11	11	1 AN ACT concerning government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 Definitions of Sex-Based Terms Act.
16	16	6 Section 5. Purpose; application; findings.
17	17	7 (a) The purpose of this Act is to bring clarity,
18	18	8 certainty, and uniformity to the laws of the State regarding
19	19	9 sex discrimination, privacy, equality of the sexes, and
20	20	10 benefits or services specifically provided to males and to
21	21	11 females.
22	22	12 (b) This Act shall apply wherever the State or an
23	23	13 instrumentality of the State classifies people on the basis of
24	24	14 sex or otherwise defines people as being female or male, women
25	25	15 or men, girls or boys.
26	26	16 (c) The General Assembly finds that:
27	27	17 (1) males and females are legally equal, but they are
28	28	18 not the same;
29	29	19 (2) males and females possess unique and immutable
30	30	20 biological differences that manifest prior to birth and
31	31	21 increase as they age and experience puberty;
32	32	22 (3) these unique and immutable biological differences
33	33	23 mean that females and males are not similarly situated in

69	69	2 (4) inconsistencies in court rulings and policy
70	70	3 initiatives regarding sex discrimination and common
71	71	4 sex-based words have endangered women's rights and
72	72	5 resources and have put the existence of private,
73	73	6 single-sex spaces in jeopardy, thereby necessitating
74	74	7 clarification of certain terms used in State law.
75	75	8 Section 10. Definitions of terms used in State statutes
76	76	9 and administrative rules. In determining the meaning of any
77	77	10 statute or of any rule, regulation, or interpretation of the
78	78	11 various administrative agencies of this State:
79	79	12 "Boy" means a human male who is a legal minor under the
80	80	13 laws of Illinois, provided that the use of "boy" in reference
81	81	14 to the participation of a high-school-aged individual in a
82	82	15 school or extracurricular program shall not be understood to
83	83	16 exclude the participation of a student who is legally an
84	84	17 adult.
85	85	18 "Father" means a male parent of a child or children as
86	86	19 defined in Illinois law.
87	87	20 "Female" means, when this term is used in reference to a
88	88	21 natural person, an individual who naturally has, had, will
89	89	22 have through the course of normal development, or would have
90	90	23 but for a developmental anomaly, genetic anomaly, or accident
91	91	24 the reproductive system that at some point produces ova.
92	92	25 "Girl" means a human female who is a legal minor under the

103	103	1 laws of Illinois, provided that the use of "girl" in reference
104	104	2 to the participation of a high-school-aged individual in a

113	113	11 "Man" means an adult human of the male sex.
114	114	12 "Mother" means a female parent of a child or children as
115	115	13 defined in Illinois law.
116	116	14 "Sex" means, when this term is used to classify or
117	117	15 describe a natural person, the state of being either male or
118	118	16 female as observed or clinically verified at birth. "Sex"
119	119	17 includes only 2 sexes, and every individual is either male or
120	120	18 female, and individuals with congenital and medically
121	121	19 verifiable differences in sex development, disorders in sex
122	122	20 development, or intersex conditions, are not members of a
123	123	21 third sex and must be accommodated consistent with State and
124	124	22 federal law. "Sex" does not include "gender identity" or any
125	125	23 other term intended to convey a person's subjective sense of
126	126	24 self; "gender identity" and other subjective terms are not
127	127	25 synonyms or substitutes for "sex".
128	128	26 "Woman" means an adult human of the female sex.
