1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by
1515 5 changing Section 11-907 as follows:

1717 7 Sec. 11-907. Operation of vehicles and streetcars on
1818 8 approach of authorized emergency vehicles.
1919 9 (a) Upon the immediate approach of an authorized emergency
2020 10 vehicle making use of audible and visual signals meeting the
2121 11 requirements of this Code or a police vehicle properly and
2222 12 lawfully making use of an audible or visual signal:
2323 13 (1) the driver of every other vehicle shall yield the
2424 14 right-of-way and shall immediately drive to a position
2525 15 parallel to, and as close as possible to, the right-hand
2626 16 edge or curb of the highway clear of any intersection and
2727 17 shall, if necessary to permit the safe passage of the
2828 18 emergency vehicle, stop and remain in such position until
2929 19 the authorized emergency vehicle has passed, unless
3030 20 otherwise directed by a police officer; and
3131 21 (2) the operator of every streetcar shall immediately
3232 22 stop such car clear of any intersection and keep it in such

6969 2 (b) This Section shall not operate to relieve the driver
7070 3 of an authorized emergency vehicle from the duty to drive with
7171 4 due regard for the safety of all persons using the highway.
7272 5 (c) Upon approaching a stationary authorized emergency
7373 6 vehicle or emergency scene, when the stationary authorized
7474 7 emergency vehicle is giving a visual signal by displaying
7575 8 oscillating, rotating, or flashing lights as authorized under
7676 9 Section 12-215 of this Code, a person who drives an
7777 10 approaching vehicle shall:
7878 11 (1) proceeding with due caution, yield the
7979 12 right-of-way by making a lane change into a lane not
8080 13 adjacent to that of the authorized emergency vehicle, if
8181 14 possible with due regard to safety and traffic conditions,
8282 15 if on a highway having at least 4 lanes with not less than
8383 16 2 lanes proceeding in the same direction as the
8484 17 approaching vehicle and reduce the speed of the vehicle to
8585 18 a speed that is reasonable and proper with regard to
8686 19 traffic conditions and the use of the highway to avoid a
8787 20 collision and leaving a safe distance until safely past
8888 21 the stationary emergency vehicle; or
8989 22 (2) if changing lanes would be impossible or unsafe,
9090 23 proceeding with due caution, reduce the speed of the
9191 24 vehicle to a speed that is reasonable and proper with
9292 25 regard to traffic conditions and the use of the highway to
9393 26 avoid a collision, maintaining a safe speed for road

104104 1 conditions and leaving a safe distance until safely past
105105 2 the stationary emergency vehicles.
106106 3 The visual signal specified under this subsection (c)
107107 4 given by a stationary authorized emergency vehicle is an
108108 5 indication to drivers of approaching vehicles that a hazardous
109109 6 condition is present when circumstances are not immediately
110110 7 clear. Drivers of vehicles approaching a stationary authorized
111111 8 emergency vehicle in any lane shall heed the warning of the
112112 9 signal, reduce the speed of the vehicle, proceed with due
113113 10 caution, maintain a safe speed for road conditions, be
114114 11 prepared to stop, and leave a safe distance until safely
115115 12 passed the stationary emergency vehicle.
116116 13 As used in this subsection (c), "authorized emergency
117117 14 vehicle" includes any vehicle authorized by law to be equipped
118118 15 with oscillating, rotating, or flashing lights under Section
119119 16 12-215 of this Code, while the owner or operator of the vehicle
120120 17 is engaged in his or her official duties. As used in this
121121 18 subsection (c), "emergency scene" means a location where a
122122 19 stationary authorized emergency vehicle as defined by herein
123123 20 is present and has activated its oscillating, rotating, or
124124 21 flashing lights.
125125 22 (d) A person who violates subsection (c) of this Section
126126 23 commits a business offense punishable by a fine of not less
127127 24 than $350 $250 or more than $15,000 $10,000 for a first
128128 25 violation plus a mandatory $500 fine to be deposited into the
129129 26 Scott's Law Fund and any mandatory court costs, and a fine of

140140 1 not less than $12,500 $750 or more than $20,000 $10,000 for a
141141 2 second or subsequent violation plus a mandatory $750 fine to
142142 3 be deposited into the Scott's Law Fund and any mandatory court
143143 4 costs. It is a factor in aggravation if the person committed
144144 5 the offense while in violation of Section 11-501, 12-610.1, or
145145 6 12-610.2 of this Code. Imposition of the penalties authorized
146146 7 by this subsection (d) for a violation of subsection (c) of
147147 8 this Section that results in the death of another person does
148148 9 not preclude imposition of appropriate additional civil or
149149 10 criminal penalties. A person who violates subsection (c) and
150150 11 the violation results in damage to another vehicle commits a
151151 12 Class 4 felony Class A misdemeanor. A person who violates
152152 13 subsection (c) and the violation results in the injury or
153153 14 death of another person commits a Class 1 4 felony.
154154 15 (e) If a violation of subsection (c) of this Section
155155 16 results in damage to the property of another person, in
156156 17 addition to any other penalty imposed, the person's driving
157157 18 privileges shall be suspended for a fixed period of not less
158158 19 than 6 months 90 days and not more than one year.
159159 20 (f) If a violation of subsection (c) of this Section
160160 21 results in injury to another person, in addition to any other
161161 22 penalty imposed, the person's driving privileges shall be
162162 23 suspended for a fixed period of not less than 180 days and not
163163 24 more than 2 years.
164164 25 (g) If a violation of subsection (c) of this Section

176176 1 other penalty imposed, the person's driving privileges shall
177177 2 be permanently revoked suspended for 2 years.
178178 3 (h) The Secretary of State shall, upon receiving a record
179179 4 of a judgment entered against a person under subsection (c) of
180180 5 this Section:
181181 6 (1) suspend the person's driving privileges for the
182182 7 mandatory period; or
183183 8 (2) extend the period of an existing suspension by the
184184 9 appropriate mandatory period.
185185 10 (i) The Scott's Law Fund shall be a special fund in the
186186 11 State treasury. Subject to appropriation by the General
187187 12 Assembly and approval by the Director, the Director of the
188188 13 State Police shall use all moneys in the Scott's Law Fund in
189189 14 the Department's discretion to fund the production of
190190 15 materials to educate drivers on approaching stationary
191191 16 authorized emergency vehicles, to hire off-duty Illinois State
192192 17 Police for enforcement of this Section, and for other law
193193 18 enforcement purposes the Director deems necessary in these
194194 19 efforts.
195195 20 (j) For violations of this Section issued by a county or
196196 21 municipal police officer, the assessment shall be deposited
197197 22 into the county's or municipality's Transportation Safety
198198 23 Highway Hire-back Fund. The county shall use the moneys in its
199199 24 Transportation Safety Highway Hire-back Fund to hire off-duty
200200 25 county police officers to monitor construction or maintenance
201201 26 zones in that county on highways other than interstate
