1212 1 AN ACT concerning transportation.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Illinois Vehicle Code is amended by
1616 5 changing Section 11-1404 and by adding Section 11-1404.5 as
1717 6 follows:
1818 7 (625 ILCS 5/11-1404) (from Ch. 95 1/2, par. 11-1404)
1919 8 Sec. 11-1404. Special equipment for persons riding
2020 9 motorcycles, motor driven cycles or mopeds.
2121 10 (a) The operator of a motorcycle, motor driven cycle or
2222 11 moped and every passenger thereon shall be protected by a
2323 12 safety helmet and glasses, goggles or a transparent shield.
2424 13 (b) For the purposes of this Section, glasses, goggles,
2525 14 and transparent shields are defined as follows:
2626 15 "Glasses" means ordinary eye pieces such as spectacles or
2727 16 sunglasses worn before the eye, made of shatter-resistant
2828 17 material. "Shatter-resistant material", as used in this
2929 18 Section, means material so manufactured, fabricated, or
3030 19 created that it substantially prevents shattering or flying
3131 20 when struck or broken.
3232 21 "Goggles" means a device worn before the eyes, the
3333 22 predominant function of which is protecting the eyes without
3434 23 obstructing peripheral vision. Goggles shall provide

7171 1 protection from the front and sides, and may or may not form a

7373 3 "Safety helmet" means a protective covering for the head
7474 4 consisting of a hard outer shell, padding adjacent to and
7575 5 inside the outer shell, and a chin-strap type retention system
7676 6 with a sticker indicating that the safety helmet meets
7777 7 standards established by the United States Department of
7878 8 Transportation.
7979 9 "Transparent shield" means a windshield attached to the
8080 10 front of a motorcycle that extends above the eyes when an
8181 11 operator is seated in the normal, upright riding position,
8282 12 made of shatter-resistant material, or a shatter-resistant
8383 13 protective face shield that covers the wearer's eyes and face
8484 14 at least to a point approximately to the tip of the nose.
8585 15 (c) Contact lenses are not acceptable eye protection
8686 16 devices.

9191 21 (a) For the purposes of this Section, "wear a safety
9292 22 helmet" or "wearing a safety helmet" means having a safety
9393 23 helmet meeting the requirements of Section 11-1404 on the
9494 24 person's head that is fastened with the helmet straps and that
9595 25 is of a size that fits the wearing person's head securely

107107 2 (b) It is unlawful to operate a motorcycle, motor driven
108108 3 cycle, or moped if the driver or any passenger is not wearing a
109109 4 safety helmet as required by Section 11-1404.
110110 5 (c) It is unlawful to ride as a passenger on a motorcycle,
111111 6 motor driven cycles, or moped if the driver or any passenger is
112112 7 not wearing a safety helmet as required by Section 11-1404.
113113 8 (d) This Section applies to a person who is riding on a
114114 9 motorcycle, motor driven cycle, or moped operated on State
115115 10 highways.
116116 11 (e) This Section does not apply to a person operating, or
117117 12 riding as a passenger in, a fully enclosed 3-wheeled motor
118118 13 vehicle that is not less than 7 feet in length and not less
119119 14 than 4 feet in width, and has an unladen weight of 900 pounds
120120 15 or more, if the vehicle meets or exceeds all of the
121121 16 requirements of this Code, the federal Motor Vehicle Safety
122122 17 Standards, and the rules and regulations adopted by the United
123123 18 States Department of Transportation and the National Highway
124124 19 Traffic Safety Administration.
125125 20 (f) This Section does not apply to a driver or passenger
126126 21 who wears a turban or patka as an expression of the person's
127127 22 religious belief and practice when riding on a motorcycle,
128128 23 motor driven cycle, or moped.
129129 24 (g) In enacting this Section, it is the intent of the
130130 25 General Assembly to ensure that all persons are provided with
131131 26 an additional safety benefit while operating or riding a
