3	11		1 AN ACT concerning education.
4	12		2 Be it enacted by the People of the State of Illinois,
5	13		3 represented in the General Assembly:
6	14		4 Section 1. Short title. This Act may be cited as the
7	15		5 Prohibition of Discriminatory Disability Mascots Act.
8	16		6 Section 5. Purpose. To ensure that all public educational
9	17		7 institutions provide a respectful and inclusive environment,
10	18		8 free from the perpetuation of harmful stereotypes or
11	19		9 discrimination based on disability.
12	20		10 Section 10. Definitions. In this Act:
13	21		11 "Discriminatory disability mascot" means any name, logo,
14	22		12 or mascot that is derogatory or representative of an
15	23		13 individual or group based on disability, as defined by the
16	24		14 federal Americans with Disabilities Act.
17	25		15 "Public educational institutions" means any kindergarten
18	26		16 through grade 12 school, public university, or community
19	27		17 college receiving public funding within the State.
20	28		18 Section 15. Discriminatory disability mascots prohibited.
21	29		19 (a) A public educational institution shall prohibit the
22	30		20 adoption or continued use of discriminatory disability
23	31		21 mascots.

32	66		1 (b) A public educational institution may continue to use
33	67		2 uniforms or other materials bearing a prohibited name, logo,
34	68		3 or mascot that were purchased on or before the effective date
35	69		4 of this Act until September 1, 2028 if all the following
36	70		5 requirements are met:
37	71		6 (1) The public educational institution selects a new
38	72		7 school or athletic team name, logo, or mascot that does
39	73		8 not violate the prohibition under subsection (a).
40	74		9 (2) The public educational institution refrains from
41	75		10 purchasing, acquiring, or using resources for the purpose
42	76		11 of distribution or sale to pupils or school employees any
43	77		12 uniform that includes or bears the prohibited school or
44	78		13 athletic team name, logo, or mascot.
45	79		14 (3) The public educational institution refrains from
46	80		15 purchasing, acquiring, or using resources for the purpose
47	81		16 of distribution or sale to pupils or school employees any
48	82		17 yearbook, newspaper, program, or other tangible material
49	83		18 that includes or bears the prohibited school or athletic
50	84		19 team name, logo, or mascot in the logo or title of the
51	85		20 yearbook, newspaper, program, or other tangible material.
52	86		21 (4) If a public educational institution facility bears
53	87		22 the prohibited school or athletic team name, logo, or
54	88		23 mascot, the school removes the prohibited name, logo, or
55	89		24 mascot no later than the next time that part of the
56	90		25 facility where the name, logo, or mascot is located is
57	91		26 remodeled or replaced in the normal course of maintenance
