1+104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 HB3769 Introduced , by Rep. Bob Morgan SYNOPSIS AS INTRODUCED: 225 ILCS 75/3.1 Amends the Illinois Occupational Therapy Practice Act. Requires a licensed occupational therapist or licensed occupational therapy assistant who intends to provide services for individuals, groups, and populations concerning occupational therapy needs without a referral to do so within the licensee's scope of practice. Provides that a referral is not required for the purpose of providing consultations, habilitation services, screenings, education, wellness services, preventions services, environmental assessments, and work-related ergonomic services. Provides that, except for occupational therapy services within the licensee's scope of practice at the time of evaluation and services provided pursuant to provisions concerning when referrals are not required, an occupational therapist shall refer a patient to the patient's treating health care professional of record, or to a health care professional of the patient's choosing if there is no health care professional of record, if the patient meets certain criteria. Provides that an occupational therapist shall refer a patient to the patient's treating health care professional of record, or to a health care professional of the patient's choosing if there is no health care professional of record if the patient does not demonstrate measurable or function improvement after 10 visits (rather than after 10 visits or 15 business days, whichever occurs first). 311 1 AN ACT concerning regulation.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Illinois Occupational Therapy Practice Act
715 5 is amended by changing Section 3.1 as follows:

917 7 (Section scheduled to be repealed on January 1, 2029)
1018 8 Sec. 3.1. Referrals.
1119 9 (a) A licensed occupational therapist or licensed
1220 10 occupational therapy assistant may, within the licensee's
1321 11 scope of practice, provide occupational therapy evaluate,
1422 12 initiate, and provide occupational therapy services and
1523 13 consult with, educate, evaluate, and monitor services for
1624 14 individuals, groups, and populations concerning occupational
1725 15 therapy needs without a referral.
1826 16 (b) (Blank).
1927 17 (b-5) A referral is not required for the purpose of
2028 18 providing consultation, habilitation, screening, education,
2129 19 wellness, prevention, environmental assessments, and
2230 20 work-related ergonomic services.
2331 21 (c) Referral from a physician or other health care
2432 22 provider is not required for evaluation or intervention for
2533 23 children and youths if an occupational therapist or

34-1 occupational therapy assistant provides the services in a
35-2 school-based or educational environment, including the child's
36-3 home.
37-4 (d) Except for occupational therapy services within the
38-5 licensee's scope of practice at the time of evaluation and
39-6 services provided pursuant to subsections (b-5) or (c), an An
40-7 occupational therapist shall refer a patient to the patient's
41-8 treating health care professional of record, or to a health
42-9 care professional of the patient's choosing if there is no
43-10 health care professional of record, if:
44-11 (1) the patient does not demonstrate measurable or
45-12 functional improvement after 10 visits or 15 business
46-13 days, whichever occurs first, and continued improvement
47-14 thereafter;
48-15 (2) the patient was under the care of an occupational
49-16 therapist without a diagnosis established by a health care
50-17 professional of a chronic disease that may benefit from
51-18 occupational therapy and returns for services for the same
52-19 or similar condition 30 calendar days after being
53-20 discharged by the occupational therapist; or
54-21 (3) the patient's medical condition, at the time of
55-22 evaluation or services, is determined to be beyond the
56-23 scope of practice of the occupational therapist.
