Provides exceptions to the time limits for billing when the customer prevented the utility from accurately reading the meter. 311 1 AN ACT concerning local government.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 1. Short title. This Act may be cited as the Local
715 5 Government Billing Act.
816 6 Section 5. Definitions. As used in this Act:
917 7 "Corporate authorities" includes, but is not limited to:
1018 8 (1) the county board of a county;
11-9 (2) the corporate authorities of a municipality;
19+9 (2) the corporate of a municipality;
1220 10 (3) the township officials of a township; and
1321 11 (4) the board of trustees of a special district.
1422 12 Section 10. Billing for services.
15-13 (a) Beginning on the effective date of this Act, the
16-14 corporate authorities of any unit of local government
17-15 operating a waterworks, sewerage system, combined waterworks
18-16 and sewerage system, or electric utility:
23+13 (a) On or after the effective date of the Act of the 104th
24+14 General Assembly, the corporate authorities of any unit of
25+15 local government operating a waterworks, sewerage system,
26+16 combined waterworks and sewerage system, or electric utility:
1927 17 (1) shall bill for any utility service, including
2028 18 previously unbilled service: (A) within 12 months after
2129 19 the provision of that service to the customer if the
2230 20 service is supplied to a residential customer; or (B)
2331 21 within 24 months after the provision of that service to

3367 1 non-residential customer; however, the corporate
3468 2 authorities of the unit of government may bill for unpaid
3569 3 amounts that were billed to a customer or if the customer
3670 4 was notified that there is an unpaid amount before the
3771 5 effective date of this Act for service that was supplied
3872 6 to the customer before January 1, 2026;
3973 7 (2) shall not intentionally delay billing beyond the
4074 8 normal billing cycle;
4175 9 (3) shall label any amount attributed to previously
4276 10 unbilled service as such on the customer's bill and
4377 11 include the beginning and ending dates for the period
4478 12 during which the previously unbilled amount accrued;
4579 13 (4) shall issue the makeup billing amount calculated
4680 14 on a prorated basis to reflect the varying rates for
4781 15 previously unbilled service accrued over a period of time
4882 16 when the rates for service have varied; and
4983 17 (5) shall provide the customer with the option of a
5084 18 payment arrangement to retire the makeup bill for
5185 19 previously unbilled service by periodic payments, without
5286 20 interest or late fees, over a time equal to the amount of
5387 21 time the billing was delayed.
5488 22 (b) The time limit of paragraph (1) of subsection (a)
5589 23 shall not apply to previously unbilled service attributed to
5690 24 tampering, theft of service, fraud, or the customer preventing
5791 25 the utility's recorded efforts to obtain an accurate reading

69-1 Section 15. Home rule. A home rule unit of local
70-2 government may not regulate utilities in a manner inconsistent
71-3 with this Act. This Section is a limitation under subsection
72-4 (i) of Section 6 of Article VII of the Illinois Constitution on
73-5 the concurrent exercise by home rule units of powers and
74-6 functions exercised by the State.
