12	12	1 AN ACT concerning transportation.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Illinois Vehicle Code is amended by
16	16	5 changing Section 11-1404 and by adding Section 11-1404.5 as
17	17	6 follows:

19	19	8 Sec. 11-1404. Special equipment for persons riding
20	20	9 motorcycles, motor driven cycles or mopeds.
21	21	10 (a) The operator of a motorcycle, motor driven cycle or
22	22	11 moped and every passenger thereon shall be protected by a
23	23	12 safety helmet and glasses, goggles or a transparent shield.
24	24	13 (b) For the purposes of this Section, glasses, goggles,
25	25	14 and transparent shields are defined as follows:
26	26	15 "Glasses" means ordinary eye pieces such as spectacles or
27	27	16 sunglasses worn before the eye, made of shatter-resistant
28	28	17 material. "Shatter-resistant material", as used in this
29	29	18 Section, means material so manufactured, fabricated, or
30	30	19 created that it substantially prevents shattering or flying
31	31	20 when struck or broken.
32	32	21 "Goggles" means a device worn before the eyes, the
33	33	22 predominant function of which is protecting the eyes without
34	34	23 obstructing peripheral vision. Goggles shall provide

79	79	9 "Transparent shield" means a windshield attached to the
80	80	10 front of a motorcycle that extends above the eyes when an
81	81	11 operator is seated in the normal, upright riding position,
82	82	12 made of shatter-resistant material, or a shatter-resistant
83	83	13 protective face shield that covers the wearer's eyes and face
84	84	14 at least to a point approximately to the tip of the nose.
85	85	15 (c) Contact lenses are not acceptable eye protection
86	86	16 devices.

91	91	21 (a) For the purposes of this Section, "wear a safety
92	92	22 helmet" or "wearing a safety helmet" means having a safety
93	93	23 helmet meeting the requirements of Section 11-1404 on the
94	94	24 person's head that is fastened with the helmet straps and that
95	95	25 is of a size that fits the wearing person's head securely

107	107	2 (b) It is unlawful to operate a motorcycle, motor driven
108	108	3 cycle, or moped if the driver or any passenger is not wearing a
109	109	4 safety helmet as required by Section 11-1404.
110	110	5 (c) It is unlawful to ride as a passenger on a motorcycle,
111	111	6 motor driven cycles, or moped if the driver or any passenger is
112	112	7 not wearing a safety helmet as required by Section 11-1404.
113	113	8 (d) This Section applies to a person who is riding on a
114	114	9 motorcycle, motor driven cycle, or moped operated on State
115	115	10 highways.
116	116	11 (e) This Section does not apply to a person operating, or
117	117	12 riding as a passenger in, a fully enclosed 3-wheeled motor
118	118	13 vehicle that is not less than 7 feet in length and not less
119	119	14 than 4 feet in width, and has an unladen weight of 900 pounds
120	120	15 or more, if the vehicle meets or exceeds all of the
121	121	16 requirements of this Code, the federal Motor Vehicle Safety
122	122	17 Standards, and the rules and regulations adopted by the United
123	123	18 States Department of Transportation and the National Highway
124	124	19 Traffic Safety Administration.
125	125	20 (f) This Section does not apply to a driver or passenger
126	126	21 who wears a turban or patka as an expression of the person's
127	127	22 religious belief and practice when riding on a motorcycle,
128	128	23 motor driven cycle, or moped.
129	129	24 (g) In enacting this Section, it is the intent of the
130	130	25 General Assembly to ensure that all persons are provided with
131	131	26 an additional safety benefit while operating or riding a
