11	11	1 AN ACT concerning safety.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Environmental Protection Act is amended by
15	15	5 adding Section 22.23g as follows:
16	16	6 (415 ILCS 5/22.23g new)
17	17	7 Sec. 22.23g. Photovoltaic modules.
18	18	8 (a) As used in this Section:
19	19	9 "Consumer electronic device" means any device containing
20	20	10 an electronic circuit board that is intended for everyday use
21	21	11 by individuals.
22	22	12 "Photovoltaic module" means the smallest, nondivisible,
23	23	13 environmentally protected assembly of photovoltaic cells or
24	24	14 other photovoltaic collector technology, and any ancillary
25	25	15 part, intended to generate electrical power under sunlight.
26	26	16 "Photovoltaic module" does not include a photovoltaic cell
27	27	17 that is part of a consumer electronic device for which it
28	28	18 provides electricity needed to make the consumer electronic
29	29	19 device function. "Photovoltaic module" includes, but is not
30	30	20 limited to, interconnections, terminals, and protective
31	31	21 devices, such as diodes, that are:
32	32	22 (1) installed on, connected to, or integral to

69	69	2 generation systems, such as for powering water pumping
70	70	3 stations, electric vehicle charging stations, fencing,
71	71	4 street and signage lights, and other commercial or
72	72	5 agricultural purposes; or
73	73	6 (3) part of a system connected to a grid or utility

75	75	8 (b) Beginning January 1, 2028, no person may knowingly
76	76	9 cause or allow the mixing of a photovoltaic module with
77	77	10 municipal waste that is intended for disposal at a landfill.
78	78	11 (c) Beginning January 1, 2028, no person may knowingly
79	79	12 cause or allow the disposal of a photovoltaic module in a
80	80	13 sanitary landfill.
