Provides that, at any time during the 6 months following the effective date of the amendatory Act, an active member of a downstate police pension fund may apply for transfer to that fund of up to 8 years of his or her creditable service accumulated in a downstate firefighter pension fund that is administered by a unit of local government if that active member was not subject to disciplinary action when he or she terminated employment with that employer. Provides that the creditable service shall be transferred upon payment of a specified amount. Provides that, at the time of applying for a transfer of creditable service, an active member of a downstate police pension fund may, for the purpose of that transfer, reinstate creditable service that was terminated by receipt of a refund, by payment to the downstate police pension fund of a specified amount. Amends the State Mandates Act to require implementation without reimbursement. 1515 1 AN ACT concerning public employee benefits.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 5. The Illinois Pension Code is amended by adding
1919 5 Sections 3-110.15 and 4-108.9 as follows:
2020 6 (40 ILCS 5/3-110.15 new)
2121 7 Sec. 3-110.15. Transfer from Article 4 fund. Until 6
2222 8 months after the effective date of this amendatory Act of the
2323 9 104th General Assembly, a person may transfer to a fund
2424 10 established under this Article up to 8 years of creditable
2525 11 service accumulated in a firefighter pension fund under
2626 12 Article 4 that is administered by a unit of local government,
2727 13 if that active member was not subject to disciplinary action
2828 14 when he or she terminated employment with that employer, upon
2929 15 payment to the fund of an amount to be determined by the board,
3030 16 equal to (i) the difference between the amount of employee and
3131 17 employer contributions transferred to the fund under Section
3232 18 4-108.9 and the amounts that would have been contributed had
3333 19 such contributions been made at the rates applicable to a
3434 20 police officer under this Article, plus (ii) interest thereon
3535 21 at the actuarially assumed rate, compounded annually, from the
3636 22 date of service to the date of payment.

8282 2 Sec. 4-108.9. Transfer to Article 3 fund.
8383 3 (a) At any time during the 6 months following the
8484 4 effective date of this amendatory Act of the 104th General
8585 5 Assembly, an active member of an Article 3 police pension fund
8686 6 may apply for transfer to that fund of up to 8 years of his or
8787 7 her creditable service accumulated in a firefighter pension
8888 8 fund under this Article that is administered by a unit of local
8989 9 government if that active member was not subject to
9090 10 disciplinary action when he or she terminated employment with
9191 11 that employer. The creditable service shall be transferred
9292 12 upon payment by the firefighter pension fund to the Article 3
9393 13 fund of an amount equal to:
9494 14 (1) the amounts accumulated to the credit of the
9595 15 applicant on the books of the fund on the date of transfer
9696 16 for the service to be transferred; and
9797 17 (2) employer contributions in an amount equal to the
9898 18 amount determined under item (1); and
9999 19 (3) any interest paid by the applicant in order to
100100 20 reinstate service.
101101 21 Participation in the firefighter pension fund with respect
102102 22 to the transferred creditable service shall terminate on the
103103 23 date of transfer.
104104 24 (b) At the time of applying for transfer of creditable
105105 25 service under this Section, an active member of an Article 3
106106 26 police pension fund may, for the purpose of that transfer,

117117 1 reinstate creditable service that was terminated by receipt of
118118 2 a refund, by payment to the police pension fund of the amount
119119 3 of the refund with interest thereon at the rate of 6% per year,
120120 4 compounded annually, from the date of the refund to the date of
121121 5 payment.
122122 6 Section 90. The State Mandates Act is amended by adding
