1212 1 AN ACT concerning children.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Abandoned Newborn Infant Protection Act is
1616 5 amended by changing Sections 10 and 20 as follows:

1818 7 Sec. 10. Definitions. In this Act:
1919 8 "Abandon" has the same meaning as in the Abused and
2020 9 Neglected Child Reporting Act.
2121 10 "Abused child" has the same meaning as in the Abused and
2222 11 Neglected Child Reporting Act.
2323 12 "Child welfare agency" means an Illinois licensed public
2424 13 or private agency that receives a child for the purpose of
2525 14 placing or arranging for the placement of the child in a foster
2626 15 or pre-adoptive family home or other facility for child care,
2727 16 apart from the custody of the child's parents.
2828 17 "Child rescue pod" means a medical device used to maintain
2929 18 an optimal environment for the care of a newborn infant.
3030 19 "Department" or "DCFS" means the Illinois Department of
3131 20 Children and Family Services.
3232 21 "Emergency medical facility" means a freestanding
3333 22 emergency center or trauma center, as defined in the Emergency
3434 23 Medical Services (EMS) Systems Act.

7171 1 "Emergency medical professional" includes licensed
7272 2 physicians, and any emergency medical technician, emergency
7373 3 medical technician-intermediate, advanced emergency medical
7474 4 technician, paramedic, trauma nurse specialist, and
7575 5 pre-hospital registered nurse, as defined in the Emergency
7676 6 Medical Services (EMS) Systems Act.
7777 7 "Fire station" means a fire station within the State with
7878 8 at least one staff person.
7979 9 "Hospital" has the same meaning as in the Hospital
8080 10 Licensing Act.
8181 11 "Legal custody" means the relationship created by a court
8282 12 order in the best interest of a newborn infant that imposes on
8383 13 the infant's custodian the responsibility of physical
8484 14 possession of the infant, the duty to protect, train, and
8585 15 discipline the infant, and the duty to provide the infant with
8686 16 food, shelter, education, and medical care, except as these
8787 17 are limited by parental rights and responsibilities.
8888 18 "Neglected child" has the same meaning as in the Abused
8989 19 and Neglected Child Reporting Act.
9090 20 "Newborn infant" means a child who a licensed physician
9191 21 reasonably believes is 30 days old or less at the time the
9292 22 child is initially relinquished to a hospital, police station,
9393 23 fire station, or emergency medical facility, and who is not an
9494 24 abused or a neglected child.
9595 25 "Parent" or "biological parent" or "birth parent" means a
9696 26 person who has established maternity or paternity of the

108108 2 "Police station" means a municipal police station, a
109109 3 county sheriff's office, a campus police department located on
110110 4 any college or university owned or controlled by the State or
111111 5 any private college or private university that is not owned or
112112 6 controlled by the State when employees of the campus police
113113 7 department are present, or any of the district headquarters of
114114 8 the Illinois State Police.
115115 9 "Relinquish" means to bring a newborn infant, who a
116116 10 licensed physician reasonably believes is 30 days old or less,
117117 11 to a hospital, police station, fire station, or emergency
118118 12 medical facility and to leave the infant with personnel of the
119119 13 facility, if the person leaving the infant does not express an
120120 14 intent to return for the infant or states that the person will
121121 15 not return for the infant. In the case of a person who gives
122122 16 birth to an infant in a hospital, the person's act of leaving
123123 17 that newborn infant at the hospital (i) without expressing an
124124 18 intent to return for the infant or (ii) stating that the person
125125 19 will not return for the infant is not a "relinquishment" under
126126 20 this Act.
127127 21 "Temporary protective custody" means the temporary
128128 22 placement of a newborn infant within a hospital or other
129129 23 medical facility out of the custody of the infant's parent.

143143 2 Sec. 20. Procedures with respect to relinquished newborn
144144 3 infants.
145145 4 (a) Hospitals. Every hospital must accept and provide all
146146 5 necessary emergency services and care to a relinquished
147147 6 newborn infant, in accordance with this Act. All necessary
148148 7 emergency services and care may include having a child rescue
149149 8 pod available for use if the hospital has an emergency
150150 9 department that is staffed and monitored at all times. The
151151 10 hospital shall examine a relinquished newborn infant and
152152 11 perform tests that, based on reasonable medical judgment, are
153153 12 appropriate in evaluating whether the relinquished newborn
154154 13 infant was abused or neglected.
155155 14 The act of relinquishing a newborn infant serves as
156156 15 implied consent for the hospital and its medical personnel and
157157 16 physicians on staff to treat and provide care for the infant.
158158 17 The hospital shall be deemed to have temporary protective
159159 18 custody of a relinquished newborn infant until the infant is
160160 19 discharged to the custody of a child welfare agency or the
161161 20 Department. The hospital shall provide all available medical
162162 21 records and information to the Department and the child
163163 22 welfare agency that has accepted the referral of the infant in
164164 23 accordance with Section 50.
165165 24 If the person who relinquished or a person claiming to be
166166 25 the parent of a newborn infant returns to reclaim the infant
167167 26 within 30 days after the infant was relinquished to a

178178 1 hospital, the hospital must inform such person of the name and
179179 2 contact information of the child welfare agency to whom
180180 3 custody of the infant was transferred.
181181 4 (b) Fire stations and emergency medical facilities. Every
182182 5 fire station and emergency medical facility must accept and
183183 6 provide all necessary emergency services and care to a
184184 7 relinquished newborn infant, in accordance with this Act.
185185 8 The act of relinquishing a newborn infant serves as
186186 9 implied consent for the fire station or emergency medical
187187 10 facility and its emergency medical professionals to treat and
188188 11 provide care for the infant, to the extent that those
189189 12 emergency medical professionals are trained to provide those
190190 13 services.
191191 14 After the relinquishment of a newborn infant to a fire
192192 15 station or emergency medical facility, the fire station or
193193 16 emergency medical facility's personnel must arrange for the
194194 17 transportation of the infant to the nearest hospital as soon
195195 18 as transportation can be arranged.
196196 19 If the person who relinquished or a person claiming to be
197197 20 the parent of a newborn infant returns to reclaim the infant
198198 21 within 30 days after the infant was relinquished to a fire
199199 22 station or emergency medical facility, the fire station or
200200 23 emergency medical facility must inform such person of the name
201201 24 and location of the hospital to which the infant was
202202 25 transported.
203203 26 (c) Police stations. Every police station must accept a
