15	15	1 AN ACT concerning public employee benefits.
16	16	2 Be it enacted by the People of the State of Illinois,
17	17	3 represented in the General Assembly:
18	18	4 Section 5. The Illinois Pension Code is amended by adding
19	19	5 Sections 3-110.15 and 4-108.9 as follows:
20	20	6 (40 ILCS 5/3-110.15 new)
21	21	7 Sec. 3-110.15. Transfer from Article 4 fund. Until 6
22	22	8 months after the effective date of this amendatory Act of the
23	23	9 104th General Assembly, a person may transfer to a fund
24	24	10 established under this Article up to 8 years of creditable
25	25	11 service accumulated in a firefighter pension fund under
26	26	12 Article 4 that is administered by a unit of local government,
27	27	13 if that active member was not subject to disciplinary action
28	28	14 when he or she terminated employment with that employer, upon
29	29	15 payment to the fund of an amount to be determined by the board,
30	30	16 equal to (i) the difference between the amount of employee and
31	31	17 employer contributions transferred to the fund under Section
32	32	18 4-108.9 and the amounts that would have been contributed had
33	33	19 such contributions been made at the rates applicable to a
34	34	20 police officer under this Article, plus (ii) interest thereon
35	35	21 at the actuarially assumed rate, compounded annually, from the
36	36	22 date of service to the date of payment.

83	83	3 (a) At any time during the 6 months following the
84	84	4 effective date of this amendatory Act of the 104th General
85	85	5 Assembly, an active member of an Article 3 police pension fund
86	86	6 may apply for transfer to that fund of up to 8 years of his or
87	87	7 her creditable service accumulated in a firefighter pension
88	88	8 fund under this Article that is administered by a unit of local
89	89	9 government if that active member was not subject to
90	90	10 disciplinary action when he or she terminated employment with
91	91	11 that employer. The creditable service shall be transferred
92	92	12 upon payment by the firefighter pension fund to the Article 3
93	93	13 fund of an amount equal to:
94	94	14 (1) the amounts accumulated to the credit of the
95	95	15 applicant on the books of the fund on the date of transfer
96	96	16 for the service to be transferred; and
97	97	17 (2) employer contributions in an amount equal to the
98	98	18 amount determined under item (1); and
99	99	19 (3) any interest paid by the applicant in order to
100	100	20 reinstate service.
101	101	21 Participation in the firefighter pension fund with respect
102	102	22 to the transferred creditable service shall terminate on the
103	103	23 date of transfer.
104	104	24 (b) At the time of applying for transfer of creditable
105	105	25 service under this Section, an active member of an Article 3
106	106	26 police pension fund may, for the purpose of that transfer,

117	117	1 reinstate creditable service that was terminated by receipt of
118	118	2 a refund, by payment to the police pension fund of the amount
119	119	3 of the refund with interest thereon at the rate of 6% per year,
120	120	4 compounded annually, from the date of the refund to the date of
