1515 2 Be it enacted by the People of the State of Illinois,

7474 1 3. The expanded mobility of nurses and the use of
7575 2 advanced communication technologies as part of our
7676 3 nation's health care delivery system require greater
7777 4 coordination and cooperation among states in the areas of
7878 5 nurse licensure and regulation;
7979 6 4. New practice modalities and technology make
8080 7 compliance with individual state nurse licensure laws
8181 8 difficult and complex;
8282 9 5. The current system of duplicative licensure for
8383 10 nurses practicing in multiple states is cumbersome and
8484 11 redundant for both nurses and states; and
8585 12 6. Uniformity of nurse licensure requirements
8686 13 throughout the states promotes public safety and public
8787 14 health benefits.
8888 15 b. The general purposes of this Compact are to:
8989 16 1. Facilitate the states' responsibility to protect
9090 17 the public's health and safety;
9191 18 2. Ensure and encourage the cooperation of party
9292 19 states in the areas of nurse licensure and regulation;
9393 20 3. Facilitate the exchange of information between
9494 21 party states in the areas of nurse regulation,
9595 22 investigation and adverse actions;
9696 23 4. Promote compliance with the laws governing the
9797 24 practice of nursing in each jurisdiction;
9898 25 5. Invest all party states with the authority to hold
9999 26 a nurse accountable for meeting all state practice laws in

111111 2 is rendered through the mutual recognition of party state
112112 3 licenses;
113113 4 6. Decrease redundancies in the consideration and
114114 5 issuance of nurse licenses; and
115115 6 7. Provide opportunities for interstate practice by
116116 7 nurses who meet uniform licensure requirements.
117117 8 ARTICLE II
118118 9 Definitions
119119 10 As used in this Compact:
120120 11 a. "Adverse action" means any administrative, civil,
121121 12 equitable or criminal action permitted by a state's laws
122122 13 which is imposed by a licensing board or other authority
123123 14 against a nurse, including actions against an individual's
124124 15 license or multistate licensure privilege such as
125125 16 revocation, suspension, probation, monitoring of the
126126 17 licensee, limitation on the licensee's practice, or any
127127 18 other encumbrance on licensure affecting a nurse's
128128 19 authorization to practice, including issuance of a cease
129129 20 and desist action.
130130 21 b. "Alternative program" means a non-disciplinary
131131 22 monitoring program approved by a licensing board.
132132 23 c. "Coordinated licensure information system" means an
133133 24 integrated process for collecting, storing and sharing

144144 1 information on nurse licensure and enforcement activities
145145 2 related to nurse licensure laws that is administered by a
146146 3 nonprofit organization composed of and controlled by
147147 4 licensing boards.
148148 5 d. "Current significant investigative information"
149149 6 means:
150150 7 1. Investigative information that a licensing
151151 8 board, after a preliminary inquiry that includes
152152 9 notification and an opportunity for the nurse to
153153 10 respond, if required by state law, has reason to
154154 11 believe is not groundless and, if proved true, would
155155 12 indicate more than a minor infraction; or
156156 13 2. Investigative information that indicates that
157157 14 the nurse represents an immediate threat to public
158158 15 health and safety regardless of whether the nurse has
159159 16 been notified and had an opportunity to respond.
160160 17 e. "Encumbrance" means a revocation or suspension of,
161161 18 or any limitation on, the full and unrestricted practice
162162 19 of nursing imposed by a licensing board.
163163 20 f. "Home state" means the party state which is the
164164 21 nurse's primary state of residence.
165165 22 g. "Licensing board" means a party state's regulatory
166166 23 body responsible for issuing nurse licenses.
167167 24 h. "Multistate license" means a license to practice as
168168 25 a registered or a licensed practical/vocational nurse
169169 26 (LPN/VN) issued by a home state licensing board that

180180 1 authorizes the licensed nurse to practice in all party
181181 2 states under a multistate licensure privilege.
182182 3 i. "Multistate licensure privilege" means a legal
183183 4 authorization associated with a multistate license
184184 5 permitting the practice of nursing as either a registered
185185 6 nurse (RN) or LPN/VN in a remote state.
186186 7 j. "Nurse" means RN or LPN/VN, as those terms are
187187 8 defined by each party state's practice laws.
188188 9 k. "Party state" means any state that has adopted this
189189 10 Compact.
190190 11 l. "Remote state" means a party state, other than the
191191 12 home state.
192192 13 m. "Single-state license" means a nurse license issued
193193 14 by a party state that authorizes practice only within the
194194 15 issuing state and does not include a multistate licensure
195195 16 privilege to practice in any other party state.
196196 17 n. "State" means a state, territory or possession of
197197 18 the United States and the District of Columbia.
198198 19 o. "State practice laws" means a party state's laws,
199199 20 rules and regulations that govern the practice of nursing,
200200 21 define the scope of nursing practice, and create the
201201 22 methods and grounds for imposing discipline. "State
202202 23 practice laws" do not include requirements necessary to
203203 24 obtain and retain a license, except for qualifications or
204204 25 requirements of the home state.

216216 2 General Provisions and Jurisdiction
217217 3 a. A multistate license to practice registered or licensed
218218 4 practical/vocational nursing issued by a home state to a
219219 5 resident in that state will be recognized by each party state
220220 6 as authorizing a nurse to practice as a registered nurse (RN)
221221 7 or as a licensed practical/vocational nurse (LPN/VN), under a
222222 8 multistate licensure privilege, in each party state.
223223 9 b. A state must implement procedures for considering the
224224 10 criminal history records of applicants for initial multistate
225225 11 license or licensure by endorsement. Such procedures shall
226226 12 include the submission of fingerprints or other
227227 13 biometric-based information by applicants for the purpose of
228228 14 obtaining an applicant's criminal history record information
229229 15 from the Federal Bureau of Investigation and the agency
230230 16 responsible for retaining that state's criminal records.
231231 17 c. Each party state shall require the following for an
232232 18 applicant to obtain or retain a multistate license in the home
233233 19 state:
234234 20 1. Meets the home state's qualifications for licensure
235235 21 or renewal of licensure, as well as, all other applicable
236236 22 state laws;
237237 23 2. i. Has graduated or is eligible to graduate from a
238238 24 licensing board-approved RN or LPN/VN prelicensure

250250 1 ii. Has graduated from a foreign RN or LPN/VN
251251 2 prelicensure education program that (a) has been approved
252252 3 by the authorized accrediting body in the applicable
253253 4 country and (b) has been verified by an independent
254254 5 credentials review agency to be comparable to a licensing
255255 6 board-approved prelicensure education program;
256256 7 3. Has, if a graduate of a foreign prelicensure
257257 8 education program not taught in English or if English is
258258 9 not the individual's native language, successfully passed
259259 10 an English proficiency examination that includes the
260260 11 components of reading, speaking, writing and listening;
261261 12 4. Has successfully passed an NCLEX-RN or NCLEX-PN
262262 13 Examination or recognized predecessor, as applicable;
263263 14 5. Is eligible for or holds an active, unencumbered
264264 15 license;
265265 16 6. Has submitted, in connection with an application
266266 17 for initial licensure or licensure by endorsement,
267267 18 fingerprints or other biometric data for the purpose of
268268 19 obtaining criminal history record information from the
269269 20 Federal Bureau of Investigation and the agency responsible
270270 21 for retaining that state's criminal records;
271271 22 7. Has not been convicted or found guilty, or has
272272 23 entered into an agreed disposition, of a felony offense
273273 24 under applicable state or federal criminal law;
274274 25 8. Has not been convicted or found guilty, or has
275275 26 entered into an agreed disposition, of a misdemeanor

286286 1 offense related to the practice of nursing as determined
287287 2 on a case-by-case basis;
288288 3 9. Is not currently enrolled in an alternative
289289 4 program;
290290 5 10. Is subject to self-disclosure requirements
291291 6 regarding current participation in an alternative program;
292292 7 and
293293 8 11. Has a valid United States Social Security number.
294294 9 d. All party states shall be authorized, in accordance
295295 10 with existing state due process law, to take adverse action
296296 11 against a nurse's multistate licensure privilege such as
297297 12 revocation, suspension, probation or any other action that
298298 13 affects a nurse's authorization to practice under a multistate
299299 14 licensure privilege, including cease and desist actions. If a
300300 15 party state takes such action, it shall promptly notify the
301301 16 administrator of the coordinated licensure information system.
302302 17 The administrator of the coordinated licensure information
303303 18 system shall promptly notify the home state of any such
304304 19 actions by remote states.
305305 20 e. A nurse practicing in a party state must comply with the
306306 21 state practice laws of the state in which the client is located
307307 22 at the time service is provided. The practice of nursing is not
308308 23 limited to patient care, but shall include all nursing
309309 24 practice as defined by the state practice laws of the party
310310 25 state in which the client is located. The practice of nursing

322322 1 subject a nurse to the jurisdiction of the licensing board,
323323 2 the courts and the laws of the party state in which the client
324324 3 is located at the time service is provided.
325325 4 f. Individuals not residing in a party state shall
326326 5 continue to be able to apply for a party state's single-state
327327 6 license as provided under the laws of each party state.
328328 7 However, the single-state license granted to these individuals
329329 8 will not be recognized as granting the privilege to practice
330330 9 nursing in any other party state. Nothing in this Compact
331331 10 shall affect the requirements established by a party state for
332332 11 the issuance of a single-state license.
333333 12 g. Any nurse holding a home state multistate license, on
334334 13 the effective date of this Compact, may retain and renew the
335335 14 multistate license issued by the nurse's then-current home
336336 15 state, provided that:
337337 16 1. A nurse, who changes primary state of residence
338338 17 after this Compact's effective date, must meet all
339339 18 applicable Article III.c. requirements to obtain a
340340 19 multistate license from a new home state.
341341 20 2. A nurse who fails to satisfy the multistate
342342 21 licensure requirements in Article III.c. due to a
343343 22 disqualifying event occurring after this Compact's
344344 23 effective date shall be ineligible to retain or renew a
345345 24 multistate license, and the nurse's multistate license
346346 25 shall be revoked or deactivated in accordance with
347347 26 applicable rules adopted by the Interstate Commission of

360360 3 Applications for Licensure in a Party State
361361 4 a. Upon application for a multistate license, the
362362 5 licensing board in the issuing party state shall ascertain,
363363 6 through the coordinated licensure information system, whether
364364 7 the applicant has ever held, or is the holder of, a license
365365 8 issued by any other state, whether there are any encumbrances
366366 9 on any license or multistate licensure privilege held by the
367367 10 applicant, whether any adverse action has been taken against
368368 11 any license or multistate licensure privilege held by the
369369 12 applicant and whether the applicant is currently participating
370370 13 in an alternative program.
371371 14 b. A nurse may hold a multistate license, issued by the
372372 15 home state, in only one party state at a time.
373373 16 c. If a nurse changes primary state of residence by moving
374374 17 between two party states, the nurse must apply for licensure
375375 18 in the new home state, and the multistate license issued by the
376376 19 prior home state will be deactivated in accordance with
377377 20 applicable rules adopted by the Commission.
378378 21 1. The nurse may apply for licensure in advance of a
379379 22 change in primary state of residence.
380380 23 2. A multistate license shall not be issued by the new
381381 24 home state until the nurse provides satisfactory evidence

393393 2 state and satisfies all applicable requirements to obtain
394394 3 a multistate license from the new home state.
395395 4 d. If a nurse changes primary state of residence by moving
396396 5 from a party state to a non-party state, the multistate
397397 6 license issued by the prior home state will convert to a
398398 7 single-state license, valid only in the former home state.
399399 8 ARTICLE V
400400 9 Additional Authorities Invested in Party State Licensing
401401 10 Boards
402402 11 a. In addition to the other powers conferred by state law,
403403 12 a licensing board shall have the authority to:
404404 13 1. Take adverse action against a nurse's multistate
405405 14 licensure privilege to practice within that party state.
406406 15 i. Only the home state shall have the power to take
407407 16 adverse action against a nurse's license issued by the
408408 17 home state.
409409 18 ii. For purposes of taking adverse action, the
410410 19 home state licensing board shall give the same
411411 20 priority and effect to reported conduct received from
412412 21 a remote state as it would if such conduct had occurred
413413 22 within the home state. In so doing, the home state
414414 23 shall apply its own state laws to determine
415415 24 appropriate action.

426426 1 2. Issue cease and desist orders or impose an
427427 2 encumbrance on a nurse's authority to practice within that
428428 3 party state.
429429 4 3. Complete any pending investigations of a nurse who
430430 5 changes primary state of residence during the course of
431431 6 such investigations. The licensing board shall also have
432432 7 the authority to take appropriate action(s) and shall
433433 8 promptly report the conclusions of such investigations to
434434 9 the administrator of the coordinated licensure information
435435 10 system. The administrator of the coordinated licensure
436436 11 information system shall promptly notify the new home
437437 12 state of any such actions.
438438 13 4. Issue subpoenas for both hearings and
439439 14 investigations that require the attendance and testimony
440440 15 of witnesses, as well as, the production of evidence.
441441 16 Subpoenas issued by a licensing board in a party state for
442442 17 the attendance and testimony of witnesses or the
443443 18 production of evidence from another party state shall be
444444 19 enforced in the latter state by any court of competent
445445 20 jurisdiction, according to the practice and procedure of
446446 21 that court applicable to subpoenas issued in proceedings
447447 22 pending before it. The issuing authority shall pay any
448448 23 witness fees, travel expenses, mileage and other fees
449449 24 required by the service statutes of the state in which the
450450 25 witnesses or evidence are located.
451451 26 5. Obtain and submit, for each nurse licensure

462462 1 applicant, fingerprint or other biometric-based
463463 2 information to the Federal Bureau of Investigation for
464464 3 criminal background checks, receive the results of the
465465 4 Federal Bureau of Investigation record search on criminal
466466 5 background checks and use the results in making licensure
467467 6 decisions.
468468 7 6. If otherwise permitted by state law, recover from
469469 8 the affected nurse the costs of investigations and
470470 9 disposition of cases resulting from any adverse action
471471 10 taken against that nurse.
472472 11 7. Take adverse action based on the factual findings
473473 12 of the remote state, provided that the licensing board
474474 13 follows its own procedures for taking such adverse action.
475475 14 b. If adverse action is taken by the home state against a
476476 15 nurse's multistate license, the nurse's multistate licensure
477477 16 privilege to practice in all other party states shall be
478478 17 deactivated until all encumbrances have been removed from the
479479 18 multistate license. All home state disciplinary orders that
480480 19 impose adverse action against a nurse's multistate license
481481 20 shall include a statement that the nurse's multistate
482482 21 licensure privilege is deactivated in all party states during
483483 22 the pendency of the order.

501501 4 Coordinated Licensure Information System and Exchange of

503503 6 a. All party states shall participate in a coordinated
504504 7 licensure information system of all licensed registered nurses
505505 8 (RNs) and licensed practical/vocational nurses (LPNs/VNs).
506506 9 This system will include information on the licensure and
507507 10 disciplinary history of each nurse, as submitted by party
508508 11 states, to assist in the coordination of nurse licensure and
509509 12 enforcement efforts.
510510 13 b. The Commission, in consultation with the administrator
511511 14 of the coordinated licensure information system, shall
512512 15 formulate necessary and proper procedures for the
513513 16 identification, collection and exchange of information under
514514 17 this Compact.
515515 18 c. All licensing boards shall promptly report to the
516516 19 coordinated licensure information system any adverse action,
517517 20 any current significant investigative information, denials of
518518 21 applications (with the reasons for such denials) and nurse
519519 22 participation in alternative programs known to the licensing
520520 23 board regardless of whether such participation is deemed
521521 24 nonpublic or confidential under state law.

551551 20 be expunged by the laws of the party state contributing that
552552 21 information shall also be expunged from the coordinated
553553 22 licensure information system.
554554 23 h. The Compact administrator of each party state shall
555555 24 furnish a uniform data set to the Compact administrator of
556556 25 each other party state, which shall include, at a minimum:

578578 11 Establishment of the Interstate Commission of Nurse Licensure

580580 13 a. The party states hereby create and establish a joint
581581 14 public entity known as the Interstate Commission of Nurse
582582 15 Licensure Compact Administrators.
583583 16 1. The Commission is an instrumentality of the party
584584 17 states.
585585 18 2. Venue is proper, and judicial proceedings by or
586586 19 against the Commission shall be brought solely and
587587 20 exclusively, in a court of competent jurisdiction where
588588 21 the principal office of the Commission is located. The
589589 22 Commission may waive venue and jurisdictional defenses to
590590 23 the extent it adopts or consents to participate in

604604 3 b. Membership, Voting and Meetings
605605 4 1. Each party state shall have and be limited to one
606606 5 administrator. The head of the state licensing board or
607607 6 designee shall be the administrator of this Compact for
608608 7 each party state. Any administrator may be removed or
609609 8 suspended from office as provided by the law of the state
610610 9 from which the Administrator is appointed. Any vacancy
611611 10 occurring in the Commission shall be filled in accordance
612612 11 with the laws of the party state in which the vacancy
613613 12 exists.
614614 13 2. Each administrator shall be entitled to one (1)
615615 14 vote with regard to the promulgation of rules and creation
616616 15 of bylaws and shall otherwise have an opportunity to
617617 16 participate in the business and affairs of the Commission.
618618 17 An administrator shall vote in person or by such other
619619 18 means as provided in the bylaws. The bylaws may provide
620620 19 for an administrator's participation in meetings by
621621 20 telephone or other means of communication.
622622 21 3. The Commission shall meet at least once during each
623623 22 calendar year. Additional meetings shall be held as set
624624 23 forth in the bylaws or rules of the commission.
625625 24 4. All meetings shall be open to the public, and
626626 25 public notice of meetings shall be given in the same
627627 26 manner as required under the rulemaking provisions in

652652 15 v. Accusing any person of a crime or formally

654654 17 vi. Disclosure of trade secrets or commercial or

656656 19 confidential;
657657 20 vii. Disclosure of information of a personal
658658 21 nature where disclosure would constitute a clearly
659659 22 unwarranted invasion of personal privacy;
660660 23 viii. Disclosure of investigatory records compiled

682682 9 Commission shall keep minutes that fully and clearly
683683 10 describe all matters discussed in a meeting and shall
684684 11 provide a full and accurate summary of actions taken, and
685685 12 the reasons therefor, including a description of the views
686686 13 expressed. All documents considered in connection with an
687687 14 action shall be identified in such minutes. All minutes
688688 15 and documents of a closed meeting shall remain under seal,
689689 16 subject to release by a majority vote of the Commission or
690690 17 order of a court of competent jurisdiction.
691691 18 c. The Commission shall, by a majority vote of the
692692 19 administrators, prescribe bylaws or rules to govern its
693693 20 conduct as may be necessary or appropriate to carry out the
694694 21 purposes and exercise the powers of this Compact, including
695695 22 but not limited to:
696696 23 1. Establishing the fiscal year of the Commission;
697697 24 2. Providing reasonable standards and procedures:
698698 25 i. For the establishment and meetings of other

720720 11 majority of the administrators vote to close a meeting in
721721 12 whole or in part. As soon as practicable, the Commission
722722 13 must make public a copy of the vote to close the meeting
723723 14 revealing the vote of each administrator, with no proxy
724724 15 votes allowed;
725725 16 4. Establishing the titles, duties and authority and
726726 17 reasonable procedures for the election of the officers of
727727 18 the Commission;
728728 19 5. Providing reasonable standards and procedures for
729729 20 the establishment of the personnel policies and programs
730730 21 of the Commission. Notwithstanding any civil service or
731731 22 other similar laws of any party state, the bylaws shall
732732 23 exclusively govern the personnel policies and programs of
733733 24 the Commission; and
734734 25 6. Providing a mechanism for winding up the operations
735735 26 of the Commission and the equitable disposition of any

752752 7 e. The Commission shall maintain its financial records in
753753 8 accordance with the bylaws.
754754 9 f. The Commission shall meet and take such actions as are
755755 10 consistent with the provisions of this Compact and the bylaws.
756756 11 g. The Commission shall have the following powers:
757757 12 1. To promulgate uniform rules to facilitate and
758758 13 coordinate implementation and administration of this
759759 14 Compact. The rules shall have the force and effect of law
760760 15 and shall be binding in all party states;
761761 16 2. To bring and prosecute legal proceedings or actions
762762 17 in the name of the Commission, provided that the standing
763763 18 of any licensing board to sue or be sued under applicable
764764 19 law shall not be affected;
765765 20 3. To purchase and maintain insurance and bonds;
766766 21 4. To borrow, accept or contract for services of
767767 22 personnel, including, but not limited to, employees of a
768768 23 party state or nonprofit organizations;
769769 24 5. To cooperate with other organizations that
770770 25 administer state compacts related to the regulation of

793793 12 services, and to receive, utilize and dispose of the same;
794794 13 provided that at all times the Commission shall avoid any
795795 14 appearance of impropriety or conflict of interest;
796796 15 8. To lease, purchase, accept appropriate gifts or
797797 16 donations of, or otherwise to own, hold, improve or use,
798798 17 any property, whether real, personal or mixed; provided
799799 18 that at all times the Commission shall avoid any
800800 19 appearance of impropriety;
801801 20 9. To sell, convey, mortgage, pledge, lease, exchange,
802802 21 abandon or otherwise dispose of any property, whether
803803 22 real, personal or mixed;

824824 7 15. To perform such other functions as may be
825825 8 necessary or appropriate to achieve the purposes of this
826826 9 Compact consistent with the state regulation of nurse
827827 10 licensure and practice.
828828 11 h. Financing of the Commission
829829 12 1. The Commission shall pay, or provide for the
830830 13 payment of, the reasonable expenses of its establishment,
831831 14 organization and ongoing activities.
832832 15 2. The Commission may also levy on and collect an
833833 16 annual assessment from each party state to cover the cost
834834 17 of its operations, activities and staff in its annual
835835 18 budget as approved each year. The aggregate annual
836836 19 assessment amount, if any, shall be allocated based upon a
837837 20 formula to be determined by the Commission, which shall
838838 21 promulgate a rule that is binding upon all party states.
839839 22 3. The Commission shall not incur obligations of any
840840 23 kind prior to securing the funds adequate to meet the
841841 24 same; nor shall the Commission pledge the credit of any of
842842 25 the party states, except by, and with the authority of,
843843 26 such party state.

859859 6 by the Commission shall be audited yearly by a certified
860860 7 or licensed public accountant, and the report of the audit
861861 8 shall be included in and become part of the annual report

863863 10 i. Qualified Immunity, Defense and Indemnification
864864 11 1. The administrators, officers, executive director,
865865 12 employees and representatives of the Commission shall be
866866 13 immune from suit and liability, either personally or in
867867 14 their official capacity, for any claim for damage to or
868868 15 loss of property or personal injury or other civil
869869 16 liability caused by or arising out of any actual or
870870 17 alleged act, error or omission that occurred, or that the
871871 18 person against whom the claim is made had a reasonable
872872 19 basis for believing occurred, within the scope of
873873 20 Commission employment, duties or responsibilities;
874874 21 provided that nothing in this paragraph shall be construed
875875 22 to protect any such person from suit or liability for any
876876 23 damage, loss, injury or liability caused by the
877877 24 intentional, willful or wanton misconduct of that person.

907907 18 omission that occurred within the scope of Commission

909909 20 person had a reasonable basis for believing occurred
910910 21 within the scope of Commission employment, duties or
911911 22 responsibilities, provided that the actual or alleged act,
912912 23 error or omission did not result from the intentional,
913913 24 willful or wanton misconduct of that person.

926926 2 a. The Commission shall exercise its rulemaking powers

929929 5 binding as of the date specified in each rule or amendment and
930930 6 shall have the same force and effect as provisions of this
931931 7 Compact.
932932 8 b. Rules or amendments to the rules shall be adopted at a
933933 9 regular or special meeting of the Commission.
934934 10 c. Prior to promulgation and adoption of a final rule or
935935 11 rules by the Commission, and at least sixty (60) days in
936936 12 advance of the meeting at which the rule will be considered and
937937 13 voted upon, the Commission shall file a notice of proposed
938938 14 rulemaking:
939939 15 1. On the website of the Commission; and
940940 16 2. On the website of each licensing board or the
941941 17 publication in which each state would otherwise publish
942942 18 proposed rules.
943943 19 d. The notice of proposed rulemaking shall include:
944944 20 1. The proposed time, date and location of the meeting
945945 21 in which the rule will be considered and voted upon;
946946 22 2. The text of the proposed rule or amendment, and the
947947 23 reason for the proposed rule;
948948 24 3. A request for comments on the proposed rule from

966966 7 f. The Commission shall grant an opportunity for a public
967967 8 hearing before it adopts a rule or amendment.
968968 9 g. The Commission shall publish the place, time and date
969969 10 of the scheduled public hearing.
970970 11 1. Hearings shall be conducted in a manner providing
971971 12 each person who wishes to comment a fair and reasonable
972972 13 opportunity to comment orally or in writing. All hearings
973973 14 will be recorded, and a copy will be made available upon
974974 15 request.
975975 16 2. Nothing in this section shall be construed as
976976 17 requiring a separate hearing on each rule. Rules may be
977977 18 grouped for the convenience of the Commission at hearings
978978 19 required by this section.
979979 20 h. If no one appears at the public hearing, the Commission
980980 21 may proceed with promulgation of the proposed rule.
981981 22 i. Following the scheduled hearing date, or by the close
982982 23 of business on the scheduled hearing date if the hearing was
983983 24 not held, the Commission shall consider all written and oral

10151015 20 l. The Commission may direct revisions to a previously
10161016 21 adopted rule or amendment for purposes of correcting
10171017 22 typographical errors, errors in format, errors in consistency
10181018 23 or grammatical errors. Public notice of any revisions shall be
10191019 24 posted on the website of the Commission. The revision shall be

10411041 10 1. Each party state shall enforce this Compact and
10421042 11 take all actions necessary and appropriate to effectuate
10431043 12 this Compact's purposes and intent.
10441044 13 2. The Commission shall be entitled to receive service
10451045 14 of process in any proceeding that may affect the powers,
10461046 15 responsibilities or actions of the Commission, and shall
10471047 16 have standing to intervene in such a proceeding for all
10481048 17 purposes. Failure to provide service of process in such
10491049 18 proceeding to the Commission shall render a judgment or
10501050 19 order void as to the Commission, this Compact or
10511051 20 promulgated rules.
10521052 21 b. Default, Technical Assistance and Termination
10531053 22 1. If the Commission determines that a party state has
10541054 23 defaulted in the performance of its obligations or
10551055 24 responsibilities under this Compact or the promulgated

10661066 1 rules, the Commission shall:
10671067 2 i. Provide written notice to the defaulting state
10681068 3 and other party states of the nature of the default,
10691069 4 the proposed means of curing the default or any other
10701070 5 action to be taken by the Commission; and
10711071 6 ii. Provide remedial training and specific
10721072 7 technical assistance regarding the default.
10731073 8 2. If a state in default fails to cure the default, the
10741074 9 defaulting state's membership in this Compact may be
10751075 10 terminated upon an affirmative vote of a majority of the
10761076 11 administrators, and all rights, privileges and benefits
10771077 12 conferred by this Compact may be terminated on the
10781078 13 effective date of termination. A cure of the default does
10791079 14 not relieve the offending state of obligations or
10801080 15 liabilities incurred during the period of default.
10811081 16 3. Termination of membership in this Compact shall be
10821082 17 imposed only after all other means of securing compliance
10831083 18 have been exhausted. Notice of intent to suspend or
10841084 19 terminate shall be given by the Commission to the governor
10851085 20 of the defaulting state and to the executive officer of
10861086 21 the defaulting state's licensing board and each of the
10871087 22 party states.
10881088 23 4. A state whose membership in this Compact has been
10891089 24 terminated is responsible for all assessments, obligations
10901090 25 and liabilities incurred through the effective date of
10911091 26 termination, including obligations that extend beyond the

11021102 1 effective date of termination.
11031103 2 5. The Commission shall not bear any costs related to
11041104 3 a state that is found to be in default or whose membership
11051105 4 in this Compact has been terminated unless agreed upon in
11061106 5 writing between the Commission and the defaulting state.
11071107 6 6. The defaulting state may appeal the action of the
11081108 7 Commission by petitioning the U.S. District Court for the
11091109 8 District of Columbia or the federal district in which the
11101110 9 Commission has its principal offices. The prevailing party
11111111 10 shall be awarded all costs of such litigation, including
11121112 11 reasonable attorneys' fees.
11131113 12 c. Dispute Resolution
11141114 13 1. Upon request by a party state, the Commission shall
11151115 14 attempt to resolve disputes related to the Compact that
11161116 15 arise among party states and between party and non-party
11171117 16 states.
11181118 17 2. The Commission shall promulgate a rule providing
11191119 18 for both mediation and binding dispute resolution for
11201120 19 disputes, as appropriate.
11211121 20 3. In the event the Commission cannot resolve disputes
11221122 21 among party states arising under this Compact:
11231123 22 i. The party states may submit the issues in
11241124 23 dispute to an arbitration panel, which will be
11251125 24 comprised of individuals appointed by the Compact
11261126 25 administrator in each of the affected party states and
11271127 26 an individual mutually agreed upon by the Compact

11401140 3 ii. The decision of a majority of the arbitrators
11411141 4 shall be final and binding.
11421142 5 d. Enforcement
11431143 6 1. The Commission, in the reasonable exercise of its
11441144 7 discretion, shall enforce the provisions and rules of this
11451145 8 Compact.
11461146 9 2. By majority vote, the Commission may initiate legal
11471147 10 action in the U.S. District Court for the District of
11481148 11 Columbia or the federal district in which the Commission
11491149 12 has its principal offices against a party state that is in
11501150 13 default to enforce compliance with the provisions of this
11511151 14 Compact and its promulgated rules and bylaws. The relief
11521152 15 sought may include both injunctive relief and damages. In
11531153 16 the event judicial enforcement is necessary, the
11541154 17 prevailing party shall be awarded all costs of such
11551155 18 litigation, including reasonable attorneys' fees.
11561156 19 3. The remedies herein shall not be the exclusive
11571157 20 remedies of the Commission. The Commission may pursue any
11581158 21 other remedies available under federal or state law.
11591159 22 ARTICLE X
11601160 23 Effective Date, Withdrawal and Amendment
11611161 24 a. This Compact shall become effective and binding on the

11721172 1 earlier of the date of legislative enactment of this Compact
11731173 2 into law by no less than twenty-six (26) states or December 31,
11741174 3 2018. All party states to this Compact, that also were parties
11751175 4 to the prior Nurse Licensure Compact, superseded by this
11761176 5 Compact, ("Prior Compact"), shall be deemed to have withdrawn
11771177 6 from said Prior Compact within six (6) months after the
11781178 7 effective date of this Compact.
11791179 8 b. Each party state to this Compact shall continue to
11801180 9 recognize a nurse's multistate licensure privilege to practice
11811181 10 in that party state issued under the Prior Compact until such
11821182 11 party state has withdrawn from the Prior Compact.
11831183 12 c. Any party state may withdraw from this Compact by
11841184 13 enacting a statute repealing the same. A party state's
11851185 14 withdrawal shall not take effect until six (6) months after
11861186 15 enactment of the repealing statute.
11871187 16 d. A party state's withdrawal or termination shall not
11881188 17 affect the continuing requirement of the withdrawing or
11891189 18 terminated state's licensing board to report adverse actions
11901190 19 and significant investigations occurring prior to the
11911191 20 effective date of such withdrawal or termination.
11921192 21 e. Nothing contained in this Compact shall be construed to
11931193 22 invalidate or prevent any nurse licensure agreement or other
11941194 23 cooperative arrangement between a party state and a non-party
11951195 24 state that is made in accordance with the other provisions of
11961196 25 this Compact.
11971197 26 f. This Compact may be amended by the party states. No

12151215 8 ARTICLE XI
12161216 9 Construction and Severability
12171217 10 This Compact shall be liberally construed so as to effectuate
12181218 11 the purposes thereof. The provisions of this Compact shall be
12191219 12 severable, and if any phrase, clause, sentence or provision of
12201220 13 this Compact is declared to be contrary to the constitution of
12211221 14 any party state or of the United States, or if the
12221222 15 applicability thereof to any government, agency, person or
12231223 16 circumstance is held invalid, the validity of the remainder of
12241224 17 this Compact and the applicability thereof to any government,
12251225 18 agency, person or circumstance shall not be affected thereby.
12261226 19 If this Compact shall be held to be contrary to the
12271227 20 constitution of any party state, this Compact shall remain in
12281228 21 full force and effect as to the remaining party states and in
12291229 22 full force and effect as to the party state affected as to all
12301230 23 severable matters.
