84 | 84 | | 14 possession of the infant, the duty to protect, train, and |
---|
85 | 85 | | 15 discipline the infant, and the duty to provide the infant with |
---|
86 | 86 | | 16 food, shelter, education, and medical care, except as these |
---|
87 | 87 | | 17 are limited by parental rights and responsibilities. |
---|
88 | 88 | | 18 "Neglected child" has the same meaning as in the Abused |
---|
89 | 89 | | 19 and Neglected Child Reporting Act. |
---|
90 | 90 | | 20 "Newborn infant" means a child who a licensed physician |
---|
91 | 91 | | 21 reasonably believes is 30 days old or less at the time the |
---|
92 | 92 | | 22 child is initially relinquished to a hospital, police station, |
---|
93 | 93 | | 23 fire station, or emergency medical facility, and who is not an |
---|

---|
119 | 119 | | 13 facility, if the person leaving the infant does not express an |
---|
120 | 120 | | 14 intent to return for the infant or states that the person will |
---|
121 | 121 | | 15 not return for the infant. In the case of a person who gives |
---|
122 | 122 | | 16 birth to an infant in a hospital, the person's act of leaving |
---|
123 | 123 | | 17 that newborn infant at the hospital (i) without expressing an |
---|
124 | 124 | | 18 intent to return for the infant or (ii) stating that the person |
---|
125 | 125 | | 19 will not return for the infant is not a "relinquishment" under |
---|
126 | 126 | | 20 this Act. |
---|
127 | 127 | | 21 "Temporary protective custody" means the temporary |
---|
128 | 128 | | 22 placement of a newborn infant within a hospital or other |

152 | 152 | | 11 perform tests that, based on reasonable medical judgment, are |

153 | 153 | | 12 appropriate in evaluating whether the relinquished newborn |
---|
154 | 154 | | 13 infant was abused or neglected. |
---|
155 | 155 | | 14 The act of relinquishing a newborn infant serves as |
---|
156 | 156 | | 15 implied consent for the hospital and its medical personnel and |
---|
157 | 157 | | 16 physicians on staff to treat and provide care for the infant. |
---|
158 | 158 | | 17 The hospital shall be deemed to have temporary protective |
---|
159 | 159 | | 18 custody of a relinquished newborn infant until the infant is |
---|
160 | 160 | | 19 discharged to the custody of a child welfare agency or the |
---|
161 | 161 | | 20 Department. The hospital shall provide all available medical |
---|
162 | 162 | | 21 records and information to the Department and the child |
---|
163 | 163 | | 22 welfare agency that has accepted the referral of the infant in |
---|
164 | 164 | | 23 accordance with Section 50. |
---|
165 | 165 | | 24 If the person who relinquished or a person claiming to be |

166 | 166 | | 25 the parent of a newborn infant returns to reclaim the infant |

188 | 188 | | 11 provide care for the infant, to the extent that those |

189 | 189 | | 12 emergency medical professionals are trained to provide those |

190 | 190 | | 13 services. |

191 | 191 | | 14 After the relinquishment of a newborn infant to a fire |

192 | 192 | | 15 station or emergency medical facility, the fire station or |

193 | 193 | | 16 emergency medical facility's personnel must arrange for the |

194 | 194 | | 17 transportation of the infant to the nearest hospital as soon |

195 | 195 | | 18 as transportation can be arranged. |

196 | 196 | | 19 If the person who relinquished or a person claiming to be |
