12	12	1 AN ACT concerning regulation.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Fair Patient Billing Act is amended by
16	16	5 changing Section 20 as follows:
17	17	6 (210 ILCS 88/20)
18	18	7 Sec. 20. Bill information. If a hospital bills a patient
19	19	8 for health care services, the hospital shall provide with its
20	20	9 bill the following information:
21	21	10 (1) the date or dates that health care services were
22	22	11 provided to the patient;
23	23	12 (2) a brief description of the hospital services;
24	24	13 (3) the amount owed for hospital services;
25	25	14 (4) hospital contact information for addressing
26	26	15 billing inquiries;
27	27	16 (5) a statement regarding how an uninsured patient may
28	28	17 apply for consideration under the hospital's financial
29	29	18 assistance policy on or with each hospital bill sent to an
30	30	19 uninsured patient; and
31	31	20 (6) notice that the patient will be given an itemized
32	32	21 statement of charges for inpatient and outpatient services
33	33	22 rendered by the hospital unless the patient chooses to opt
34	34	23 out of receiving such a statement may obtain an itemized

72	72	2 If a hospital bills a patient, then the hospital must
73	73	3 provide an itemized statement of charges for the inpatient and
74	74	4 outpatient services rendered by the hospital unless the
75	75	5 patient opts out of receiving such a statement upon receiving
76	76	6 a request from the patient. The itemized statement of charges
77	77	7 may be provided in an electronic format at the discretion of
78	78	8 the hospital unless the patient requests a physical copy of
79	79	9 the statement of charges, which shall be provided upon
80	80	10 request.
81	81	11 Information regarding the patient's choice to opt out
82	82	12 shall be prominent, clearly labeled, and provided to the
83	83	13 patient before signing any documents relating to itemized
84	84	14 billing. The patient shall not be under the influence of any
85	85	15 anesthetic or drug that inhibits mental performance when given
86	86	16 the documents.
87	87	17 The hospital's failure to comply with the requirements of
88	88	18 this Section constitutes an unlawful practice under the
89	89	19 Consumer Fraud and Deceptive Business Practices Act.
