11	11	1 AN ACT concerning revenue.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Motor Fuel Tax Law is amended by changing
15	15	5 Section 8b as follows:

17	17	7 Sec. 8b. Transportation Renewal Fund; creation;
18	18	8 distribution of proceeds.
19	19	9 (a) The Transportation Renewal Fund is hereby created as a
20	20	10 special fund in the State treasury. Moneys in the Fund shall be
21	21	11 used as provided in this Section:
22	22	12 (1) 80% of the moneys in the Fund shall be used for
23	23	13 highway maintenance, highway construction, bridge repair,
24	24	14 congestion relief, and construction of aviation
25	25	15 facilities; of that 80%:
26	26	16 (A) before Fiscal Year 2026 and for Fiscal Year
27	27	17 2031 and thereafter, the the State Comptroller shall
28	28	18 order transferred and the State Treasurer shall
29	29	19 transfer 60% to the State Construction Account Fund;
30	30	20 those moneys shall be used solely for construction,
31	31	21 reconstruction, improvement, repair, maintenance,
32	32	22 operation, and administration of highways and are
33	33	23 limited to payments made pursuant to design and

68	68	1 construction contracts awarded by the Department of
69	69	2 Transportation; and
70	70	3 (B) before Fiscal Year 2026 and for Fiscal Year
71	71	4 2031 and thereafter, 40% 40% shall be distributed by
72	72	5 the Department of Transportation to municipalities,
73	73	6 counties, and road districts of the State using the
74	74	7 percentages set forth in subdivisions (A), (B), (C),
75	75	8 and (D) of paragraph (2) of subsection (e) of Section
76	76	9 8; distributions to particular municipalities,
77	77	10 counties, and road districts under this subdivision
78	78	11 (B) shall be made according to the allocation
79	79	12 procedures described for municipalities, counties, and
80	80	13 road districts in subsection (e) of Section 8 and
81	81	14 shall be subject to the same requirements and
82	82	15 limitations described in that subsection; and
83	83	16 (C) beginning with Fiscal Year 2026 and continuing
84	84	17 through Fiscal Year 2030, the State Comptroller shall
85	85	18 order transferred and the State Treasurer shall
86	86	19 transfer 40% to the State Construction Account Fund;
87	87	20 those moneys shall be used solely for construction,
88	88	21 reconstruction, improvement, repair, maintenance,
89	89	22 operation, and administration of highways and are

91	91	24 construction contracts awarded by the Department of

104	104	1 through Fiscal Year 2030, 60% shall be distributed by
105	105	2 the Department of Transportation to municipalities,
106	106	3 counties, and road districts of the State using the
107	107	4 percentages set forth in subdivisions (A), (B), (C),
108	108	5 and (D) of paragraph (2) of subsection (e) of Section
109	109	6 8; distributions to particular municipalities,
110	110	7 counties, and road districts under this subdivision
111	111	8 (B) shall be made according to the allocation
112	112	9 procedures described for municipalities, counties, and
113	113	10 road districts in subsection (e) of Section 8 and
114	114	11 shall be subject to the same requirements and
115	115	12 limitations described in that subsection; and
116	116	13 (2) 20% of the moneys in the Fund shall be used for
117	117	14 projects related to rail facilities and mass transit
118	118	15 facilities, as defined in Section 2705-305 of the
119	119	16 Department of Transportation Law of the Civil
120	120	17 Administrative Code of Illinois, including rapid transit,
121	121	18 rail, high-speed rail, bus and other equipment in
122	122	19 connection with the State or a unit of local government,
123	123	20 special district, municipal corporation, or other public
124	124	21 agency authorized to provide and promote public
125	125	22 transportation within the State; of that 20%:
126	126	23 (A) 90% shall be deposited into the Regional
127	127	24 Transportation Authority Capital Improvement Fund, a
128	128	25 special fund created in the State Treasury; moneys in
129	129	26 the Regional Transportation Authority Capital

140	140	1 Improvement Fund shall be used by the Regional
141	141	2 Transportation Authority for construction,
142	142	3 improvements, and deferred maintenance on mass transit
143	143	4 facilities and acquisition of buses and other
144	144	5 equipment; and
145	145	6 (B) 10% shall be deposited into the Downstate Mass
146	146	7 Transportation Capital Improvement Fund, a special
147	147	8 fund created in the State Treasury; moneys in the
148	148	9 Downstate Mass Transportation Capital Improvement Fund
149	149	10 shall be used by local mass transit districts other
150	150	11 than the Regional Transportation Authority for
151	151	12 construction, improvements, and deferred maintenance
152	152	13 on mass transit facilities and acquisition of buses
