22 | 22 | | 12 practice of dentistry in the State of Illinois is hereby |

23 | 23 | | 13 declared to affect the public health, safety and welfare and |

24 | 24 | | 14 to be subject to regulation and control in the public |
---|
25 | 25 | | 15 interest. It is further declared to be a matter of public |
---|
26 | 26 | | 16 interest and concern that the dental profession merit and |

27 | 27 | | 17 receive the confidence of the public and that only qualified |

28 | 28 | | 18 persons be permitted to practice dentistry in the State of |

---|
83 | 83 | | 16 "Address of record" means the designated address recorded |

113 | 113 | | 11 "Dental therapist" means a person licensed to practice |
---|
114 | 114 | | 12 dental therapy as described in Section 14.6. |
---|
115 | 115 | | 13 "Dental therapy" means the provision of services described |
---|
116 | 116 | | 14 in Section 14.6 and any related services or procedures |
---|
117 | 117 | | 15 required in the performance of those services. |
---|
118 | 118 | | 16 "Dental therapist supervision" means the supervision of a |
---|
119 | 119 | | 17 dental therapist by a licensed dentist who has a written |
---|
120 | 120 | | 18 collaborative management agreement with the dental therapist |
---|
121 | 121 | | 19 that allows the dental therapist to treat patients in any |
---|
122 | 122 | | 20 setting outlined by the written collaborative management |
---|
123 | 123 | | 21 agreement without a dentist first examining the patient or |
---|
124 | 124 | | 22 being present in the facility during treatment. |
---|
125 | 125 | | 23 "Dental assistant" means an appropriately trained person |
---|
126 | 126 | | 24 who, under the supervision of a dentist, provides dental |
---|
127 | 127 | | 25 services as authorized by Section 17. |
---|
128 | 128 | | 26 "Expanded function dental assistant" means a dental |

148 | 148 | | 10 (ii) utilizes or employs a dental technician to |
---|
149 | 149 | | 11 provide such services; and |
---|
150 | 150 | | 12 (iii) performs such functions only for a dentist or |
---|
151 | 151 | | 13 dentists. |
---|
152 | 152 | | 14 "Supervision" means supervision of a dental hygienist, or |
---|
153 | 153 | | 15 a dental assistant, or a dental therapist requiring that a |
---|
154 | 154 | | 16 dentist authorize the procedure, remain in the dental facility |
---|
155 | 155 | | 17 while the procedure is performed, and approve the work |
---|
156 | 156 | | 18 performed by the dental hygienist, or dental assistant, or |
---|
157 | 157 | | 19 dental therapist before dismissal of the patient, but does not |
---|
158 | 158 | | 20 mean that the dentist must be present at all times in the |
---|
159 | 159 | | 21 treatment room. |
---|
160 | 160 | | 22 "General supervision" means supervision of a dental |
---|
161 | 161 | | 23 hygienist or dental therapist requiring that the patient be a |
---|
162 | 162 | | 24 patient of record, that the dentist examine the patient in |
---|
163 | 163 | | 25 accordance with Section 18 prior to treatment by the dental |
---|
164 | 164 | | 26 hygienist or dental therapist, and that the dentist authorize |
---|

185 | 185 | | 11 collaborative management agreement, requiring (i) that the |
---|
186 | 186 | | 12 patient be a patient of record, (ii) that the dentist examines |
---|
187 | 187 | | 13 the patient in accordance with Section 18.5 prior to treatment |
---|
188 | 188 | | 14 by the dental therapist, and (iii) that the dentist authorize |
---|
189 | 189 | | 15 the procedures to be carried out by a notation in the patient's |
---|
190 | 190 | | 16 record. After the probationary dental therapist supervision |
---|
191 | 191 | | 17 period, the dental therapist may work under dental therapist |
---|
192 | 192 | | 18 supervision. |
---|
193 | 193 | | 19 "Public member" means a person who is not a health |
---|
194 | 194 | | 20 professional. For purposes of board membership, any person |
---|
195 | 195 | | 21 with a significant financial interest in a health service or |
---|
196 | 196 | | 22 profession is not a public member. |
---|
197 | 197 | | 23 "Dentistry" means the healing art which is concerned with |
---|
198 | 198 | | 24 the examination, diagnosis, treatment planning, and care of |

220 | 220 | | 10 is employed by a dental laboratory and engages in making, |
---|
221 | 221 | | 11 providing, repairing, or altering dental prosthetic appliances |

222 | 222 | | 12 and other artificial materials and devices which are returned |
---|
223 | 223 | | 13 to a dentist for insertion into the human oral cavity or which |
---|
224 | 224 | | 14 come in contact with its adjacent structures and tissues. |
---|
225 | 225 | | 15 "Informed consent" means legally valid consent that is |
---|
226 | 226 | | 16 given by a patient or legal guardian, that is recorded in |
---|
227 | 227 | | 17 writing or digitally, that authorizes intervention or |
---|
228 | 228 | | 18 treatment services from the treating dentist, and that |
---|
229 | 229 | | 19 documents agreement to participate in those services and |
---|
230 | 230 | | 20 knowledge of the risks, benefits, and alternatives, including |
---|
231 | 231 | | 21 the decision to withdraw from or decline treatment. |

232 | 232 | | 22 "Impaired dentist", "impaired dental therapist", or |
---|
233 | 233 | | 23 "impaired dental hygienist" means a dentist, dental therapist, |

293 | 293 | | 11 center; a federal, State, or local public health facility; |

294 | 294 | | 12 Head Start; a special supplemental nutrition program for |
---|
295 | 295 | | 13 Women, Infants, and Children (WIC) facility; a certified |
---|
296 | 296 | | 14 school-based health center or school-based oral health |
---|
297 | 297 | | 15 program; a prison; or a long-term care facility. |
---|
298 | 298 | | 16 "Public health supervision" means the supervision of a |
---|
299 | 299 | | 17 public health dental hygienist by a licensed dentist who has a |
---|
300 | 300 | | 18 written public health supervision agreement with that public |
---|
301 | 301 | | 19 health dental hygienist while working in an approved facility |
---|
302 | 302 | | 20 or program that allows the public health dental hygienist to |
---|
303 | 303 | | 21 treat patients, without a dentist first examining the patient |
---|
304 | 304 | | 22 and being present in the facility during treatment, (1) who |
---|
305 | 305 | | 23 are eligible for Medicaid or (2) who are uninsured or whose |
---|
306 | 306 | | 24 household income is not greater than 300% of the federal |
---|

861 | 861 | | 13 hygiene, and dental therapy and nonclinical courses such as |
---|
862 | 862 | | 14 patient management, legal and ethical responsibilities, and |
---|
863 | 863 | | 15 stress management. The Department shall allow up to 4 hours of |
---|
864 | 864 | | 16 continuing education credit hours per license renewal period |
---|
865 | 865 | | 17 for volunteer hours spent providing clinical services at, or |
---|
866 | 866 | | 18 sponsored by, a nonprofit community clinic, local or state |
---|
867 | 867 | | 19 health department, or a charity event. Courses shall not be |
---|
868 | 868 | | 20 approved in such subjects as estate and personal financial |
---|
869 | 869 | | 21 planning, personal investments, or personal health. Approved |
---|
870 | 870 | | 22 courses may include, but shall not be limited to, courses that |

871 | 871 | | 23 are offered or sponsored by approved colleges, universities, |

900 | 900 | | 16 conduct random audits of more than 10% of the licensed |
---|
901 | 901 | | 17 dentists, and dental hygienists, and dental therapists in any |
---|
902 | 902 | | 18 one licensing cycle to verify compliance with continuing |
---|
903 | 903 | | 19 education requirements. If the Department, however, receives a |
---|
904 | 904 | | 20 complaint that a licensee has not completed the required |

---|
1005 | 1005 | | 14 purchasing these materials; or (iii) provides appropriate |
---|
1006 | 1006 | | 15 equipment on-site to the consumer for the consumer to |
---|
1007 | 1007 | | 16 self-apply teeth whitening materials. |
---|
1008 | 1008 | | 17 The fact that any person engages in or performs, or offers |
---|
1009 | 1009 | | 18 to engage in or perform, any of the practices, acts, or |
---|
1010 | 1010 | | 19 operations set forth in this Section, shall be prima facie |
---|
1011 | 1011 | | 20 evidence that such person is engaged in the practice of |
---|
1012 | 1012 | | 21 dentistry. |
---|
1013 | 1013 | | 22 The following practices, acts, and operations, however, |
---|
1014 | 1014 | | 23 are exempt from the operation of this Act: |
