11	11	1 AN ACT concerning health.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 Expanded Access to Lung Cancer Screening Act.
16	16	6 Section 5. Definitions. In this Act:
17	17	7 "Department" means the Department of Public Health.
18	18	8 "Nicotine replacement therapy" means a treatment that
19	19	9 helps people quit smoking by providing a lower dose of
20	20	10 nicotine without the harmful chemicals in cigarettes.
21	21	11 "Nicotine replacement therapy" includes a patch, gum, lozenge,
22	22	12 spray, or inhaler that releases nicotine into the body.
23	23	13 "Retailer of tobacco products" has the meaning given to
24	24	14 the term "retailer" in Section 10-5 of the Tobacco Products
25	25	15 Tax Act of 1995.
26	26	16 "Retailer of nicotine replacement therapies" means a
27	27	17 person engaged in the business of selling nicotine replacement
28	28	18 therapies to consumers.
29	29	19 "Tobacco quitline" means a resource that is free to
30	30	20 tobacco users in Illinois who want to quit using tobacco, that
31	31	21 is accessible by a toll-free telephone number, and that is
32	32	22 established, operated, and funded with the assistance of the
33	33	23 Department. "Tobacco quitline" includes an evidence-based

68	68	1 program, certified counselors, and staff to provide the
69	69	2 support needed for tobacco users in Illinois to break the
70	70	3 habit of using tobacco.
71	71	4 Section 10. Lung cancer screening counseling. The
72	72	5 Department shall require information and counseling concerning
73	73	6 lung cancer screening to be made available to individuals
74	74	7 through the tobacco quitline. The Department may enter into
75	75	8 contracts and agreements with persons operating the tobacco
76	76	9 quitline on behalf of the Department and may award grants for
77	77	10 the purposes of this Act. In the course of providing
78	78	11 information and counseling concerning lung cancer screening,
79	79	12 the Department and the operators of the tobacco quitline
80	80	13 shall:
81	81	14 (1) rely upon the criteria and guidelines developed by
82	82	15 the United States Preventive Service Task Force for lung
83	83	16 cancer screening;
84	84	17 (2) provide information about, and direct eligible
85	85	18 individuals to, lung cancer screening services; and
86	86	19 (3) participate in quality improvement activities,
87	87	20 including reporting data to the Department on the number
88	88	21 of callers referred to lung cancer screening.
89	89	22 Section 15. Education about lung cancer screening.
90	90	23 (a) The Department shall develop signage that discloses
91	91	24 referral information for lung cancer screening. The signage

102	102	1 shall include, but shall not be limited to, the following:
103	103	2 (1) information about who is eligible for lung cancer
104	104	3 screening; and
105	105	4 (2) contact information for the tobacco quitline,
106	106	5 including the toll-free telephone number.
107	107	6 The Department shall make available this signage to
108	108	7 retailers of tobacco products and retailers of nicotine
109	109	8 replacement therapies. Retailers of tobacco products and
110	110	9 retailers of nicotine replacement therapies shall
111	111	10 conspicuously post this signage in their retail
112	112	11 establishments.
113	113	12 (b) The Department shall develop an educational insert to
114	114	13 accompany the sale of tobacco products and nicotine
115	115	14 replacement therapies. This educational insert shall include,
116	116	15 but shall not be limited to, the following:
117	117	16 (1) information on the effectiveness of lung cancer
118	118	17 screening;
119	119	18 (2) information on the eligibility criteria for lung
120	120	19 cancer screening under the United States Preventive
121	121	20 Service Task Force guidelines; and
122	122	21 (3) contact information for the tobacco quitline,
123	123	22 including the toll-free telephone number.
124	124	23 The Department shall make available this educational
125	125	24 insert to retailers of tobacco products and retailers of
126	126	25 nicotine replacement therapies. Retailers of tobacco products
127	127	26 and retailers of nicotine replacement therapies shall provide

139	139	2 every person purchasing a tobacco product or nicotine
140	140	3 replacement therapy at the point of sale.
141	141	4 (c) A retailer of tobacco products or a retailer of
142	142	5 nicotine replacement therapies who intentionally violates any
143	143	6 provision of this Section is guilty of a petty offense.
