1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Dental Practice Act is amended by
1515 5 changing Sections 2, 4, 5, 8.5, 12.5, 13.05, 13.15, 15.5, 16,
1616 6 16.1, 17, 18.5, 19, 19.1, 20, 21, 23, 24, 25, 25.1, 26, 34, 36,
1717 7 37, 38.1, 51, 54.2, 54.3, and 55 and by adding Sections 7.7,
1818 8 14.5, and 14.6 as follows:

2020 10 (Section scheduled to be repealed on January 1, 2026)
2121 11 Sec. 2. Legislative declaration of public policy. The
2222 12 practice of dentistry in the State of Illinois is hereby
2323 13 declared to affect the public health, safety and welfare and
2424 14 to be subject to regulation and control in the public
2525 15 interest. It is further declared to be a matter of public
2626 16 interest and concern that the dental profession merit and
2727 17 receive the confidence of the public and that only qualified
2828 18 persons be permitted to practice dentistry in the State of
2929 19 Illinois. Despite the authority granted under this Act
3030 20 allowing dentists to delegate the performance of certain
3131 21 procedures to dental therapists, dental hygienists, and dental
3232 22 assistants, nothing contained in this Act shall be construed
3333 23 in any way to relieve the supervising dentist from ultimate

6868 1 responsibility for the care of his or her patient. This Act
6969 2 shall be liberally construed to carry out these objects and

7171 4 It is further declared to be the public policy of this
7272 5 State, pursuant to subsections (h) and (i) of Section 6 of
7373 6 Article VII of the Illinois Constitution of 1970, that any
7474 7 power or function set forth in this Act to be exercised by the
7575 8 State is an exclusive State power or function. Such power or
7676 9 function shall not be exercised concurrently, either directly
7777 10 or indirectly, by any unit of local government, including home
7878 11 rule units, except as otherwise provided in this Act.

8282 15 Sec. 4. Definitions. As used in this Act:
8383 16 "Address of record" means the designated address recorded
8484 17 by the Department in the applicant's or licensee's application
8585 18 file or license file as maintained by the Department's
8686 19 licensure maintenance unit. It is the duty of the applicant or
8787 20 licensee to inform the Department of any change of address and
8888 21 those changes must be made either through the Department's
8989 22 website or by contacting the Department.
9090 23 "Department" means the Department of Financial and

104104 2 "Board" means the Board of Dentistry.
105105 3 "Dentist" means a person who has received a general
106106 4 license pursuant to subsection paragraph (a) of Section 11 of
107107 5 this Act and who may perform any intraoral and extraoral
108108 6 procedure required in the practice of dentistry and to whom is
109109 7 reserved the responsibilities specified in Section 17.
110110 8 "Dental hygienist" means a person who holds a license
111111 9 under this Act to perform dental services as authorized by
112112 10 Section 18.
113113 11 "Dental therapist" means a person licensed to practice
114114 12 dental therapy as described in Section 14.6.
115115 13 "Dental therapy" means the provision of services described
116116 14 in Section 14.6 and any related services or procedures
117117 15 required in the performance of those services.
118118 16 "Dental therapist supervision" means the supervision of a
119119 17 dental therapist by a licensed dentist who has a written
120120 18 collaborative management agreement with the dental therapist
121121 19 that allows the dental therapist to treat patients in any
122122 20 setting outlined by the written collaborative management
123123 21 agreement without a dentist first examining the patient or
124124 22 being present in the facility during treatment.
125125 23 "Dental assistant" means an appropriately trained person
126126 24 who, under the supervision of a dentist, provides dental
127127 25 services as authorized by Section 17.
128128 26 "Expanded function dental assistant" means a dental

139139 1 assistant who has completed the training required by Section
140140 2 17.1 of this Act.
141141 3 "Dental laboratory" means a person, firm, or corporation
142142 4 which:
143143 5 (i) engages in making, providing, repairing, or
144144 6 altering dental prosthetic appliances and other artificial
145145 7 materials and devices which are returned to a dentist for
146146 8 insertion into the human oral cavity or which come in
147147 9 contact with its adjacent structures and tissues; and
148148 10 (ii) utilizes or employs a dental technician to
149149 11 provide such services; and
150150 12 (iii) performs such functions only for a dentist or
151151 13 dentists.
152152 14 "Supervision" means supervision of a dental hygienist, or
153153 15 a dental assistant, or a dental therapist requiring that a
154154 16 dentist authorize the procedure, remain in the dental facility
155155 17 while the procedure is performed, and approve the work
156156 18 performed by the dental hygienist, or dental assistant, or
157157 19 dental therapist before dismissal of the patient, but does not
158158 20 mean that the dentist must be present at all times in the
159159 21 treatment room.
160160 22 "General supervision" means supervision of a dental
161161 23 hygienist or dental therapist requiring that the patient be a
162162 24 patient of record, that the dentist examine the patient in
163163 25 accordance with Section 18 prior to treatment by the dental
164164 26 hygienist or dental therapist, and that the dentist authorize

175175 1 the procedures which are being carried out by a notation in the
176176 2 patient's record, but not requiring that a dentist be present
177177 3 when the authorized procedures are being performed. The
178178 4 issuance of a prescription to a dental laboratory by a dentist
179179 5 does not constitute general supervision.
180180 6 "Probationary dental therapist supervision" means
181181 7 supervision of a dental therapist by the supervising
182182 8 collaborative dentist, during the dental therapist's
183183 9 probationary supervision period, as determined by the
184184 10 supervising collaborative dentist and outlined by the written
185185 11 collaborative management agreement, requiring (i) that the
186186 12 patient be a patient of record, (ii) that the dentist examines
187187 13 the patient in accordance with Section 18.5 prior to treatment
188188 14 by the dental therapist, and (iii) that the dentist authorize
189189 15 the procedures to be carried out by a notation in the patient's
190190 16 record. After the probationary dental therapist supervision
191191 17 period, the dental therapist may work under dental therapist
192192 18 supervision.
193193 19 "Public member" means a person who is not a health
194194 20 professional. For purposes of board membership, any person
195195 21 with a significant financial interest in a health service or
196196 22 profession is not a public member.
197197 23 "Dentistry" means the healing art which is concerned with
198198 24 the examination, diagnosis, treatment planning, and care of
199199 25 conditions within the human oral cavity and its adjacent
200200 26 tissues and structures, as further specified in Section 17.

211211 1 "Branches of dentistry" means the various specialties of
212212 2 dentistry which, for purposes of this Act, shall be limited to
213213 3 the following: endodontics, oral and maxillofacial surgery,
214214 4 orthodontics and dentofacial orthopedics, pediatric dentistry,
215215 5 periodontics, prosthodontics, oral and maxillofacial
216216 6 radiology, and dental anesthesiology.
217217 7 "Specialist" means a dentist who has received a specialty
218218 8 license pursuant to subsection (b) of Section 11 11(b).
219219 9 "Dental technician" means a person who owns, operates, or
220220 10 is employed by a dental laboratory and engages in making,
221221 11 providing, repairing, or altering dental prosthetic appliances
222222 12 and other artificial materials and devices which are returned
223223 13 to a dentist for insertion into the human oral cavity or which
224224 14 come in contact with its adjacent structures and tissues.
225225 15 "Informed consent" means legally valid consent that is
226226 16 given by a patient or legal guardian, that is recorded in
227227 17 writing or digitally, that authorizes intervention or
228228 18 treatment services from the treating dentist, and that
229229 19 documents agreement to participate in those services and
230230 20 knowledge of the risks, benefits, and alternatives, including
231231 21 the decision to withdraw from or decline treatment.
232232 22 "Impaired dentist", "impaired dental therapist", or
233233 23 "impaired dental hygienist" means a dentist, dental therapist,
234234 24 or dental hygienist who is unable to practice with reasonable
235235 25 skill and safety because of a physical or mental disability as

248248 2 aging process, loss of motor skills, abuse of drugs or
249249 3 alcohol, or a psychiatric disorder, of sufficient degree to
250250 4 diminish the person's ability to deliver competent patient
251251 5 care.
252252 6 "Nurse" means a registered professional nurse, a certified
253253 7 registered nurse anesthetist licensed as an advanced practice
254254 8 registered nurse, or a licensed practical nurse licensed under
255255 9 the Nurse Practice Act.
256256 10 "Patient of record", except as provided in Section 17.2,
257257 11 means a patient for whom the patient's most recent dentist,
258258 12 dental therapist, or public health dental hygienist has
259259 13 obtained a relevant medical and dental history and on whom the
260260 14 dentist, dental therapist, or public health dental hygienist
261261 15 has performed a physical examination within the last year and
262262 16 evaluated the condition to be treated, including a review of
263263 17 the patient's most recent x-rays.
264264 18 "Dental responder" means a dentist, dental therapist, or
265265 19 dental hygienist who is appropriately certified in disaster
266266 20 preparedness, immunizations, and dental humanitarian medical
267267 21 response consistent with the Society of Disaster Medicine and
268268 22 Public Health and training certified by the National Incident
269269 23 Management System or the National Disaster Life Support
270270 24 Foundation.
271271 25 "Mobile dental van or portable dental unit" means any
272272 26 self-contained or portable dental unit in which dentistry is

283283 1 practiced that can be moved, towed, or transported from one
284284 2 location to another in order to establish a location where
285285 3 dental services can be provided.
286286 4 "Public health dental hygienist" means a hygienist who
287287 5 holds a valid license to practice in the State, has 2 years of
288288 6 full-time clinical experience or an equivalent of 4,000 hours
289289 7 of clinical experience, and has completed at least 42 clock
290290 8 hours of additional structured courses in dental education in
291291 9 advanced areas specific to public health dentistry.
292292 10 "Public health setting" means a federally qualified health
293293 11 center; a federal, State, or local public health facility;
294294 12 Head Start; a special supplemental nutrition program for
295295 13 Women, Infants, and Children (WIC) facility; a certified
296296 14 school-based health center or school-based oral health
297297 15 program; a prison; or a long-term care facility.
298298 16 "Public health supervision" means the supervision of a
299299 17 public health dental hygienist by a licensed dentist who has a
300300 18 written public health supervision agreement with that public
301301 19 health dental hygienist while working in an approved facility
302302 20 or program that allows the public health dental hygienist to
303303 21 treat patients, without a dentist first examining the patient
304304 22 and being present in the facility during treatment, (1) who
305305 23 are eligible for Medicaid or (2) who are uninsured or whose
306306 24 household income is not greater than 300% of the federal
307307 25 poverty level.
308308 26 "Teledentistry" means the use of telehealth systems and

324324 6 "Moderate sedation" means a drug-induced depression of
325325 7 consciousness during which: (1) patients respond purposefully
326326 8 to verbal commands, either alone or accompanied by light
327327 9 tactile stimulation; (2) no interventions are required to
328328 10 maintain a patient's airway and spontaneous ventilation is
329329 11 adequate; and (3) cardiovascular function is usually
330330 12 maintained.
331331 13 "Deep sedation" means a drug-induced depression of
332332 14 consciousness during which: (1) patients cannot be easily
333333 15 aroused, but respond purposefully following repeated or
334334 16 painful stimulation; (2) the ability to independently maintain
335335 17 ventilatory function may be impaired; (3) patients may require
336336 18 assistance in maintaining airways and spontaneous ventilation
337337 19 may be inadequate; and (4) cardiovascular function is usually
338338 20 maintained.
339339 21 "General anesthesia" means a drug-induced loss of
340340 22 consciousness during which: (1) patients are not arousable,
341341 23 even by painful stimulation; (2) the ability to independently
342342 24 maintain ventilatory function is often impaired; (3) patients
343343 25 often require assistance in maintaining airways and positive
344344 26 pressure ventilation may be required because of depressed

368368 14 submucosal, subcutaneous, or intraosseous methods.

375375 21 Sec. 5. Powers and duties of Department. Subject to the
376376 22 provisions of this Act, the Department shall exercise the

391391 2 upon the qualifications of applicants for licenses, and issue
392392 3 licenses to such as are found to be fit and qualified.
393393 4 (b) Prescribe rules and regulations for a method of
394394 5 examination of candidates.
395395 6 (c) Prescribe rules and regulations defining what shall
396396 7 constitute an approved program, school, college or department
397397 8 of a university except that no program, school, college or
398398 9 department of a university that refuses admittance to
399399 10 applicants solely on account of race, color, creed, sex or
400400 11 national origin shall be approved.
401401 12 (d) Conduct hearings on proceedings to revoke, suspend, or
402402 13 on objection to the issuance of licenses and to revoke,
403403 14 suspend or refuse to issue such licenses.
404404 15 (e) Promulgate rules and regulations required for the
405405 16 administration of this Act.
406406 17 (f) The Department may require completion of a census by
407407 18 all licensed dentists in order to obtain relevant information
408408 19 regarding the availability of dental services within the
409409 20 State.

413413 24 Sec. 8.5. Unlicensed practice; violation; civil penalty.
414414 25 (a) Any person who practices, offers to practice, attempts

425425 1 to practice, or holds oneself out to practice dentistry,
426426 2 dental therapy, or dental hygiene without being licensed under
427427 3 this Act shall, in addition to any other penalty provided by
428428 4 law, pay a civil penalty to the Department in an amount not to
429429 5 exceed $10,000 for each offense as determined by the
430430 6 Department. The civil penalty shall be assessed by the
431431 7 Department after a hearing is held in accordance with the
432432 8 provisions set forth in this Act regarding the provision of a
433433 9 hearing for the discipline of a licensee.
434434 10 (b) The Department has the authority and power to
435435 11 investigate any and all unlicensed activity.
436436 12 (c) The civil penalty shall be paid within 60 days after
437437 13 the effective date of the order imposing the civil penalty.
438438 14 The order shall constitute a judgment and may be filed and
439439 15 execution had thereon in the same manner as any judgment from
440440 16 any court of record.

443443 19 Sec. 12.5. Necessity for licensure of dental therapists.
444444 20 No person, unless the person is a dentist, shall perform the
445445 21 operative procedures of dental therapy without first applying
446446 22 for and obtaining a license for such purpose. The Department
447447 23 shall issue a license authorizing practice as a dental
448448 24 therapist to any person who qualifies for such license

464464 5 Sec. 13.05. Qualifications of applicants for dental
465465 6 therapy licenses.
466466 7 (a) Every person who desires to obtain a license as a
467467 8 dental therapist shall apply to the Department in writing,
468468 9 upon forms prepared and furnished by the Department. Each
469469 10 application shall contain proof of the particular
470470 11 qualifications required of the applicant, shall be verified by
471471 12 the applicant under oath, and shall be accompanied by the
472472 13 required examination fee.

474474 15 a license as a dental therapist meets the following criteria:
475475 16 (1) be at least 21 years of age and have good moral
476476 17 character;
477477 18 (2) present satisfactory evidence of having
478478 19 successfully completed 3 academic years of credit at a
479479 20 dental therapy program accredited by the Commission on
480480 21 Dental Accreditation of the American Dental Association;
481481 22 (3) submit evidence that he or she currently holds a
482482 23 valid certification to perform cardiopulmonary
483483 24 resuscitation. The Department shall adopt rules

496496 2 for exception to this requirement only in instances where
497497 3 the applicant is a person with a physical disability and
498498 4 is unable to secure such certification; and
499499 5 (4) present satisfactory evidence that he or she has
500500 6 successfully completed a dental therapy examination
501501 7 administered by one of the following regional testing
502502 8 services:
503503 9 (i) Central Regional Dental Testing Service
504504 10 (CRDTS);
505505 11 (ii) Southern Regional Testing Agency (SRTA); or
506506 12 (iii) Commission on Dental Competency Assessments -
507507 13 Western Regional Examining Board - Council of
508508 14 Interstate Testing Agencies (CDCA-WREB-CITA).
509509 15 For the purposes of this Section, successful
510510 16 completion shall mean that the applicant has achieved a
511511 17 minimum passing score as determined by the applicable
512512 18 regional testing service under this paragraph (4).
513513 19 (c) The Secretary may suspend a regional testing service
514514 20 under paragraph (4) of subsection (b) if, after proper notice
515515 21 and hearing, it is established that (i) the integrity of the
516516 22 examination has been breached in a way that makes future test
517517 23 results unreliable or (ii) the examination is fundamentally
518518 24 deficient in testing clinical competency.

535535 6 collaborative management agreement and under the scope of

538538 9 Sec. 14.5. Examination of dental therapists; licensing.
539539 10 (a) Every person who desires to obtain a license as a
540540 11 dental therapist shall apply to the Department in writing,
541541 12 upon forms prepared and furnished by the Department. Each
542542 13 application shall contain proof of the particular
543543 14 qualifications required of the applicant, be verified by the
544544 15 applicant under oath, and be accompanied by the required
545545 16 examination fee.
546546 17 (b) The Department shall require that every applicant for
547547 18 a license as a dental therapist shall:
548548 19 (1) be 18 years of age or older;
549549 20 (2) be a graduate of a dental therapy college or
550550 21 school accredited by the Commission on Dental
551551 22 Accreditation of the American Dental Association or any
552552 23 other dental therapy accrediting entity recognized by the
553553 24 United States Department of Education. For applicants

565565 1 2029, the Board must approve the applicant's dental
566566 2 therapy education program if the program was administered
567567 3 by a college or school that operates as an accredited
568568 4 dental or dental hygiene program and the college or school
569569 5 certifies to the Board that the applicant's education
570570 6 substantially conformed to the education standards
571571 7 established by the Commission on Dental Accreditation of
572572 8 the American Dental Association; and
573573 9 (3) successfully completed a dental therapy practical
574574 10 or clinical examination designated by the Department. If
575575 11 an applicant fails to pass an examination after 3
576576 12 attempts, the applicant is not eligible to retake the
577577 13 examination unless the applicant completes additional
578578 14 education requirements as specified by the Department.
579579 15 (c) An applicant who satisfies the requirements of this
580580 16 Section and who has successfully completed an examination
581581 17 identified in paragraph (3) of subsection (b) in another
582582 18 state, or who has successfully completed a comparable
583583 19 examination administered or approved by the licensing
584584 20 authority in another state, shall be licensed to practice
585585 21 dental therapy in this State if the Department determines that
586586 22 the other state's examination is substantially similar to
587587 23 those identified in paragraph (3) of subsection (b).
588588 24 (d) The Department shall adopt rules to implement and
589589 25 administer this Section.

602602 3 (a) Except as otherwise provided in this Act, a dental
603603 4 therapist may perform the dental therapy services specified in
604604 5 subsection (b) under the general supervision of a dentist to
605605 6 the extent authorized by the supervising dentist and provided
606606 7 within the terms of a written collaborative management
607607 8 agreement signed by the dental therapist and the supervising
608608 9 dentist that meets the requirements of subsection (c).
609609 10 (b) Dental therapy services shall include all of the
610610 11 following:
611611 12 (1) All services, treatments, and competencies
612612 13 identified by the Commission on Dental Accreditation of
613613 14 the American Dental Association in the Accreditation
614614 15 Standards for Dental Therapy Education Programs.
615615 16 (2) The following State-specific services, if the
616616 17 dental therapist's education included curriculum content
617617 18 satisfying the criteria established by the Commission on
618618 19 Dental Accreditation of the American Dental Association
619619 20 for State-specific dental therapy services:
620620 21 (A) evaluating radiographs;
621621 22 (B) placement of space maintainers;
622622 23 (C) pulpotomies on primary teeth;
623623 24 (D) dispensing and administering non-opioid
624624 25 analgesics, including nitrous oxide,
625625 26 anti-inflammatories, and antibiotics, as authorized by

641641 6 subject to any conditions, limitations, and protocols
642642 7 specified by the supervising dentist in the written
643643 8 collaborative management agreement.
644644 9 (c) Before performing any of the services authorized in
645645 10 subsection (b), a dental therapist shall enter into a written
646646 11 collaborative management agreement with a supervising dentist.
647647 12 The agreement shall be signed by the dental therapist and the
648648 13 supervising dentist and shall include all of the following
649649 14 information:
650650 15 (1) practice settings where services may be provided
651651 16 by the dental therapist and the populations to be served
652652 17 by the dental therapist;
653653 18 (2) any limitations on the services that may be
654654 19 provided by the dental therapist, including the level of
655655 20 supervision required by the supervising dentist and
656656 21 teledentistry;
657657 22 (3) age-specific and procedure-specific practice
658658 23 protocols for the dental therapist, including case
659659 24 selection criteria, assessment guidelines, and imaging
660660 25 frequency;
661661 26 (4) a procedure for creating and maintaining dental

674674 3 (5) a plan to manage medical emergencies in each
675675 4 practice setting where the dental therapist provides care;
676676 5 (6) a quality assurance plan for monitoring care
677677 6 provided by the dental therapist, including patient care
678678 7 review, referral follow-up, and a quality assurance chart
679679 8 review;
680680 9 (7) protocols for the dental therapist to administer
681681 10 and dispense medications, including the specific
682682 11 conditions and circumstances under which the medications
683683 12 are to be dispensed and administered;
684684 13 (8) criteria relating to the provision of care by the
685685 14 dental therapist to patients with specific medical
686686 15 conditions or complex medication histories, including
687687 16 requirements for consultation before the initiation of
688688 17 care;
689689 18 (9) supervision criteria of dental therapists; and
690690 19 (10) a plan for the provision of clinical resources
691691 20 and referrals in situations that are beyond the
692692 21 capabilities of the dental therapist.
693693 22 (d) A supervising dentist shall determine the number of
694694 23 hours of practice that a dental therapist must complete under
695695 24 direct or indirect supervision of the supervising dentist
696696 25 before the dental therapist may perform any of the services
697697 26 authorized in subsection (b) under general supervision.

708708 1 (e) A supervising dentist may restrict or limit the dental
709709 2 therapist's practice in the written collaborative management
710710 3 agreement to be less than the full scope of practice for dental
711711 4 therapists that is authorized in subsection (b).
712712 5 (f) A supervising dentist may authorize a dental therapist
713713 6 to provide dental therapy services to a patient before the
714714 7 supervising dentist examines or diagnoses the patient if the
715715 8 authority, conditions, and protocols are established in a
716716 9 written collaborative management agreement and if the patient
717717 10 is subsequently referred to a dentist for any needed
718718 11 additional services that exceed the dental therapist's scope
719719 12 of practice or authorization under the written collaborative
720720 13 management agreement.
721721 14 (g) A supervising dentist must be licensed and practicing
722722 15 in this State. The supervising dentist is responsible for all
723723 16 services authorized and performed by the dental therapist
724724 17 pursuant to the collaborative management agreement and for
725725 18 providing or arranging follow-up services to be provided by a
726726 19 dentist for any additional services that exceed the dental
727727 20 therapist's scope of practice or authorization under the
728728 21 written collaborative management agreement.

749749 7 keep available for inquiry or inspection a similar list of all
750750 8 persons whose licenses have been suspended or revoked in the
751751 9 interim between such published lists. All lists required to be
752752 10 published or kept by this Section shall be arranged
753753 11 alphabetically.

756756 14 Sec. 16. Expiration, renewal and restoration of licenses.
757757 15 The expiration date and renewal date for each license issued
758758 16 under this Act shall be set by rule. The renewal period for
759759 17 each license issued under this Act shall be 3 years. A dentist,
760760 18 or dental hygienist, or dental therapist may renew a license
761761 19 during the month preceding its expiration date by paying the
762762 20 required fee. All initial licenses issued during an open
763763 21 renewal period shall have the next expiration date. A dentist,
764764 22 or dental hygienist, or dental therapist shall provide proof
765765 23 of current Basic Life Support (BLS) certification intended for
766766 24 health care providers at the time of renewal as provided by

778778 1 requirement of this Section shall be counted for no more than 4
779779 2 hours during each licensure period towards the continuing
780780 3 education hours under Section 16.1 of this Act. The Department
781781 4 shall provide by rule for exemptions from this requirement for
782782 5 a dentist, or dental hygienist, or dental therapist with a
783783 6 physical disability that would preclude him or her from
784784 7 performing BLS.
785785 8 Any dentist, or dental hygienist, or dental therapist
786786 9 whose license has expired or whose license is on inactive
787787 10 status may have his or her license restored at any time within
788788 11 5 years after the expiration thereof, upon payment of the
789789 12 required fee and a showing of proof of compliance with current
790790 13 continuing education requirements, as provided by rule.
791791 14 Any person whose license has been expired for more than 5
792792 15 years or who has had his or her license on inactive status for
793793 16 more than 5 years may have his or her license restored by
794794 17 making application to the Department and filing proof
795795 18 acceptable to the Department of taking continuing education
796796 19 and of his or her fitness to have the license restored,
797797 20 including sworn evidence certifying to active practice in
798798 21 another jurisdiction, and by paying the required license
799799 22 restoration fee. A person practicing on an expired license is
800800 23 deemed to be practicing without a license. However, a holder
801801 24 of a license may renew the license within 90 days after its
802802 25 expiration by complying with the requirements for renewal and

816816 3 If a person whose license has expired or who has had his or
817817 4 her license on inactive status for more than 5 years has not
818818 5 maintained an active practice satisfactory to the Department
819819 6 department, the Department shall determine, by an evaluation
820820 7 process established by rule, his or her fitness to resume
821821 8 active status and may require the person to complete a period
822822 9 of evaluated clinical experience and may require successful
823823 10 completion of a practical examination.
824824 11 However, any person whose license expired while he or she
825825 12 was (i) on active duty with the Armed Forces of the United
826826 13 States or called into service or training by the State militia
827827 14 or (ii) in training or education under the supervision of the
828828 15 United States preliminary to induction into the military
829829 16 service, may have his or her license renewed, reinstated, or
830830 17 restored without paying any lapsed renewal or restoration fee,
831831 18 if within 2 years after termination of such service, training,
832832 19 or education other than by dishonorable discharge, he or she
833833 20 furnishes the Department with satisfactory proof that he or
834834 21 she has been so engaged and that his or her service, training,
835835 22 or education has been so terminated.

849849 1 Sec. 16.1. Continuing education. The Department shall
850850 2 promulgate rules of continuing education for persons licensed
851851 3 under this Act. In establishing rules, the Department shall
852852 4 require a minimum of 48 hours of study in approved continuing
853853 5 education courses for dentists, dental therapists, and public
854854 6 health dental hygienists during each 3-year licensing period
855855 7 and a minimum of 36 hours of study in approved continuing
856856 8 education courses for dental hygienists and dental therapists
857857 9 during each 3-year licensing period.
858858 10 The Department shall approve only courses that are
859859 11 relevant to the treatment and care of patients, including, but
860860 12 not limited to, clinical courses in dentistry, and dental
861861 13 hygiene, and dental therapy and nonclinical courses such as
862862 14 patient management, legal and ethical responsibilities, and
863863 15 stress management. The Department shall allow up to 4 hours of
864864 16 continuing education credit hours per license renewal period
865865 17 for volunteer hours spent providing clinical services at, or
866866 18 sponsored by, a nonprofit community clinic, local or state
867867 19 health department, or a charity event. Courses shall not be
868868 20 approved in such subjects as estate and personal financial
869869 21 planning, personal investments, or personal health. Approved
870870 22 courses may include, but shall not be limited to, courses that
871871 23 are offered or sponsored by approved colleges, universities,
872872 24 and hospitals and by recognized national, State, and local
873873 25 dental and dental hygiene organizations. When offering a
874874 26 continuing education course, whether at no cost or for a fee,

886886 2 is an approved course for continuing education in the State of
887887 3 Illinois, as provided in this Section or by the rules adopted

889889 5 No license shall be renewed unless the renewal application
890890 6 is accompanied by an affidavit indicating that the applicant
891891 7 has completed the required minimum number of hours of
892892 8 continuing education in approved courses as required by this
893893 9 Section. The affidavit shall not require a listing of courses.
894894 10 The affidavit shall be a prima facie evidence that the
895895 11 applicant has obtained the minimum number of required
896896 12 continuing education hours in approved courses. The Department
897897 13 shall not be obligated to conduct random audits or otherwise
898898 14 independently verify that an applicant has met the continuing
899899 15 education requirement. The Department, however, may not
900900 16 conduct random audits of more than 10% of the licensed
901901 17 dentists, and dental hygienists, and dental therapists in any
902902 18 one licensing cycle to verify compliance with continuing
903903 19 education requirements. If the Department, however, receives a
904904 20 complaint that a licensee has not completed the required
905905 21 continuing education or if the Department is investigating
906906 22 another alleged violation of this Act by a licensee, the
907907 23 Department may demand and shall be entitled to receive
908908 24 evidence from any licensee of completion of required
909909 25 continuing education courses for the most recently completed

962962 7 to diagnose, treat, or remove stains, calculus, and
963963 8 bonding materials from human teeth or jaws; or
964964 9 (7) Who uses or administers local or general
965965 10 anesthetics in the treatment of dental or oral diseases or
966966 11 in any preparation incident to a dental operation of any
967967 12 kind or character; or
968968 13 (8) Who takes material or digital scans for final
969969 14 impressions of the human tooth, teeth, or jaws or performs
970970 15 any phase of any operation incident to the replacement of
971971 16 a part of a tooth, a tooth, teeth, or associated tissues by
972972 17 means of a filling, a crown, a bridge, a denture, or other
973973 18 appliance; or
974974 19 (9) Who offers to furnish, supply, construct,
975975 20 reproduce, or repair, or who furnishes, supplies,
976976 21 constructs, reproduces, or repairs, prosthetic dentures,
977977 22 bridges, or other substitutes for natural teeth to the
978978 23 user or prospective user thereof; or
979979 24 (10) Who instructs students on clinical matters or
980980 25 performs any clinical operation included in the curricula
981981 26 of recognized dental and dental therapy schools and

998998 7 for the purpose of assisting in the application of teeth
999999 8 whitening materials. A person does not practice dentistry
10001000 9 when he or she discloses to the consumer that he or she is
10011001 10 not licensed as a dentist under this Act and (i) discusses
10021002 11 the use of teeth whitening materials with a consumer
10031003 12 purchasing these materials; (ii) provides instruction on

10051005 14 purchasing these materials; or (iii) provides appropriate

10821082 19 Department. "Dental service", however, shall not include:
10831083 20 (1) Any and all diagnosis of or prescription for
10841084 21 treatment of disease, pain, deformity, deficiency,
10851085 22 injury, or physical condition of the human teeth or

13681368 18 Each dentist who enters into a written collaborative
13691369 19 management agreement must document and maintain a copy of any
13701370 20 change or termination of that agreement.
13711371 21 (b) Dental records shall be owned and maintained by the
13721372 22 supervising collaborative dentist for all patients treated by
13731373 23 the dental therapist unless the supervising dentist is an
13741374 24 employee of a public health clinic or federally qualified
13751375 25 health center, in which case the public health clinic or
13761376 26 federally qualified health center shall maintain the records.

14011401 15 duties within the accepted scope of practice in the written

14731473 16 Commission on Dental Accreditation (CODA) accredited dental
14741474 17 college or school in the United States or Canada, presented
14751475 18 evidence that the applicant has passed both parts of the
14761476 19 National Board Dental Examination if the applicant applies to
14771477 20 practice dentistry, a dental specialty, or dental hygiene, and
14781478 21 successfully completed an examination conducted by a regional
14791479 22 testing service.
14801480 23 Applicants have 3 years from the date of application to

20402040 13 The request for an informal conference shall contain the
20412041 14 nature of the alleged actions or inactions that constitute the
20422042 15 possible violations.
20432043 16 A dentist, or dental hygienist, or dental therapist shall
20442044 17 be allowed to have legal counsel at the informal conference.
20452045 18 If the informal conference results in a consent order between
20462046 19 the accused dentist, or dental hygienist, or dental therapist
20472047 20 and the Department, the consent order must be approved by the
20482048 21 Secretary. However, if the consent order would result in a
20492049 22 fine exceeding $10,000 or the suspension or revocation of the
20502050 23 dentist, or dental hygienist, or dental therapist license, the
20512051 24 consent order must be approved by the Board and the Secretary.

20832083 20 disciplinary action may be taken with regard thereto,
20842084 21 including limiting the scope, nature or extent of his or her
20852085 22 practice, as the Secretary may deem proper.

21132113 14 Board and the Department may subpoena copies of hospital,
21142114 15 medical, or dental records in mandatory report cases alleging
21152115 16 death or permanent bodily injury when consent to obtain the
21162116 17 records has not been provided by a patient or a patient's legal
21172117 18 representative. All records and other information received
21182118 19 pursuant to a subpoena shall be confidential and shall be
21192119 20 afforded the same status as information concerning medical
21202120 21 studies under Part 21 of Article VIII of the Code of Civil
21212121 22 Procedure. The use of these records shall be restricted to
21222122 23 members of the Board, the dental coordinator, and appropriate

21462146 12 (d) The Department may provide reimbursement for fees and

21482148 14 prescribed by law for judicial procedure in a civil case.
21492149 15 (e) Nothing in this Section shall be deemed to supersede
21502150 16 the provisions of Part 21 of Article VIII of the Code of Civil
21512151 17 Procedure, now or hereafter amended, to the extent applicable.
21522152 18 (f) All information gathered by the Department during any
21532153 19 investigation, including information subpoenaed under this Act
21542154 20 and the investigative file, shall be kept for the confidential
21552155 21 use of the Secretary, the dental coordinator, the Board's
21562156 22 attorneys, the dental investigative staff, authorized clerical
21572157 23 staff, and persons employed by contract to advise the dental

22182218 13 a hearing, a hearing by the Board must be held within 15 days
22192219 14 after such suspension has occurred.
22202220 15 (c) The entry of a judgment by any circuit court
22212221 16 establishing that any person holding a license under this Act
22222222 17 is a person subject to involuntary admission under the Mental
22232223 18 Health and Developmental Disabilities Code shall operate as a
22242224 19 suspension of that license. That person may resume his or her
22252225 20 practice only upon a finding by the Board that he or she has
22262226 21 been determined to be no longer subject to involuntary
22272227 22 admission by the court and upon the Board's recommendation to
22282228 23 the Secretary that he or she be permitted to resume his or her
22292229 24 practice.

23282328 18 construed as prohibiting the seeking or giving of advice
23292329 19 or assistance with respect to these matters.
23302330 20 The purpose of this Section is to prevent a non-dentist
23312331 21 from influencing or otherwise interfering with the exercise of
23322332 22 independent professional judgment by a dentist, dental
23332333 23 hygienist, dental therapist, or other entity which can provide
23342334 24 dental services under this Act. Nothing in this Section shall
23352335 25 be construed to prohibit insurers and managed care plans from

23642364 18 is engaged in such unlawful practice, the court may enter an
23652365 19 order or judgment perpetually enjoining the defendant from
23662366 20 further such practice. In all proceedings hereunder the court,
23672367 21 in its discretion, may apportion the costs among the parties
23682368 22 interested in the action, including cost of filing the
23692369 23 complaint, service of process, witness fees and expenses,
23702370 24 court reporter charges and reasonable attorneys' fees. In case
23712371 25 of violation of any injunctive order entered under the
23722372 26 provisions of this Section, the court may summarily try and

25062506 19 order by a physician licensed to practice medicine in all its
25072507 20 branches who, in the course of professional practice,
25082508 21 administers vaccines to patients. Methods of communication
25092509 22 shall be established for consultation with the physician in
25102510 23 person or by telecommunications.

25242524 2 Vaccines shall only be administered by the dentist or dental
25252525 3 therapist and shall not be delegated to an assistant or any
25262526 4 other person. Vaccination of a patient by a dentist or dental
25272527 5 therapist shall be documented in the patient's dental record
25282528 6 and the record shall be retained in accordance with current
25292529 7 dental recordkeeping standards. The dentist or dental
25302530 8 therapist shall notify the patient's primary care physician of
25312531 9 each dose of vaccine administered to the patient and shall
25322532 10 enter all patient level data or update the patient's current
25332533 11 record. The dentist or dental therapist may provide this
25342534 12 notice to the patient's physician electronically. In addition,
25352535 13 the dentist or dental therapist shall enter all patient level
25362536 14 data on vaccines administered in the immunization data
25372537 15 registry maintained by the Department of Public Health.
25382538 16 (c) A dentist or dental therapist shall only provide
25392539 17 vaccinations under this Section if contracted with and
25402540 18 credentialed by the patient's health insurance, health
25412541 19 maintenance organization, or other health plan to specifically
25422542 20 provide the vaccinations allowed under this Section. Persons
25432543 21 enrolled in Medicare or Medicaid may only receive the
25442544 22 vaccinations allowed for under this Section from dentists or
25452545 23 dental therapists who are authorized to do so by the federal
25462546 24 Centers for Medicare and Medicaid Services or the Department
25472547 25 of Healthcare and Family Services.

25682568 10 subsection (d) of Section 10-65 of the Illinois Administrative

25722572 14 continuation or renewal of the license is specifically
25732573 15 excluded. For the purposes of this Act the notice required
25742574 16 under Section 10-25 of the Administrative Procedure Act is
25752575 17 deemed sufficient when mailed to the last known address of a
25762576 18 party.
