1212 1 AN ACT concerning regulation.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Fair Patient Billing Act is amended by
1616 5 changing Section 20 as follows:
1717 6 (210 ILCS 88/20)
1818 7 Sec. 20. Bill information. If a hospital bills a patient
1919 8 for health care services, the hospital shall provide with its
2020 9 bill the following information:
2121 10 (1) the date or dates that health care services were
2222 11 provided to the patient;
2323 12 (2) a brief description of the hospital services;
2424 13 (3) the amount owed for hospital services;
2525 14 (4) hospital contact information for addressing
2626 15 billing inquiries;
2727 16 (5) a statement regarding how an uninsured patient may
2828 17 apply for consideration under the hospital's financial
2929 18 assistance policy on or with each hospital bill sent to an
3030 19 uninsured patient; and
3131 20 (6) notice that the patient will be given an itemized
3232 21 statement of charges for inpatient and outpatient services
3333 22 rendered by the hospital unless the patient chooses to opt
3434 23 out of receiving such a statement may obtain an itemized

7272 2 If a hospital bills a patient, then the hospital must
7373 3 provide an itemized statement of charges for the inpatient and
7474 4 outpatient services rendered by the hospital unless the
7575 5 patient opts out of receiving such a statement upon receiving
7676 6 a request from the patient. The itemized statement of charges
7777 7 may be provided in an electronic format at the discretion of
7878 8 the hospital unless the patient requests a physical copy of
7979 9 the statement of charges, which shall be provided upon
8080 10 request.
8181 11 Information regarding the patient's choice to opt out
8282 12 shall be prominent, clearly labeled, and provided to the
8383 13 patient before signing any documents relating to itemized
8484 14 billing. The patient shall not be under the influence of any
8585 15 anesthetic or drug that inhibits mental performance when given
8686 16 the documents.
8787 17 The hospital's failure to comply with the requirements of
8888 18 this Section constitutes an unlawful practice under the
8989 19 Consumer Fraud and Deceptive Business Practices Act.
