1111 1 AN ACT concerning health.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Expanded Access to Lung Cancer Screening Act.
1616 6 Section 5. Definitions. In this Act:
1717 7 "Department" means the Department of Public Health.
1818 8 "Nicotine replacement therapy" means a treatment that
1919 9 helps people quit smoking by providing a lower dose of
2020 10 nicotine without the harmful chemicals in cigarettes.
2121 11 "Nicotine replacement therapy" includes a patch, gum, lozenge,
2222 12 spray, or inhaler that releases nicotine into the body.
2323 13 "Retailer of tobacco products" has the meaning given to
2424 14 the term "retailer" in Section 10-5 of the Tobacco Products
2525 15 Tax Act of 1995.
2626 16 "Retailer of nicotine replacement therapies" means a
2727 17 person engaged in the business of selling nicotine replacement
2828 18 therapies to consumers.
2929 19 "Tobacco quitline" means a resource that is free to
3030 20 tobacco users in Illinois who want to quit using tobacco, that
3131 21 is accessible by a toll-free telephone number, and that is
3232 22 established, operated, and funded with the assistance of the
3333 23 Department. "Tobacco quitline" includes an evidence-based

6868 1 program, certified counselors, and staff to provide the
6969 2 support needed for tobacco users in Illinois to break the
7070 3 habit of using tobacco.
7171 4 Section 10. Lung cancer screening counseling. The
7272 5 Department shall require information and counseling concerning
7373 6 lung cancer screening to be made available to individuals
7474 7 through the tobacco quitline. The Department may enter into
7575 8 contracts and agreements with persons operating the tobacco
7676 9 quitline on behalf of the Department and may award grants for
7777 10 the purposes of this Act. In the course of providing
7878 11 information and counseling concerning lung cancer screening,
7979 12 the Department and the operators of the tobacco quitline
8080 13 shall:
8181 14 (1) rely upon the criteria and guidelines developed by
8282 15 the United States Preventive Service Task Force for lung
8383 16 cancer screening;
8484 17 (2) provide information about, and direct eligible
8585 18 individuals to, lung cancer screening services; and
8686 19 (3) participate in quality improvement activities,
8787 20 including reporting data to the Department on the number
8888 21 of callers referred to lung cancer screening.
8989 22 Section 15. Education about lung cancer screening.
9090 23 (a) The Department shall develop signage that discloses
9191 24 referral information for lung cancer screening. The signage

102102 1 shall include, but shall not be limited to, the following:
103103 2 (1) information about who is eligible for lung cancer
104104 3 screening; and
105105 4 (2) contact information for the tobacco quitline,
106106 5 including the toll-free telephone number.
107107 6 The Department shall make available this signage to
108108 7 retailers of tobacco products and retailers of nicotine
109109 8 replacement therapies. Retailers of tobacco products and
110110 9 retailers of nicotine replacement therapies shall
111111 10 conspicuously post this signage in their retail
112112 11 establishments.
113113 12 (b) The Department shall develop an educational insert to
114114 13 accompany the sale of tobacco products and nicotine
115115 14 replacement therapies. This educational insert shall include,
116116 15 but shall not be limited to, the following:
117117 16 (1) information on the effectiveness of lung cancer
118118 17 screening;
119119 18 (2) information on the eligibility criteria for lung
120120 19 cancer screening under the United States Preventive
121121 20 Service Task Force guidelines; and
122122 21 (3) contact information for the tobacco quitline,
123123 22 including the toll-free telephone number.
124124 23 The Department shall make available this educational
125125 24 insert to retailers of tobacco products and retailers of
126126 25 nicotine replacement therapies. Retailers of tobacco products
127127 26 and retailers of nicotine replacement therapies shall provide

138138 1 a copy of the educational insert provided by the Department to
139139 2 every person purchasing a tobacco product or nicotine
140140 3 replacement therapy at the point of sale.
141141 4 (c) A retailer of tobacco products or a retailer of
142142 5 nicotine replacement therapies who intentionally violates any
143143 6 provision of this Section is guilty of a petty offense.
