1111 1 AN ACT concerning government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Definitions of Sex-Based Terms Act.
1616 6 Section 5. Purpose; application; findings.
1717 7 (a) The purpose of this Act is to bring clarity,
1818 8 certainty, and uniformity to the laws of the State regarding
1919 9 sex discrimination, privacy, equality of the sexes, and
2020 10 benefits or services specifically provided to males and to
2121 11 females.
2222 12 (b) This Act shall apply wherever the State or an
2323 13 instrumentality of the State classifies people on the basis of
2424 14 sex or otherwise defines people as being female or male, women
2525 15 or men, girls or boys.
2626 16 (c) The General Assembly finds that:
2727 17 (1) males and females are legally equal, but they are
2828 18 not the same;
2929 19 (2) males and females possess unique and immutable
3030 20 biological differences that manifest prior to birth and
3131 21 increase as they age and experience puberty;
3232 22 (3) these unique and immutable biological differences
3333 23 mean that females and males are not similarly situated in

7272 5 resources and have put the existence of private,
7373 6 single-sex spaces in jeopardy, thereby necessitating
7474 7 clarification of certain terms used in State law.
7575 8 Section 10. Definitions of terms used in State statutes
7676 9 and administrative rules. In determining the meaning of any
7777 10 statute or of any rule, regulation, or interpretation of the
7878 11 various administrative agencies of this State:
7979 12 "Boy" means a human male who is a legal minor under the
8080 13 laws of Illinois, provided that the use of "boy" in reference
8181 14 to the participation of a high-school-aged individual in a
8282 15 school or extracurricular program shall not be understood to
8383 16 exclude the participation of a student who is legally an
8484 17 adult.
8585 18 "Father" means a male parent of a child or children as
8686 19 defined in Illinois law.
8787 20 "Female" means, when this term is used in reference to a
8888 21 natural person, an individual who naturally has, had, will
8989 22 have through the course of normal development, or would have
9090 23 but for a developmental anomaly, genetic anomaly, or accident
9191 24 the reproductive system that at some point produces ova.
9292 25 "Girl" means a human female who is a legal minor under the

103103 1 laws of Illinois, provided that the use of "girl" in reference

113113 11 "Man" means an adult human of the male sex.
114114 12 "Mother" means a female parent of a child or children as
115115 13 defined in Illinois law.
116116 14 "Sex" means, when this term is used to classify or
117117 15 describe a natural person, the state of being either male or
118118 16 female as observed or clinically verified at birth. "Sex"
119119 17 includes only 2 sexes, and every individual is either male or
120120 18 female, and individuals with congenital and medically
121121 19 verifiable differences in sex development, disorders in sex
122122 20 development, or intersex conditions, are not members of a
123123 21 third sex and must be accommodated consistent with State and
124124 22 federal law. "Sex" does not include "gender identity" or any
125125 23 other term intended to convey a person's subjective sense of
126126 24 self; "gender identity" and other subjective terms are not
127127 25 synonyms or substitutes for "sex".
128128 26 "Woman" means an adult human of the female sex.

139139 1 Section 97. Severability. The provisions of this Act are
