2929 2 Be it enacted by the People of the State of Illinois,
3030 3 represented in the General Assembly:
3131 4 Section 5. The Barber, Cosmetology, Esthetics, Hair
3232 5 Braiding, and Nail Technology Act of 1985 is amended by
3333 6 changing Sections 2-2, 2-3, 2-4, 2-7, 2-10, 3-2, 3-3, 3-4,
3434 7 3-6, 3-9, 3A-2, 3A-3, 3A-5, 3C-2, 3C-3, 3C-7, 3E-2, and 3E-3 as
3535 8 follows:

3838 11 Sec. 2-2. Licensure as a barber; qualifications. A person
3939 12 is qualified to receive a license as a barber if that person
4040 13 has applied in writing on forms prescribed by the Department,
4141 14 has paid the required fees, and:
4242 15 a. Is at least 16 years of age; and
4343 16 b. Has a certificate of graduation from a school
4444 17 providing secondary education, or the recognized
4545 18 equivalent of such a certificate, or persons who are
4646 19 beyond the age of compulsory school attendance; and

121121 3 Department, accept up to 800 1,000 hours of cosmetology
122122 4 school training at a recognized cosmetology school toward

124124 6 spent in such study under the laws of another state or
125125 7 territory of the United States or of a foreign country or
126126 8 province shall be credited toward the period of study
127127 9 required by the provisions of this paragraph; and
128128 10 d. Has passed an examination caused to be conducted by
129129 11 the Department or its designated testing service to
130130 12 determine fitness to receive a license as a barber; and
131131 13 e. Has met all other requirements of this Act.

200200 12 (3) completed the cosmetology teacher training as
201201 13 specified in paragraph (4) of subsection (a) of
202202 14 Section 3-4 of this Act and completed a supplemental
203203 15 barbering course as established by rule;
204204 16 e. Has passed an examination authorized by the
205205 17 Department to determine fitness to receive a license as a
206206 18 barber teacher or a cosmetology teacher; and
207207 19 f. Has met any other requirements set forth in this
208208 20 Act.
209209 21 An applicant who is issued a license as a barber teacher is
210210 22 not required to maintain a barber license in order to practice
211211 23 barbering as defined in this Act.

226226 3 Sec. 2-7. Examination of applicants. The Department shall
227227 4 hold examinations of applicants for licensure as barbers and
228228 5 teachers of barbering at such times and places as it may
229229 6 determine. Upon request, the examinations shall be
230230 7 administered in Spanish.
231231 8 Each applicant shall be given a written examination
232232 9 testing both theoretical and practical knowledge of the
233233 10 following subjects insofar as they are related and applicable
234234 11 to the practice of barber science and art: (1) anatomy, (2)
235235 12 physiology, (3) skin diseases, (4) hygiene and sanitation, (5)
236236 13 barber history, (6) this Act and the rules for the
237237 14 administration of this Act, (7) hair cutting and styling, (8)
238238 15 shaving, shampooing, and permanent waving, (9) massaging, (10)
239239 16 bleaching, tinting, and coloring, and (11) implements.
240240 17 The examination of applicants for licensure as a barber
241241 18 teacher shall include: (a) practice of barbering and styling,
242242 19 (b) theory of barbering, (c) methods of teaching, and (d)
243243 20 school management.
244244 21 An applicant for licensure as a barber who has completed
245245 22 960 1,200 hours in the study of barbering may take the
246246 23 examination. If an applicant for licensure as a barber fails
247247 24 to pass 3 examinations conducted by the Department, the
248248 25 applicant shall, before taking a subsequent examination,
249249 26 furnish evidence of not less than 200 250 hours of additional

260260 1 study of barbering in an approved school of barbering or
261261 2 cosmetology since the applicant last took the examination. If
262262 3 an applicant for licensure as a barber teacher fails to pass 3
263263 4 examinations conducted by the Department, the applicant shall,
264264 5 before taking a subsequent examination, furnish evidence of
265265 6 not less than 64 80 hours of additional study in teaching
266266 7 methodology and educational psychology in an approved school
267267 8 of barbering or cosmetology since the applicant last took the
268268 9 examination. An applicant who fails to pass the fourth
269269 10 examination shall not again be admitted to an examination
270270 11 unless: (i) in the case of an applicant for licensure as a
271271 12 barber, the applicant again takes and completes a program of
272272 13 1,200 1,500 hours in the study of barbering in an approved
273273 14 school of barbering or cosmetology extending over a period
274274 15 that commences after the applicant fails to pass the fourth
275275 16 examination and that is not less than 8 months nor more than 7
276276 17 consecutive years in duration; or (ii) in the case of an
277277 18 applicant for licensure as a barber teacher, the applicant
278278 19 again takes and completes a program of 800 1,000 hours of
279279 20 teacher training in an approved school of barbering or
280280 21 cosmetology, except that if the applicant had 2 years of
281281 22 practical experience as a licensed barber within the 5 years
282282 23 preceding the initial examination taken by the applicant, the
283283 24 applicant must again take and complete a program of 400 500
284284 25 hours of teacher training in an approved school of barbering

486486 15 2009, may renew the license after that date under this Act and
487487 16 that person may continue to renew the license or have the
488488 17 license restored during his or her lifetime, subject only to
489489 18 the renewal or restoration requirements for the license under
490490 19 this Act; however, such licensee and license shall remain
491491 20 subject to the provisions of this Act, including, but not
492492 21 limited to, provisions concerning renewal, restoration, fees,
493493 22 continuing education, discipline, administration, and
494494 23 enforcement.

525525 19 before taking a subsequent examination, furnish evidence of

808808 18 license, except the passing of an examination to be eligible
809809 19 to receive such license certificate, until: (i) the expiration
810810 20 of 6 months after the filing of such written application, or
811811 21 (ii) the decision of the Department that the applicant has
812812 22 failed to pass an examination within 6 months or failed
813813 23 without an approved excuse to take an examination conducted
814814 24 within 6 months by the Department, or (iii) the withdrawal of

843843 17 (d) Has passed an examination authorized by the
844844 18 Department to determine eligibility to receive a license
845845 19 as a nail technician; and
846846 20 (e) Has met any other requirements of this Act.
847847 21 Time spent in the study of nail technology under the laws
848848 22 of another state or territory of the United States, or of a
849849 23 foreign country or province, shall be credited toward the
850850 24 period of study required by the provisions of subsection (c).

874874 13 hours of teacher training in a licensed school of nail
875875 14 technology or cosmetology, and had 2 years of practical
876876 15 experience as a nail technician; or (2) has completed a
877877 16 program of 600 625 hours of teacher training in a licensed
878878 17 school of cosmetology approved to teach nail technology or
879879 18 school of nail technology; and
880880 19 (5) who has passed an examination authorized by the
881881 20 Department to determine eligibility to receive a license
882882 21 as a cosmetology or nail technology teacher.
883883 22 (b) An applicant who receives a license as a nail
884884 23 technology teacher shall not be required to maintain a license
885885 24 as a nail technician.

899899 3 Sec. 3C-7. Examinations; failure or refusal to take
900900 4 examination. The Department shall authorize examinations of
901901 5 applicants for licenses as nail technicians and teachers of
902902 6 nail technology at the times and places as it may determine. An
903903 7 applicant for licensure as a nail technician who has completed
904904 8 224 280 hours in the study of nail technology may take the
905905 9 examination.
906906 10 The Department shall authorize not less than 4
907907 11 examinations for licenses as nail technicians, and nail
908908 12 technology teachers in a calendar year.
909909 13 If an applicant neglects, fails without an approved
910910 14 excuse, or refuses to take the next available examination
911911 15 offered for licensure under this Act, the fee paid by the
912912 16 applicant shall be forfeited to the Department and the
913913 17 application denied. If an applicant fails to pass an
914914 18 examination for licensure under this Act within 3 years after
915915 19 filing an application, the application shall be denied.
916916 20 Nevertheless, the applicant may thereafter make a new
917917 21 application for examination, accompanied by the required fee,
918918 22 if he or she meets the requirements in effect at the time of
919919 23 reapplication. If an applicant for licensure as a nail
920920 24 technician or nail technology teacher is unsuccessful at 3
921921 25 examinations conducted by the Department, the applicant shall,

934934 3 than 48 60 hours of additional study of nail technology in a

936936 5 technology or nail technology and (ii) for a nail technology
937937 6 teacher, not less than 64 80 hours of additional study in
938938 7 teaching methodology and educational psychology in an approved
939939 8 school of cosmetology or nail technology since the applicant
940940 9 last took the examination.
941941 10 An applicant who fails the fourth examination shall not
942942 11 again be admitted to an examination unless: (i) in the case of
943943 12 an applicant for a license as a nail technician, the applicant
944944 13 again takes and completes a total of 280 350 hours in the study
945945 14 of nail technology in an approved school of cosmetology or
946946 15 nail technology extending over a period that commences after
947947 16 the applicant fails to pass the fourth examination and that is
948948 17 not less than 8 weeks nor more than 2 consecutive years in
949949 18 duration; or (ii) in the case of an applicant for licensure as
950950 19 a nail technology teacher, the applicant again takes and
951951 20 completes a program of 500 625 hours of teacher training in a
952952 21 licensed school of cosmetology, or nail technology, except
953953 22 that if the applicant had 2 years of practical experience as a
954954 23 licensed nail technician within 5 years preceding the initial
955955 24 examination taken by the applicant, the applicant must again
956956 25 take and complete a program of 400 500 hours of teacher
957957 26 training in a licensed school of cosmetology approved to teach

973973 6 product chemistry, sanitary rules, sanitary procedures,
974974 7 hazardous chemicals and exposure minimization, this Act, and
975975 8 labor and compensation laws.
976976 9 The examination for licensure as a nail technology teacher
977977 10 may include knowledge of the subject matter, teaching
978978 11 methodology, classroom management, record keeping, and any
979979 12 other subjects that the Department in its discretion may deem
980980 13 necessary to insure competent performance.
981981 14 This Act does not prohibit the practice of nail technology
982982 15 by a person who has applied in writing to the Department, in
983983 16 form and substance satisfactory to the Department, for a
984984 17 license as a nail technician, or the teaching of nail
985985 18 technology by one who has applied in writing to the
986986 19 Department, in form and substance satisfactory to the
987987 20 Department, for a license as a nail technology teacher, if the
988988 21 person has complied with all the provisions of this Act in
989989 22 order to qualify for a license, except the passing of an
990990 23 examination to be eligible to receive a license, until: (a)
991991 24 the expiration of 6 months after the filing of the written
992992 25 application, or (b) the decision of the Department that the
993993 26 applicant has failed to pass an examination within 6 months or

10111011 8 (a) A person is qualified to receive a license as a hair

10151015 12 (1) Is at least 16 years of age;

10801080 6 amendatory Act of the 96th General Assembly, the Department
10811081 7 may issue a hair braider license to any applicant who does not
10821082 8 meet the requirements of items (2) and (3) of subsection (a) of
10831083 9 this Section if the applicant: (1) files an application in
10841084 10 accordance with subsection (a), (2) pays the required fee, (3)
10851085 11 has not committed an offense that would be grounds for
10861086 12 discipline under this Act, and (4) is able to demonstrate to
10871087 13 the Department through tax records or affidavits that he or
10881088 14 she has practiced hair braiding for at least 2 consecutive
10891089 15 years immediately prior to the date of his or her application.
10901090 16 A hair braider who obtains his or her license under this
10911091 17 subsection (c) may renew his or her license if he or she
10921092 18 applies to the Department for renewal and has completed at
10931093 19 least 52 65 hours of relevant training in health, safety,
10941094 20 hygiene, and business management in accordance with the
10951095 21 requirements of this Section or any rule adopted pursuant to
10961096 22 this Section. A hair braider who renews his or her license
10971097 23 under this subsection (c) may thereafter only renew his or her
10981098 24 license if he or she meets the requirements of Section 3E-5 of
10991099 25 this Act.
