311 1 AN ACT concerning State government.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Energy Transition Act is amended by

1018 8 Sec. 5-40. Illinois Climate Works Preapprenticeship
1119 9 Program.
1220 10 (a) Subject to appropriation, the Department shall
1321 11 develop, and through Regional Administrators administer, the
1422 12 Illinois Climate Works Preapprenticeship Program. The goal of
1523 13 the Illinois Climate Works Preapprenticeship Program is to
1624 14 create a network of hubs throughout the State that will
1725 15 recruit, prescreen, and provide preapprenticeship skills
1826 16 training, for which participants may attend free of charge and
1927 17 receive a stipend, to create a qualified, diverse pipeline of
2028 18 workers who are prepared for careers in the construction and
2129 19 building trades and clean energy jobs opportunities therein.
2230 20 Upon completion of the Illinois Climate Works
2331 21 Preapprenticeship Program, the candidates will be connected to
2432 22 and prepared to successfully complete an apprenticeship

3468 1 (b) Each Climate Works Hub that receives funding from the
3569 2 Energy Transition Assistance Fund shall provide an annual
3670 3 report to the Illinois Works Review Panel by April 1 of each
3771 4 calendar year. The annual report shall include the following
3872 5 information:
3973 6 (1) a description of the Climate Works Hub's
4074 7 recruitment, screening, and training efforts, including a
4175 8 description of training related to construction and
4276 9 building trades opportunities in clean energy jobs;
4377 10 (2) the number of individuals who apply to,
4478 11 participate in, and complete the Climate Works Hub's
4579 12 program, broken down by race, gender, age, and veteran
4680 13 status;
4781 14 (3) the number of the individuals referenced in
4882 15 paragraph (2) of this subsection who are initially
4983 16 accepted and placed into apprenticeship programs in the
5084 17 construction and building trades; and
5185 18 (4) the number of individuals referenced in paragraph
5286 19 (2) of this subsection who remain in apprenticeship
5387 20 programs in the construction and building trades or have
5488 21 become journeymen one calendar year after their placement,
5589 22 as referenced in paragraph (3) of this subsection.
5690 23 (c) Subject to appropriation, the Department shall provide
5791 24 funding to 3 Climate Works Hubs throughout the State,
5892 25 including one to the Illinois Department of Transportation
5993 26 Region 1, one to the Illinois Department of Transportation

70104 1 Regions 2 and 3, and one to the Illinois Department of
71105 2 Transportation Regions 4 and 5. An eligible organization may
72106 3 serve as the designated Climate Works Hub for all 5 regions.
73107 4 Climate Works Hubs shall be awarded grants in multi-year
74108 5 increments not to exceed 36 months. Each grant shall come with
75109 6 a one year initial term, with the Department renewing each
76110 7 year for 2 additional years unless the grantee either declines
77111 8 to continue or fails to meet reasonable performance measures
78112 9 that consider apprenticeship programs timeframes. The
79113 10 Department may take into account experience and performance as
80114 11 a previous grantee of the Climate Works Hub as part of the
81115 12 selection criteria for subsequent years.
82-13 (d) Each Climate Works Hub that receives funding from the
83-14 Energy Transition Assistance Fund shall recruit, prescreen,
84-15 and provide preapprenticeship training to program
85-16 participants. Each Climate Works Hub that receives funding
86-17 from the Energy Transition Assistance Fund shall:
87-18 (1) in each Hub Site where the applicant pool allows:
88-19 (A) dedicate at least one-third of Program
89-20 placements to applicants who reside in a geographic
90-21 area that is impacted by economic and environmental
91-22 challenges, defined as an area that is both (i) an R3
92-23 Area, as defined pursuant to Section 10-40 of the
93-24 Cannabis Regulation and Tax Act, and (ii) an
94-25 environmental justice community, as defined by the
95-26 Illinois Power Agency under the Illinois Power Agency
116+13 (d) The Climate Works Pre-Apprenticeship Program shall
117+14 recruit, prescreen, and provide pre-apprenticeship training
118+15 relevant to clean energy apprenticeships in the construction
119+16 and building trades and shall meet all of the following:
120+17 (1) The Program shall dedicate at least one-third of
121+18 Program placements to applicants who reside in a
122+19 geographic area that is (i) an R3 Area, as defined in
123+20 Section 10-40 of the Cannabis Regulation and Tax Act, (ii)
124+21 an environmental justice community, as defined in the
125+22 Illinois Power Agency Act, and (iii) impacted by economic
126+23 and environmental challenges, excluding any racial or
127+24 ethnic indicators used by the Agency unless and until the
128+25 constitutional basis for the inclusion of the factors in

161-20 training to equity investment eligible persons;

163-22 opportunities and certifications relevant to clean energy
164-23 jobs in the construction and building trades; and
165-24 (3) provide preapprentices with stipends they receive
166-25 that may vary depending on the occupation the individual
167-26 is training for.

193-16 (a) The Illinois Works Preapprenticeship Program is
194-17 established and shall be administered by the Department. The
195-18 goal of the Illinois Works Preapprenticeship Program is to
196-19 create a network of community-based organizations throughout
197-20 the State that will recruit, prescreen, and provide
198-21 preapprenticeship skills training, for which participants may
199-22 attend free of charge and receive a stipend, to create a

214-3 (b) There is created the Illinois Works Fund, a special
215-4 fund in the State treasury. The Illinois Works Fund shall be
216-5 administered by the Department. The Illinois Works Fund shall
217-6 be used to provide funding for community-based organizations
218-7 throughout the State. In addition to any other transfers that
219-8 may be provided for by law, on and after July 1, 2019 at the
220-9 direction of the Director of the Governor's Office of
221-10 Management and Budget, the State Comptroller shall direct and
222-11 the State Treasurer shall transfer amounts not exceeding a
223-12 total of $50,000,000 from the Rebuild Illinois Projects Fund
224-13 to the Illinois Works Fund.
225-14 (b-5) In addition to any other transfers that may be
226-15 provided for by law, beginning July 1, 2024 and each July 1
227-16 thereafter, or as soon thereafter as practical, the State
228-17 Comptroller shall direct and the State Treasurer shall
229-18 transfer $20,000,000 from the Capital Projects Fund to the
230-19 Illinois Works Fund.
231-20 (c) Each community-based organization that receives
232-21 funding from the Illinois Works Fund shall provide an annual
233-22 report to the Illinois Works Review Panel by April 1 of each
234-23 calendar year. The annual report shall include the following

257-10 (d) The Department shall create and administer the
258-11 Illinois Works Bid Credit Program that shall provide economic
259-12 incentives, through bid credits, to encourage contractors and
260-13 subcontractors to provide contracting and employment
261-14 opportunities to historically underrepresented populations in
262-15 the construction industry.
263-16 The Illinois Works Bid Credit Program shall allow
264-17 contractors and subcontractors to earn bid credits for use
265-18 toward future bids for public works projects contracted by the
266-19 State or an agency of the State in order to increase the
267-20 chances that the contractor and the subcontractors will be
268-21 selected.
269-22 Contractors or subcontractors may be eligible to earn bid
270-23 credits for employing apprentices who have completed the
271-24 Illinois Works Preapprenticeship Program, the Climate Works
272-25 Preapprenticeship Program, or the Highway Construction Careers
273-26 Training Program. Contractors or subcontractors shall earn bid

284-1 credits at a rate established by the Department and based on
285-2 labor hours worked by apprentices who have completed the
286-3 Illinois Works Preapprenticeship Program, the Climate Works
287-4 Preapprenticeship Program, or the Highway Construction Careers
288-5 Training Program. In order to earn bid credits, contractors
289-6 and subcontractors shall provide the Department with certified
290-7 payroll documenting the hours performed by apprentices who
291-8 have completed the Illinois Works Preapprenticeship Program,
292-9 the Climate Works Preapprenticeship Program, or the Highway
293-10 Construction Careers Training Program. Contractors and
294-11 subcontractors can use bid credits toward future bids for
295-12 public works projects contracted or funded by the State or an
296-13 agency of the State in order to increase the likelihood of
297-14 being selected as the contractor for the public works project
298-15 toward which they have applied the bid credit. The Department
299-16 shall establish the rate by rule and shall publish it on the
300-17 Department's website. The rule may include maximum bid credits
301-18 allowed per contractor, per subcontractor, per apprentice, per
302-19 bid, or per year.
303-20 The Illinois Works Credit Bank is hereby created and shall
304-21 be administered by the Department. The Illinois Works Credit
305-22 Bank shall track the bid credits.
306-23 A contractor or subcontractor who has been awarded bid
307-24 credits under any other State program for employing
308-25 apprentices who have completed the Illinois Works
309-26 Preapprenticeship Program is not eligible to receive bid

320-1 credits under the Illinois Works Bid Credit Program relating
321-2 to the same contract.
322-3 The Department shall report to the Illinois Works Review
323-4 Panel the following: (i) the number of bid credits awarded by
324-5 the Department; (ii) the number of bid credits submitted by
325-6 the contractor or subcontractor to the agency administering
326-7 the public works contract; and (iii) the number of bid credits
327-8 accepted by the agency for such contract. Any agency that
328-9 awards bid credits pursuant to the Illinois Works Credit Bank
329-10 Program shall report to the Department the number of bid
330-11 credits it accepted for the public works contract.
331-12 Upon a finding that a contractor or subcontractor has
332-13 reported falsified records to the Department in order to
333-14 fraudulently obtain bid credits, the Department may bar the
334-15 contractor or subcontractor from participating in the Illinois
335-16 Works Bid Credit Program and may suspend the contractor or
336-17 subcontractor from bidding on or participating in any public
337-18 works project. False or fraudulent claims for payment relating
338-19 to false bid credits may be subject to damages and penalties
339-20 under applicable law.
340-21 (e) The Department shall adopt any rules deemed necessary
341-22 to implement this Section. In order to provide for the
342-23 expeditious and timely implementation of this Act, the
343-24 Department may adopt emergency rules. The adoption of
344-25 emergency rules authorized by this subsection is deemed to be
345-26 necessary for the public interest, safety, and welfare.
