11	11	1 AN ACT concerning transportation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Fox Waterway Agency Act is amended by
15	15	5 changing Section 7.2 as follows:

17	17	7 Sec. 7.2. The Agency may charge reasonable user fees for
18	18	8 recreational and commercial boating, and has the authority to
19	19	9 issue revenue bonds and to borrow funds from any financial
20	20	10 lending institution, but shall not have the authority to
21	21	11 impose any property tax. The Agency shall devise a schedule of
22	22	12 user fees. The Agency shall conduct public hearings before
23	23	13 establishing or changing user fees or soliciting the issuance
24	24	14 of revenue bonds or the borrowing of funds. The Agency may
25	25	15 issue stickers as evidence of the payment of user fees. The
26	26	16 Agency may impose a civil penalty on persons who knowingly use
27	27	17 the waterway without paying a required user fee in an amount
28	28	18 not exceeding $500 for each violation. Such civil penalty may
29	29	19 be recovered by the Agency in a civil action.
30	30	20 The Agency may also sell its dredging materials from the
31	31	21 waterway as reclaimed topsoil.
32	32	22 At least 75% of the gross income collected under this
33	33	23 Section shall be used exclusively for projects designed to
