1313 1 AN ACT concerning criminal law.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Freedom of Information Act is amended by
1717 5 changing Sections 2 and 7 as follows:

1919 7 Sec. 2. Definitions. As used in this Act:
2020 8 (a) "Public body" means all legislative, executive,
2121 9 administrative, or advisory bodies of the State, state
2222 10 universities and colleges, counties, townships, cities,
2323 11 villages, incorporated towns, school districts and all other
2424 12 municipal corporations, boards, bureaus, committees, or
2525 13 commissions of this State, any subsidiary bodies of any of the
2626 14 foregoing including but not limited to committees and
2727 15 subcommittees thereof, and a School Finance Authority created
2828 16 under Article 1E of the School Code. "Public body" does not
2929 17 include a child death review team or the Illinois Child Death
3030 18 Review Teams Executive Council established under the Child
3131 19 Death Review Team Act, or a regional youth advisory board or
3232 20 the Statewide Youth Advisory Board established under the
3333 21 Department of Children and Family Services Statewide Youth
3434 22 Advisory Board Act.
3535 23 (b) "Person" means any individual, corporation,

7676 3 (c) "Public records" means all records, reports, forms,
7777 4 writings, letters, memoranda, books, papers, maps,
7878 5 photographs, microfilms, cards, tapes, recordings, electronic
7979 6 data processing records, electronic communications, recorded
8080 7 information and all other documentary materials pertaining to
8181 8 the transaction of public business, regardless of physical
8282 9 form or characteristics, having been prepared by or for, or
8383 10 having been or being used by, received by, in the possession
8484 11 of, or under the control of any public body. "Public records"
8585 12 includes records of the names of persons on electronic
8686 13 monitoring and the number of times a person on electronic
8787 14 monitoring has violated the terms of electronic monitoring and
8888 15 includes court records of that information. These records are
8989 16 subject to inspection and copying under this Act even if the
9090 17 records are maintained in a judicial office or by a judicial
9191 18 official. In this Act, "judicial office" means the circuit,
9292 19 Appellate, or Supreme Court of this State and "judicial
9393 20 official" means a judge or associate judge of the circuit
9494 21 court of this State, a judge of the Appellate or Supreme Court
9595 22 of this State, or the clerk of the circuit, Appellate, or
9696 23 Supreme Court of this State.
9797 24 (c-5) "Private information" means unique identifiers,
9898 25 including a person's social security number, driver's license
9999 26 number, employee identification number, biometric identifiers,

110110 1 personal financial information, passwords or other access
111111 2 codes, medical records, home or personal telephone numbers,
112112 3 and personal email addresses. Private information also
113113 4 includes home address and personal license plates, except as
114114 5 otherwise provided by law or when compiled without possibility
115115 6 of attribution to any person. For a public body that is a
116116 7 HIPAA-covered entity, "private information" includes
117117 8 electronic medical records and all information, including
118118 9 demographic information, contained within or extracted from an
119119 10 electronic medical records system operated or maintained by
120120 11 the public body in compliance with State and federal medical
121121 12 privacy laws and regulations, including, but not limited to,
122122 13 the Health Insurance Portability and Accountability Act and
123123 14 its regulations, 45 CFR Parts 160 and 164. As used in this
124124 15 subsection, "HIPAA-covered entity" has the meaning given to
125125 16 the term "covered entity" in 45 CFR 160.103.
126126 17 (c-10) "Commercial purpose" means the use of any part of a
127127 18 public record or records, or information derived from public
128128 19 records, in any form for sale, resale, or solicitation or
129129 20 advertisement for sales or services. For purposes of this
130130 21 definition, requests made by news media and non-profit,
131131 22 scientific, or academic organizations shall not be considered
132132 23 to be made for a "commercial purpose" when the principal
133133 24 purpose of the request is (i) to access and disseminate
134134 25 information concerning news and current or passing events,

146146 1 public, or (iii) for the purpose of academic, scientific, or
147147 2 public research or education.
148148 3 (d) "Copying" means the reproduction of any public record
149149 4 by means of any photographic, electronic, mechanical or other
150150 5 process, device or means now known or hereafter developed and
151151 6 available to the public body.
152152 7 (e) "Head of the public body" means the president, mayor,
153153 8 chairman, presiding officer, director, superintendent,
154154 9 manager, supervisor or individual otherwise holding primary
155155 10 executive and administrative authority for the public body, or
156156 11 such person's duly authorized designee.
157157 12 (f) "News media" means a newspaper or other periodical
158158 13 issued at regular intervals whether in print or electronic
159159 14 format, a news service whether in print or electronic format,
160160 15 a radio station, a television station, a television network, a
161161 16 community antenna television service, or a person or
162162 17 corporation engaged in making news reels or other motion
163163 18 picture news for public showing.
164164 19 (g) "Recurrent requester", as used in Section 3.2 of this
165165 20 Act, means a person that, in the 12 months immediately
166166 21 preceding the request, has submitted to the same public body
167167 22 (i) a minimum of 50 requests for records, (ii) a minimum of 15
168168 23 requests for records within a 30-day period, or (iii) a
169169 24 minimum of 7 requests for records within a 7-day period. For
170170 25 purposes of this definition, requests made by news media and
171171 26 non-profit, scientific, or academic organizations shall not be

182182 1 considered in calculating the number of requests made in the
183183 2 time periods in this definition when the principal purpose of
184184 3 the requests is (i) to access and disseminate information
185185 4 concerning news and current or passing events, (ii) for
186186 5 articles of opinion or features of interest to the public, or
187187 6 (iii) for the purpose of academic, scientific, or public
188188 7 research or education.
189189 8 For the purposes of this subsection (g), "request" means a
190190 9 written document (or oral request, if the public body chooses
191191 10 to honor oral requests) that is submitted to a public body via
192192 11 personal delivery, mail, telefax, electronic mail, or other
193193 12 means available to the public body and that identifies the
194194 13 particular public record the requester seeks. One request may
195195 14 identify multiple records to be inspected or copied.
196196 15 (h) "Voluminous request" means a request that: (i)
197197 16 includes more than 5 individual requests for more than 5
198198 17 different categories of records or a combination of individual
199199 18 requests that total requests for more than 5 different
200200 19 categories of records in a period of 20 business days; or (ii)
201201 20 requires the compilation of more than 500 letter or
202202 21 legal-sized pages of public records unless a single requested
203203 22 record exceeds 500 pages. "Single requested record" may
204204 23 include, but is not limited to, one report, form, e-mail,
205205 24 letter, memorandum, book, map, microfilm, tape, or recording.
206206 25 "Voluminous request" does not include a request made by
207207 26 news media and non-profit, scientific, or academic

218218 1 organizations if the principal purpose of the request is: (1)
219219 2 to access and disseminate information concerning news and
220220 3 current or passing events; (2) for articles of opinion or
221221 4 features of interest to the public; or (3) for the purpose of
222222 5 academic, scientific, or public research or education.
223223 6 For the purposes of this subsection (h), "request" means a
224224 7 written document, or oral request, if the public body chooses
225225 8 to honor oral requests, that is submitted to a public body via
226226 9 personal delivery, mail, telefax, electronic mail, or other
227227 10 means available to the public body and that identifies the
228228 11 particular public record or records the requester seeks. One
229229 12 request may identify multiple individual records to be
230230 13 inspected or copied.
231231 14 (i) "Severance agreement" means a mutual agreement between
232232 15 any public body and its employee for the employee's
233233 16 resignation in exchange for payment by the public body.

236236 19 Sec. 7. Exemptions.
237237 20 (1) When a request is made to inspect or copy a public
238238 21 record that contains information that is exempt from
239239 22 disclosure under this Section, but also contains information
240240 23 that is not exempt from disclosure, the public body may elect
241241 24 to redact the information that is exempt. The public body

253253 1 and copying. Subject to this requirement, the following shall
254254 2 be exempt from inspection and copying:
255255 3 (a) Information specifically prohibited from
256256 4 disclosure by federal or State law or rules and
257257 5 regulations implementing federal or State law.
258258 6 (b) Private information, unless disclosure is required
259259 7 by another provision of this Act, a State or federal law,
260260 8 or a court order.
261261 9 (b-5) Files, documents, and other data or databases
262262 10 maintained by one or more law enforcement agencies and
263263 11 specifically designed to provide information to one or
264264 12 more law enforcement agencies regarding the physical or
265265 13 mental status of one or more individual subjects.
266266 14 (c) Personal information contained within public
267267 15 records, the disclosure of which would constitute a
268268 16 clearly unwarranted invasion of personal privacy, unless
269269 17 the disclosure is consented to in writing by the
270270 18 individual subjects of the information. "Unwarranted
271271 19 invasion of personal privacy" means the disclosure of
272272 20 information that is highly personal or objectionable to a
273273 21 reasonable person and in which the subject's right to
274274 22 privacy outweighs any legitimate public interest in
275275 23 obtaining the information. The disclosure of information
276276 24 that bears on the public duties of public employees and
277277 25 officials shall not be considered an invasion of personal

289289 1 (d) Records in the possession of any public body
290290 2 created in the course of administrative enforcement
291291 3 proceedings, and any law enforcement or correctional
292292 4 agency for law enforcement purposes, but only to the
293293 5 extent that disclosure would:
294294 6 (i) interfere with pending or actually and
295295 7 reasonably contemplated law enforcement proceedings
296296 8 conducted by any law enforcement or correctional
297297 9 agency that is the recipient of the request;
298298 10 (ii) interfere with active administrative
299299 11 enforcement proceedings conducted by the public body
300300 12 that is the recipient of the request;
301301 13 (iii) create a substantial likelihood that a
302302 14 person will be deprived of a fair trial or an impartial
303303 15 hearing;
304304 16 (iv) unavoidably disclose the identity of a
305305 17 confidential source, confidential information
306306 18 furnished only by the confidential source, or persons
307307 19 who file complaints with or provide information to
308308 20 administrative, investigative, law enforcement, or
309309 21 penal agencies; except that the identities of
310310 22 witnesses to traffic crashes, traffic crash reports,
311311 23 and rescue reports shall be provided by agencies of
312312 24 local government, except when disclosure would
313313 25 interfere with an active criminal investigation
314314 26 conducted by the agency that is the recipient of the

326326 2 (v) disclose unique or specialized investigative
327327 3 techniques other than those generally used and known
328328 4 or disclose internal documents of correctional
329329 5 agencies related to detection, observation, or
330330 6 investigation of incidents of crime or misconduct, and
331331 7 disclosure would result in demonstrable harm to the
332332 8 agency or public body that is the recipient of the
333333 9 request;
334334 10 (vi) endanger the life or physical safety of law
335335 11 enforcement personnel or any other person; or
336336 12 (vii) obstruct an ongoing criminal investigation
337337 13 by the agency that is the recipient of the request.
338338 14 (d-5) A law enforcement record created for law
339339 15 enforcement purposes and contained in a shared electronic
340340 16 record management system if the law enforcement agency
341341 17 that is the recipient of the request did not create the
342342 18 record, did not participate in or have a role in any of the
343343 19 events which are the subject of the record, and only has
344344 20 access to the record through the shared electronic record
345345 21 management system.
346346 22 (d-6) Records contained in the Officer Professional
347347 23 Conduct Database under Section 9.2 of the Illinois Police
348348 24 Training Act, except to the extent authorized under that
349349 25 Section. This includes the documents supplied to the

412412 16 (e-10) Law enforcement records of other persons
413413 17 requested by a person committed to the Department of
414414 18 Corrections, Department of Human Services Division of
415415 19 Mental Health, or a county jail, including, but not
416416 20 limited to, arrest and booking records, mug shots, and
417417 21 crime scene photographs, except as these records may be
418418 22 relevant to the requester's current or potential case or
419419 23 claim.
420420 24 (f) Preliminary drafts, notes, recommendations,
421421 25 memoranda, and other records in which opinions are
422422 26 expressed, or policies or actions are formulated, except

434434 2 shall not be exempt when the record is publicly cited and
435435 3 identified by the head of the public body. The exemption
436436 4 provided in this paragraph (f) extends to all those
437437 5 records of officers and agencies of the General Assembly
438438 6 that pertain to the preparation of legislative documents.
439439 7 (g) Trade secrets and commercial or financial
440440 8 information obtained from a person or business where the
441441 9 trade secrets or commercial or financial information are
442442 10 furnished under a claim that they are proprietary,
443443 11 privileged, or confidential, and that disclosure of the
444444 12 trade secrets or commercial or financial information would
445445 13 cause competitive harm to the person or business, and only
446446 14 insofar as the claim directly applies to the records
447447 15 requested.
448448 16 The information included under this exemption includes
449449 17 all trade secrets and commercial or financial information
450450 18 obtained by a public body, including a public pension
451451 19 fund, from a private equity fund or a privately held
452452 20 company within the investment portfolio of a private
453453 21 equity fund as a result of either investing or evaluating
454454 22 a potential investment of public funds in a private equity
455455 23 fund. The exemption contained in this item does not apply
456456 24 to the aggregate financial performance information of a
457457 25 private equity fund, nor to the identity of the fund's

476476 8 (h) Proposals and bids for any contract, grant, or

478478 10 disclosed would frustrate procurement or give an advantage
479479 11 to any person proposing to enter into a contractor
480480 12 agreement with the body, until an award or final selection
481481 13 is made. Information prepared by or for the body in
482482 14 preparation of a bid solicitation shall be exempt until an
483483 15 award or final selection is made.
484484 16 (i) Valuable formulae, computer geographic systems,
485485 17 designs, drawings, and research data obtained or produced
486486 18 by any public body when disclosure could reasonably be
487487 19 expected to produce private gain or public loss. The
488488 20 exemption for "computer geographic systems" provided in
489489 21 this paragraph (i) does not extend to requests made by
490490 22 news media as defined in Section 2 of this Act when the
491491 23 requested information is not otherwise exempt and the only
492492 24 purpose of the request is to access and disseminate
