260 13 discharged or separated under honorable conditions.
261261 14 (e-7) Upon providing the required documentation, at the
262262 15 request of the applicant, the driver's license may reflect
263263 16 Gold Star Family designation. The Secretary shall designate a
264264 17 space on each original or renewal driver's license for such
265265 18 designation. This designation shall be available to a person
266266 19 eligible for Gold Star license plates under subsection (f) of
267267 20 Section 6-106 of this Code.
268268 21 (f) The Secretary of State shall inform all Illinois
269269 22 licensed commercial motor vehicle operators of the
270270 23 requirements of the Uniform Commercial Driver License Act,
271271 24 Article V of this Chapter, and shall make provisions to insure
272272 25 that all drivers, seeking to obtain a commercial driver's
273273 26 license, be afforded an opportunity prior to April 1, 1992, to

284284 1 obtain the license. The Secretary is authorized to extend
285285 2 driver's license expiration dates, and assign specific times,
286286 3 dates and locations where these commercial driver's tests
287287 4 shall be conducted. Any applicant, regardless of the current
288288 5 expiration date of the applicant's driver's license, may be
289289 6 subject to any assignment by the Secretary. Failure to comply
290290 7 with the Secretary's assignment may result in the applicant's
291291 8 forfeiture of an opportunity to receive a commercial driver's
292292 9 license prior to April 1, 1992.
293293 10 (g) The Secretary of State shall designate on a driver's
294294 11 license issued, a space where the licensee may indicate that
295295 12 he or she has drafted a living will in accordance with the
296296 13 Illinois Living Will Act or a durable power of attorney for
297297 14 health care in accordance with the Illinois Power of Attorney
298298 15 Act.
299299 16 (g-1) The Secretary of State, in his or her discretion,
300300 17 may designate on each driver's license issued a space where
301301 18 the licensee may place a sticker or decal, issued by the
302302 19 Secretary of State, of uniform size as the Secretary may
303303 20 specify, that shall indicate in appropriate language that the
304304 21 owner of the license has renewed his or her driver's license.
305305 22 (h) A person who acts in good faith in accordance with the
306306 23 terms of this Section is not liable for damages in any civil
307307 24 action or subject to prosecution in any criminal proceeding
308308 25 for his or her act.
309309 26 (i) The Secretary shall designate a space on each original
